Il Congresso statunitense si accinge ad approvare la legge di riforma del settore marittimo

Il cammino dello S414, il disegno di legge divenuto la Legge di Riforma del Trasporto Marittimo del 1998 e che ora andrà a modificare la corrispondente normativa del 1984, ha avuto inizio nel 1995. Tre anni dopo, esso ha quasi completato il proprio iter legislativo ed ora deve solo essere sottoposto all'approvazione del Senato, per poi ricevere l'approvazione definitiva dal Presidente Clinton. Tuttavia, il documento in questione è cambiato notevolmente da quando esso era stato presentato la prima volta.

Dapprincipio vigeva il concetto dell'assoluta riservatezza dei contratti, poi quest'ultima era stata abolita. La FMC (Commissione Marittima Federale) risultava essere stata abolita, poi è stata graziata. Ora, ai sensi dell'attuale legge di riforma, essa potrebbe ritrovarsi in una posizione più salda di quella antecedente. Infine, è persino accaduto che politici che in origine avevano sostenuto la legge si sono espressi a sfavore della versione definitiva. Si veda, infatti, il comportamento di uno di questi ultimi, il congressista Henry J. Hyde, presidente della commissione affari legali, il quale - pur dichiarandosi d'accordo sulla rinuncia a qualsiasi impugnazione del progetto di legge - ha espresso critiche sulla sua approvazione integrale.

Hyde, in una lettera inviata a Bud Schuster, presidente della commissione trasporti ed infrastrutture della Camera dei Rappresentanti statunitense, ha dichiarato: "In ragione della richiesta della direzione di esaminare alla svelta questo progetto di legge, nonché dei delicati equilibri politici implicati da questa legislazione di compromesso, desidero rinunciare al diritto di questa commissione di riferire in ordine allo S414... Vorrei sottolineare, tuttavia, che sono molto preoccupato circa la situazione degli nvoccs, ovvero i vettori comuni non proprietari di navi, degli spedizionieri e delle associazioni marittime (molti dei quali - ha ammesso Hyde - sono suoi elettori). Questi gruppi non sono stati inseriti nel compromesso raggiunto al Senato e ritengo che i contenuti di questa legge possano finire per danneggiarli". Forse, l'aver lasciato andare avanti il procedimento legislativo, senza peraltro giungere alla approvazione definitiva del disegno di legge, costituisce un bel passo avanti nella direzione giusta, ha ammesso Hyde.

Di modo che, quali sono i punti-chiave della legge? La norma si suddivide in cinque sezioni denominate Titoli. Il Titolo I rappresenta la sezione principale e riguarda, specificamente, le modifiche alla Legge Marittima del 1984. I Titoli dal II al V si riferiscono a vari argomenti, tra cui l'autorizzazione agli stanziamenti per la FMC, certe garanzie sui prestiti e le commesse. Nel Titolo I sono presenti specifiche modifiche alle 13 sezioni della legge originale, le più importanti delle quali sono:

  • conferma della FMC e rafforzamento della sua posizione. Un emendamento alla Sezione 108 corregge i parametri alla luce dei quali la FMC giudicava della ingiustizia e l'irragionevolezza delle tariffe controllate dai vettori. Ora la FMC, in luogo della facoltà di disapprovare le tariffe ingiuste e irragionevoli, disporrà dell'autorità di proibirle direttamente;
  • riservatezza dei contratti di servizio. Ai sensi della legge emendata, in sede di revisione della Sezione 106, la prescrizione di registrare le tariffe presso la FMC è abrogata. Essa viene sostituita dalla prescrizione di sottoporre ad ispezioni le tariffe in caso di richiesta nel contesto di un sistema tariffario automatizzato. Sono state rivedute anche le prescrizioni relative alla pubblicazione dei contratti di servizio.
  • La nuova normativa statuisce: "I termini essenziali dei contratti di servizio registrati presso la FMC devono essere pubblicati e messi a disposizione del pubblico". Ciò significa che tutti i particolari dei contratti dovranno essere sottoposti alla FMC ma le tariffe, gli affidamenti di servizio ed i danni liquidati dovranno essere mantenuti riservati. L'emendamento prescrive inoltre che un vettore marittimo impegnato in contrattazioni collettive con le organizzazioni dei lavoratori debba - su richiesta del sindacato - dichiarare la propria responsabilità riguardo ai trasporti di servizio ai sensi di un contratto di servizio. I vettori comuni non proprietari di navi e gli spedizionieri sono esclusi dalla riservatezza del contratto;
  • nessuna immunità anti-trust per i contratti di garanzia. Nella Sezione 105, vengono regolamentati gli accordi in cui il caricatore ottiene tariffe più basse assegnando tutto il proprio carico, ovvero una sua parte, ad un vettore, ad una alleanza o ad una conferenza;
  • revisione di determinate prassi vietate. Tra esse vi sono: le compensazioni tariffarie per servizi di trasporto diverse da quelle dichiarate nelle tariffe o nei contratti; nella stipulazione di un contratto di garanzia, la contrattazione di tariffe di trasporto terrestre congiunte ed il rifiuto di negoziarle con un'associazione di caricatori;
  • nuovi divieti, tra cui: l'utilizzazione di una nave in un traffico al fine di eliminare, evitare o ridurre la concorrenza inducendo i concorrenti ad uscire da un determinato traffico ed il rifiuto irragionevole di accordarsi o contrattare con qualche società.

