Verso una nuova normativa europea sulla concorrenza nel settore marittimo

Ai caricatori che hanno partecipato alla Conferenza 1997 dell'ESC (Consiglio dei Caricatori Europei), tenutosi ad Anversa alla fine di ottobre, le parole di Karel Van Miert, commissario europeo per la concorrenza, debbono aver procurato un certo sollievo. Al contrario, i rappresentanti in sala dei vettori marittimi non debbono aver trovato i suoi concetti altrettanto rassicuranti, sebbene per loro non si sia trattato certo di una sorpresa.

Ciò, perché Van Miert ha detto molto chiaramente che la DGIV, la direzione per la concorrenza dell'Unione Europea, è fermamente decisa a far sì che la politica europea sulla concorrenza venga rispettata nel settore del trasporto marittimo e che - se necessario - ammende piuttosto salate vengano comminate ai vettori marittimi che agiscono in modo anticoncorrenziale. Egli ha inoltre avvertito che le tattiche dilatorie non avranno alcun effetto, se non quello - al contrario - di comportare ammende persino più cospicue. "Di modo che, se gli armatori non dovessero cogliere il messaggio, vi sarebbe un solo modo per farglielo comprendere, imponendogli, cioè, ammende più alte" ha concluso.

Fornendo precisazioni in merito a quanto starebbe per accadere, Van Miert ha cominciato affermando: "Non è assodato che l'autoregolamentazione nel settore marittimo abbia avuto maggior successo ed abbia comportato più vantaggi per i consumatori rispetto alla regolamentazione governativa degli altri settori".

Alludendo all'esenzione di gruppo dalla normativa europea sulla concorrenza di cui le conferenze marittime di linea hanno potuto usufruire, il commissario ha sottolineato il fatto che "l'esenzione di gruppo non consente agli armatori di fissare i prezzi relativi alla tratta terrestre di un'operazione di trasporto multimodale". Continua Van Miert: "Le conferenze che fissano tali tariffe lo fanno illegittimamente e, nel caso non abbiano notificato i propri accordi alla Commissione, divengono potenzialmente assoggettabili a sanzioni... Il solo fatto che gli armatori offrano servizi porta a porta, ovvero il fatto che desiderino fissare i prezzi relativi ai servizi porta a porta al fine di ostacolare la concorrenza tariffaria, non bastano di per se stessi per giustificare una esenzione".

Occorre rammentare che la questione della fissazione dei prezzi multimodali continua a costituire materia di acceso dibattito nell'ambito dei circuiti di diritto marittimo in relazione alla concorrenza europea, laddove un certo numero di casi è vicino alla soluzione. Anche il cosiddetto Gruppo Multimodale di "saggi", guidato da Sir Bryan Carsberg, e chiamato da Van Miert a stabilire se le compagnie di navigazione di linea possano ottenere un trattamento speciale per le proprie attività interne, dovrebbe sottoporre il proprio rapporto definitivo a Van Miert entro le prossime settimane. Quest'ultimo lo pubblicherà ed invierà al Consiglio dei Ministri. Il rapporto provvisorio del Gruppo, rilasciato a febbraio del 1996, ha concluso che il Gruppo non era convinto del fatto che ai vettori marittimi dovesse essere consentito di fissare prezzi per le tratte interne.

Riguardo agli sforzi effettuati dai vettori per aumentare la capacità, come ad esempio il TAA (Accordo Trans-Atlantico), Van Miert ha chiarito che tali accordi sono da considerarsi vantaggiosi solamente allorquando "eliminano selettivamente la capacità inefficiente od obsoleta in modo da ridurre i costi".

Il commissario per la concorrenza approva i singoli contratti di servizio riservati, che descrive come "una delle chiavi del futuro del settore". Egli ne ha tessuto le lodi poiché, a suo dire, rendono più vicini fornitori e consumatori. Commenta Van Miert: "Non è stato dimostrato che le limitazioni alla disponibilità nei contratti di servizio costituiscano un interesse dei caricatori, ed anzi hanno comportato effetti dannosi impedendo la formazione di associazioni tra singoli vettori e singoli caricatori. Essi hanno impedito la conclusione di contratti globali e hanno fatto sì che non evolvessero nuovi tipi di servizi a valore aggiunto. Van Miert ha altresì suggerito che l'unico scopo di tali limitazioni era quello di impedire la concorrenza tariffaria".

