Agitazione intorno all'ARC

La proposta di fusione tra BNSF e CN, ormai abbandonata, ha messo in luce il potere di lobbying dell'Alliance for Rail Competition di Washington - DC.

Gli utenti delle ferrovie del Nord America si sono lamentati seriamente per un discreto numero di anni per problemi in merito a servizi ferroviari e per i prezzi esorbitanti. Così, alla fine, questi hanno costituito un gruppo per trovare il modo migliore di indirizzare le future politiche ferroviarie. È stato deciso che, invece di permettere al regolamento vigente di cercare di risolvere la situazione, "la soluzione migliore fosse accrescere il livello di concorrenza tra gli operatori ferroviari", secondo l'opinione di Diane Duff, amministratrice dell'ARC1.

"Ciò che scaturì fu la creazione dell'ARC, ovvero l'Alliance for Rail Competition (Alleanza per la concorrenza nelle ferrovie). È una compagnia dalle molte sfaccettature che cerca di mutare la legislazione mediante l'ingresso della concorrenza, tipica del libero mercato, nell'industria ferroviaria2. Facciamo tutto questo commissionando studi e ricerche che mettano in evidenza il dato statistico, piuttosto che la solita retorica su come siano scese le tariffe del trasporto ferroviario".

L'ARC è stata creata nel 1997 ed attualmente collabora con circa altri 15 gruppi commerciali rappresentativi degli utenti ferroviari delle più svariate industrie e merceologie. Tra queste vi sono prodotti chimici, veicoli a motore, beni agricoli, fibre plastico-sintetiche provenienti da imprese quali DuPont, Potomac Electric Poker Company e Dow Chemical USA. L'ARC ha anche altri 11 partners costituiti da associazioni che si occupano di industria forestale e cartacea, cooperative agricole, manufatti chimici e gruppi di servizi pubblici.

Secondo il parere della Duff, ci sono parecchie ragioni per cui i clienti dell'industria ferroviaria americana hanno bisogno di vedere un più alto livello di concorrenza. "Le ferrovie stanno solo cercando di salvare il loro monopolio. E pensano che questa sia la strada giusta. Ma quest'approccio ad oggi ha generato soltanto dei fallimenti. Essi, infatti, si aggrappano ancora alla speranza di poter fare affari come hanno sempre fatto negli ultimi 150 anni. È pazzesco", dice la Duff.

Tra l'altro non si può fare a meno di notare come l'aumentare della concentrazione e la diminuzione conseguente della concorrenza all'interno dell'industria ferroviaria abbiano portato ad un calo nel numero dei servizi offerti agli utenti delle ferrovie. Lo Staggers Rail Act del 1980, la legge federale che ha costituito l'ultimo importante emendamento della legge sull'industria ferroviaria, è in parte responsabile della situazione. "Questo atto ha certamente migliorato il contesto generale, perché ha permesso agli utenti di entrare in contatto diretto con le ferrovie, ma ha anche causato tutta la concentrazione che oggi osserviamo. Questa concentrazione ha sistematicamente rimosso la concorrenzialità. Il risultato netto è che oggi c'è meno possibilità di scelta per il consumatore", ha detto la Duff.

L'Association of American Railroads (AAR) ha presentato una diversa prospettiva dello Staggers Act. L'AAR è un gruppo d'affari di Washington-DC che ha competenza sulle maggiori linee ferroviarie merci in USA, Canada e Messico per quanto concerne le politiche pubbliche, il governo federale e le istanze regolamentari. Ne fanno parte sette operatori di prima categoria (Class One) e 550 compagnie ferroviarie minori. "Prima dello Staggers Act l'industria ferroviaria era in cattive acque. Dopo l'entrata in vigore della legge i volumi globali di scambio sono cresciuti del 50%, con una crescita considerevole del settore intermodale, un incremento del ritorno sugli investimenti da -2% a +8% ed una caduta delle tariffe di trasporto del 56%. Tutto ciò dimostra che l'Act è stato un successo", afferma Thomas C. White, dirigente dell'AAR.

Negli ultimi anni la concentrazione nell'industria ferroviaria americana è stata ben documentata, come dimostrano anche i conseguenti problemi di servizio sofferti dagli utenti di questa modalità di trasporto. L'ARC dice che questa concentrazione ha implicato questa situazione: oggi ci sono solo quattro operatori di prima categoria (Burlington Northern Santa Fe [BNSF], CSX, Norfolk Southern [NS] e Union Pacific [UP]), che hanno chiuso molti tracciati di collegamento, eliminando così molte stazioni d'accesso e abbandonando circa la metà dei binari in precedenza operativi.

Una specifica conseguenza di questo è che molti clienti della ferrovia sono attualmente un "mercato prigioniero", schiavo delle volontà di BNSF, CSX, NS ed UP, perché il servizio è solo disponibile da una di queste quattro major. Il risultato è che gli spedizionieri ferroviari pagano dei prezzi più alti del 30%.

