1' Les fonctions de recouvrement des recettes et d’achats

a) Le recouvrement des recettes

La fonction de recouvrement des recettes a donn' lieu ' plusieurs types de constatations de la Cour.

De graves probl'mes de recouvrement sont observ's au port autonome de Guadeloupe. A titre d’exemple, la taxe sur les passagers n’est pas pay'e par ces derniers.

De fa'on g'n'rale, l’apurement des comptes des clients douteux est in'galement assur' selon les ports. Des admissions en non valeur, notamment, qui devraient 'tre limit'es aux cas d’insolvabilit' des d'biteurs, ont 't' ' plusieurs reprises prononc'es alors que l’insolvabilit' du client n’'tait pas d'montr'e.

b) Les achats

Les proc'dures de passation des march's

Aux termes de l’article R. 113-18 du code des ports maritimes, les march's des ports autonomes relatifs ' des op'rations donnant lieu ' participation financi're de l’Etat sont soumis ' la r'glementation des march's de l’Etat. En revanche, les march's relatifs aux autres op'rations sont pass's suivant des r'gles fix'es par le conseil d’administration et approuv'es par les tutelles, et qui doivent " s’inspirer des r'gles applicables aux march's de l’Etat ". En pratique, les conseils d’administration ont adopt' des r'glements int'rieurs fixant les seuils ' partir desquels les achats doivent s’effectuer sous forme de march's. Ce seuil est ainsi fix' ' 300 000 F, comme ' l’article 123 du code des march's publics, aux ports autonomes du Havre (proc'dure simplifi'e de 300 ' 900 000 F), de Dunkerque, de Nantes-Saint-Nazaire et de Rouen, mais ' 500 000 F ' Rouen pour l’acquisition de certains petits mat'riels, ' 600 000 F ' Marseille, et ' 700 000 F ' Bordeaux depuis un r'cent r'glement des march's du 21 juin 1999.

Les contr'les de la Cour ont permis de constater que, par une d'cision ancienne, les agents comptables s’'taient vu d'l'guer le visa pr'alable (33) du contr'leur d’Etat sur les march's publics relatifs aux op'rations financ'es par l’Etat et soumises aux commissions sp'cialis'es des march's de l’Etat. Il n’en demeure pas moins que, dans l’'tat actuel des textes, le contr'le d’Etat reste comp'tent pour v'rifier les conditions du bon exercice de ce pouvoir d'l'gu'.

La Cour observe globalement une tendance des ports ' faire un appel restreint ' la concurrence : la part des march's n'goci's est de 18 % ' Rouen sur la p'riode 1989-1994, tandis que 78 % des march's ont 't' conclus sur appels d’offre restreints. A Marseille, sur la p'riode 1991-1995, la proportion est de 46 % pour les march's n'goci's, dont 21 % n'goci's sans mise en concurrence. Au Havre, la proportion de march's n'goci's 'tait de 22,3 % sur la p'riode 1989-1992. Elle est cependant revenue ' 8 % en 1998.

La Cour a constat' un recours abusif aux dispositions des articles 104-I et 104-II du code des march's publics. Le premier article pr'voit la possibilit' de passer des march's n'goci's apr's mise en concurrence. Le second, qui pr'voit que des march's n'goci's peuvent 'tre pass's " sans mise en concurrence pr'alable lorsque l’ex'cution ne peut 'tre r'alis'e que par un entrepreneur ou un fournisseur d'termin' ", a 't' utilis' par exemple pour un montage audiovisuel, pour la fourniture de p'riodiques ou la r'paration d’une porte d’'cluse.

Les infractions suivantes ont fr'quemment 't' relev'es : des estimations initiales nettement sous-'valu'es par manque d’'tudes pr'alables des travaux ou prestations ' r'aliser ; la pratique de march's ou d’avenants de r'gularisation en violation de la r'gle pos'e par l’article 39 du code des march's publics selon laquelle" les march's doivent 'tre notifi's avant tout commencement d’ex'cution " ; l’extension de l’objet du march' sans passation d’avenants ; le manque de diligence des services pour solder les march's.

Ainsi ' Rouen, le port a eu recours en 1989 ' une soci't' d’achat d’espaces publicitaires dans le cadre d’un march' de 1 686 967,26 F, renouvel' en 1990, 1991 et 1992. En revanche, le port a renonc' en 1993 ' passer un march', au motif discutable que la loi n' 93-122 du 29 janvier 1993 impose l’'galit' des conditions de vente d’espaces publicitaires aux annonceurs et que" dans ce nouveau contexte, l’appel ' la concurrence par la proc'dure de l’appel d’offres devient sans objet ". Des prestations d’un montant de 2 330 227,64 F en 1993 et de 599 279,51 F en 1994 ont donc 't' r'gl'es sur factures.

