Trasporto marittimo

Inconvenienti per la navigazione di linea

Quando la Commissione Europea aveva proibito le conferenze di linea nell'ottobre del 2008, si aspettava che il mercato di linea diventasse un posto migliore in cui vivere.

I vettori marittimi avrebbero dovuto essere costretti a competere in uno scenario più aperto al di fuori dei cartelli, diventando così più concentrati sulla clientela.

I servizi, fondati sui principi del libero mercato, avrebbero dovuto essere migliori ed i caricatori consegnatari avrebbero dovuto conseguire un valore migliore per il denaro.


Ma questo è avvenuto davvero in pratica e, cosa più importante, adesso altri paesi staranno pensando di copiare quella normativa?

Il problema, quando si cerca di interpretare gli eventi successivi, è che l'Unione Europea (ed il resto del mondo) da allora sono piombati negli abissi della recessione.

Ciò ha altresì modificato i comportamenti dei vettori marittimi, rendendo così difficile discernere cause ed effetti.

Il mercato si è rivelato un bagno di sangue per tutti quanti e la situazione è ben lungi dal risolversi.

In conseguenza del fatto che i volumi dei carichi europei sono diminuiti di circa il 20% e le tariffe di nolo di oltre il 50% su alcune direttrici di traffico, i vettori marittimi sono stati costretti a concentrarsi sulla sopravvivenza finanziaria piuttosto che su un modo diverso di provvedere alla cura del cliente.

Ai caricatori è stato presentato un servizio di livello inferiore poiché quello era tutto ciò che molte linee di navigazione potevano permettersi.

I vettori marittimi affermano che la situazione è stata resa peggiore dal fatto che non gli viene più consentito di mettersi assieme attorno ad un tavolo allo scopo di pianificare iniziative correttive.

Il bilanciamento fra l'offerta e la domanda globale è stato un incubo, anche se non è che esse prima stessero poi tanto bene.

Riassumendo tale situazione, Jacques Saade, presidente della CMA CGM, parlando recentemente (a settembre) si è lamentato in questo senso: "In cima a tutti i problemi indotti dalla recessione, dobbiamo aggiungere le nuove regole di Bruxelles, che sono penalizzati, irrazionali ed ingiustificate.

Penalizzanti, perché a noi (vettori marittimi) viene proibito di incontrarci per discutere il mercato, le sue esigenze, il livello delle sue tariffe di nolo ed i sovrapprezzi (incrementi del prezzo del carburante, ritardi nei porti, ecc.).

Irrazionali, dal momento che cinesi, coreani ed asiatici in generale non devono seguire le stesse regole, di modo che essi dispongono di una libertà che comporta effetti sfavorevoli in Europa.

Infine, ingiustificabili, poiché Bruxelles sta ancora seriamente valutando l'abolizione dei consorzi.

In effetti, lo scopo dei consorzi è quello di razionalizzare gli orari di viaggio mediante la condivisione degli spazi sulle navi.

Ciò ci consente di migliorare le tariffe di nolo dei clienti ed i nostri costi, così come di ridurre le emissioni di CO2".

Di conseguenza, è pur vero che Bruxelles ha consentito ai vettori marittimi di continuare a lavorare nell'ambito di consorzi anche successivamente all'aprile del 2010, ma le linee di navigazione non hanno ottenuto tutto ciò che volevano.

Il presidente della OOIL (società-madre della OOCL), C. C. Tung, si è soffermato su questo argomento ad ottobre quando, di fronte ad un altro uditorio, si è trovato a descrivere le iniziative politiche di cui ci sarebbe bisogno per agevolare la ripresa del settore.

Ha infatti sostenuto: "Il nostro convincimento è che le attuali piattaforme di discussione in ordine alle questioni del settore dovrebbero essere ampliate ancor di più.

Mentre il settore è in sofferenza sino a tal punto, il nostro obiettivo dovrebbe essere quello di lavorare assieme ai governi per assicurare al nostro settore l'idoneità a discutere collettivamente la gestione della capacità e la sua razionalizzazione per il breve periodo di circa un anno".

Continua Tung: "Non sto sostenendo un ritorno al passato, né appoggiando le conferenze per la fissazione dei prezzi.

Invece di assicurare sussidi finanziari alle linee di navigazione containerizzate nazionali, i governi potrebbero concedere una sospensione temporanea della normativa anti-trust".

I caricatori sosterranno che i problemi dei vettori marittimi nel corso della recessione sono stati peggiorati dal fatto di avere ordinato troppe navi nei momenti belli.

Come succede ai lemming che corrono verso la scogliera, la loro esigenza di ulteriore capacità sembra essersi fondata su previsioni di crescita dei carichi eccessivamente ottimistiche.

Queste previsioni, inoltre, sono state fatte in un momento in cui i vettori potevano ancora sedersi attorno ad un tavolo per discutere dell'offerta e della domanda.

