REPONSE DU PRESIDENT DU PORT AUTONOME DE DUNKERQUE

1. Missions portuaires contradictoires

La politique d’am'nagement de l’espace industriel et portuaire de Dunkerque vise prioritairement ' attirer des entreprises et investisseurs pouvant permettre d’accro'tre les flux de trafics locaux, ' l’export comme ' l’import. Cette politique est difficile et exige du temps, compte tenu de la concurrence existant en la mati're au plan national et europ'en.

Il est vrai que le port attire parfois des entreprises qui ne g'n'rent pas de trafic portuaire, mais il s’agit g'n'ralement soit d’entreprises susceptibles de g'n'rer ult'rieurement des trafics portuaires gr'ce au d'veloppement de leurs activit's, soit d’entreprises de service aux industries install'es dans le port.

Par ailleurs, le port attire des entreprises qui ne g'n'rent aucun trafic portuaire dans les zones proches du centre ville, sur des sites portuaires en reconversion.

2. Coh'rence entre secteurs ferroviaire, routier et fluvial

Le port de Dunkerque rejoint la Cour sur cette remarque, 'tant pr'cis' que la coh'rence multimodale des transports du Dunkerquois d'pend essentiellement et d’abord de la qualit' des infrastructures de communication de son hinterland.

Cette qualit' est largement perfectible :

  • La liaison autorouti're vers l’agglom'ration lilloise est v'tuste et insuffisante au regard du nombre de voies disponibles rapport'es au trafic de camions actuel et, ' fortiori, futur.
  • Les liaisons fluviales offrent un tirant d’air insuffisant pour optimiser la rentabilit' des trafics fluviaux vers Dunkerque. Cette insuffisance tient au fait qu’un grand nombre de ponts construits sur le canal Dunkerque - Escaut sont actuellement trop bas pour permettre la navigation des unit's modernes.

3. La coop'ration en mati're d’investissement (Dunkerque – Calais – Boulogne)

  • Partenariat Boulogne - Calais – Dunkerque

L’'tablissement public industriel et commercial " Port autonome de Dunkerque " est pr't ' apporter son concours ' toute 'tude juridique, financi're, comptable, et technique portant sur le rapprochement des ports de Dunkerque, Calais et Boulogne.

  • Plateformes logistiques

Les pressions exerc'es par les ouvriers dockers pour 'tendre leur monopole ' la manutention ' l’int'rieur des entrep'ts logistiques ont conduit dans le pass' ' privil'gier l’implantation de ces activit's sur des sites 'loign's des quais.

C’est le cas d’Eurofret qui b'n'ficie, ' contrario, d’une tr's bonne desserte autorouti're.

Le changement de climat social depuis la mise en œuvre de la r'forme de 1992 permet aujourd’hui l’implantation d’activit's ' proximit' des quais et contribue ' ce que le port devienne dans son ensemble une plateforme logistique.

4. Les organes de d'cisions des ports : signification des pr'visions budg'taires affich'es

La liste des investissements qui sert de base ' l’'laboration du compte emploi-ressource de l’EPRD est pr'visionnelle. Certains investissements sont subordonn's ' des d'cisions externes : Etat, clients, investisseurs priv's… D’autres peuvent subir des retards pour des raisons techniques ou de proc'dures. L’appr'ciation de l’opportunit' de l’investissement se fait lors de l’approbation de celui-ci par le conseil d’administration, pr'alablement au lancement effectif des travaux. Cette pratique ne porte atteinte ni aux pr'rogatives du conseil d’administration, ni ' la bonne gestion de l’'tablissement.

5. La r'forme de la manutention

Accord sur l’analyse de la Cour. Le co't du plan social est conforme aux 'l'ments d’information fournis par le port lors de l’enqu'te de 1996. Ces indications font donc abstraction du plan emploi de 1996.

6. Le r'gime fiscal applicable au domaine portuaire en mati're de taxe fonci're

Le probl'me appelle une clarification. Accord sur l’analyse de la Cour.

7. Les contrats de plan Etat-r'gion

  • Le recours ' l’expertise de l’Etat

Tout en reconnaissant l’int'r't des orientations pr'conis'es par la Cour et la r'alit' des faits rapport's, le Port autonome de Dunkerque tient ' pr'ciser quelques 'l'ments constants de sa strat'gie.