Attraverso uno studio dettagliato della situazione e l'ascolto delle istanze di tutti gli attori in gioco, l'ARC sta tentando di trovare un modo di alterare la situazione attuale della concorrenza ferroviaria in favore degli utenti della ferrovia. La Duff si rende conto che non sarà facile per l'ARC raggiungere il suo scopo, anche perché i tempi sono molto stringati. "L'ARC spera di ottenere con successo un libero mercato ferroviario americano ad elevata concorrenzialità. Raggiunto questo scopo il gruppo ARC potrà sciogliersi. Il tutto dovrebbe essere conseguito entro cinque anni, anche perché non è conveniente investire più tempo nel progetto. Però, considerando quelli che sono i tempi della politica, la sfida è ancora più ardua. Per l'OSRA (Ocean Reform Shipping Act) del 1998, ad esempio, si è impiegato all'incirca lo stesso tempo.

White dell'AAR presenta una visione ancora più succinta di quello che l'ARC spera di ottenere: "alcuni utenti della ferrovia vorrebbero una situazione in cui potessero contestare le tariffe di trasporto merci via ferrovia a loro piacimento. E così era prima del 1980 ed è stato un disastro per l'industria delle ferrovie".

La Duff sostiene che il problema attuale dei clienti delle ferrovie è se gli operatori ferroviari sono o non sono in grado di offrire ai loro clienti un servizio accettabile ed affidabile ad un prezzo ragionevole. È convinta che questo può essere ottenuto, ma non allo stato attuale delle cose. "Potenzialmente, le ferrovie possono offrire il tipo di servizio richiesto, ma non con l'attuale scenario legislativo. Solo l'introduzione della concorrenza potrà cambiare qualcosa. La concorrenza è un male per gli oligopolisti, che, se non costretti, continuano a comportarsi allo stesso modo, perché conviene loro di più, visto che in teoria potrebbero alzare i prezzi a loro piacimento", sostiene la Duff.

Questa è una visione che DuPont, la maggiore compagnia farmaceutica al mondo, condivide fino ad un certo punto. La compagnia spende circa 200 milioni di dollari l'anno per trasportare i propri prodotti via ferrovia ed altre modalità per tutto il Nord America. Rich Abel, manager per sicurezza e distribuzione, ha così riassunto la situazione, guardando dalla prospettiva del grosso spedizioniere: "Bisogna puntare il dito su una vera e propria mancanza di concorrenza nel mercato".

Ma per quanto concerne il mercato ferroviario di per sé, non sono molto convinti che sostanzialmente ci sia mancanza di concorrenza per i clienti. Quando la BSNF e la Canadian National Railway (CN) proposero la loro fusione all'inizio del 2000 hanno sostenuto che l'impresa che avrebbe avuto origine dall'accordo sarebbe stata "competitiva nei prezzi e nei prodotti", e lo stesso network operativo sarebbe stato "più concorrenziale, promuovendo anche la crescita in intermodalità".

L'AAR non è d'accordo con l'ARC sul tema concorrenza. Spiega White: "Non penso ci sia bisogno di lamentarsi per una mancanza di concorrenza. Si deve soltanto guardare alla situazione attuale da un differente punto di vista. Non solo, infatti, le ferrovie già competono l'una con l'altra, ma competono anche con la strada ed il mare. C'è una sovrabbondanza di forze concorrenziali là fuori. E il punto è che se le tariffe ed i prezzi delle ferrovie sono troppo elevati, il cliente cercherà un'altra impresa sempre restando nell'ambito delle ferrovie, oppure sceglierà il trasporto via terra o via mare".

La Duff ha anche asserito che le ferrovie non usano le tecnologie in loro possesso abbastanza efficacemente per risolvere in modo adeguato i problemi di servizio. "Ogni camion oggi ha un sistema di monitoraggio globale, mentre le imprese ferroviarie riescono a malapena a rintracciare i propri convogli, che spesso sono anche lunghi circa un miglio. Le ferrovie utilizzano sistemi arretrati che non permettono loro di ottimizzare le potenzialità del proprio network. Noi pensiamo che invece le compagni ferroviarie avrebbero più di un incentivo per ottimizzare la capacità del proprio network. E poi, se le capacità sono così vincolate, non è inevitabile attendersi continui aumenti tariffari? Al momento attuale le ferrovie stanno solamente ignorando servizi e clienti", dice la Duff.

Un'iniziativa recentemente intrapresa dall'ARC. è stata la pubblicazione di una ricerca che valutasse l'impatto finanziario dell'accresciuta concorrenza e del miglioramento dei servizi per i clienti delle ferrovie. Si è ipotizzato uno scenario in cui il mercato ferroviario fosse ad elevata concorrenzialità. Si sono tratte tre specifiche conclusioni:

  1. I profitti netti sarebbero aumentati di circa 500 milioni di dollari dal 2005.

  2. Se, come avviene attualmente, la ferrovia non si prenderà cura delle esigenze dei suoi clienti, vedrà la propria crescita sicuramente limitata.

