L'offensiva dei trasportatori

Temendo che i cambiamenti nei regolamenti canadesi potessero privarli dell'immunità dall'anti-trust nei traffici da e per il Canada, le principali imprese di trasporto hanno costituito un gruppo per combattere la modifica dell'Atto di Esenzione degli Accordi di Shipping.

Dimenticatevi di Bruxelles, Washington DC, o anche di Canberra, se siete spedizionieri singoli o una compagnia di spedizionieri interessati a vedere la fine dell'immunità dall'anti-trust per gli accordi sulle navi da carico, allora la capitale del Canada, Ottawa, è dove dovreste dirigere l'attenzione d'ora in poi. Perché la legislazione che modifica quell'Atto di Esenzione degli Accordi di Shipping della nazione del 1987 (SCEA), che è in fase di stesura attualmente, potrebbe includere una possibile clausola che ponga fine dopo dieci anni all'immunità degli accordi.

"Costituirebbe una novità per qualunque amministrazione", spiega Michael J. Jordan, presidente esecutivo di Canada Maritime e Cast, aggiungendo: "si daranno veramente la zappa sui piedi se ciò accadesse". Non c'è da meravigliarsi che Jordan abbia opinioni molto incisive su questo argomento, essendo a capo della Intersted Carrier Working GROUP (ICWG), un insieme di compagnie di navigazione che servono il mercato canadese che si sono raggruppate per portare argomenti in favore della conservazione del regolamento vigente. Allo stesso tempo CP Ships, che possiede Canada Maritime e Cast, ed è una delle maggiori imprese di trasporto nei traffici canadesi, sta anche facendo attività di lobbying per conservare lo SCEA così com'è.

Costituitasi circa 6 mesi fa, l'ICWG ha come scopo dichiarato: "fare sì che la legislazione canadese rispecchi le iniziative globali senza mettere in pericolo gli investimenti delle imprese di trasporto in navi, equipaggiamento ed infrastrutture di servizio ai porti canadesi e ridurre di conseguenza il livello dei servizi agli spedizionieri canadesi o da/per i porti canadesi". I suoi membri includono ACL, APL, CP Ships, Senator Lines, Hamburg Sud - The Shipping Group, Hapag - Lloyd, Maersk Sealand, Mitsui OSK Lines, NYK, OOCL, P&O Nedlloyd e Zim.

Le imprese di trasporto sono state spinte all'azione perché il Governo Canadese sta proponendo di modificare lo SCEA alla luce di cambiamenti che sono avvenuti negli USA in seguito all'entrata in vigore nel Maggio 1999 della Legge di Riforma della Navigazione Oceanica (Ocean Shipping Reform Act, OSRA) del 1998 e visti i mutamenti nella navigazione transoceanica nelle altre parti del mondo.

Lo SCEA attualmente dà ai trasportatori oceanici esenzione dall'anti-trust per quelle che l'ICWG definisce "6 diverse aree chiave di attività", così elencate:

  • la facoltà di discutere/mettersi d'accordo su comuni cambi di tariffe e prezzi;
  • l'uso di contratti di esclusiva;
  • il permesso di concludere accordi per stabilire i termini base e le condizioni dei contratti di servizio;
  • la facoltà che i membri hanno di coordinare i servizi (porti di scalo);
  • la possibilità di concludere accordi circa gli orari di navigazione ed altri servizi forniti dal gruppo;
  • la possibilità, per i diversi partecipanti all'accordo, di suddividersi utili e perdite per i diversi servizi.

Di questi 6 punti l'ICWG ritiene che i più importanti siano la facoltà di coordinare i servizi e la possibilità di concludere accordi su orari di navigazione ed altri servizi, perché permetterebbero al singolo trasportatore di ridurre i costi e di non perdere in efficienza e competitività. Secondo il pensiero di Jordan "La SCEA va abbastanza bene". Dice inoltre: "Secondo noi ha lavorato bene per tutti gli azionisti... Non vediamo la vera necessità, in questa attuale revisione, di fare quelle che noi riteniamo essere delle proposte drastiche di cambiamento".

L'anno scorso Transport Canada ha invitato gli azionisti a esprimere la loro opinione sull'argomento. Allo stesso tempo gli spedizionieri, capitanati dal Consiglio Canadese degli Spedizionieri (CSC), hanno chiesto a gran voce la cancellazione dello SCEA, inclusa l'abolizione dell'immunità dall'anti-trust per gli accordi di stabilizzazione. Come gruppo di minoranza il CSC vuole essere alla pari dell'OSRA (per un'analisi più dettagliata della posizione del CSC vedere "Maple-leaf mission", Containerisation International, Febbraio 2000, pp. 57-59).