Le port de Dunkerque n’est pas et n’entend pas 'tre seulement un " port industriel de marchandises en vrac ". Si les trafics de grands vracs constituent bien entendu un domaine particuli'rement important d’activit's, les installations du port lui permettent d’accueillir toutes sortes de marchandises au service des chargeurs de son hinterland.Cette analyse semble valid'e par l’'volution actuelle du trafic, et par l’int'r't d’investisseurs 'trangers, dans le domaine des marchandises diverses et en particulier celui des conteneurs.A ce titre, le chiffre de cent mille conteneurs devrait 'tre atteint en 1999, et ne constitue qu’un objectif interm'diaire dans le cadre d’une croissance tr's rapide.

  • L’anticipation strat'gique ' Dunkerque

L’'laboration d’un plan d’investissement ' cinq ans (sept dans le nouveau contrat de plan) est un exercice tr's difficile pour un secteur d’activit' soumis ' une concurrence internationale et aux 'volutions du commerce mondial.

Cet exercice est d’autant plus difficile qu’' la diff'rence des ports voisins d’Europe du nord, la faiblesse des soutiens publics aux investissements d’infrastructure ne permet pas de mettre en œuvre une strat'gie d’anticipation.

8. Les proc'dures budg'taires

  • L’E P R D :

Tel que pr'vu et organis' par la r'glementation, l’EPRD constitue un outil pr'visionnel indicatif et souple, susceptible de r'pondre aux imp'ratifs de gestion rencontr's par un 'tablissement industriel et commercial dont l’essentiel des ressources ne peut 'tre qualifi' de " captif ", puisque relevant d’une activit' ressortissant ' un environnement 'conomique concurrentiel. Assimiler un tel outil au budget mis en œuvre dans des collectivit's publiques, o' les variations de ressources n’ont 'videmment pas les m'mes ampleurs, rel've semble-t-il d’une d'marche analogique excessive.

Pour autant, il convient d’harmoniser le plus possible les r'alisations avec les pr'visions. Il n’en demeure pas moins que l’EPRD des EPIC constitue un instrument de communication important, vis ' vis des partenaires des ports, pour amener ces derniers ' se positionner sur des enjeux ou des objectifs d’investissement pour lesquels leurs participations ext'rieures sont 'videmment toujours les bienvenues.

Ces contraintes g'n'rent des 'carts, corrig's en cours d’exercice au travers de d'cisions modificatives. Celles-ci permettent des int'grations ou des ajustements budg'taires effectu's non pas tardivement mais bien en fonction de l’'volution r'elle d’activit's parfois irr'guli'res ou al'atoires(exemple : les fluctuations de trafics agricoles li'es aux d'cisions europ'ennes en mati're de quotas c'r'aliers).

  • L’adoption tardive des budgets :

Si la date du 1er octobre n’est pas toujours respect'e pour l’arr't' de l’EPRD par le conseil d’administration, on ne constate pas ' Dunkerque de d'rive telle qu’elle porterait sur plusieurs mois. La date des arr't's des EPRD par le CA du PAD furent les suivantes depuis 1995 : 1995 : 7/10/94 ; 1996 : 20/10/95 ; 1997 : 18/10/96 ; 1998 : 17/10/97 ; 1999 : 16/10/98. Malgr' les difficult's rencontr'es pour tenir les d'lais r'glementaires (vacances g'nant les travaux budg'taires des services, disponibilit' des administrateurs en septembre/octobre, etc), les dates d’approbation mentionn'es pr'sentent une r'gularit' qui ne peut 'tre assimil'e ' une d'rive.

  • L’exercice de la tutelle sur les budgets.

Les remarques formul'es rel'vent des tutelles. Force est toutefois de constater que celles-ci se trouvent souvent confront'es, de concert avec les ports eux-m'mes, ' la n'cessit' de faire face ' la continuit' des activit's et le cas 'ch'ant ' celle du service public portuaire, notamment dans des circonstances exceptionnelles. Les tensions sociales rencontr'es par le PAD en 1992 'taient tr's graves ; il semble excessif de faire un cas g'n'ral des actions adopt'es par les autorit's publiques ' l’occasion de ces circonstances exceptionnelles.

  • La programmation pluriannuelle :

Cette programmation, sans doute encore perfectible, existe bien au PAD. Un plan glissant ' trois ans est actualis' chaque ann'e et pr'sent' au conseil d’administration lors de l’adoption de l’EPRD. Un soin important est apport' par l’'quipe de direction ' l’'laboration de ce plan qui constitue un outil de pilotage essentiel.

9. La comptabilit' et le contr'le de gestion

Les modalit's comptables d'nonc'es par la Cour ont fait l’objet de r'ponses dans le cadre de la proc'dure contradictoire de contr'le sur place de la Cour.

