L'informatizzazione delle procedure doganali nel Regno Unito

Caricatori, vettori e 3PLs hanno tratto tutti vantaggio dalla sostituzione negli ultimi anni delle procedure cartacee con un ambiente elettronico nei settori marittimo e bancario.

I vantaggi principali per il settore marittimo consistono nella semplificazione e nello snellimento delle procedure di commercio internazionale, compresa la possibilità di stampare a distanza le polizze di carico ed altra documentazione di viaggio, le lettere di credito elettronico ed i portali dei vettori marittimi, INTRA, GT Nexus e CargoSmart. Inoltre, la diffusione della documentazione elettronica è stata incrementata negli ultimi due anni mediante una modifica della normativa europea che consente un'utilizzazione maggiormente estesa della firma elettronica.

La Commissione Europea, la WCO (Organizzazione Mondiale delle Dogane) e le autorità doganali nazionali stanno traendo grossi vantaggi dagli sviluppi elettronici che semplificano le procedure doganali.

La Commissione Europea, sebbene debba ancora ottenere l'approvazione da parte del Parlamento e del Consiglio europeo, sta spingendo verso il proprio obiettivo di sviluppare un sistema elettronico non cartaceo nel contesto dell'espansione dell'Unione Europea nel 2007.

La Commissione Europea ha lanciato la sperimentazione della SEA (Autorizzazione Unica Europea), ai sensi della quale le imprese che importano merci in più di uno degli stati membri dell'Unione Europea possono accentrare i loro rapporti doganali attraverso una sola autorità, piuttosto che in ciascun singolo paese. Ciò comprende l'accentramento dei pagamenti degli oneri di importazione, per quanto l'IVA resti decentrata. Il sistema SEA è stato implementato da un certo numero di importanti caricatori.

Un altro progetto della Commissione Europea consiste nel NCTS (Nuovo Sistema di Transito Comunitario), che dovrebbe essere realizzato concretamente alla fine di quest'anno, una versione elettronica del regime di Transito Comunitario cartaceo, che controlla la movimentazione nell'ambito dell'Unione Europea delle merci che non sono in libera circolazione (vale a dire, in relazione alle quali non si pagano oneri di importazione e tasse). Il NCTS si estende a 22 paesi, vale a dire quelli dell'Unione Europea più gli stati baltici, la Repubblica Ceca, l'Ungheria, la Polonia e la Slovacchia.

L'Iniziativa G7 è per definizione più globale per sua natura rispetto ai progetti SEA e NCTS e recentemente è entrata nelle grazie della WCO, che è intenzionata ad estendere tale programma a tutti i suoi 161 paesi membri. L'iniziativa è pilotata dalle autorità doganali canadese e britannica per conto di tutti i paesi del G7 (che comprende anche Giappone, Stati Uniti, Francia, Germania ed Italia).

L'iniziativa è finalizzata ad armonizzare e semplificare le procedure di importazione ed esportazione a livello mondiale e ha sviluppato uno standard globale per le dichiarazioni doganali elettroniche. I messaggi doganali di importazione ed esportazione sono stati concordati utilizzando la stessa struttura. Ciò consente agli stessi dati di essere usati per le dichiarazioni sia d'esportazione che d'importazione. Gli insiemi di dati uniformi concordati a livello internazionale saranno trasmessi servendosi di messaggi elettronici standard basati sulla struttura UN-EDIFACT (Interscambio Dati Elettronico delle nazioni Unite per l'Amministrazione, il Commercio ed i Trasporti).

Un certo numero di autorità doganali europee, segnatamente quelle del Regno Unito, ha introdotto procedure semplificate elettroniche di importazione ed esportazione. Nel 2002, la HMCE (Dogane e Dazi di Sua Maestà) ha pubblicato il suo "Commercio internazionale: una formula per il futuro scenario doganale", che promuove un incremento dell'approccio collaborativo tra le attività imprenditoriali e le dogane britanniche, nel contesto del quale gli operatori del commercio che vi si adeguano traggono vantaggio dalle agevolazioni e dalle procedure semplificate. Esso dichiara altresì l'intenzione della HMCE, unitamente agli altri dipartimenti del governo britannico, di rendere i proprio servizi elettronicamente disponibili entro il 2005.

