REPONSE DU MAIRE DE MARSEILLE

J’ai bien re'u l’extrait du rapport public concernant la politique portuaire fran'aise qui vise les subventions vers'es au port autonome, et notamment par la ville en 1991, au moment o' la r'paration navale connaissait de graves difficult's. J’ai bien not' que la Cour rel've " une infraction notoire aux r'gles encadrant les aides 'conomiques des collectivit's territoriales… " dans la mesure o' l’intervention de la ville de Marseille et du d'partement visait une r'duction tarifaire du m'me montant au profit des entreprises CMR et Sud Marine. En r'ponse ' cette observation, je suis en mesure de vous apporter les 'l'ments d’information suivants.

La ville a d'cid' en d'cembre 1987 d’accorder un soutien de 10 MF aux investissements du plan de conqu'te des trafics du port autonome de Marseille pour la p'riode 1988-1990 (d'lib'ration 87 A01/FAE). Ce soutien visait un programme de 160 MF d’investissements r'parti entre trois activit's : marchandises diverses (110 MF), r'paration navale (30 MF), passagers (20 MF).

Les difficult's de la r'paration navale en 1991 ont mobilis' les trois collectivit's territoriales, conseil r'gional, conseil g'n'ral, Ville de Marseille qui ont, en partenariat et avec l’accord de l’Etat, d'cid' d’octroyer une aide suppl'mentaire au port autonome de Marseille. Il s’agissait, en effet, de cr'er les conditions n'cessaires pour permettre la r'alisation ' Marseille de l’allongement et de la modernisation du CYRNOS. La part de la ville fix'e ' 3,3 MF a 't' vers'e pour aider le port ' moderniser ses 'quipements et ainsi accro'tre sa comp'titivit'. Le paiement de cette participation a 't', conform'ment ' cette intention, appuy' sur la pr'sentation des factures de travaux de modernisation.

REPONSE DU MAIRE DE PORT SAINT LOUIS DU RHONE

La commune de Port Saint Louis du Rh'ne a 't' cr''e d's la fin du si'cle dernier, lorsque Napol'on III a d'cid' la mise en chantier du canal Saint Louis permettant de relier le Rh'ne ' la mer M'diterran'e. La ville s’est alors d'velopp'e autour de son port central comptant jusqu’' 10 378 habitants. Mais en 1970, la r'alisation par le port autonome de Marseille des deux darses sur la commune de Fos-sur-Mer a orient' l’activit' portuaire vers la mise en containers des marchandises ce qui a entra'n' une chute du dynamisme 'conomique sur la commune. La ville a perdu en 10 ans plus de 20 % de sa population, le taux de ch'mage atteint 22,41 % de la population active, et repr'sente 32,65 % chez les jeunes de moins de 26 ans. Qualifi'e depuis lors d’ancienne cit' industrialo-portuaire, la ville subit de plein fouet la crise 'conomique.

Devant cet 'tat de fait, la municipalit' a fait un effort d’importance afin de favoriser le d'veloppement et l’implantation d’entreprises sur son territoire et intervenant notamment sur le taux et les exon'rations de taxe professionnelle. A compter de 1990, le conseil municipal a proc'd' ' la baisse du taux de taxe professionnelle passant de 24,92 % ' 22,5 %. Cette politique incitative a 't' maintenue l’ann'e suivante puisque l’assembl'e d'lib'rante a vot' un taux de taxe professionnelle 'gal ' 22,4 % pour 1991, taux qui est rest' inchang' depuis, ce qui permet notamment ' la commune d’'tre fiscalement attractive eu 'gard aux taux vot's par les autres communes limitrophes qui avoisinent les 23,5 % (Fos-sur-Mer, Grans, Martigues).

Cette taxe constitue pour la commune des recettes indispensables pour supporter notamment les transferts de charges cons'cutifs ' la d'centralisation et au d'sengagement de l’Etat et pour faire face aux diff'rentes contraintes qui p'sent sur une commune gravement touch'e par les difficult's sociales et le ch'mage. Par ailleurs, s’il est vrai que la commune dispose de la libert' de voter les taux des quatre taxes, il n’en demeure pas moins que cette facult' est encadr'e par une l'gislation d'finie au niveau national qui laisse peu de marge de manœuvre aux collectivit's. Toute politique fiscale d’incitation ' l’implantation des entreprises ne peut donc pas 'tre mise en œuvre par la collectivit' mais d'pend bien de choix nationaux.

A ce titre, c’est l’Etat seul qui d'cide quelles seront les parties du territoire exon'r'es de taxe professionnelle ' l’exemple des zones de redynamisation urbaine ou des zones franches, sans pr'judice financier pour la commune puisque ces exon'rations sont compens'es par des cr'dits vot's sur le budget de l’Etat. Ainsi, la loi d’orientation et de d'veloppement du territoire en date du 4 f'vrier 1995, da class' la ville dans une aire g'ographique lui permettant de b'n'ficier de ces avantages. Cette typologie a 't' modifi'e par la loi du 14 novembre 1996 relative ' la mise en œuvre du pacte de relance de la ville qui a chang' les limites de ce p'rim'tre. Ces dispositions pour les entreprises choisissant de s’implanter ' Port Saint Louis se limitent dor'navant au quartier d'nomm' Vauban compos' de HLM, excluant de fait toute la zone portuaire.

