REPONSE DU PRESIDENT DU PORT AUTONOME DE NANTES SAINT-NAZAIRE

Le port autonome de Nantes-Saint-Nazaire souhaite compl'ter certaines informations sp'cifiques contenues dans le rapport particulier et infl'chir certaines conclusions qui en sont tir'es.

I. - Pr'ambule

Le port autonome de Nantes/Saint-Nazaire est charg' de la gestion du premier port de la fa'ade Atlantique, moteur du d'veloppement 'conomique interr'gional du Grand Ouest dont il conditionne pr's de 25 000 emplois. Son activit' a progress' de 27 % de 1990 ' 1998, soutenue par une dynamique commune du port autonome et de la communaut' portuaire s'appuyant sur une progression simultan'e de la comp'titivit' et des volumes et par un programme d'investissements important, tant publics que priv's.

Etablissement public de l'Etat, le port autonome est g'r' dans le strict respect des proc'dures administratives et financi'res, avec efficacit' et prudence, tout en laissant la part au r'alisme de la gestion au quotidien et en veillant ' la coh'rence avec les imp'ratifs 'conomiques et sociaux. La bonne sant' financi're de l''tablissement a permis d'engager, depuis 1997, des remboursements partiels de la dotation en capital de l'Etat et d'effectuer en 1999 un reversement ' l'Etat de 50 % de l'exc'dent de l'exercice 1998, comme le pr'voit le code des ports maritimes.

Les extraits du rapport qui ont 't' communiqu's au port autonome ne lui permettent pas de formuler une r'ponse globale aux travaux de la Cour des comptes, mais il souhaite apporter quelques 'l'ments d'appr'ciation compl'mentaires sur certains points sp'cifiques.

II. - R'ponses aux observations

A. - La gestion 'conomique et financi're du port autonome

1' Les proc'dures budg'taires

Les budgets du port autonome de Nantes-Saint-Nazaire ne peuvent 'tre qualifi's "d'ambitions non r'alistes". En effet, au cours des exercices 1994 ' 1998, les r'sultats ont 't' sup'rieurs aux pr'visions. Cette situation, d'ailleurs critiqu'e par les clients du port autonome, l'gitime ' leurs yeux des baisses de tarifs plus importantes que celles qui ont d'j' 't' effectu'es.

Le port g're avec prudence un 'quilibre entre comp'titivit' et solidit' financi're de l'entreprise.

2' Les autres difficult's de fonctionnement

La productivit' du personnel est d'finie comme 'tant le rapport de la production 'largie sur l'effectif moyen. Cette d'finition ne traduit qu'imparfaitement l''volution r'elle de la productivit' du personnel du port autonome.

1') Une forte part de la production 'largie est li'e aux trafics de vracs liquides qui font peu appel aux personnels d'exploitation ;

2') La politique de mod'ration tarifaire, qui constitue une action constante du port, entra'ne, par effet m'canique, une baisse de la productivit'.

Si l'on examine sp'cifiquement l'outillage public, qui est l'activit' la plus consommatrice de personnel, l''volution, sur la p'riode 1990 - 1997 analys'e par le rapport, est la suivante :

- effectifs ouvriers et ma'trise (environ la moiti' de l'effectif du port) : - 2 %

- recettes d'outillage : + 44 %

- recettes d'outillage par agent ouvrier ou ma'trise : + 46 %

B. - La coh'rence des investissements

1' Co'ts d'escale d'un navire p'trolier

Les co'ts recens's par l'Union Fran'aise des Industries P'troli'res (UFIP) concernent les comptes d'escales et pas uniquement les droits per'us par les 'tablissements portuaires eux-m'mes. Ils incluent notamment les prestations de pilotage et de remorquage qui ne d'pendent pas du port autonome. Si, en 1996, le port autonome de Nantes-Saint-Nazaire apparaissait plus cher que ses concurrents, il a consenti, ' plusieurs reprises, depuis cette date, d'importantes baisses des taux des droits de port marchandise qui ont 't' ramen's de 2,20 F ' 0,80 F par tonne de p'trole brut, sur un volume d'environ 12 Mt par an.

Le port autonome de Nantes-Saint-Nazaire se trouve aujourd'hui parmi les ports fran'ais les moins chers pour ce trafic.

