- The TAR of Lazio has taken a series of claims brought by the Port Authorities and Assoporti
- Address the reduction in the compensation of enforcement bodies and personnel of public port authorities
The Association of Italian Ports (Assoporti) announced that the Administrative Court of Lazio accepted the appeals filed by the Port Authorities and Assoporti reduction in the compensation of public bodies and enforcement staff of the Port Authority.
- There are two types of appeals by the Port Authorities and Assoporti against the Ministry of Infrastructure and Transportation and the Ministry of Economy and Finance.
- The first, sponsored by 16 Port Authorities, against the ministerial order which extended the obligation to reduce the compensation of the organs of the Port Authority after the deadline set by law. On this litigation, the Lazio Regional Administrative Court on May 19 last year published its ruling upheld the appeals and ordered the ministries to pay the costs.
- In the second case, the Port Authority of Naples has appealed against a move that prevented the same salary increases to recognize the institution of the national contract for the sector, considering the applicable standards in the field of public employment. Assoporti recalled that the staff of the Port Authority is subject to a system of private law, and that the Port Authority is applied to the National Labour Agreement for port workers signed by the trade union organizations (transport) and employers' associations, for Port Authorities and the Association of Italian ports. On appeal, the Lazio Regional Administrative Court suspended the effectiveness of that move in May 2012 to defer the discussion of the merits.
- "The outcome of these actions - said the president Assoporti, Francesco Nerli - we can say that we were right in saying that the Ministry of Economy can not, in fact, block the activity and autonomy provided by law with the notes and circulars.In the last two years we have seen a succession of letters, memos, complaints made by the Ministry through our ministry vigilante (Transport) which seek to limit the role of the Port Authority, which, I remember, were established by a special legislation aimed, through the powers conferred upon them, also to simplify and streamline operations in port. "
