- The International Group of P&I Clubs confirmation the intention to bring some amendments to the International Group Agreement
-
The EU commission has concluded without outcome an investigation antitrust in the field of the marine insurances that had started in August 2010 and that it is centralized in particular on some clauses of the agreements of division of the lefts and coriassicurazione between mutual insurers in order to verify if they are consistent to the communitarian norms on the competition.-
- The Commission, in fact, considered that these clauses in the agreements between Protection & Indemnity Clubs (P&I Clubs) that they operate in the within of the International Group of P&I Clubs (IGP&I) could damage the shipowners and the insurers who are not members of the IGP&I. The Commission has remembered that the P&I Clubs are mutual insurers that take care of the shipowning responsibilities and that the investigation has examined the International Group Agreement (IGA) and the Pooling Agreement between P&I Clubs. Brussels has remembered moreover that the agreements concluded in the within of the International Group of P&I Clubs enjoyed exemption regarding the norms on the competition of the European Union on the base of a decision decision of the Commission of 12 April 1999, exemption that has expired 20 February 2009.
-
- The Commission has explained to have carried out a market survey between the commercial shipowners, broker and insurers that however has not been sufficiently conclusive in order to confirm such initial fears.
-
- The International Group of P&I Clubs has received with satisfaction the decision of the EU commission to close the case and has specified to have totally cooperated with the Commission in the course of the investigation. The IGP&I have emphasized that, even if the EU commission has decided to close the investigation, the International Group of P&I Clubs has in forecast to bring some amendments to the International Group Agreement.