N'anmoins, chacun sait que toute entreprise d'sireuse de s’implanter sur un territoire ne d'termine pas seulement son choix en fonction de la fiscalit' locale mais d’'l'ments d’externalit' : pr'sence de r'seaux ferroviaires et routiers, d’un a'roport international, possibilit' d’un acc's direct sur la fa'ade maritime et donc sur les pays m'diterran'ens, pr'sence d’infrastructures industrielles importantes et d’entreprises sous-traitantes, proximit' d’un client, consolidation d’une strat'gie de fili'res… ' l’exemple du groupe Shell qui s’est install' sur la commune de Berre de l’Etang alors que l’alternative italienne et britannique semblait plus favorable. La prise en compte du taux de taxe professionnelle n’est pas un 'l'ment d'terminant pour la localisation.

Ainsi, l’implantation d’entreprises sur la zone logistique de Distriport r'cemment cr''e sur le territoire de la commune de Port Saint Louis du Rh'ne et appartenant au port autonome de Marseille ne peut donc d'pendre du seul taux de la taxe professionnelle vot' par le conseil municipal. Cet 'tablissement public administratif 'tant exon'r', en vertu de d'cisions minist'rielles des 11 ao't 1942 et 27 avril 1943, du paiement de la taxe professionnelle sur les installations portuaires, cela repr'sente un manque ' gagner pour la commune et un avantage financier ind'niable pour le port autonome de Marseille qui peut de son c't' offrir aux entreprises s’installant sur le Distriport des prestations que la commune ne peut en aucun cas se permettre de leur proposer.

Pour conclure, la politique d’accompagnement de l’implantation des entreprises sur une commune ne d'pend pas seulement de la fiscalit' locale mais repose pour une large part sur des param'tres intrins'ques ' la strat'gie de d'veloppement de l’entreprise.

REPONSE DU MAIRE DE SAINT-CYPRIEN

Le port de Saint-Cyprien est cit' ' titre d’illustration des cessions ill'gales du domaine public constat'es dans certains ports et des difficult's pour l’autorit' domaniale d’y veiller et rem'dier.

Initiatives et actions de la commune de Saint-Cyprien

1. Tout d’abord, par la d'lib'ration susvis'e du 26 septembre 1990, la commune, en r'duisant la surface du terre-plein portuaire inclus dans le contrat d’amodiation du 23 octobre 1987, a pu recouvrer l’enti're disposition d’une fraction importante du domaine public (superficie amodi'e ramen'e de 11 615 ' 6 060,20 m'tres carr's), 'tant rappel' que la superficie amodi'e, de 15 725 m'tres carr's dans l’amodiation du 26 f'vrier 1982, avait d'j' 't' ramen'e ' 11 615 m'tres carr's dans celle du 23 octobre 1987. La S.C.I. amodiataire a sans succ's contest' la l'galit' de cette d'cision du 26 septembre 1990. Elle n’a pas davantage recherch' la responsabilit' de la commune.

2. En 1995, approch'e par divers acqu'reurs de la S.C.I. amodiataire, la commune a pris connaissance des op'rations immobili'res conduites ' son insu par cet amodiataire. Elle a refus' d’y pr'ter la main, en s’opposant au transfert du b'n'fice de l’amodiation ' ces acqu'reurs. La commune a 'galement inform' les acqu'reurs de la S.C.I. amodiataire des limites de leurs droits d'coulant de la domanialit' publique du terrain d’assiette.

3. Par requ'te n' 96-1989 pr'sent'e le 25 janvier 1996, la commune de Saint-Cyprien a saisi le tribunal administratif de Montpellier d’une action tendant ' ce que le juge du contrat prononce la r'siliation pour faute du contrat d’amodiation du 23 octobre 1987, aux torts de l’amodiataire. Au soutien de ses conclusions, la commune fait valoir que la S.C.I. amodiataire et son g'rant ont manifestement gravement m'connu leurs obligations en proc'dant ' des locations ' des tiers qui ont eux-m'mes sous-lou', ' la conclusion de " baux commerciaux " sur le domaine public, ' des cessions d’appartements et de commerces en pleine propri't', en attribuant des droits r'els sur le domaine public ' des cocontractants sous-locataires.

En r'sum', l’amodiataire a purement et simplement commercialis' le domaine public, la commune n’ayant jamais 't' inform'e en temps utile de ces diverses mutations immobili'res.

Le fondement juridique de la demande r'side tant dans les stipulations de l’amodiation et de son cahier des clauses et conditions g'n'rales, que dans l’article R. 631-2 du Code des ports maritimes (issu du d'cret n' 84-941 du 24 octobre 1984), ainsi que dans les principes g'n'raux gouvernant toute occupation du domaine public, en particulier le caract're personnel de l’occupation et du titre d’occupation, de m'me que le principe d’inali'nabilit' du domaine public. Compte tenu du caract're tr's s'rieux des manquements imputables ' l’amodiataire, la collectivit' locale attend avec s'r'nit' la d'cision du tribunal administratif.

4. La commune est intervenue devant le tribunal de grande instance au soutien de l’une des actions dirig'es par les acqu'reurs de la S.C.I. amodiataire contre cette derni're. La commune souhaite obtenir du juge civil qu'il ordonne l'annulation ou constate la nullit' de l’acte du 20 septembre 1991 par lequel le S.C.I. du Conn'table a acquis de l’amodiataire 30 appartements dans l’ensemble immobilier par lui 'difi'.

Il r'sulte de ce qui pr'c'de que, mise au fait des errements de l’amodiataire, la commune de Saint-Cyprien s’est employ'e, par les moyens de droit ' sa disposition et dans le respect de la l'galit', ' y mettre fin, en recherchant l’'viction de l’amodiataire, en informant les tiers de la r'alit' de leur situation juridique et en s’associant ' des actions tendant ' ce que soient autant que possible d'faites les op'rations immobili'res en leur temps entreprises par la S.C.I. amodiataire. Ce faisant, la commune s’emploie ' ce que les principes de la domanialit' publique ne se r'duisent pas qu’' une affirmation.