De plus, ' Rouen, fin 1994, pr's de la moiti' des march's consid'r's comme " en cours " concernait en fait des travaux d'j' r'ceptionn's.

Il semble que la proc'dure d’achats sous forme de march's ne constitue pour certains ports qu’une formalit' oblig'e sans r'elle signification. Pourtant, le non respect de ces r'gles d’ex'cution des d'penses peut engager la responsabilit' des ordonnateurs devant la Cour de discipline budg'taire et financi're.

L’organisation des services de march'

La proc'dure relative aux march's des ports autonomes est diff'rente selon les 'tablissements.

Ainsi, ' Nantes-Saint-Nazaire, c’est seulement en mars 1991 qu’une cellule " march's publics " a 't' mise en place.

L’organisation du port autonome de Dunkerque en mati're de march's a fait l’objet d’une 'tude approfondie. La proc'dure y a 't' red'finie en juillet 1992, de fa'on ' transf'rer aux services la responsabilit' principale pour l''laboration des march's, qui appartenait auparavant ' la direction des finances. Cela a conduit ' une nouvelle r'partition des t'ches entre les directions sectorielles et la direction des finances, sans 'viter des tensions et un manque de coordination entre ces directions. Ce manque de suivi dans la mise en œuvre de la r'forme de l’organisation interne du port en mati're de march's a donc conduit ' transf'rer une responsabilit' sans avoir pr'vu la formation des agents. De sorte qu’aujourd’hui, contrairement au projet initial de responsabilisation des services, le service de la ma'trise d’ouvrage assure, seul, un r'le majeur de conseil en mati're de march's - sans pour autant que ce r'le soit clairement pr'cis' et organis', et sans qu’il corresponde ' l’organisation " officielle " 'tablie par 'crit. A la direction des finances, l’ancien service des march's a 't' remplac' par un charg' de mission march's. Dans la pratique, cette cellule march's, dot'e de trois personnes, se borne ' donner des visas purement formels, ce qui apparente son r'le ' celui d’une " bo'te aux lettres ".

La fonction de veille juridique en mati're de r'glementation relative aux march's n’est donc actuellement attribu'e ' aucun service. Ce manque de coordination et de concentration du savoir faire en mati're de march's est pr'judiciable au bon fonctionnement de leur passation et de leur ex'cution. Dans un pr'c'dent rapport particulier relatif au port autonome de Rouen, la Cour avait d'j' constat' les inconv'nients r'sultant du fait qu’" il n’y avait aucun d'partement ou cellule sp'cialis'e responsable de cette coordination des engagements ". Dans le m'me rapport, elle avait jug' que le respect des dispositions r'glementaires dans le domaine des march's publics ne peut se concevoir qu’' l’'chelle de l’ensemble de l’'tablissement portuaire, et non service par service, avec un point central de contr'le et de coordination des proc'dures de mise en concurrence. Cette observation s’applique tout ' fait ' l’organisation interne du port autonome de Dunkerque en mati're de march's.

Il revient aux tutelles, par l’interm'diaire du contr'le d’Etat et du commissaire du gouvernement, de veiller ' ce que de telles situations ne se reproduisent pas.

Suite aux observations de la Cour, les proc'dures relatives aux march's publics du port de Dunkerque ont 't' red'finies en octobre 1997 par la cr'ation d’un " p'le de comp'tences march's ". En outre, pour restaurer une r'elle s'paration des fonctions de comptable et d’ordonnateur, le visa de l’agent comptable, qui 'tait donn' avant la signature des march's par l’ordonnateur, a 't' supprim'.

L’unification n'cessaire des r'gles d’achat

La Cour prend acte du d'cret du 9 septembre 1999, qui pr'voit un alignement plus complet des proc'dures d’achat sur les r'gles pos'es par le code des march's publics. Celui-ci est d'sormais 'galement applicable aux march's ne donnant pas lieu ' participation financi're de l’Etat et dont le montant de l’op'ration est sup'rieur ' 700 000 F (TTC).