2' Les terminaux ' conteneurs

Le port autonome de Nantes-Saint-Nazaire a d'velopp' plus tardivement que les autres ports son trafic de conteneurs. La fiabilit' sociale des ouvriers dockers, obtenue depuis la r'forme de 1992, a permis une progression de trafic continue depuis 1993. Si le d'ficit du terminal ' conteneurs s''tablissait effectivement ' 17 MF, en 1995, avec 34 000 mouvements de conteneurs, il a 't' ramen' ' 10 MF, en 1998, avec 68000 mouvements. L'exc'dent brut d'exploitation (hors frais g'n'raux et amortissements) de ce terminal qui 'tait de -  3 MF, en 1995, est pass' ' + 9 MF, en 1998. L'augmentation de trafic, constat'e en 1999 (plus de + 2 0%), confortera cette tendance. Gr'ce ' une tarification conforme au march' et sur laquelle le port veille ' ce qu'elle ne s''rode pas avec les effets de productivit', ces chiffres d'montrent que le terminal ' conteneurs a d'pass' la taille critique en termes de rentabilit'.

Le port autonome et la place portuaire ont fait du d'veloppement de ce trafic leur objectif prioritaire pour les prochaines ann'es, en visant un trafic de 250 000 conteneurs 'quivalent 20 pieds ' l'horizon 2015, soit une croissance moyenne de 8 % par an.

REPONSE DU PRESIDENT DU PORT AUTONOME DE BORDEAUX

La r'forme de la manutention

En ce qui concerne les "mesures discriminatoires ' l'embauche", il y a lieu de noter que l'accord local a 't' 'labor' directement entre les entreprises de manutention et le syndicat CGT des ouvriers dockers.

DEUXIEME PARTIE : LA GESTION ECONOMIQUE ET FINANCIERE DES PORTS AUTONOMES

les proc'dures budg'taires

L’'tat pr'visionnel des recettes et des d'penses

* Le port autonome de Bordeaux donne aux 'tats pr'visionnels de recettes et de d'penses un caract're strictement limitatif, les cr'dits vot's par le conseil d’administration faisant l’objet d’une notification 'crite pr'par'e par la direction financi're et sign'e par le directeur g'n'ral.

La r'cente migration du syst'me informatique permettra dans les prochaines semaines de proc'der ' un blocage automatique des engagements, d's lors que les cr'dits ouverts seront insuffisants. Dans l’attente, un contr'le strict et p'riodique des consommations budg'taires est r'alis' ' partir d’une 'dition r'guli're d’un document fournissant aux services : les r'alisations des exercices N - 3 et N – 2, les pr'visions et r'sultats de l’exercice N – 1, les pr'visions et r'alisations de l’exercice en cours.

* Le r'glement int'rieur pr'voit une d'l'gation du conseil d’administration au directeur g'n'ral pour :

'  les projets de travaux imputables ' la section de fonctionnement de l’'tat pr'visionnel, dans la limite des cr'dits disponibles ;

'  les projets d’ex'cution des travaux imputables ' la section des op'rations en capital de l’'tat pr'visionnel dont les avant-projets ont 't' pr'alablement approuv's par une d'cision du conseil d’administration portant fixation du montant des d'penses autoris'es et pour l’ex'cution desquels des cr'dits ont 't' ouverts ;

'  les projets d’ex'cution relatifs aux travaux accessoires qui se rattachent directement ' une entreprise principale pr'alablement autoris'e et dont la d'pense est imputable sur la somme ' valoir de cette entreprise, lorsque l’ex'cution des travaux ne doit avoir pour effet ni d’apporter des modifications importantes dans les dispositions des ouvrages existants, ni dans la consistance d’avant-projets ant'rieurement approuv's par le conseil d’administration, ni d’entra'ner une augmentation du montant de la d'pense autoris'e ;

'  les virements de cr'dits entre sous-comptes ' trois chiffres de la section de fonctionnement de l’'tat pr'visionnel, dans la limite du cr'dit total du compte ' deux chiffres.

* Les s'ances budg'taires du conseil d’administration sont l’occasion de d'bats favoris's par la transmission de l’ensemble des documents financiers aux administrateurs une semaine au moins avant la date de r'union. Les investissements font l’objet de notes de pr'sentation individualis'es et sont discut's au conseil d’administration avant leur inscription ' l’'tat pr'visionnel. La commission sp'cialis'e des investissements, 'manation du conseil d’administration, se prononce 'galement chaque ann'e sur le programme des investissements de l’exercice budg'taire ' venir.