E' forse in ragione del progressivo approccio della HMCE che il Regno Unito rappresenta l'Europa nell'iniziativa pilota G7. Joe O'Connor, specialista della HMCE per le politiche, le dogane ed i traffici internazionali, con ufficio a Londra, spiega: "Il Regno Unito è all'avanguardia dello sviluppo e della sperimentazione delle risultanze della G7. Altre amministrazioni doganali del G7 e dell'Unione Europea stanno programmando di implementarle in seguito. Alcuni paesi non G7 dell'Unione Europea, tra cui l'Olanda, la Svezia e la Finlandia, sono sempre aperti a nuove ed innovative idee che miglioreranno le prestazioni internazionali dei loro operatori commerciali; noi, peraltro, non siamo a conoscenza di tutte le azioni-pilota G7 intraprese in tali paesi".

Anche le autorità doganali olandesi si sono attivate per dar corso ad alcuni progetti elettronici, segnatamente il NCTS ed il SEA. Una ragione sta nel fatto che un gran numero di imprese multinazionali hanno istituito centri distributivi nei Paesi Bassi, in particolar modo nei settori dell'abbigliamento e delle industrie ad alta tecnologia, oltre al fatto che l'inglese là è parlato diffusamente.

Tuttavia, Tim Cornell, dirigente nazionale della Squadra Relazioni Sviluppo Scambi Internazionali della divisione servizi alle imprese e tasse della HMCE, con sede a Redhill, spiega: "Il Regno Unito primeggia in Europa nelle iniziative elettroniche sin dal 1987, segnatamente con l'introduzione del sistema computerizzato CHIEF (Movimentazione Doganale del Trasporto Merci d'Importazione ed Esportazione). La maggior parte degli stati membri dell'Unione Europea non dispongono di un sistema d'importazioni completamente elettronico. L'Olanda ne ha uno per le importazioni via Rotterdam e l'Aeroporto di Schiphol, denominato Sagitta, ma non per l'intero paese. La Francia, la Germania ed il Belgio non hanno sistemi elettronici. Esistono procedure semplificate disponibili in altri paesi, ma si tratta di sistemi cartacei. Pertanto, tra gli stati membri esistono divari inerenti ai tempi di sviluppo. Quello che tendenzialmente abbiamo scoperto è stato che più si va a sud nell'Unione Europea, meno si trovano procedure elettroniche, e meno progredite".

In relazione all'Europa del sud, una notevole eccezione è costituita dalla Spagna, che dispone di un sistema elettronico. Tuttavia, il paese è meno progredito per quanto attiene alla propria partecipazione agli attuali progetti-pilota dell'Unione Europea.

Il primo stadio delle modifiche procedurali a lungo termine della HMCE delineate nel suo documento del 1997 "Politica del trasporto merci a lungo termine" è stato posto in atto nel 1998, con le procedure doganali semplificate relative al trasporto merci (CFSP). Esse rappresentano una pietra miliare nell'ambito delle procedure doganali elettroniche semplificate, dato che il documento cartaceo per l'ingresso delle importazioni (C88) è stato rimpiazzato da un sistema di messaggeria elettronica tra l'importatore ed il sistema CHIEF della HMCE.

Data la diffusa adozione da parte degli importatori britannici, la HMCE giustificatamente considera le CFSP come un successo. Spiega Cornell: "Ben oltre il 50% delle dichiarazioni d'importazione del Regno Unito sono ora trattate mediante le CFSP. L'elevato numero di contatti tiene conto del fatto che gli integratori, che rappresentano una grossa percentuale dei contatti d'importazione, per lo più si serve delle CFSP".