Comunque stiano le cose, il mercato di linea dallo scorso anno fino adesso non è stato un posto felice, ed il modo in cui i vettori marittimi si sono comportati nel suo ambito non può essere scisso dalla recessione.

Molti caricatori lo hanno affermato in occasione della recente indagine di Containerisation International sui caricatori.

Jean-Louis Cambon, della commissione gestione trasporti marittimi della Michelin, ha riassunto con precisione le opinioni di molti.

Afferma infatti: "Il divieto delle conferenze di trasporto marittimo, simultaneamente all'avvento della crisi economica, rende molto difficile definire una correlazione causale fra il loro conseguente comportamento e ciò che abbiamo sperimentato prima".

Pur tenendo conto di questo avvertimento, è ciononostante interessante notare come il 42% di tutti i caricatori che hanno risposto all'indagine di Containerisation International hanno detto che i vettori marittimi non sono più concentrati sul cliente di quanto lo fossero prima, mentre un robusto 21% ha riferito di cambiamenti solo limitati.

Inoltre, solo il 21% ha sperimentato "qualche" cambiamento, rispetto al 7% che ha assistito a cambiamenti notevoli ed al 9% che ha potuto fruire di cambiamenti in meglio significativi.

Un'altra aspettativa collegata alla fine delle conferenze era rappresentata dal fatto che i prezzi dei vettori marittimi sarebbero dovuti diventare più trasparenti.

Sebbene i caricatori da tempo abbiano smesso di pagare tariffe di nolo comuni, preferendo al loro posto accordi di servizio privati, la maggior parte degli oneri ausiliari alle tariffe, quali i THC, e dei sovrapprezzi, quali CAF e BAF, erano ancora fissati dai cartelli e si pensava diffusamente che il loro livello fosse inflazionato artificialmente allo scopo di far lievitare i proventi dei loro membri, piuttosto che per pagare i costi autentici.

Peraltro, anche in questo caso sembra che i caricatori siano delusi, dal momento che qualcosa come il 23% di coloro che hanno risposto hanno riferito di non avere riscontrato nessun miglioramento nella trasparenza, mentre il 40% ha sperimentato solo cambiamenti limitati.

Un altro 25% ha dichiarato di aver visto solo "qualche" cambiamento, lasciando solo il 12% di coloro che hanno risposto a dire che i cambiamenti sono stati notevoli.

In effetti i BAF sono stati resi più trasparenti, sebbene ancora non del tutto, mentre la definizione dei THC resta poco chiara.

Inoltre, esistono molte contraddizioni circa la definizione dei sovrapprezzi per l'alta stagione e su cosa si suppone che essi debbano includere.

Ad esempio, a novembre alcune linee di navigazione per la prima volta hanno reclamato un sovrapprezzo per l'alta stagione in direzione est nella direttrice di traffico dall'Europa all'Estremo Oriente, mentre le altre direttrici ne presentano uno nell'altra direzione.

In passato, i vettori marittimi affermavano che i sovrapprezzi per l'alta stagione erano necessari per recuperare i costi eccezionali relativi al riposizionamento dei contenitori vuoti, anche se pochi vuoti, o addirittura nessuno del tutto, hanno mai dovuto essere riposizionati dall'Estremo Oriente all'Europa.

Steve Berry, dirigente importazioni e trasporto merci della Princes, importatore di alimentari con sede nel Regno Unito, è uno di coloro che hanno riferito di miglioramenti solo limitati perché le linee di navigazione ancora tendono ad annunciare ripristini tariffari e sovrapprezzi in parallelo.

Lamenta Berry: "Anche se ufficialmente le conferenze non esistono più, le linee di navigazione seguono ancora il sentiero tracciato dai grossi operatori come la Maersk e la MSC".

Rial Robinson, dirigente all'approvvigionamento dei noli aerei e marittimi del gigante farmaceutico Ciba, con sede in Svizzera, ha dichiarato: "La

Non dispongo di prove secondo cui l'abolizione delle conferenze abbia comportato in qualche modo un impatto diretto sulla competitività".

Quest'ultima affermazione conduce al terzo dei vantaggi che si supponeva dovessero evolvere dal divieto delle conferenze nell'Unione Europea, vale a dire il fatto che i vettori marittimi dovessero diventare più competitivi.

Coloro che hanno risposto all'indagine si sono dimostrati più rilassati in ordine a tale argomento, dato che solo il 13% ha dichiarato di non aver sperimentato alcun cambiamento, mentre il 19% ha assistito a cambiamenti limitati.

D'altro canto, il 34% ha sperimentato "qualche" cambiamento, il 28% ha riferito di cambiamenti notevoli ed il 6% di cambiamenti significativi.