Un projet de service de l’agence comptable est actuellement en cours. L’un des objectifs de ce projet est de moderniser le syst'me d’information comptable dont l’architecture informatique, d'velopp'e en interne, n’offre plus la transparence et la souplesse requise. A partir des proc'dures comptables et informatiques ainsi d'crypt'es et mises ' plat, une 'volution de l’existant pourra 'tre effectu'e et permettra l’acquisition d’un progiciel int'gr' (ERP).

Compl'mentairement ' ce travail sur les proc'dures et leur automatisation, une r'flexion est en cours en mati're d’organisation des contr'les internes sur les cha'nes de travail recettes et d'penses.

10. Les missions de l’agent comptable

La Cour pr'conise une modification, voire la suppression, du statut d’'tablissement public des ports autonomes.

Il appartient aux pouvoirs publics de se prononcer sur l’opportunit' de ce changement substantiel de statut des 'tablissements portuaires.

Toutefois, il n’appara't pas que le cumul des fonctions d’agent comptable et de chef des services financiers, cumul certes original mais pr'vu express'ment par l’instruction M9-5, fasse courir un risque aux fonds publics g'r's dans les ports ou dans les autres 'tablissements publics recourant ' cette modalit' fonctionnelle.

Le principe de la s'paration des pouvoirs entre ordonnateur et comptable doit 'tre en r'alit' appr'ci' par rapport ' la ma'trise effective du syst'me d’information utilis' respectivement par les services ordonnateurs et comptables, chacun pour ce qui les concerne, et par rapport aux moyens de contr'les internes mis ' la disposition de l’agent comptable. Les r'dacteurs de la M9-5 avaient parfaitement pris en compte et organis' ces imp'ratifs. Les ports ont, de ce point de vue, appliqu', semble-t-il, l’instruction de mani're correcte.

Enfin, le r'le de conseiller assur' par l’agent comptable, ' travers son r'le de Directeur Financier, ne met pas en danger la sinc'rit' et la r'gularit' des comptes pr'sent's au conseil d’administration. Bien plus, cette pr'sentation est effectu'e dans des conditions plus significatives que celles relevant d’un commissariat aux comptes, 'pisodique et la plupart du temps conduit a posteriori de l’ex'cution budg'taire et comptable r'alis'e par l’'tablissement.

En r'alit', la certification de la sinc'rit' et de la r'gularit' des comptes attest'e par un agent comptable appara't non pas li'e ' la coexistence fonctionnelle de fonctions de comptable public et de directeur des finances, mais ' la possibilit' qui lui est faite :

. d’'tre inform', par le fait m'me de son int'gration au sein de l’'quipe de direction, des choix strat'giques et financiers de l’'tablissement, et des implications qu’ils auront pour ses prises en charge comptables,

. de s’exprimer, de la fa'on la plus libre et la plus responsable, aupr's des instances d'cisionnelles de l’'tablissement ou aupr's des organes de contr'le ou de tutelle habilit's,

. de disposer d’un outil proc'dural (comptable et informatique) et d’une logistique lui permettant d’assurer ses missions correctement afin notamment d’apporter ' l’ordonnateur, de fa'on rapide et s're, toutes informations ou conseils dont il pourrait avoir besoin.

Cette coexistence de fonctions est, ' l’exp'rience, positivement appr'ci'e au port de Dunkerque, ' la fois par l’ordonnateur, eu 'gard aux avantages fonctionnels, aux 'conomies d’'chelle, et ' la souplesse de gestion qu’elle permet, mais aussi par le comptable public pour l’acc's aux informations utiles, la pertinence des contr'les internes effectu's et en d'finitive la s'curisation des imputations et enregistrements comptables qu’elle autorise.

11. La comptabilit' analytique et le contr'le de gestion

Un contr'leur de gestion, rattach' au directeur g'n'ral, est en fonction au PAD depuis le 1er Janvier 1998.

Dans le cadre du projet de service de l’agence comptable, une r'flexion a 't' engag'e sur l’am'lioration de la comptabilit' analytique ' laquelle est associ' le contr'leur de gestion.

12. Les proc'dures de passation des march's

Le seuil des march's pris en compte par le PAD est dor'navant le seuil de droit commun : 300 000 F. L’organisation des proc'dures mises en œuvre est conforme ' la r'glementation. Les chefs de services ont 't' sensibilis's ' l’int'r't offert par les march's :

. anticipation des projets, consommation des cr'dits budg'taires, mise en œuvre des march's, mise en commun de march's entre services, etc ;

. obtention de prix comp'titifs au plan national voire international ;

. facilitation de la gestion une fois le march' r'alis' : ordres de service, engagements, etc.