L'equivalente delle CFSP per quanto attiene alle esportazioni, vale a dire il NES (Nuovo Sistema Esportazioni), è entrato nel vivo nel 2002; ci si aspetta che anch'esso abbia successo, malgrado il fatto che i suoi vantaggi nei confronti dei caricatori siano meno ovvii rispetto a quelli assicurati dalle CFSP. Mike Dixon, amministratore delegato dell'importante fornitore di software Langdon Systems Ltd, approfondisce il concetto: "Proviamo moltissimo interesse nei confronti del NES. E' un vantaggio per i 3PLs, dato che questi ultimi possono in tal modo procedere ad esportazioni in modo molto più svelto di quanto non accada con la documentazione. Abbiamo proceduto ad un esperimento pilota con tre imprese nel 2001, tra cui la Elliott Turno Machinery e la Polaroid. Ma poiché esso potrebbe essere di minore interesse per gli esportatori, provvederemo ad offrire il NES sul nostro sito web, piuttosto che installarlo come un sistema a se stante, o come un'aggiunta ad un altro sistema, quale quello dei depositi doganali".

Il sistema NES funziona in un modo simile alle CFSP, ma in senso inverso. Un messaggio elettronico viene inviato dal caricatore alla HMCE via CHIEF prima che la spedizione sia fatta partire dai locali dell'esportatore. Il messaggio contiene dettagli sulle merci e sul loro valore, così come un numero alfanumerico denominato UCR (riferimento unico di consegna).

Quando la HMCE accondiscende alla spedizione della consegna, invia la propria autorizzazione all'inoltro del messaggio di ritorno al caricatore; le merci, successivamente, viaggiano sino al porto di esportazione, dopodiché viene rilasciato un messaggio di arrivo, seguito da un messaggio di autorizzazione all'esportazione. Chiaramente, ciò ridurrà notevolmente i tempi trascorsi in porto dalle consegne in esportazione, semplificando le procedure sia per la HMCE che per il caricatore. Come per le CFSP, le informazioni richieste alla frontiera sono minime, dato che la maggior parte delle informazioni (a scopi statistici e di controllo) vengono fornite in seguito.

Sia le CFSP che il NES realizzano l'obiettivo della HMCE di eseguire i controlli doganali interni, vale a dire uno dei punti fermi del progetto 2002. Entrambi i regimi dipendono da un elevato livello di fiducia e di approccio collaborativo tra l'imprenditore e la HMCE.

Per utilizzare tali procedure, gli imprenditori devono essere autorizzati dalla HMCE ed avere buone tradizioni di correttezza nei traffici. Le CFSP ed il NES stanno contribuendo a modificare il tradizionale sistema di controlli alla frontiera da parte della HMCE nel momento in cui le merci vengono esportate od importate, trasformandolo in verifiche periodiche (della documentazione, dei sistemi informatici, ecc.).

Questa concezione è stata sviluppata ulteriormente in Svezia, con l'introduzione dello Starway, un sofisticato sistema di procedure semplificate. Lo Starway è stato concepito dalle Dogane Svedesi in collaborazione con il dipartimento svedese Industria e Commercio ed altri dipartimenti governativi. Gli utenti, tra cui l'importante dettagliante Ikea, possono scegliere tra cinque livelli di servizio e semplificazione, ciascuno dei quali rappresenta un gradino metaforico della scala. Maggiore è la responsabilità che l'operatore concorda di accettare nella gestione delle proprie operazioni doganali, più sono le opportunità di semplificazione.

L'implementazione delle CFSP e della NES aiuta altresì la HMCE ad individuare con maggiore efficienza la piccola percentuale di imprenditori fraudolenti. Secondo Cornell, a causa della carenza di un sistema inerente alle esportazioni completamente elettronico, i controlli anti-frode sino ad ora sono stati incompleti. Cornell spiega altresì che in precedenza non vi era un buon collegamento con il sistema dell'IVA, né alcuna capacità di seguire le movimentazioni in modo appropriato.

Commenta al riguardo: "Abbiamo sperimentato frodi sulle esportazioni per molti milioni di sterline, ad esempio quelle sui telefoni mobili dirottati sul mercato interno invece di essere riesportati. Il NES sta conseguendo il controllo doganale delle esportazioni, dato che esse vengono tassate ai sensi della normativa comunitaria.

