The establishment of the Port Authority

THE DECREE

The Port Authority of Genoa was established by the following decree n. 1/COMM, 5th January 1995, drafted by the commissioner Fabio Capocaccia:
  1. With effect from January 1st 1995 it is established the Port Authority for the Port of Genoa, with reference to the law n. 84, 28th January 1994, art. 6 and to subsequent amendments, which takes the name of "Port Authority of Genoa" and has its head office in Genoa - Palazzo San Giorgio, Via della Mercanzia, n. 2.
  2. The Port Authority has the power to provide to the following duties in conformity with the aims of the general plan of transports:
    1. direction, programming, coordination, promotion and check of the harbour operations with reference to the art. 16, paragraph 1, and of other activities practised inside the harbour ambit, even referring to safety because of the accident risks linked with such activities;
    2. maintenance of the common areas of the harbour ambit;
    3. assurance and check of the activities directed to the supply, for valuable consideration, for the harbour users of services of general interest, neither coincident nor closely linked with the port operations, as the Minister of Transport and Navigation singled out with the 14th November 1994 Decree of carrying into effect of the art. 6, paragraph 1, Law 84,1994;
    4. management of the maritime lands included in its own area;
    5. other duties provided for by law.
  3. The Port Authority has jurisdiction on the spotted area according to the law n. 84 of 1994, art. 6, paragraph 7, with a decree of the Minister of Transport and Navigation (6th April 1994).
  4. Until the settlement of the bodies provided for by the law n. 84 of 1994, articles 8 and 9 and by subsequent amendments, the above mentioned Commissioner for the Port Organization is appointed head of the Port Authority and carries on the respective duties, availing himself of the organizing display, as before established and shaped in the circle of the Port Organization - CAP of Genoa and of the personnel with its respective qualifications.
  5. Starting from the date of the former point 1., the Port Authority takes the place of the Port Organization - CAP of Genoa in the ownership and possession of the properties and in every outstanding relation.
  6. According to the law n. 84 of 1994, art. 23, paragraph 2, from the date of point 1 the staff of the Port Organization - CAP of Genoa with reference to the enclosed list (Add. 1) - is transferred and employed by the Port Authority, continuing the business relationship and the position held and keeping the same social security conditions for pension in force at the above mentioned date, wages excepted according to the art. 10 and 23, paragraphs 2 and 3, of the already known law.
  7. In relation to what is written in the art. 23, paragraph 5, of the law n. 84 of 1994, the Port Authority will carry on the management of the railway shunting works, already fullfilled by the Port Organization, availing itself of the present Railway Shunting Works Department with the same staff as in Add. 1. This will last until a Company for the operation of the same service will be established.
  8. Until the completed accomplishment of the provision of the law n. 84 of 1994, art. 14, concerning the maritime Authority competences, the assistant commissioner will think of all the necessary duties in order to guarantee the regular course of the police and safety roles and of the remaining administrative functions, about which see the above mentioned article.