La direction des ports avait en outre indiqu' ' la Cour fin 1997 que " sur la base d’un premier travail de mise ' plat des pratiques dans les diff'rents ports r'alis' par le contr'leur d’Etat ", un groupe de travail interminist'rieldevait commencer ses travaux en 1998. Elle indiquait en janvier 1999 que les travaux de ce groupe, charg' d’'laborer un guide des proc'dures de la commande publique dans les ports autonomes maritimes, devraient 'tre disponibles courant 1999.

2' Les autres difficult's du fonctionnement

a) Des interventions hors du champ de comp'tence des ports

Plusieurs types d’intervention financi're des ports autonomes ne rel'vent pas de leur sp'cialit'.

La politique de communication des 'tablissements a par exemple donn' lieu ' des abus.

L’insertion dans le milieu 'conomique local - en soi indispensable pour une entreprise qui est souvent un important donneur d’ordre de la r'gion - a 't' le pr'texte pour se substituer aux collectivit's publiques, Etat ou collectivit's territoriales, et transformer ainsi l’'tablissement public sp'cialis' en organisme public ' vocation g'n'rale. Les ports subventionnent ainsi des activit's sans int'r't portuaire, au motif d’un " int'r't de place " sans contour d'fini.

Tel a 't' le cas, d'j' cit', du financement massif des op'rations " Voiles de la Libert' " en 1989 et " Armada de la libert' " en 1994 qui ont co't' 7,5 MF au port de Rouen, alors qu’il s’agissait d’une manifestation organis'e par et au profit des collectivit's territoriales. Les seules d'penses de communication du port de Rouen ont atteint 8 MF en 1993 et 4,7 MF en 1994 alors que la situation financi're du port 'tait s'rieusement d'grad'e par des d'ficits de 11,4 MF en 1993 et de 35,7 MF en 1994.

Les ports autonomes du Havre et de Dunkerque octroient des concours ou subventions respectivement ' plus de cent et quarante organismes divers, pour des montants annuels de 2,5 et 1,1 MF.

Certains ports se sont m'me comport's en organismes de cr'dit vis-'-vis d’organismes publics ou d’usagers du port. A titre d’exemple, dans le cadre du financement du plan social dockers, le port autonome de Marseille a consenti des avances sans int'r't ' la caisse de compensation des cong's pay's (4,38 MF en 1995). Il a 'galement consenti des avances ' la soci't' Gyptis (7,5 MF en 1990-1991) et ' France Telecom (2,088 MF en 1991). Trois avances ' plus d’un an (2,162 MF en 1991, 1,130 MF en 1992 et 0,043 MF en 1993) ' la SNCF ont 't' octroy'es par le port autonome de Rouen pour pr'financer des travaux ' la charge de la soci't' nationale, relatifs ' la modification de la desserte ferroviaire du quai de Grand-Couronne/Moulineaux r'alis'e dans le cadre du r'am'nagement d’un terminal conteneurs et de la desserte d’un quai de marchandises diverses.

La Cour a enfin relev' ' plusieurs reprises la propension de la direction des ports ' faire prendre en charge par les 'tablissements portuaires des d'penses incombant ' l’administration centrale. En particulier, plusieurs ports ont mis des v'hicules ' disposition de la DTMPL : cette pratique a 't' constat'e ' Nantes-Saint-Nazaire en 1989-1990, ainsi qu’au Havre et ' Dunkerque depuis 1994.

b) Le personnel des ports

Le co't et la productivit' du personnel

Le co't du personnel des ports autonomes peut 'tre mesur' par le niveau et l’'volution du co't salarial moyen par agent. Ce co't s’'levait en moyenne ' 318 000 F par agent en 1997, soit 305 000 F par agent ' Bordeaux, 308 000 F par agent ' Marseille, 309 000 F au Havre, 315 000 F ' Rouen, mais 327 000 F ' Nantes - Saint Nazaire, 343 000 F ' Dunkerque et 374 000 F en Guadeloupe. Pour l’ensemble des ports autonomes, ce co't moyen par agent a augment' de 27 % de 1990 ' 1997 en francs courants : alors que, dans le m'me temps, l’effectif moyen pay' a diminu' de 17 %, le co't total du personnel a augment' de 10 %.

Il est int'ressant de comparer ce co't moyen par agent ' la productivit' du personnel, mesur'e en rapportant la production 'largie (productions vendue, stock'e et immobilis'e + subvention d’exploitation) ' l’effectif moyen.

