AIUTI DI STATO: LA COMMISSIONE ADOTTA DUE DECISIONI CON LE QUALI PROPONE LA TASSAZIONE DEI PORTI IN ITALIA E SPAGNA

La Commissione Europea ha proposto, con due decisioni distinte, che l'Italia e la Spagna adeguino il proprio sistema fiscale dei porti alle regole degli aiuti di stato.

La Commissione resta impegnata ad assicurare regole uguali per tutti in tutta l'Unione Europea in questo fondamentale settore economico.

La Commissaria Margrethe Vestager, responsabile della politica sulla concorrenza, afferma: "I porti sono infrastrutture chiave per la crescita economica e lo sviluppo locale.

Ciò accade perché le regole dell'Unione Europea sugli aiuti di stato offrono ampio spazio agli stati membri al fine di supportare i porti ed effettuarvi investimenti.

Allo stesso tempo, allo scopo di assicurare la concorrenza leale in tutta l'Unione Europea, i porti che generano profitti da attività economiche dovrebbero pagare le tasse allo stesso modo delle altre imprese: né più, né meno".

La concorrenza transfrontaliera svolge un ruolo importante nel settore dei porti e la Commissione è impegnata ad assicurare regole uguali per tutti in questo settore economico fondamentale.

I porti svolgono attività sia non economiche che economiche:
  • Le attività non economiche, come il controllo del traffico marittimo e la sorveglianza in tema di sicurezza o contro l'inquinamento, tipicamente ricadono nella competenza delle autorità pubbliche.

    Tali attività pubbliche di missione sono al di fuori del raggio di azione del controllo dell'Unione Europea sugli aiuti di stato.
  • Le operazioni commerciali delle infrastrutture portuali, come la fornitura degli accessi a pagamento al porto, d'altro canto costituiscono un'attività economica.

    Le regole europee sugli aiuti di stato si applicano a tali attività.
Un'esenzione dall'imposta sulle imprese per i porti che conseguono profitti dalle attività economiche potrebbe garantire loro un vantaggio in termini di concorrenza quando effettuano operazioni nel mercato interno e pertanto comportano aiuti di stato che potrebbero essere incompatibili con le regole dell'Unione Europea.

In Italia i porti sono del tutto esentati dalle imposte sul reddito d'impresa.

In Spagna i porti sono esentati dalle imposte sul reddito d'impresa rispetto alle loro principali fonti di proventi, come gli oneri portuali o il reddito da contratti di locazione o concessione.

Nei Paesi Baschi, i porti sono del tutto esentati dalle imposte sul reddito d'impresa.

Ad aprile 2018, la Commissione aveva informato l'Italia e la Spagna delle proprie preoccupazioni inerenti i loro regimi fiscali relativi ai porti.

La Commissione è preliminarmente del parere che sia in Italia che in Spagna gli attuali regimi fiscali assicurino ai porti un vantaggio selettivo che potrebbe violare le regole sugli aiuti di stato dell'Unione Europea.

Oggi la Commissione ha pertanto invitato Italia e Spagna ad adeguare la propria normativa al fine di far sì che i porti dal 1° gennaio 2020 paghino imposte d'impresa nelle stesse modalità delle altre imprese rispettivamente in Italia e Spagna.

Entrambi i paesi ha ora due mesi per rispondere.

Le decisioni odierne fanno seguito alle recenti decisioni della Commissione che richiedono ai Paesi Bassi, al Belgio ed alla Francia di abolire le esenzioni dalle imposte d'impresa per i loro porti.

Il contesto

I regimi fiscali applicabili ai porti in Italia e Spagna esistevano prima dell'entrata in vigore del Trattato dell'Unione Europea in questi stati membri.

Pertanto, queste misure sono considerate come "aiuti esistenti" e la loro valutazione è soggetta ad una specifica procedura di cooperazione fra gli stati membri coinvolti e la Commissione.

Per quegli aiuti di stato che venissero ritenuti in violazione delle regole sugli aiuti di stato dell'Unione Europea, ai beneficiari non si richiede il rimborso degli aiuti ottenuti in passato.

Nel caso che gli aiuti esistenti appaiano in violazione delle regole sugli aiuti di stato dell'Unione Europea, la Commissione, come prima misura, informa gli stati membri in ordine alle proprie perplessità.

Tenuto conto della risposta, la Commissione può quindi proporre misure appropriate al fine di portare il provvedimento in linea con le regole sugli aiuti di stato dell'Unione Europea.

Le proposte odierne all'Italia ed alla Spagna sono queste fasi successive.

Se gli stati membri non dovessero accettare le proposte, la Commissione potrebbe decidere, in terzo luogo, di aprire un'indagine approfondita per verificare la compatibilità degli aiuti esistenti.

Se la Commissione concludesse che il regime non è compatibile con le regole sugli aiuti di stato dell'Unione Europea potrebbe richiedere allo stato membro di porre fine al programma di aiuti che distorce la concorrenza nel Mercato Unico.

Parallelamente la Commissione proseguirebbe nella propria indagine in ordine al funzionamento ed alla tassazione dei porti in altri stati membri e adotterebbe i passi necessari per assicurare la concorrenza leale fra tutti i porti nell'Unione Europea.

La soppressione dei vantaggi fiscali ingiustificati non significa che i porti non possano più ricevere supporto dallo stato.

Gli stati membri hanno molte possibilità di supportare i porti in linea con le regole sugli aiuti di stato dell'Unione Europea, ad esempio per conseguire gli obiettivi di trasporto dell'Unione Europea o per mettere in atto i necessari investimenti infrastrutturali che non sarebbero stati possibili senza l'aiuto pubblico.

A tale riguardo, a maggio del 2017 la Commissione aveva semplificato le regole per gli investimenti pubblici nei porti.

Poiché la Commissione aveva esteso il Regolamento per l'Esenzione Generale per Categoria agli investimenti non problematici nei porti, gli stati membri possono ora investire sino a 150 milioni di euro nei porti marittimi e sino a 50 milioni di euro nei porti interni con piena certezza giuridica e senza previa verifica da parte della Commissione.

Il regolamento consente alle autorità pubbliche, ad esempio, di coprire i costi del dragaggio nei porti e degli accessi alle idrovie.

Inoltre, le regole dell'Unione Europea consentono agli stati membri di compensare i porti per i costi sostenuti nell'esecuzione dei compiti di pubblico servizio (servizi di interesse economico generale).