Pour information, l’'volution du nombre des march's pass's par le PAD au cours de ces derni'res ann'es fut la suivante : 1995 : 58 ; 1996 : 55 ; 1997 : 30 ; 1998 : 80 ; 1999 : 52 (' fin ao't). Certains de ces march's sont pluriannuels.

13. Les 'tudes pr'alables aux investissements

Les investissements nouveaux en outillage ont 't' rendus n'cessaires par les caract'ristiques insuffisantes des grues et portiques du port de Dunkerque. Les grues nouvelles ont une capacit' de levage de 40 tonnes , ' comparer avec celle de 6 et 10 tonnes pour la quasi-totalit' des grues qui 'quipent le port. L’arriv'e de 4 nouvelles grues de 40 tonnes – dont une grue mobile et une grue financ'e par le secteur priv' – s’est accompagn'e de la diminution de 40 ' 27 du parc de grues anciennes. Sans m'me parler de la contrainte que poserait la r'ception de navires de type over-panamax, les portiques ' conteneurs anciens ne peuvent plus op'rer sur certains navires fr'quentant le port, du fait, en particulier d’une capacit' de levage des panneaux de cale insuffisante.

14. La coh'rence des investissements

  • Les terminaux de vracs liquides

Il est indiqu' que deux raffineries disposent chacune d’un terminal. Une seule traite du p'trole brut.

Un appontement priv' unique, au Port Ouest, permet de concevoir les grands p'troliers. Des appontements priv's, ' l’int'rieur du Port Est, permettent ' Total et ' BP-Elf de traiter les trafics de produit raffin's ' l’import et ' l’export, pour des bateaux de tonnage plus r'duits. Ces terminaux, y compris leur appontement p'trolier, ayant fait l’objet d’un financement totalement priv' ne sauraient 'tre pris en consid'ration pour d'noncer des incoh'rences dans les investissements de l’'tablissement public.

Le rapport UFIP du 29.09.1995 fait appara'tre un certain nombre de donn'es permettant une comparaison des co'ts de frais d’escale des navires p'troliers en Europe. Il permet ' la Cour de mettre en lumi're, ' juste titre, la rentabilit' des trafics p'troliers, les surco'ts des ports fran'ais par rapport aux ports europ'ens, et le risque non n'gligeable de pertes d’activit's qui pourrait d'couler de cette situation. Il convient toutefois de signaler l’avantage de l’'conomie d’'chelle li'e en l’esp'ce aux volumes trait's dans chaque port ; les trafics p'troliers de Dunkerque et de Rotterdam se situent ainsi dans un rapport de 1 ' 10. Ce type de comparaison appelle en tout 'tat de cause une certaine prudence.

  • Les terminaux de vracs solides

Le montant de 244 MF mentionn' par la Cour comprend le co't de construction du Quai Pechiney (127 MF), situ' dans le prolongement du QPO mais dont l’exploitation est totalement ind'pendante du QPO.

15. La gestion des tarifs : les ristournes sur droits de port

Les contraintes concurrentielles et les usages des ports 'trangers voisins rendent indispensable la mise en œuvre d’une politique tarifaire ayant les souplesses requises pour d'velopper ou pr'server les fonds de commerce du port.

Il est souvent difficile d’'valuer a posteriori l’effet de cette politique tarifaire : l’absence de soutien de l’armement Sally aurait-il conduit ' un arr't plus rapide de la ligne ? Il convient de prendre en compte dans l’analyse deux 'l'ments :

  • En d'pit du niveau 'lev' des ristournes, l’activit' de Sally gardait une tr's forte rentabilit' pour le port, ce qui a incit' l’'tablissement ' s’accrocher au maintien de la ligne.
  • La baisse des recettes a permis de lisser l’effet financier de l’effondrement du trafic et facilit' une adaptation structurelle de l’'tablissement ' la perte d’un fonds de commerce aussi r'mun'rateur.

 

16. La gestion de l’outillage : les exp'riences d’unit' de gestion

La question de savoir si la manutention est ou non une mission de service public est effectivement un probl'me essentiel qui conditionne l’avenir des ports fran'ais. Le port a adress' ' la DTMPL une note de r'flexion en ce sens. Il est vraisemblable qu’aucun investisseur n’acceptera de prendre le risque d’un investissement en outillage sur des terminaux portuaires si cette op'ration rel've d’une d'l'gation de service public, les contraintes de tarification inh'rentes ' la gestion de service public 'tant incompatibles avec les contraintes commerciales d’une activit' soumise ' la concurrence internationale.