Nel luglio 1999 Transport Canada ha pubblicato un documento di consulenza sullo SCEA in cui prende in esame 4 opzioni: mantenere l'atto così com'è; abolirlo del tutto; introdurre dei cambiamenti per ordine del consiglio; emendare l'atto introducendo provvedimenti pro-concorrenza. Transport Canada ha consigliato di seguire quest'ultima via e ha proposto le seguenti modifiche:

  • permettere l'archiviazione elettronica e l'accesso ai documenti degli accordi;
  • abolire l'archiviazione delle tariffe per gli accordi;
  • ridurre il numero di giorni di notifica per le azioni indipendenti (SCEA ne dà 15, OSRA 5);
  • non permettere più agli accordi di stabilire termini e condizioni per l'uso dei contratti di servizio;
  • incrementare il livello delle multe per le infrazioni.

Allo stesso tempo, Transport Canada ha elencato altri tre problemi da tenere in seria considerazione:

  • definizione di accordo;
  • meccanismo di reclamo;
  • clausola decennale conclusiva.

In accordo con l'esito della consulenza dell'anno scorso, ci si aspettava che lo SCEA quest'anno sarebbe stato emendato. Comunque i sempre più pressanti conti del trasporto hanno certamente significato un posticipo nei mutamenti nella legislazione della SCEA. Ora tutti attendono che la legislazione sia portata alla House of Common dopo l'intervallo estivo. Tuttavia, se il Primo Ministro canadese Jean Chretien decidesse di indire un'elezione generale in autunno, allora la revisione dello SCEA si posporrebbe fino all'anno prossimo.

Fintanto che è in ballo l'ICWG, non c'è tempo da perdere per attività di lobbying. Jordan ed altri direttori autorevoli di imprese di trasporto hanno già incontrato il Ministro dei trasporti canadese David Collenette ed alcuni suoi colleghi presso Transport Canada. "Abbiamo avuto un buon incontro e spiegato la nostra posizione al Ministro. Egli è conscio della situazione e non ci ha dato motivo di pensare che il radicalismo fosse all'ordine del giorno", confida Jordan. Ora lo scopo dei trasportatori sarà porre la loro situazione all'attenzione dei propri clienti e, in modo più ampio, all'intero mondo degli affari.

Dalla prospettiva dell'ICWG, il cambiamento maggiore e più preoccupante è la clausola decennale. Essa infatti, pur lasciando inalterata per adesso l'immunità dall'anti-trust, prevede che l'esenzione sia automaticamente abrogata dopo 10 anni, a meno che non si trovi una motivazione convincente per il suo mantenimento. Secondo quanto affermato da Transport Canada, "la clausola dovrebbe lasciare abbastanza tempo a chiunque voglia fare delle proposte per costruire la necessaria casistica e raccogliere evidenze empiriche del fatto che l'abolizione dell'Atto risulterebbe un male per l'economia reale, nonché danneggerebbe l'interesse pubblico".

Jordan argomenta: "La più evidente penalizzazione della clausola decennale è che produce la più sconcertante incertezza riguardo agli investimenti in quella parte del mondo sia per i trasportatori come noi che per tutti gli altri". Naturalmente questa non è l'opinione del CSC il cui segretario, Walter Mueller, ritiene che l'abrogazione automatica dovrebbe scattare dopo 5, non 10, anni, perché in tal modo si darebbe tempo a sufficienza per adattarsi alla nuova realtà."

Argomentando a favore del mantenimento di questa esenzione, Jordan dice che i trasportatori "non stanno neanche prendendo di mira lo scenario dei prezzi. Come dato di fatto - continua - pensiamo che i prezzi siano scesi gradatamente per gli spedizionieri negli ultimi 15 anni."

L'ICGW è anche interessato alla proposta che gli accordi siano ridefiniti per proibire intese di discussione e stabilizzazione. "Una volta elaborato un piano d'azione, non si ha una qualsiasi banchina dove degli operatori con un po' d'iniziativa possano ricavare delle economie di scala che provengano dal lavoro in comune ed allo stesso tempo permettano loro di competere l'un l'altro, sia che applichino o no gli stessi prezzi" - si lamenta Jordan.

Né il gruppo dei trasportatori è felice all'idea di perdere la facoltà di discutere i termini dei contratti di servizio delle linee di navigazione senza riguardo al fatto che questi siano collettivi o personali. Altro problema - di minore importanza, ma sentito anche dall'ICWG - è la revisione dei meccanismi di lamentela e l'aumento del livello delle multe. Secondo Jordan l'archiviazione automatica delle tariffe non è una soluzione.