Il risultato non sorprende, tenuto conto del modo in cui le tariffe di nolo sono calate da allora, sebbene i vettori marittimi possano giustificatamente ribattere che i caricatori avrebbero potuto essere più benevoli nei loro commenti.

Il problema è che il 59% di tutti coloro che hanno risposto hanno affermato che i vettori marittimi debbono in gran parte biasimare solo se stessi per la caduta libera dei prezzi a causa della guerra tariffaria da loro scatenata sul mercato.

Non si sa se il declino delle tariffe sarebbe stato meno grave se le conferenze fossero state consentite, ma è facile immaginarselo.

Un caricatore con sede in Germania ha dichiarato: "Le linee di navigazione potrebbero essere diventate più competitive a causa della linea di tendenza verso il basso causata dalla carenza dei carichi, ma essi potrebbero ribattere che le tariffe si sono abbassate a causa dell'abolizione delle conferenze".

Ivan Seow, procacciatore dei trasporti internazionali della Schneider Electric, parla a nome di molti: "Il miglioramento della competitività è stato probabilmente causato dalla situazione economica" sostiene.

Riassumendo, il divieto delle conferenze nell'Unione Europea non sembra ancora avere apportato i miglioramenti previsti, tanto che la maggior parte dei caricatori ne ' preoccupata, sebbene coloro che l'avevano promosso possano sottolineare alcune circostanze eccezionali.

L'attenzione nei confronti della clientela resta scarsa, e da parte dei vettori marittimi non viene impiegato ancora abbastanza tempo sulla differenziazione del prodotto.

Peraltro, come ribatte un vettore marittimo, "quando mai i clienti sono contenti?".

Malgrado ciò, la Commissione Europea, lo ESC (Consiglio dei Caricatori Europei), il Forum dei Caricatori Globali e la maggior parte di coloro che hanno risposto all'indagine sui caricatori condotta quest'anno da Containerisation International vorrebbero ancora veder bandire le conferenze nel resto del mondo.

Secondo la citata indagine, un massiccio 74% ha votato a favore dell'abolizione, facendo chiaramente capire che la fine della partita deve ancora arrivare.

Fra i commenti dei caricatori che hanno risposto, si possono citare i seguenti:

  • tenendo presente i traffici mondiali, non avrebbe senso disporre di una soluzione isolata in Europa;
  • le conferenze di linea condizionano direttamente la scelta e non promuovono la concorrenza;
  • le conferenze sono sostanzialmente anticoncorrenziali e dovrebbero essere sempre scoraggiate;
  • le conferenze non hanno motivo di esistere nel mondo odierno, ma questa opinione non si fonda sulle esperienze fatte dal momento del divieto da parte dell'Unione Europea;
  • da un punto di vista di principio, non comprendiamo perché quel settore abbia diritto ad esenzioni dalla normativa sulla concorrenza;
  • probabilmente, pertanto, le conferenze sono sopravvissute alle loro esigenze ed i vettori oggi - o almeno, alcuni di loro - sono abbastanza raffinati da riuscire a capire come condurre le proprie attività.
Da quanto sopra esposto, sembra chiaro che i voti espressi contro le conferenze si fondano su questioni di principio, piuttosto che sull'esperienza fatta, il che è difficile da comprendere dal momento che i cartelli vengono criticati in tutti i settori di attività.

Il problema per il settore del trasporto marittimo di contenitori è che esso, a differenza dei mercati regolamentati a livello locale, è talmente aperto e globalmente non regolamentato che la concorrenza può facilmente divenire del tutto rovinosa, il che è ciò a cui abbiamo assistito quest'anno.

Ognuno può giocare la propria partita e non ci sono regole anti-trust accettate a livello internazionale.

Quello che viene accettato in Cina non lo è in Corea del Sud, mentre ciò che è accettato in Corea del Sud non è accettato nell'Unione Europea, ma tutti quanti devono competere dentro allo stesso pentolone bollente.

È questa una delle ragioni per cui i primi 20 operatori mondiali controllano ancora solo il 70% circa di tutta la capacità delle portacontainer.

Se non fosse stato per il grande impegno e la protezione statale, particolarmente in Asia, molti vettori marittimi sarebbero ora in bancarotta.

Le perdite subite nella prima metà dell'anno, fra cui i 961 milioni di dollari USA della divisione contenitori della Maersk, i 561 milioni di dollari della Hanjin Shipping, i 499 milioni di dollari della CSCL ed i 413 milioni di dollari della CSAV sono semplicemente insostenibili.

Pertanto, se le conferenze venissero abolite in tutto il mondo, rendendo il mercato ancora più esposto ai principi del libero scambio, i caricatori dovrebbero accettare che il settore possa alla fine essere controllato da appena una manciata di operatori in guerra fra loro, ovvero dovrebbero cercare di far approvare una migliore regolamentazione a livello globale.