17. La gestion du domaine portuaire

Les observations de la Cour formul'es en mati're de gestion du domaine portuaire appellent quelques pr'cisions sur trois points importants.

  • Le droit de l’environnement

La Cour observe, ' juste titre, que la proximit' des zones urbaines pose des difficult's au d'veloppement des ports. A cet 'gard, m'me si des zones urbaines sont tr's proches, il n’existe pas ' Dunkerque d’enclaves urbaines dans le domaine public maritime. Une confusion a peut-'tre 't' faite ici avec le cas du village de Mardyck, compl'tement enclav' dans le domaine priv' du port.

Il est vrai qu’il n’existe pas dans le domaine portuaire de dispositions du m'me type qu’en mati're a'roportuaire. Cette situation s’explique peut-'tre par la grande diversit' des sources potentielles de nuisances rencontr'es dans le domaine portuaire, alors que l’essentiel des nuisances a'roportuaires rel've du bruit. Il convient toutefois de rappeler que les dispositions particuli'res applicables aux industries ' risque entra'nent des restrictions au d'veloppement dans des p'rim'tres identifi's par les POS, et g'lent, en cons'quence, des surfaces non n'gligeables du domaine portuaire. C’est ainsi qu’il existe ' Dunkerque pas moins de 11 'tablissements class's Seveso, ainsi que trois stockages d’hydrocarbures engendrant des p'rim'tres de restriction de l’urbanisation importants compte tenu des risques industriels encourus.

Il faut ' cet 'gard signaler l’initiative dunkerquoise de mise en place d’un sch'ma d’environnement industriel. Ce sch'ma r'sulte d’un accord conclu entre le PAD, la communaut' urbaine de Dunkerque et la chambre de commerce et d’industrie de Dunkerque, et constitue ainsi une r'f'rence, certes non r'glementaire mais cependant conventionnelle, par laquelle sont d'finies les orientations de gestion du d'veloppement urbain et 'conomique, aux fins d’anticiper tous conflits d’usage susceptibles d’advenir aux abords de la zone industrialo - portuaire .

  • La gestion des cessions fonci'res

La Cour observe que les 'tablissements portuaires proc'dent ' des cessions fonci'res " davantage dict'es par les besoins financiers des 'tablissements " que par un souci de bonne gestion du patrimoine directement li' ' l’activit' portuaire.

Le cas de Dunkerque peut ' cet 'gard 'tre signal' au titre du projet " Neptune ", qui constitue l’op'ration de cession fonci're la plus importante conclue ' ce jour par un port en France. Cette op'ration, suite d’une n'gociation d'but'e en 1991, a abouti en 1998 et 1999 ' la cession d’environ 40 Ha. L’absence de besoins vis-'-vis des activit's portuaires a 't' constat'e en 1997 ' la suite d’une enqu'te publique qui a conduit au d'classement des terrains concern's. Ces terrains ont 't' vendus en 1999 ' la communaut' urbaine de Dunkerque et ' la S3D (soci't' d’'conomie mixte locale) moyennant le versement de 90 % du montant des ventes. Ces ventes ont permis la mise en œuvre d’une op'ration d’urbanisme d’envergure.

Il est pr'cis' ' cet 'gard que le port de Dunkerque a initi' en temps utile la proc'dure pour obtenir l’affectation d’une partie du fonds de r'emploi ' des op'rations fonci'res. Le port est surpris de la r'action de la direction g'n'rale des imp'ts signal'e par la Cour, alors m'me que cette administration (Bureau III A4) a 't' saisie officiellement du dossier par le minist're des transports par lettre du 19 octobre 1993 et n’a apport' aucune r'ponse ' notre demande.

  • La r'partition juridique du domaine des ports autonomes

La Cour indique que sur " une superficie totale probable de 6 100 Ha, la r'partition juridique des emprises entre le domaine public et le domaine priv' serait, selon le port de 50/50 ".

Sur la base d’une superficie de 6 100 Ha hors plan d’eau, dont 6 100 Ha – 232 ha = 5 868 Ha ' l’int'rieur de la circonscription du port, la proportion de domaine priv' ressort des chiffres communiqu's par le PAD ' 3 767 Ha / 5 868 Ha = 64 %.
