L'evoluzione della sicurezza marittima secondo lo ESC

La sicurezza marittima figurava ben in cima all'agenda dei rappresentanti globali dei caricatori, in occasione dell'annuale incontro in programma nello scorso mese di settembre a New Orleans. Gruppi di caricatori provenienti dall'Asia, dall'Europa e dal Nordamerica si sono preparati a discutere un'ampia gamma di questioni inerenti alla sicurezza, tra cui la richiesta degli Stati Uniti che il contenuto di un container in entrata venga notificato 24 ore prima del carico presso un porto estero, nonché l'iniziativa del governo statunitense C-TPAT (associazione anti-terrorismo tra dogane ed operatori).

Lo ESC (Consiglio Europeo dei Caricatori) assumerà di prima mano maggiori informazioni circa i contenuti di tali programmi presso le dogane statunitensi e la Commissione Marittima Federale ed informerà i propri colleghi negli Stati Uniti in ordine alle problematiche dei caricatori e di coloro che prendono le decisioni politiche europei.

Nello scorso mese di maggio, Nicolette van der Jagt, segretario generale dello ESC, aveva riferito che lo ESC riteneva fermamente che la sicurezza della catena delle forniture avesse bisogno di un approccio internazionale e globale, di modo che ogni esportatore sappia che non importa quale sia il luogo in cui deve consegnare le merci, dal momento che egli deve rispettare gli stessi parametri di sicurezza ovunque. Da allora, programmi e proposte inerenti la sicurezza sono progressivamente emersi negli Stati Uniti ed altrove.

Il Servizio Doganale statunitense ha lanciato un'iniziativa finalizzata ad incrementare la sicurezza dei contenitori, che rappresentano il 60% circa del volume dei traffici mondiali. Al riguardo è stata avviata una collaborazione con le autorità responsabili di 20 grandi porti, che a loro volta rappresentano quasi i due terzi dei containers inviati negli Stati Uniti. I carichi che hanno origine in quei porti potrebbero trarre vantaggi da procedure doganali più veloci in entrata negli Stati Uniti sfrecciando attraverso una "corsia preferenziale".

Oltre alla continua incertezza circa tutte le implicazioni per i traffici in generale, i caricatori non sono sicuri di quanto gli costerà continuare ad effettuare traffici con gli Stati Uniti e di quali saranno le regole che dovranno osservare per dare agli Stati Uniti le assicurazioni in termini di sicurezza che stanno cercando. E' probabile che le proposte relative ai nuovi requisiti di sicurezza comportino conseguenze per i costi del trasporto di merci attraverso le frontiere, in ordine sia ai costi più elevati sia ai tempi di viaggio più lunghi. Un recente rapporto dell'OECD sulle conseguenze economiche del terrorismo stima che i provvedimenti relativi alla sicurezza proposti potrebbero far aumentare il costo ad valorem degli scambi internazionali dall'1% al 3%. Il rapporto sottolinea altresì la possibilità che le misure di sicurezza possano comportare un impatto notevole sui flussi di traffico.

La situazione è ulteriormente complicata dal fatto che pare che i caricatori non abbiano altra scelta se non quella di aderire all'iniziativa C-TPAT se vogliono assicurare un transito veloce ai propri carichi. Caricatori che non rischiano volontariamente ispezioni del carico più frequenti, con potenziali ritardi della catena delle forniture. Per diventare "noto", un caricatore deve investire a livello di elevata sicurezza, spendendo tempi di gestione e costi aggiuntivi. Tuttavia, lo ESC supporta la concezione del "cliente noto", dato che essa identifica con chiarezza le responsabilità di ciascuno nella catena delle forniture e crea la struttura di collaborazione tra clienti e fornitori. Questi ultimi sono accolti con favore, al fine di assicurare non solo elevati livelli di sicurezza, ma anche elevati livelli di prestazioni di servizio.

I caricatori sono altresì preoccupati in ordine alla proposta di modifica della normativa doganale statunitense. Nello scorso mese di agosto, le Dogane degli Stati Uniti hanno pubblicato una proposta di regolamento ai sensi della quale un vettore marittimo od una qualificata impresa di trasporto non operante con navi dovrebbero trasmettere elettronicamente all'agenzia le informazioni relative al manifesto di carico almeno 24 ore prima che il carico sia caricato presso un porto estero su una nave diretta negli Stati Uniti.