Abbiamo introdotto contatti non cartacei sulle importazioni in tutto il Regno Unito, secondo una modalità per fasi, negli ultimi 18 mesi. La prossima mossa verso la "elettronificazione" è il NES, che è stato sviluppato per tutta una serie di ragioni. Oltre ai controlli sulle esportazioni, esso comprende la standardizzazione dell'aggregazione delle statistiche. In passato, un porto la faceva in un modo ed un altro porto in modo diverso".

Per quanto attiene alla HMCE, l'introduzione del NES è da tempo in ritardo. Il sistema CHIEF è stato progettato per movimentare sia le esportazioni che le importazioni, ma, dato che la maggior parte dei contatti relativi alle esportazioni si basa sul cartaceo, il CHIEF è stato sottoutilizzato.

La HCME sta inoltre continuando ad effettuare i controlli di frontiera per alcune importazioni, come ha spiegato O'Connor: "La nostra attività principale alla frontiera del Regno Unito consiste nell'assoggettare a controllo doganale i carichi relativi a paesi terzi, nonché nella scoperta del contrabbando". Per la maggior parte delle merci, non sarà richiesta la presentazione alle dogane alla frontiera della documentazione integrativa affinché possa essere sdoganata. Tuttavia, ci si aspetta che la presentazione di determinati documenti possa essere decisiva per il rilascio della merce. Ciò si applica ad una ristretta gamma di merci, a causa della loro natura e del potenziale pericolo all'ambiente, quali i prodotti agricoli ed alimentari, le armi e gli esplosivi. Ma per la maggior parte delle importazioni, il nostro interesse alla frontiera consisterà nell'ammissibilità e nella responsabilità, cioè nell'identificazione di quelle merci, in una fase tempestiva, che sono autorizzate alla movimentazione e nel nome del soggetto che è tenuto al pagamento delle imposte, nonché nel soddisfacimento degli altri requisiti normativi. Questi saranno identificati principalmente in base al rapporto elettronico sul carico (manifesto del vettore) prima che la nave arrivi".

O'Connor ha dichiarato che alcuni vettori marittimi stanno attualmente inviando informazioni preventive sul manifesto direttamente alla HMCE per via elettronica, attraverso il formato di messaggeria CUSCAR. Si spera che questo standard comune possa alla fine essere esteso sino a comprendere tutte le merci, quale che sia la modalità trasportistica. I nuovi requisiti di sicurezza vengono riprodotti nel modello di dati G7 allo scopo di ridurre il loro impatto sulle attività quanto più possibile. Le modifiche alle dichiarazioni doganali in conseguenza dell'iniziativa G7 vengono al momento apportate dai fornitori del software.

Un certo numero di altre soluzioni di commercio elettronico a disposizione dei caricatori completano questi sistemi, assicurando la documentazione non cartacea relativa ad importazioni ed esportazioni. Un importante importatore che trae vantaggio da tali strumenti è la Otto UK, che fa parte della società tedesca di ordinazioni per posta Otto International, che importa ogni anno dalla Cina, da Hong Kong e da Taiwan alla volta di Southampton circa 5.000 TEU di beni di consumo da movimentare rapidamente. Un'ampia gamma di prodotti viene importata per i cataloghi di ordinazioni postali della Freeman e Grattan. I containers vengono trasportati per ferrovia (dalla Freightliner) a sei magazzini nell'Inghilterra settentrionale.

Justin Gales, dirigente addetto alla catena delle forniture della Otto UK con sede a Bradford, spiega che i fornitori asiatici della società emettono fatture, liste di imballaggio e polizze di carico marittime (P&O Nedlloyd) non cartacee, con immissione minima di dati, utilizzando i servizi del provider informatico boleroXML. Attraverso un collegamento tra i sistemi della Otto UK e quelli dei suoi fornitori, il boleroXML consente la creazione automatica di tale documentazione (utilizzando i dati degli ordini d'acquisto della Otto UK) e la loro stampa a distanza. Il boleroXML riesce ad ottenerlo fornendo una serie di standard comuni che descrive come "transazioni commerciali agevolate nel contesto di tutte le organizzazioni".