En niveau moyen, cette productivit' atteint 665 065 F par agent en 1997, avec des diff'rences importantes entre ports : 560 123 F ' Bordeaux contre 691 551 F au Havre, 682 361 F ' Dunkerque, 675 816 F ' Rouen et 1 217 013 F en Guadeloupe. Pour la p'riode 1990-1997, la productivit' du personnel de l’ensemble des ports a augment' de 19 % seulement : il en ressort un 'cart n'gatif de plus de six points avec la progression du co't moyen par agent. Cette augmentation de la productivit' est particuli'rement faible ' Nantes - Saint Nazaire, Marseille, comme le montre le tableau. Les 'carts les plus importants entre les 'volutions du co't et de la productivit' du personnel se situent ' Nantes-Saint-Nazaire (19 points), Dunkerque (11 points) et Marseille (9 points).

Cette premi're approche de la productivit' globale des ports peut cependant 'tre compl't'e par la pond'ration des trafics en fonction de la non intervention des personnels dans certains domaines d’activit' (transmanche, vracs liquides, certains vracs solides) et des 'carts de rendement sur les vracs solides. Le port autonome de Dunkerque estime que sa productivit' ainsi mesur'e a progress' de 73 % sur 1990-1997.

L’organisation du travail

La r'forme de la manutention portuaire a fait 'voluer l’organisation du travail des ouvriers dockers, mais elle ne s’est pas attaqu'e ' la question des personnels de manutention des ports autonomes, soit, au plan national, un effectif d’environ 900 grutiers. Dans ce domaine, les 'tablissements sont impuissants ' faire 'voluer leur propre personnel. L’enjeu est pourtant de taille puisque l’activit' " outillage public " repr'sente une source de perte pour les ports autonomes, dont les tarifs sont contest's par les manutentionnaires, notamment au Havre et ' Rouen. Or, en d'pit de quelques tentatives, l’'volution de la gestion de l’outillage et des grutiers n’a pas 't' prioritaire pour les ports ces derni'res ann'es.

Au Havre, un accord sign' en novembre 1992 devait rapprocher l’organisation du travail du personnel du port de celle pr'vue pour les personnels de la manutention par un accord du 31 octobre 1992. A Rouen, un accord de juillet 1993 a permis d’obtenir des souplesses suppl'mentaires dans l’emploi des grutiers, mais le syst'me reste qualifi' de " rigide et cher ", malgr' la mise en œuvre d’un plan social fin 1995. A Bordeaux, un plan de restructuration du port qui visait ' r'duire les co'ts de revient de l’outillage, pour le rapprocher des tarifs de Bayonne et La Rochelle, n’a 't' appuy' ni par les usagers portuaires, ni par le minist're, ce qui a provoqu' le d'part de l’ancien directeur d’exploitation. A Nantes, de nombreuses gr'ves, soit 17 en 1997, sont dues aux grutiers du port et l’absence de souplesse des horaires du personnel du port pose probl'me aux manutentionnaires. Les tentatives de faire 'voluer l’organisation du travail des personnels des ports sont donc loin d’avoir abouti.

En particulier, ' d'faut ou dans l’attente d’une int'gration plus pouss'e entre les personnels des entreprises de manutention portuaire et ceux des ports autonomes, l’'volution du mode de travail des grutiers et portiqueurs des ports appara't in'luctable : elle devrait aller vers une meilleure adaptation aux contraintes de travail des manutentionnaires et dans le sens d’une r'duction des effectifs des ports, compte tenu du poids de ces derniers sur les co'ts de l’outillage public. Or l’Etat et ses 'tablissements publics portuaires ne se sont jusqu’ici pas v'ritablement appliqu's ' cette t'che.

Recommandations

- veiller ' la l'galit' des proc'dures d’apurement des comptes des clients douteux ; am'liorer les recouvrements du port autonome de Guadeloupe ;
- faire aboutir rapidement l’'laboration d’un guide des proc'dures de la commande publique dans les ports autonomes maritimes, en organiser la mise ' jour r'guli're et pr'voir des formations pour les agents concern's par ces proc'dures ; veiller ' la mise en place de proc'dures suffisamment centralis'es et coordonn'es de passation des march's ;
- veiller au respect du principe de sp'cialit' des 'tablissements publics portuaires en mati're de communication, concours et subventions, avances ' d’autres organismes ;
- engager une politique d’int'gration entre les personnels des entreprises de manutention portuaire et ceux des ports autonomes ; adapter davantage le mode de travail des grutiers et portiqueurs des ports aux contraintes de travail des manutentionnaires.