Le Dogane degli Stati Uniti asseriscono che tale informazione è necessaria allo scopo di ridurre il rischio che vengano introdotte clandestinamente armi di distruzione di massa attraverso l'uso di contenitori marittimi, nonché per agevolare lo sdoganamento dei carichi legittimi in arrivo negli Stati Uniti. Il fondamento logico della nuova regola delle 24 ore è quello di mettere in grado il personale delle dogane di identificare i containers ad alto rischio, assicurando nel contempo il pronto espletamento dei containers a basso rischio. La prassi comune del completamento dei manifesti di carico dopo l'arrivo della nave non sarà più possibile. Le dogane vorrebbero altresì, alla luce della proposta, l'abolizione delle descrizioni di carico generiche, quali la FAK (merci di tutti i tipi).

Lo ESC ha consultato molti caricatori circa il loro giudizio in ordine all'impatto che tale proposta potrebbe avere sulla loro catena delle forniture. La preoccupazione generale consiste nel fatto che essa renderebbe meno flessibili e commercialmente meno rischiosi i traffici con gli USA. Il programma potrebbe, se entrasse in vigore intempestivamente, causare un'interruzione delle operazioni di trasporto senza per questo fornire agli Stati Uniti le assicurazioni in tema di sicurezza di cui è in cerca. Esso potrebbe ingenerare costi aggiuntivi e tempi di viaggio maggiormente imprevedibili, e renderebbe quasi impossibili le consegne just-in-time.

I provvedimenti proposti potrebbero inoltre richiedere notevoli investimenti in tecnologia informatica per assicurare connessioni aggiornate tra caricatori e dogane. Naturalmente, questa potrebbe essere un'opportunità per aggiornare prassi di cui si avrebbe sempre bisogno. Tuttavia, i caricatori ritengono che la proposta abbia bisogno di un periodo di maturazione prima di poter funzionare con efficienza.

Altri caricatori non sono poi così allarmati da questa regolamentazione poiché essi ritengono che la maggior parte delle informazioni siano già disponibili 24 ore prima del carico e che, se si dimostrasse necessario, essi potrebbero infondere maggiore disciplina nelle loro catene delle forniture. La loro conclusione è che ciò almeno gli consentirebbe di continuare a commerciare con gli Stati Uniti.

Per il settore, peraltro, vi sono anche delle opportunità che derivano da livelli di sicurezza maggiormente levati. Sul lungo termine, l'attenzione data alle ispezioni doganali dopo l'11 settembre potrebbe provocare uno sforzo finalizzato al miglioramento di procedure di sicurezza maggiormente efficaci. Ad esempio, la WCO (Organizzazione Mondiale delle Dogane), ha riconosciuto il nuovo ruolo delle dogane nella riorganizzazione della fornitura di informazioni. I provvedimenti finalizzati alla agevolazione dei traffici potrebbero comprendere la riduzione del numero delle ispezioni dei carichi in transito, l'esazione elettronica dei diritti doganali ed il miglioramento della condivisione delle informazioni tra dogane. La Task Force della WCO - istituita in seguito ad una risoluzione del consiglio della WCO svoltosi a giugno - si propone di rendere sicura e di proteggere la catena internazionale delle forniture dal terrorismo, pur agevolando nel contempo i traffici legittimi. Lo ESC era presente nella Task Force e ha accolto favorevolmente l'ammissione che la catena delle forniture inizia con la fornitura eseguita il più presto possibile. Uno dei suoi compiti sarà quello di sviluppare linee-guida sugli accordi di collaborazione tra dogane ed imprese al fine di incrementare la sicurezza della catena delle forniture dal giugno 2003.

Lo ESC, a giudizio di Nicolette van der Jagt, ritiene che questa sia la strada da percorrere: i migliori risultati in ordine alla sicurezza della catena delle forniture possono essere raggiunti attraverso un approccio collaborativo basato sul consenso tra imprese e settore pubblico. A lungo termine, occorrerà dare una risposta globale e multilaterale alla sicurezza della catena delle forniture. Lo scenario da incubo per i caricatori, e cioè quello di dover dialogare con sistemi di sicurezza diversi per modalità diverse e rotte diverse, potrebbe divenire una realtà in assenza di una risposta maggiormente coordinata a livello internazionale alla minaccia del terrorismo.

Lo ESC gradisce il proprio compito consistente nel far sì che queste diverse e spesso contrastanti proposte risultino in un sistema di sicurezza che da un lato assicuri livelli di sicurezza molto alti e dall'altro davvero agevoli i traffici. Dichiara la van der Jagt: "Noi guardiamo avanti e lavoreremo con i nostri partners di tutta la catena delle forniture e degli uffici che devono applicare la normativa al fine di far sì che ciò diventi una realtà sia negli Stati Uniti che altrove".
