CAPITOLO 11 LA RIORGANIZZAZIONE DELLE COMPETENZE NEI TRASPORTI

Una corretta valutazione delle nuove forme organizzative che l’intervento pubblico dovrà assumere nel settore dei trasporti non può che partire dall’analisi del nuovo ruolo che a detto intervento pubblico è attribuito incentrato sulle attività di programmazione, regolamentazione e controllo, configurando l’intervento sul mercato limitatamente alle ipotesi in cui le imprese non siano in grado di fornire, da sole, un livello di servizio corrispondente alle esigenze della collettività di volta in volta interessata.

Alla luce del delineato nuovo ruolo dell’intervento pubblico e della recente scelta di massima valorizzazione delle autonomie regionali e locali, il ruolo del Parlamento dovrebbe riguardare essenzialmente la definizione della politica del trasporto nel rispetto dei vincoli comunitari e l'approvazione degli interventi programmatici del governo; lo stanziamento delle risorse per investimenti infrastrutturali; l'individuazione dei settori da sottoporre a regolazione e dei principi conseguenti.

Al Governo dovrebbero essere ricondotte le seguenti attività:

fissazione dei livelli dei servizi di rilievo nazionale da garantire alla collettività, attivando le risorse finanziarie per gli investimenti infrastrutturali e incentivando determinate tipologie, attraverso attività di indirizzo, programmazione e coordinamento;

elaborazione e attuazione delle normative in tema di: sicurezza delle infrastrutture e dei mezzi; circolazione; formazione e abilitazione degli addetti al settore; idoneità delle imprese a operare sia con riferimento agli ambiti liberalizzati che a quelli sottoposti a regolazione; accordi di programma con le Regioni definendo i criteri per l'attribuzione delle risorse in relazione al perseguimento di obiettivi e al rispetto di standard predeterminati; contratti di servizio con le imprese, nei settori soggetti a regolazione.

Le medesime funzioni (nei rispettivi ambiti territoriali) esercitate dal Governo - ad esclusione di quelle relative all'elaborazione e attuazione delle normative di carattere nazionale - dovrebbero spettare a Regioni ed Enti locali.

A tale riguardo è necessario definire con precisione, attraverso nuove norme, le forme di coordinamento tra l'attività di programmazione svolta a livello nazionale e a livello locale. E' del pari opportuno puntualizzare che gli strumenti di programmazione di settore devono coordinarsi con quelli in campo urbanistico e ambientale. I dubbi interpretativi che attualmente sorgono al riguardo sembrano determinare problemi operativi non lievi.

 

11.1 Opportunità di costituzione di un'autorità indipendente per il trasporto e eventuali funzioni

La necessità della costituzione di un organo indipendente è per il trasporto va valutata in considerazione del nuovo ruolo che lo Stato dovrà assumere in seguito alla riorganizzazione delle competenze dei Ministeri che si occupano di trasporti (trasporti e navigazione, lavori pubblici e ambiente). Il ruolo assunto dall’organo indipendente di cui si fa menzione in questo contesto potrebbe essere assunto dal nuovo Ministero, una volta che si è proceduto alla sua formazione mediante l’accorpamento delle funzioni e dei compiti di tutte le strutture centrali con competenze attuali nel settore dei trasporti.

Un’eventuale Autorità per il settore dovrebbero svolgere le seguenti attività:

predisposizione degli schemi per la stipula di contratti di servizio con riguardo alla definizione di modelli e criteri per la determinazione dei livelli quantitativi e qualitativi richiesti dalla Pubblica amministrazione; elaborazione dei meccanismi di fissazione e variazione delle tariffe; obblighi delle imprese relativamente ai piani degli investimenti, al rispetto delle norme per il trattamento del personale ecc.;

definizioni di criteri e modalità (inclusa la verifica del regime tariffario) per l'accesso alle infrastrutture e ai servizi regolati da parte delle imprese utenti;

proposta al Parlamento e al governo delle aree da sottoporre a regolazione e per eventuali riforme della disciplina in materia di accesso e regolazione delle attività di trasporto;

proposte in tema di forme e procedure di dismissioni e vigilanza sulla loro attuazione.

Quanto ai rapporti con l'Autorità garante della concorrenza e del mercato, questa deve intervenire nei settori liberalizzati dove c'è un mercato: L'Autorità per il trasporto interverrebbe nelle sole aree sottoposte a regolazione.

 

11.2 La riorganizzazione della Pubblica Amministrazione nel settore dei trasporti

In virtù delle norme di riforma della Pubblica amministrazione in tema di decentramento e delle disposizioni precedenti in materia di trasporti sta emergendo la focalizzazione dell'intervento dell'Amministrazione centrale su compiti di regolamentazione generale, indirizzo, coordinamento e controllo dell'attività degli altri soggetti pubblici cui sono attribuiti la maggior parte dei compiti di amministrazione.

In questo quadro si inserisce la riorganizzazione dei Ministeri, diretta a realizzare nella struttura centrale un adeguato potenziamento qualitativo. Al tempo stesso si pone l'esigenza di realizzare quello snellimento dell'attività amministrativa indispensabile per un adeguato assolvimento dei nuovi compiti.