Quindi, a chi piace lo S414? In realtà, a molta gente. Ai vettori marittimi, i quali - pur dichiarando com'era prevedibile che si sarebbe potuto andare oltre - sono ragionevolmente contenti. La Sea-Land è stata di valido aiuto nello sviluppo della normativa in questione ed ha dichiarato che sarebbe stata molto felice in occasione della sua definitiva approvazione. Un portavoce della P&O Nedlloyd ha commentato: "Noi saremo felicissimi quando, e se, questa legge verrà approvata, ma aspettiamo ancora la conferma definitiva".

Anche la maggior parte dei caricatori ha accolto favorevolmente la legge ed il presidente della Lega Nazionale Trasporto Industriale, Ed Emmett, ha dichiarato: "I membri del Congresso che si sono impegnati nel processo legislativo in discorso si meritano la gratitudine degli imprenditori attivi in questo settore. Il disegno di legge rappresenta un gigantesco passo in avanti nel processo di deregolamentazione del trasporto marittimo di linea". Un sostegno in tal senso è venuto anche dai porti, dalle organizzazioni sindacali e dalle imprese logistiche.

In tal modo, chi non è favorevole alla legge? Semplice: quel gruppo di imprese che ai sensi della nuova normativa sono state riclassificate come intermediari di trasporto, vale a dire i vettori comuni non proprietari di navi e gli spedizionieri. Un vettore comune non proprietario di navi della Costa Occidentale degli Stati Uniti ha dichiarato: "Sfortunatamente, le piccole attività non verranno a far parte di questo compromesso. Anche se lo S414 rappresenta un tentativo di introdurre maggiore concorrenza, e questo va bene, sinceramente abbiamo delle riserve circa questo disegno di legge e riguardo a come noi - quale gruppo - potremo competere in futuro".

Questo è anche l'atteggiamento di Hyde. Ha infatti affermato: "Ritengo che questa normativa possa causare seri danni in varie circostanze. In primo luogo, e si tratta del caso più importante, un gruppo di piccoli imprenditori, vale a dire i vettori comuni non proprietari di navi e gli spedizionieri, verranno seriamente danneggiati se questo disegno di legge dovesse diventare legge a tutti gli effetti... In secondo luogo, sono preoccupato anche del fatto che questo disegno di legge in realtà incoraggia la contrattazione congiunta delle tariffe di trasporto terrestre".

Ma davvero tutti i giochi sono fatti ed il disegno di legge diventerà legge il prossimo maggio? Allo scopo di portare lo S414 nella sessione parlamentare del 2 agosto scorso, la Disposizione IV del disegno di legge, che si riferiva ai benefici per il personale della marina mercantile, è stata stralciata dal testo complessivo. A causa di ciò, essa dovrà nuovamente passare dal Senato per l'approvazione definitiva. Ci si aspettava tale passaggio entro lo scorso mese di settembre; subito dopo l'approvazione, essa verrà consegnata al Presidente Clinton. Secondo fonti informate di Washington, dovrebbe trattarsi di una mera formalità, ma, alla luce delle precedenti tempestose vicende, chi può dirlo?