* Sur les 'carts r'currents entre pr'visions et r'alisations, il convient de noter que, pour la section de fonctionnement, les r'alisations sont largement tributaires du trafic maritime qui d'pend pour une large part de facteurs exog'nes. Ainsi, les trafics p'troliers fluctuent au gr' des variations du prix du baril qui vient de passer en quelques mois de 10 dollars ' 20 dollars. De m'me, le port de Bordeaux est aujourd’hui confront' aux r'actions du march' du ma's affect' par la probl'matique de la tra'abilit' des organismes g'n'tiquement modifi's.

* La date butoir (1er octobre de l’ann'e pr'c'dente), impos'e par l’article R 113.15 du Code des Ports Maritimes pour le vote du budget, ne permet pas un ajustement pr'cis de l’'tat pr'visionnel rectifi' du fait de sa pr'sentation ' une date avanc'e, sans doute fix'e ainsi pour permettre une approbation avant le premier janvier de l’exercice. Il convient de noter que les nouvelles dispositions du d'cret 99-575 du 8 juillet 1999 relatif aux nouvelles modalit's d’approbation de certaines d'cisions financi'res des 'tablissements publics de l’Etat sont de nature ' am'liorer sensiblement le dispositif.

Il est ainsi difficile de dire de mani're aussi cat'gorique que "les observations de la Cour r'v'lent en r'alit' le peu d’int'r't port' par les ports autonomes au respect des proc'dures budg'taires qui s’imposent ' eux".

L’absence de programmation pluriannuelle.

L’int'r't d’une programmation pluriannuelle des investissements n’a pas 'chapp' aux instances dirigeantes du port autonome de Bordeaux et les 'tudes pr'alables men'es dans les diff'rents secteurs, tant avec les partenaires institutionnels (Etat, collectivit's locales, chambres de commerce) qu’avec la communaut' portuaire, peuvent en t'moigner. Par ailleurs, la pr'paration et l’'laboration des contrats de plan Etat-R'gion sont 'galement l’occasion de d'finir une politique globale des investissements.

Enfin, il convient de ne pas omettre la n'cessaire r'activit' de l'autorit' portuaire, dans un secteur fortement concurrentiel, qui peut aussi conduire ' modifier o' infl'chir certaines d'cisions pour fid'liser ou conqu'rir certains trafics.

La comptabilit' et le contr'le de gestion

L’insuffisance et la mauvaise utilisation des outils comptables.

L’insuffisance de pr'cision de l’instruction comptable M9-5 de la direction g'n'rale de la comptabilit' publique, relev'e ' juste titre par la Cour, a conduit la direction du transport maritime, des ports et du littoral et la direction g'n'rale de la comptabilit' publique ' initier, d's le d'but de l’ann'e 1999, un groupe de travail avec pour mission, l’harmonisation des pratiques comptables dans les principaux domaines ayant fait l’objet des critiques de la Cour. Il est int'ressant de pr'ciser que le groupe de travail associait les agents comptables des ports autonomes ' des directeurs de ports, des repr'sentants des deux directions pr'cit'es et du contr'leur d’Etat. Il est ' noter, de plus, que les ports autonomes ne sont pas des EPIC, m'me si une partie de leurs missions est industrielle et commerciale.

Les missions de l’agent comptable

La direction g'n'rale de la comptabilit' publique et la direction du transport maritime, des ports et du littoral devraient communiquer prochainement ' la Cour des comptes la note conclusive du groupe de travail qui s’est r'uni au cours de l’ann'e 1999 sur le th'me de l’exercice conjoint des fonctions d’agent comptable et de chef des services financiers. Il est ' noter que le directeur g'n'ral et l'agent comptable du port de Bordeaux en faisaient partie.

En compl'ment, le port de Bordeaux tient ' pr'ciser que l’agent comptable n’a jamais b'n'fici' en tant que directeur financier d’une quelconque d'l'gation de signature de l’ordonnateur, hormis celles relatives ' l’affectation des personnels entre les services de l’agence comptable, les mesures disciplinaires pr'vues ' l’article 26 de la convention collective UPACCIM ne n'cessitant pas la consultation de la commission pr'vue ' l’article 27 de la m'me convention, et ce apr's information du directeur et du directeur des ressources humaines. Il convient 'galement de noter que les d'penses du service financier ne peuvent 'tre engag'es par l’agent comptable.