Già il precedente PGT aveva evidenziato l'esigenza di superare la frammentazione delle competenze realizzando una unicità del "quadro di comando"; questa esigenza si pone oggi con urgenza ancora maggiore perché:

il decentramento di funzioni a livello locale richiede un rafforzamento del ruolo di coordinamento del centro;

la necessità di realizzare una redistribuzione del traffico verso modalità socialmente meno costose impone il superamento della dispersione di competenza in materia di programmazione;

l'esistenza di un sistema logistico idoneo a supportare le esigenze sul piano produttivo e della distribuzione è fondamentale per l'ulteriore sviluppo e integrazione dell'economia nazionale sul piano europeo.

Una razionalizzazione dell'intervento amministrativo suggerisce pertanto l'attribuzione a un unico Ministero delle funzioni e dei compiti nel settore dei trasporti.

 

11.3 Gli strumenti dell'azione amministrativa

E' stata da più parti contestata l'adeguatezza dello strumento della concessione amministrativa ai fini del perseguimento delle finalità pubbliche proprie dello Stato e degli enti locali. Sul problema è intervenuta l'Autorità garante della concorrenza dei mercati che ha sottolineato i limiti dello strumento concessorio. In sua sostituzione, l'Autorità valuta che autorizzazioni amministrative semplici potrebbero essere sufficienti a regolare attività aventi natura di mera impresa che non comportano prestazioni di pubblici servizi (ad esempio, servizi di trasporto turistici su strada). Autorizzazioni amministrative congiunte a contratti di servizio potrebbero disciplinare attività non riservate che si concretano in servizi pubblici resi a tutti gli utenti a prezzi ragionevoli (servizi di base nei settori delle ferrovie).

Tale ampliamento dello strumento autorizzatorio ha trovato conferma nel contesto della liberalizzazione dell'accesso al mercato già realizzato in alcuni settori del trasporto (si pensi al trasporto aereo intracomunitario, già liberalizzato) e che ora si sta estendendo anche ad altri settori.

Analoga evoluzione si sta realizzando nel campo del trasporto merci: non solo si è completata la liberalizzazione dell'accesso dei vettori comunitari ai trasporti di cabotaggio, ma si è anche avviato il superamento dell'attuale regime di accesso alla professione di autotrasportatore di cose per conto terzi, attraverso un nuovo sistema di autorizzazioni alle imprese e il riordino del sistema tariffario in un mercato concorrenziale e aperto.

Non appare fuori luogo la possibilità di ulteriori estensioni ad altri settori oggi caratterizzati dalla riserva a favore dello Stato dell'esercizio del trasporto. Significativi elementi di liberalizzazione si stanno cos' prospettando per quanto riguarda le ferrovie, nei settori del trasporto merci e del trasporto internazionale di persone.

Appare indubbio che il regime concessorio non risulta più in sintonia con il nuovo ruolo affidato al sistema pubblico. Un regime autorizzatorio sembra maggiormente idoneo.

Per quanto concerne la realizzazione di coordinamenti e raccordi nell'attività di soggetti pubblici titolari di competenze in un determinato segmento, lo strumento sempre più identificato come idoneo è quello dell'accordo di programma. Ma occorre evidenziare che le sue caratteristiche non sembrano ancora pienamente puntualizzate. Risulta opportuno che, in sede di disciplina di carattere generale dell'istituto ovvero di regolamentazione dei singoli accordi di programma, sia valutata la possibilità di introdurre la previsione di conseguenze negative per la parte eventualmente inadempiente.

Quando lo Stato - o l'ente incaricato dell'attività di reperimento delle risorse per l'erogazione del servizio - non vi provveda adeguatamente e tempestivamente, non potrà pretendere il raggiungimento degli obiettivi programmati. D'altro canto l'ente pubblico titolare delle competenze che, pur essendo stato dotato di mezzi finanziari, sia risultato incapace di raggiungere gli obiettivi indicati nell'accordo di programma, dovrà soggiacere a conseguenze negative.

Dovrebbero ritenersi ammissibili forme di intervento pubblico di sostegno all'esercizio di servizi minimi nel caso in cui le imprese private non abbiano mostrato interesse.

Per la promozione dell'efficienza occorre privilegiare in tale contesto l'adozione di procedure aperte e trasparenti di tipo concorsuale e una regolamentazione dei rapporti con l'impresa affidataria del servizio (e beneficiaria del contributo pubblico) incentrata su strumenti che consentano la definizione degli obblighi di servizio pubblico e l'individuazione delle conseguenze negative derivanti dal mancato rispetto degli impegni. A tali fini è stata promossa l'utilizzazione dei contratti di servizio, la cui efficacia - come per gli accordi di programma - è condizionata da una più precisa definizione delle caratteristiche e dall'inserimento di adeguate sanzioni in caso di inadempienza.

Per quanto riguarda le procedure di tipo concorsuale, queste possono avere ad oggetto un pacchetto di servizi che comprenda anche quelli cui si connettono obblighi di servizio pubblico. Ciò al fine di pervenire a un equilibrio tra l'esigenza di realizzare aperture alla concorrenza e quella di evitare che l'intervento delle imprese private si concentri sulle sole aree remunerative, lasciando gravare sulla finanza pubblica gli oneri di un adeguato livello di servizio.