Per la DGIV l'obiettivo resta quello di ridurre i costi di trasporto di modo che le importazioni/esportazioni della Comunità Europea possano essere connotate da prezzi più bassi. In vista di questo scopo (cioè, costi di trasporto minori), Van Miert riconosce che la collaborazione tra vettori marittimi sulla tratta terrestre può comportare vantaggi nel caso conduca ad efficienze operative, quale la migliore utilizzazione dei containers. Egli ha inoltre riconosciuto come le esenzioni per i gruppi siano state concesse ai consorzi nell'interesse delle economie di scala e della riduzione dei costi.

Guardando al futuro, Van Miert dichiara: "C'è ancora molto da fare in relazione al processo di liberalizzazione del settore del trasporto marittimo di linea". In particolare, Van Miert ha riflettuto sul fatto che debba anche essere ripristinata una "effettiva concorrenza" rispetto ai traffici nord-sud.

Sebbene egli abbia affermato che l'esenzione di gruppo per le conferenze di linea non necessiti di abrogazione o modifiche, il commissario ha precisato che essa era stata elaborata con accuratezza. E non ha lasciato alcun dubbio tra i presenti alla manifestazione in relazione al fatto che le violazioni alla normativa comunitaria sulla concorrenza non saranno tollerate e che verranno comminate ammende significative al fine di dissuadere gli armatori dall'intraprendere simili iniziative.

L'auspicio di ulteriore liberalizzazione da parte di Van Miert è stato condiviso da un altro conferenziere, Knut Hansen, presidente della Distrilux AB di Stoccolma, una società di logistica appartenente al Gruppo Electrolux. Afferma Hansen: "La Distrilux supporta la recente decisione della Commissione di proibire gli accordi relativi alla fissazione dei prezzi nel settore marittimo laddove le conferenze di linea continuano a fissare i prezzi di trasporto terrestre".

In effetti, egli si è spinto più oltre rispetto a Van Miert, proponendo la abrogazione del Regolamento 4056/86, che esenta le conferenze di linea dalla normativa comunitaria sulla concorrenza. Hansen argomenta con convinzione: "Il sistema delle conferenze ai miei occhi non è che un cartello e non è di alcun valore per i caricatori".

Rammentando ai delegati che la Electrolux "non ha alcuna possibilità di aumentare i prezzi" nel contesto della propria piazza di mercato concorrenziale, Hansen ha quindi fornito una serie di indici di tariffe di trasporto. Questi mostrano come i prezzi di trasporto marittimo della sua società siano aumentati ad un ritmo assai più alto rispetto ai prezzi sia stradali che ferroviari tra il 1993 ed il 1997. Nel caso del trasporto marittimo, l'indice - che nel 1993 era di 100 - ora è attestato poco sotto i 140 punti, dopo un picco di oltre 140 punti nel 1996.

Il compito di difendere le posizioni dei vettori è toccato ad Alfons Guinier, segretario generale della ECSA (Associazione Armatori della Comunità Europea). Guinier, il quale ha sottolineato di parlare a titolo personale più che per conto della ECSA, ha fatto notare come "in pratica le conferenze non esistano più" e come "il trasporto marittimo si sia adattato ad una situazione mutevole e dovrebbe continuare a farlo".

In difesa della condizione di esenzione in cui si trovano le conferenze di linea, Guinier ha rimarcato la necessità di stabilità per far sì che le compagnie di navigazione di linea possano continuare ad attirare i necessari investimenti. Riferendosi ai commenti di Van Miert sul quantitativo di denaro che i vettori marittimi gettano in spese legali nel tentativo di dilazionare l'entrata in vigore delle regole in determinate materie, Guinier ha poi affermato che i vettori sono "in qualche modo divenuti ostaggi degli avvocati".

Egli, tuttavia, ha espresso la speranza che le questioni politiche e le diatribe legali non distraggano gli operatori dai comuni interessi che esistono tra i fornitori di servizio ed i caricatori "dal momento che i due sono partners naturali".

Guinier si è affannato a convincere i delegati che il trasporto marittimo di linea è più competitivo di ogni altro settore trasportistico e che il livello dei prezzi si è abbassato nel corso degli ultimi 10 anni. Alludendo ai commenti di Van Miert sui traffici nord/sud, egli ha suggerito che l'influenza politico-economica dell'Unione Europea dovrebbe essere utilizzata per risolvere i problemi derivanti dalle prassi protezionistiche di Paesi terzi, piuttosto che quelli inerenti alla concorrenza.