La Otto UK trae altresì vantaggio da una struttura EDI fornita dal dipartimento britannico dell'Industria e del Commercio per le applicazioni elettroniche della licenza di importazione. Afferma Gales: "Noi siamo una delle poche imprese che lo fanno. Trattiamo molte applicazioni relative alle licenze in ragione degli elevati volumi di vestiario che importiamo".

Tuttavia, il notevole cambiamento della normativa europea in materia di licenze che dovrebbe essere posto in atto entro la fine del 2004 sembra fatto apposta per comportare vantaggi a società quali la Otto UK. Spiega O'Connor: "Le licenze d'importazione dei capi di abbigliamento, che rappresentano la gran massa delle licenze in Europa, stanno scomparendo ai sensi dello MFA (Accordo Multi Fibra). Nel Regno Unito, il dipartimento dell'Industria e del Commercio attualmente rilascia circa un terzo di milione di licenze all'anno in ordine a questo tipo di merce. Nel 2005, saremo lasciati soli alle prese con merci che necessitano di controlli. Per le esportazioni vi saranno ancora le licenze ' ad esempio per i prodotti agricoli ' ma nel Regno Unito il NES le tratterà elettronicamente".

Questi ultimi prodotti includono le merci ai sensi della Politica Agricola Comunitaria, a cui si applicano i rimborsi per le esportazioni. Nel Regno Unito, controlla questi rimborsi la RPA (Agenzia Pagamenti Rurali) e la HMCE amministra tali esportazioni (tra cui gli esami, le autorizzazioni al rimborso, ecc.) per conto del dipartimento dell'Ambiente, degli Alimenti e degli Affari agricoli (DEFRA). Allo scopo di agevolare le pratiche intercorrenti tra i dipartimenti della pubblica amministrazione del Regno Unito, tra cui il DEFRA, così come per agevolare il dialogo con i vari dipartimenti della comunità dello shipping e del pubblico in generale, la HMCE sta sviluppando la "Finestra Unica" nell'ambito del proprio progetto. Essa sarà costituita da un portale Internet, con collegamenti tra i vari dipartimenti, vale a dire l'Ufficio IVA, le Entrate Interne ed il dipartimento dell'Industria e del Commercio.

Nel frattempo, l'implementazione delle iniziative NCTS, G7 e SEA procede, sebbene non così alla svelta come piacerebbe alla comunità dello shipping. Lo NCTS è pilotato dalle Dogane Olandesi, ma, secondo Dixon, la messaggeria elettronica su cui il sistema fa affidamento è nuovo per tale organismo. Lo NCTS richiede al caricatore di inviare un avviso di pre-spedizione al suo ufficio doganale locale, avvertendolo della destinazione programmata. Il caricatore quindi attende conferma circa la possibilità che la merce venga sottoposta ad ispezione. Un altro messaggio elettronico viene inviato alla destinazione finale della spedizione.

Il programma è quello di diffondere lo NCTS in tutta l'Europa quest'anno. Ci si aspetta che diventi operativo nel Regno Unito nel secondo trimestre. La Langdon Systems ha recentemente consegnato una soluzione NCTS alla Trek Bikes, giusto in tempo per l'espansione nei Paesi Bassi della società con sede negli U.S.A.

L'iniziativa G7 finalmente quest'anno verrà sottoposta ad esperimento-pilota ed il primo caricatore a partecipare sarà l'importante società canadese di telecomunicazioni Nortel Networks. La società spedisce notevoli volumi di equipaggiamenti e pezzi di ricambio per mare (in contenitori) e via aria, utilizzando una varietà di porti e di aeroporti.

Le operazioni doganali e logistiche della Nortel sono affidate all'esterno alla Vastera, per cui il software per l'agevolazione degli scambi globali di quest'ultima viene utilizzato per gestire tutte le questioni di conformità e per fornire il collegamento con i sistemi doganali canadese e britannico.

