    La législation belge sur le travail portuaire, qui stipule que le traitement des marchandises dans les zones portuaires ne peut être effectué que par les travailleurs portuaires reconnus, n'est pas contraire à la législation européenne de libre concurrence. C'est la conclusion de l'avocat-général Ruiz-Jarabo Colomer de la Cour européenne de Justice, qui s'est penché sur une question préjudicielle du tribunal d'appel de Gand. S'il s'est uniquement prononcé sur l'application de la loi dans le port de Gand, sa conclusion vaut également pour les autres ports maritimes flamands. L'avocat-général espagnol estime en outre que d'un point de vue juridique, la situation à Gand ne peut être assimilée au précédent à Gênes, qui a donné lieu à la condamnation de la législation italienne en la matière. La Cour européenne de Justice doit encore formuler un avis définitif, mais l'avis de l'avocat-général est généralement suivi.