La comptabilit' analytique et le contr'le de gestion.

* Le contr'le de gestion

La fonction de contr'le de gestion existe au port autonome depuis plusieurs ann'es. Elle 'tait jusqu’' pr'sent exerc'e par un cadre de la direction g'n'rale de la comptabilit' publique, plac' en service d'tach' au port, qui cumulait cette fonction avec celle d’adjoint ' l’agence comptable. Depuis quelques mois, cette situation a 't' clarifi'e et le contr'leur de gestion exerce sa fonction ' temps plein sous l’autorit' directe du directeur g'n'ral du port. Un informaticien est 'galement venu renforcer ce service.

* La comptabilit' analytique

La comptabilit' analytique existe depuis de nombreuses ann'es au port de Bordeaux et les r'sultats annuels font l’objet d’un rapport g'n'ral et d'taill' pr'sent' au conseil d’administration. La mise en place du nouveau logiciel comptable a permis de renforcer le degr' de pr'cision de la comptabilit' analytique et offre 'galement la possibilit' de fournir ' la demande des situations ponctuelles aux diff'rents services.

LE FONCTIONNEMENT DES ETABLISSEMENTS

Le port autonome de Bordeaux s’est dot' depuis le 19 mars 1973 d’un r'glement des march's, annex' au r'glement int'rieur de l’'tablissement, r'affirm' par le conseil d’administration du 29 avril 1991, mis ' jour en 1995 et modifi' le 21 juin 1999, lors de l’adoption du nouveau r'glement int'rieur, conform'ment aux dispositions de l’article R 113.18 du code des march's publics.

* dispositions en vigueur jusqu’au 21 juin 1999 :

Dans son article 1er, le r'glement pr'cisait que les march's du port autonome de Bordeaux relatifs aux op'rations ne donnant pas lieu ' participation financi're de l’Etat 'taient soumis ' la r'glementation des march's de l’Etat et aux textes propres ' l’administration charg'e des ports maritimes de commerce, sous r'serve des dispositions suivantes du r'glement pr'cit' :

'  La composition des bureaux d’adjudication, de la commission sp'ciale d’adjudication restreinte et de la commission des march's sur appels d’offres est adapt'e. L’agent comptable est membre du bureau des adjudications et de la commission d’appels d’offres. Le repr'sentant de la direction de la concurrence, de la consommation et de la r'pression des fraudes est membre ' titre consultatif.

'  Le seuil fix' est celui appliqu' pour les march's de l’Etat.

'  Tout projet de march' fait l’objet d’un rapport du directeur rappelant la nature et l’'tendue des besoins ' satisfaire, le montant pr'vu de l’op'ration exposant l’'conomie g'n'rale du march', son d'roulement pr'vu et la justification du choix de la proc'dure de passation adopt'e, notamment lorsqu’il s’agit d’un march' n'goci' pour lequel les mesures prises pour assurer une comp'tition aussi large que possible doivent 'tre clairement explicit'es.

'  Il est cr'' une commission consultative des march's comprenant le pr'sident du conseil d’administration, le vice-pr'sident et le membre secr'taire, les autres membres du comit' de direction, le commissaire du gouvernement, le contr'leur d’Etat et le repr'sentant de l’administration des finances au conseil d’administration (le tr'sorier payeur g'n'ral).

'  Enfin, il est pr'cis' que toutes les nouvelles dispositions qui interviendraient ' l’avenir dans la r'glementation des march's de l’Etat seraient applicables de plein droit aux march's du port ' l’expiration d’un d'lai de deux mois, sauf proposition contraire adopt'e par le conseil d’administration.

