La nuova normativa sulle acque dell'Unione Europea preoccupa i porti

Sebbene la nuova direttiva-quadro europea sulle acque non sia stata sviluppata allo specifico scopo di occuparsi delle masse d'acqua nei porti e nelle baie marittime, come invece accade per la direttiva europea sugli uccelli e gli habitats, tuttavia potrebbe comportare serie conseguenze collaterali per loro, a detta dei rappresentanti di alcuni dei principali organismi portuali in Europa.

Jan Brooke, consulente in materie ambientali che lavora per la PLA (Autorità del Porto di Londra) ed altri organismi, fa altresì parte del gruppo di lavoro guidato dall'Associazione Internazionale della Navigazione (in precedenza PIANC) impegnato nell'esame delle possibili implicazioni della direttiva-quadro sulle acque per i porti, le baie, la navigazione turistica e commerciale ed il dragaggio. La Brooke, in occasione della conferenza NCE di luglio sulla direttiva-quadro sulle acque, ha detto di ritenere che la direttiva potesse presentare "diverse implicazioni pratiche".

"Tra i provvedimenti che probabilmente potrebbero essere di particolare rilievo per i porti, le baie ed il settore del dragaggio, vi sono quelli inerenti alla soddisfazione dei requisiti dell'articolo 16 della direttiva-quadro sulle acque, nell'ottica della progressiva riduzione e della eliminazione delle principali sostanze pericolose" ha spiegato la Brooke.

"I nuovi sviluppi - ad esempio il dragaggio e la dismissione della risulta, ovvero le nuove infrastrutture - sono consentiti ai sensi dell'art. 4 (7) della direttiva-quadro sulle acque, sempre che vengano osservati determinati criteri, e debbono essere resi noti ai sensi di quelli che sono conosciuti con il nome di Piani di Gestione dei Bacini Fluviali. Le ragioni di qualsiasi proposta di modifica o alterazione con conseguenze sullo stato delle acque devono essere presentate e spiegate in questi piani e riviste ogni sei anni" ha dichiarato la Brooke.

Ulteriori criteri richiedono l'adozione di tutti i provvedimenti pratici per la mitigazione dei fenomeni; devono esserci motivi di preponderante interesse pubblico; infine, gli obiettivi vantaggiosi possono essere conseguiti mediante la migliore opzione possibile dal punto di vista ambientale, tecnicamente fattibile, che non comporti costi sproporzionati. Tuttavia, come ha spiegato la Brooke, al momento non è molto chiaro come verranno applicati tali criteri, che non tengono conto del fatto che essi siano riferiti o meno ad una determinata località (come accade per la direttiva sugli uccelli e gli habitats).

La direttiva-quadro sulle acque è entrata in vigore nel 2000. Il cronogramma relativo alla sua implementazione si estende su 15 anni e richiede "un buono stato ecologico" od uno equivalente per ottenere entro il 2015 le masse d'acqua previste. Il suo scopo è quello di "istituire una struttura comunitaria per la protezione delle acque interne di superficie, per la acque di transito, le acque costiere e le acque freatiche, al fine di impedire e ridurre l'inquinamento, promuovere l'uso sostenibile delle acque, proteggere l'ambiente acquatico, migliorare lo stato dell'ecosistema acquatico e mitigare gli effetti delle inondazioni e della siccità".

Ai sensi della direttiva-quadro sulle acque, alle masse d'acqua che sono state assoggettate a mutamenti significativi in conseguenza di attività umane tali che non sia possibile ottenere "un buono stato ecologico" - le cosiddette masse d'acqua pesantemente modificate - verrà richiesto di conseguire "un buon potenziale ecologico". Tra gli esempi di tali masse d'acqua si potrebbero includere gli estuari che sono stati dragati od altrimenti modificati per l'uso portuale.

A giugno, un gruppo di organizzazioni europee impegnate nei settori della navigazione marittima e del dragaggio ha pubblicato un documento di opinione che mette in luce quelle che essi ritengono siano alcune delle implicazioni della direttiva-quadro dell'Unione Europea sulle acque per i porti, le baie, la navigazione commerciale e turistica ed il dragaggio. Il documento è stato pubblicato dalla PIAC per conto della ESPO (Organizzazione Scali Marittimi Europei), della EFIP (Federazione Europea dei Porti Interni), della CEDA (Associazione Centrale Dragaggio), della INE (Navigazione Interna Europa) e della IADC (Associazione Internazionale delle Imprese di Dragaggio).

Come sottolinea la PIANC, gli scopi della direttiva-quadro sulle acque sono ampiamente supportati dai porti e dalle baie. "Tuttavia" afferma il documento di opinione, "la direttiva-quadro sulle acque solleva altresì questioni che sono di fondamentale importanza per il settore e richiedono urgente attenzione. Se gli obiettivi della direttiva-quadro sulle acque devono essere conseguiti in modo sostenibile, compatibilmente con la realtà dei settori marittimo ed idroviario, occorre affrontare tali questioni". Le problematiche in questione, che il documento mette in evidenza, comprendono le più ampie questioni ambientali della direttiva-quadro sulle acque, la necessità di chiarezza, coerenza e trasparenza e le implicazioni pratiche ed economiche della direttiva-quadro sulle acque.

"La direttiva-quadro sulle acque potrebbe comportare conseguenze potenzialmente avverse per i settori dei porti, delle baie, della navigazione e del dragaggio" afferma il documento. "Attenzione prioritaria dev'essere prestata alle implicazioni pratiche della direttiva, tra cui le possibili limitazioni alle attività ed alle operazioni, all'aumento dei costi ed alle incertezze o ai ritardi".

Inoltre, si afferma nel documento, "le analisi economiche debbono necessariamente comprendere una valutazione delle implicazioni economico-finanziarie della direttiva-quadro sulle acque per le attività portuali, di navigazione e di dragaggio".

Secondo Jan Brooke, le responsabilità delle autorità portuali, delle baie e della navigazione quali fonti normative ai sensi della direttiva-quadro sulle acque restano poco chiare. "L'implementazione della direttiva-quadro sulle acque è senz'altro in corso, ma vi sono ancora molte opportunità da introdurre nel procedimento per influenzarlo. L'effettiva partecipazione proattiva di coloro che hanno interessi in gioco sarà decisiva per la riuscita dell'implementazione della direttiva-quadro sulle acque" ha concluso la Brooke. "L'articolo 4 (7), e parecchie altre cose nella direttiva, sollevano più questioni di quante abbiano ricevuto da essi risposta ed i porti hanno bisogno di intavolare una discussione con le autorità competenti in relazione alla sua applicazione pratica".
