SEEN art. the 46 of the Bill n. 201 on December 06, 2011 enacted the 214/2011 that, to the aim to promote the infrastructure realization of connection between the ports and harbour areas back, allows with the harbour authorities to constitute logistic systems that take part through actions of understanding and coordination with the regions, the provinces and the municipalities interested let alone with the managers of railway infrastructures;

CONSIDERED that the PON previews that the Authority of Management (AdG) is identified in the Ministry of Infrastructures (now Ministry of Infrastructures and the international Transports), Head office for the development of the territory, programming and projects Division II "European and national Programs for the nets and mobility";
SEEN I decree of the AdG 6650 of the 16.06.2009 that characterizes the Augusta Port as beneficiary of the Great Harbour Project "Hub of Augusta";

SEEN the Conventions which signed between the Authority of Management of the PON Nets and Mobility and the Beneficiaries Harbour Authority of Augusta and RFI;
SEEN the Agreement of Program Picture for marine transport the stipulated in date 05.11.2001 between the Ministry of the Economy and Finances, the Ministry of Infrastructures and the Transports, the Sicilian Region and the Sicilian Harbour Authorities and next integrating action of the 31.01.2006 for the programming of the resources allotted from Deliberation CIPE n° 35 of 2005;
SEEN the Financial law of the 2007 (L.296 of 2006) that it characterizes the four Augusta as one of Hub harbour Italian of the Mediterranean on which state investments in such sense are activated;
SEEN the Project Territory I unwind 2 INTERMED of November 2011, written up from the Regional Province of Catania on financing of the Ministry of Infrastructures and the transports;
SEEN the Regional Plan of the Transports and Mobility - Slowly director of 2002 of the Sicilian Region;

SEEN the Deliberation of the Harbour Committee n. 80 of the 14.06.2012 that it gave sent to the President of the Harbour Authority of Catania to stipulate a protocol of understanding and/or constitution of an Association between the Harbour Authorities of Catania and Augusta, in order to strengthen the sinergica activity between the two Sicilian ports;

EC 1083/2006.

It is moreover engaged to stipulate the Convention with the Sicilian Region for the financing of the Participation “Interporto of Catania - Polo Intermodale”, already inserted in the list of the Participations of Decreto of the AdG of the PON Nets and Mobility n. 9957 of the 2.11.2011.
The MIT is also engaged:
  • to promote, in independent way or upon request of the responsibles of the single participations, every useful initiative to the aims of the respect of the engagements and the obligations by the subject underwriters of anticipates Protocol;
  • to put into effect every initiative useful to accelerate the release of the opinions of own competence on the projects of Protocollo, to the aim to guarantee the respect of the times of performance.

ART. 4 - Engagements of the Sicilian Region -
Department of Infrastructures, Mobility and the Transports
The Sicilian Region is beneficiary of the participation “Interporto of Catania: Intermodal pole” for the development of the interporto same. The participation will be realized by the Society of Interposing to you Siciliani Spa with the scope to complete and to upgrade the zone of interchange and the logistics of the goods to support of the marine ports of call of the port of Augusta and Catania.
The Sicilian Region has the task to sign with the Society of Sicilian Interposing you the Convention having to object the operating modalities of verification and monitoring of the participations to the aim to afford the start of the projects second program and to afford the reimbursement of the expense previewed from the PON Nets and Mobility.

ART. 8 - Modalities and times of performance of the Participations
The works will be planned, entrusted, executed and tested in the respect of the enforced communitarian, national and regional picture normative of reference and in particular of D.L.vo 163/06 and s.m.i and regional law 12/2011.
Regarding the participations financed with deep of the PON Nets and Mobility, the final deadline of admissibility of the previewed expense is that from enforced communitarian norm (31.12.2015).
The parts are engaged, each in the within of own competences, to guarantee the maximum and mutual collaboration, information and transparency beyond assuring the immediate availability of the documentation of technical nature and administrative profit and propedeutica for the editing of the project for the phases of realization and the activities of control, monitoring and communication.


9 ART. - Technical Table and nomination of the responsibles
for the performance of Protocollo of understanding
The underwriters of anticipate Protocol agree about the constitution near the MIT, Authority of Management of the PON, permanent a Technical Table for the coordination and the monitoring of all the activities connected to anticipates protocol.
In particular it competes to the aforesaid Technical Table verifying the projects, monitoring the correct performance of the participations, placing in being the necessary measures times to the overcoming of inherent criticalities the relationships between the Parts underwriters and to promote actions towards other Agencies for the resolution of eventual criticalities. It is up moreover to the table to monitor the effectiveness at the level of system of the participations activated on the base of anticipates protocol to the aims of the verification about the attainment of the objectives connected to the potenziamento of the Southeastern Quadrant of the Sicily.
The Parts will indicate respective referring for the participation to saying the Table, to which it is invited to participate the represented ones of the Regal DG of the EU commission.
The MIT provvederà with own note to name own representative, which will assume also the function of Coordinator of the Technical Table and will be designated to convene Partì, every qualvolta of ravvisi the necessity, to the aim to guarantee the monitoring of the project and the resolution of the eventual criticalities.
The burdens for the participation to the Technical Table will be at the expense of every Administration/represented Society.
For all eventual the problematic ones that had to rebel in the prosieguo of the activities, the MIT, on indication of the Technical Table, will convene appropriate encounters with the Representatives of the Territorial Agencies as well as of the Agencies signers to the aim to reach, in times breviums, to solutions shared.