* dispositions en vigueur depuis le 21 juin 1999 :

Le nouveau r'glement des march's adopt' par le conseil d’administration a confirm' la soumission des march's du port autonome, relatifs aux op'rations ne donnant pas lieu ' participation financi're de l’Etat, aux textes d'j' 'voqu's dans le pr'c'dent r'glement sous r'serve de certaines dispositions :

- modification des seuils. Les travaux compris entre 100 000 F et 300 000 F TTC peuvent 'tre trait's sur facture, sous r'serve d’une consultation 'crite d’au moins trois fournisseurs et de la r'daction d’une note argumentaire sur le choix op'r' (ant'rieurement le seuil de la consultation 'tait de 30 000 F ' 300 000 F, mais sans proc'dure 'crite argument'e). Les travaux compris entre 300 000 F et 700 000 F TTC peuvent 'tre trait's hors march', sous r'serve des dispositions pr'c'dentes et de l’avis conjoint de la cellule des march's et de la direction financi're.

- dispositions propres ' la commission consultative des march's. La composition reste inchang'e, mais doivent assister avec voix consultative le DGCCRF, le directeur g'n'ral du port, le secr'taire g'n'ral en charge de la cellule des march's, l’agent comptable et le directeur sectoriel concern'. La commission fixe elle-m'me les seuils d’examen qui sont appr'ci's hors taxes compte tenu du r'gime fiscal des ports, sans d'passer les seuils d'finis pour les march's de l’Etat. En cas d’urgence imp'rieuse, la personne responsable peut passer un march' sans demander l’avis de la commission, sous r'serve d’avoir obtenu l’accord pr'alable du commissaire du gouvernement.

* A titre indicatif, le tableau ci-dessous synth'tise les march's que le port autonome de Bordeaux a pass's au cours des cinq derni'res ann'es.

* Une cellule des march's, rattach'e au secr'taire g'n'ral, assure la tenue ' jour des textes de r'glementation et de jurisprudence et l'information des services, le contr'le des proc'dures de passation, le mode d’attribution des march's, en particulier le respect des crit'res de s'lection, la pertinence des garanties et le caract're dissuasif des p'nalit's. Cette cellule prend syst'matiquement l’attache de la direction financi're lors de la phase pr'alable, afin de s’assurer du respect des proc'dures et des dispositions r'glementaires en m'me temps que la disponibilit' des cr'dits, notamment pour les op'rations en capital. Avant signature par la personne responsable, le march' est soumis dans une phase ultime au visa de l’agent comptable. L’ensemble des proc'dures ainsi mises en place en 'troite association avec l’agent comptable aux diff'rentes phases de la pr'paration, de l’'laboration et de la passation des march's est aussi de nature ' am'liorer le respect des dispositions r'glementaires et la qualit' de la d'pense publique.

* Le secr'taire g'n'ral du port de Bordeaux a particip' au r'cent groupe de r'flexion sur la mise en place des proc'dures "march's publics" dans les ports autonomes.

II. - LA STRATEGIE ECONOMIQUE ET LA GESTION DES PORTS AUTONOMES

a. - LA POLITIQUE COMMERCIALE ET TARIFAIRE

La Cour fait ressortir de mani're nette la difficult' ' laquelle se trouve confront' un port autonome pour appliquer une politique tarifaire adapt'e tout en respectant les textes auxquels il est soumis. Cela repr'sente une difficult' certaine ' laquelle il y a lieu de rem'dier.

TROISIEME PARTIE

LA GESTION DU DOMAINE PORTUAIRE

La protection du domaine public

Il est exact que le domaine public n'est pas cadastr' dans sa plus grande partie, mais ce n'est pas une g'ne pour l'utilisation des conventions constitutives de droits r'els. En effet, le port fait intervenir, au coup par coup, un g'om'tre qui proc'de ' la d'limitation de la parcelle sur laquelle portera le droit r'el, et lui fait attribuer des r'f'rences cadastrales (n' de section et de plan) par le service du cadastre. Le droit r'el est donc bien assis sur une parcelle cadastrale, ce qui permet au notaire de faire publier ' la conservation des hypoth'ques les conventions correspondantes. A ce jour, huit conventions ont 't' publi'es ou sont en cours de publication.

La connaissance du domaine

Le port autonome de Bordeaux a fourni les donn'es relatives aux superficies g'r'es qui lui paraissent correspondre ' la r'alit', m'me s'il y a lieu de reconna'tre que plusieurs facteurs (absence de cadastre du domaine public, r'f'rences cadastrales "incertaines" dans certains cas, 'volution du domaine public national…) rendent impossible leur d'termination exacte.