Facendo pressione per il mantenimento dell'attuale regime, la lobby dei trasportatori non solo ritiene che i cambiamenti proposti avrebbero effetti negativi sulla capacità dei trasportatori di investire e ridurre i costi, ma anche che il commercio canadese ne risulterebbe globalmente danneggiato. "Comprendiamo perfettamente perché gli spedizionieri canadesi dicono quello che dicono, ma non siamo sicuri che abbiano ben calcolato le conseguenze di lungo periodo per il Canada", dice Jordan. Nel futuro cupo degli operatori i cambiamenti proposti, specialmente la clausola decennale, potrebbero costringere le linee di navigazione a ridurre i porti di scalo in Canada ed imbarcare merci negli USA dove c'è immunità per l'anti-trust.

Jordan dice: "Pensiamo che il Canada sia molto diverso dalle altre parti del mondo, nel senso che il mercato canadese è molto piccolo e con scarsa popolazione. Meno del 40% delle merci che vanno e vengono dal Canada sono di origine o destinazione canadese, e ciò implica che i servizi che penetrano nel Canada in sostanza sollevano una parte rilevante del cargo statunitense. L'attrazione che molti trasportatori hanno per i porti canadesi, specialmente di Montreal (servito da Canada Maritime e Cast), è dovuta al fatto che essi pagano le tasse agli USA piuttosto che al Canada." Pertanto la logica dell'ICWG è la seguente: se fosse abolita l'immunità dall'anti-trust per gli accordi, allora non solo i porti canadesi perderebbero del cargo, ma anche delle merci statunitensi.

Questa argomentazione non è sfuggita ai porti canadesi che hanno discusso molto con Transport Canada contro qualunque cosa potesse metterli in svantaggio rispetto ai rivali USA. Ad esempio Dominic J. Taddeo, presidente e funzionario capo del porto di Montreal, ha affermato che il suo porto spera nella conservazione dello SCEA così com'è. Così pure Patricia McDermott, vice presidente della divisione marketing dell'Autorità Portuale di Halifax, spiega che Halifax era contro ogni legislazione che portasse via affari targati USA. Questo è uno dei settori del porto a crescita più rapida, cresciuto dallo 0% nel 1994 al 16% del traffico totale di 463 mila teus nel 1999. "Ora è al 23%" - afferma.

Allo stesso modo, alleata dei trasportatori nell'opposizione dell'immunità all'anti-trust è la Canadian International Freight Forwarders Association (CIFFA). Nel documento in cui la CIFFA prende posizione sulla SCEA, si dice: "CIFFA non si fa carico della raccomandazione del CSC secondo cui la SCEA e l'immunità dall'anti-trust per gli accordi di navigazione vengano abolite". L'opinione di CIFFA è che mentre le forze di mercato e la concorrenza avrebbero un ruolo chiave nell'industria della navigazione canadese, la concorrenza senza alcun controllo potrebbe portare le diverse compagnie di navigazione a danneggiarsi l'un l'altra, nonostante i provvedimenti contro le azioni predatorie nella Legge sulla Concorrenza". Comunque, CIFFA mitiga il suo appunto dicendo che "l'immunità dall'anti-trust dovrebbe avere lo scopo di offrire una rete di salvataggio alle compagnie di navigazione, non di cercare di trarre profitti dall'abbandono dell'efficienza di costo e della realtà di mercato".

Al CSC, Mueller non è convinto del fatto che privare gli accordi dell'immunità dall'anti-trust costringerà i trasportatori a non poter più servire i porti canadesi. "Canada Maritime e Cast hanno investito pesantemente nel porto di Montreal (Cast e CP Ships hanno anche un terminal li). Non approderanno più li? Tanto più che l'ICWG non ha proposto niente di nuovo", dice.

Mueller argomenta: "Dall'ottica di un addetto della navigazione, il primo obiettivo è muovere i cargos nella maniera più efficiente e conveniente. Non è rilevante che passi o meno dai porti canadesi... gli stessi trasportatori canadesi regolarmente traghettano merci fuori dai porti statunitensi con trasportatori statunitensi".

A Mueller non sfugge neppure l'ironia di una situazione in cui i trasportatori canadesi si lamentano perché non potrebbero più continuare ad operare come partners di un accordo per i traffici canadesi, quando in realtà già operano singolarmente per i cargos sbarcati dai porti USA transitando per porti canadesi.

Comunque, allorché la nuova legge apparirà, resta da vedere se rifletterà la posizione del CSC o quella dell'ICGW . Forse non sarà lontana da nessuna delle due visioni, né da quella dell'OSRA.

E se così fosse saranno soddisfatti Jordan ed i suoi colleghi? "Sono sicuro che il gruppo in cui sono inserito potrà in parte abbracciare questa mia visione, ma non necessariamente in modo totale ed esclusivo", dice Jordan. Nel frattempo continua l'offensiva dei trasportatori.