O'Connor, che è responsabile delle politiche inerenti al progetto G7 della HMCE, ha dichiarato che la messaggeria elettronica tra i due paesi potrà essere ottenuta senza alcuna riformattazione degli assiemi di dati della spedizione. Tuttavia, i dati dovranno essere modificati in relazione al valore delle merci, al codice della derrata ed al Codice di Procedura Doganale.

Secondo O'Connor, altri produttori, alcuni dei quali utilizzano i servizi gestiti dalla Vastera (affidati a terzi), sono interessati a partecipare al progetto-pilota. A detta di O'Connor sono state contattate sino a 20 società, tra cui 3PLs, sebbene non tutte siano in condizione di partire ad aprile. Tra loro vi è un certo numero di altre società tecnologiche: "Le società tecnologiche sono state duramente colpite nel corso dell'ultimo paio d'anni, e stanno cercando il modo di gestire meglio le loro attività e di tagliare i costi".

Un altro incentivo alla partecipazione di imprese sta nel potenziale di applicazione dei principi del modello svedese Stairway. O'Connor ha suggerito la possibilità di istituzione dello stato di "carta d'oro", sia per gli imprenditori che vi si conformano sia per i vettori marittimi. Per gli importatori ed esportatori autorizzati, un tale sistema presenterebbe somiglianze con le CFSP ed il NES, ma su scala globale (WCO).

O'Connor è stato altresì incoraggiato dalla cooperazione di un gran numero di spedizionieri britannici, che hanno espresso la propria volontà di assumersi la responsabilità di conformità per conto degli importatori partecipanti. E' interessante notare come esista la possibilità che anche quattro società giapponesi (tra cui la Hitachi e la Matsuita) partecipino al progetto-pilota G7, il che lo estenderebbe all'Asia.

Il SEA è già stato attivato in alcuni stati dell'Unione Europea, dato che la Kimberly-Clark, la Philips e la Toyota lo utilizzano. Essi trattano con una sola autorità doganale per il pagamento degli oneri e lo sdoganamento delle importazioni alla volta di diversi paesi europei.

Mike Wingate, direttore operatore finanziarie della Toyota nel Regno Unito, spiega: "Noi importiamo automobili dal Giappone nei nostri depositi in Belgio, Finlandia, Francia e Regno Unito, così come parti di auto containerizzate in diversi paesi europei. Dati gli elevati volumi e l'ammontare degli oneri sulle importazioni per le automobili, noi traiamo vantaggio in modo significativo dalla possibilità di accentrare le nostre operazioni in Belgio".

Tuttavia, il SEA non è stato ancora adottato da paesi dell'Unione Europea. Continua: "Le autorità doganali nord-europee, in particolar modo quelle dei quattro paesi in cui importiamo automobili, si sono dimostrate più collaborative di quelle delle autorità dell'Europa meridionale".

Uno dei principali punti di stallo che comportano questa frammentazione del SEA è rappresentato dalla carenza di interpretazione uniforme delle regole doganali in tutti gli stati membri. Ciò ha richiesto la stipulazione di accordi bilaterali (i JUC, Intese Congiunte di Comunicazione) tra le autorità doganali nazionali. Secondo Cornell, il sistema SEA attualmente gira attorno a tali JUC. E' stata definita la questione del 25% del valore degli oneri di importazione che viene assegnato all'autorità doganale del paese in cui viene riscosso (le cosiddette "risorse proprie").

La risoluzione di questo problema è un arduo compito per la Commissione Europea, a causa delle diverse strutture interne degli stati membri rispetto alle dogane, alle IVA ed a Intrastat. Cornell ha sottolineato ci si aspetta che entro il 2013 gli oneri di importazione scompaiano nell'Unione Europea in ordine ad esportazioni provenienti dai paesi GATT. Come i progetti sopra descritti, ciò rappresenterà una sfida per l'Unione Europea così come per le autorità doganali, ma costituirà solamente una buona notizia per gli imprenditori interessati.