  3. L'intera industria ferroviaria ne uscirebbe più forte finanziariamente, ed i suoi clienti ne sarebbero più felici, e questo darebbe all'intero settore industriale la migliore opportunità di accrescere la sua quota di mercato e di soddisfare le aspettative finanziarie di Wall Street.

James J. Valentine, esperto analista della Morgan Stanley Dean Witter, non è però d'accordo con queste conclusioni. "L'accrescimento della concorrenza non aumenterebbe inizialmente il valore degli azionisti in quanto se così fosse gli azionisti lo avrebbero già chiesto", commenta.

La Duff sostiene che la STB americana (Surface Transportation Board), l'organizzazione federale che regolamenta gli aspetti commerciali dell'industria ferroviaria degli Stati Uniti, deve anche addossarsi di un po' della responsabilità per la carenza di concorrenza tra gli operatori ferroviari. E questo è particolarmente vero se si guarda alle recenti fusioni tra ferrovie negli States. "Non sentiamo mai l'STB parlare dei tremendi errori che vengono dalle fusioni. L'atteggiamento dell'STB è fare accadere tutto quello che deve accadere e stare a guardare e giudicare il risultato, semplicemente ignorando se si sta sbagliando qualcosa", dice la Duff.

White dell'AAR non concorda. Egli dice che il ruolo dell'STB è stato fin qui svolto con successo: "Bisogna ricordarsi che c'è un sistema regolatorio in uso in cui, se le tariffe del trasporto merci a mezzo ferrovia sono troppo elevate, si richiede subito una diminuzione. È questo uno dei ruoli dell'STB. I clienti possono fare ricorso se i prezzi non sono tenuti bassi dalla concorrenza".

Ciononostante, la Duff mette in luce il fatto che l'interessamento della STB a proposito dell'affare proposto da BNSF e CN poco è servito per tutelare i clienti delle ferrovie. "L'STB si è rivelato un organo regolatore la cui prima preoccupazione non è certo l'interesse dei clienti", dice la Duff. E la stessa decisione moratoria della STB di sospendere la fusione dei due colossi per 15 mesi non ha fatto nient'altro che "limitare l'opportunità per gli spedizionieri di vedere più chiaramente l'intera politica dell'industria delle ferrovie, mentre invece avrebbe dovuto portare più concorrenzialità nell'intero sistema".

Il fatto che BNSF e CN abbiano poi deciso di abbandonare i loro piani di fusione ha convinto poco la Duff, che ritiene che comunque non sia mutata la situazione per i clienti delle ferrovie in materia di concorrenza. "Sono abbastanza incerta intorno alla decisione di BNSF e CN di ritirare la fusione. Il maggiore disappunto è che ora che la divisione tra le ferrovie di primo livello è stata 'curata', non c'è molto spazio perché le nostre proposte vengano accolte", spiega. "Qualunque cosa fosse scaturita da questa situazione sarebbe stata molto limitata, e, perciò, non avrebbe risolto i problemi che i nostri membri hanno su più larga scala. Pertanto rivolgiamo la nostra attenzione all'STB per vedere se produrrà nuove regole sulle fusioni che apportino vantaggi alla concorrenza".

Nonostante l'ARC sia scettica sul fatto che la STB riuscirà a dare più concorrenza al mercato dell'industria ferroviaria americana nel futuro, la Duff rimane fiduciosa nel ritenere che l'ARC raggiungerà i suoi scopi. Ella ritiene che la via giusta da seguire sia la seguente: "Per quanto ci riguarda, è il Congresso USA che farà la differenza. La politica ferroviaria non attirerà la candidatura di nessuno. Guardiamo in faccia alla realtà: la ferrovia non è un argomento 'caldo', non è mai stato portato al livello al quale i consumatori capiscono le implicazioni per la loro vita delle politiche ferroviarie. Comunque, molti consumatori stanno sperimentando perdite in vetture e merci. E si accorgono che questo danneggia in qualche modo i loro affari, limita la loro produttività, a causa di stabilimenti e fabbriche chiuse e personale in continua riduzione. Lentamente anche il Congresso si sta accorgendo di ciò ed i politici si stanno rendendo conto che forse qualche problema c'è veramente".

L'AAR, però, sostiene che le ferrovie stanno già lavorando molto su questo punto. "Viviamo in un mondo altamente concorrenziale", spiega White, "e le ferrovie si stanno dando da fare con i loro clienti per raggiungere degli accordi soddisfacenti per risolvere i problemi, in particolare riguardo alle carenze nella concorrenzialità".

Comunque, l'ARC dice che continuerà a far sentire la sua voce prima del Congresso e dell'STB. In vista del fatto che quest'organizzazione ha più di due anni per raggiungere i propri scopi, non è ancora possibile vedere che differenza, se mai ce ne sarà una, l'ARC farà nel portare più concorrenza nel mercato dell'industria ferroviaria americana.

Lo scopo dell'ARC è ottenere più concorrenza nell'industria del trasporto merci ferroviario grazie a cambi nella legislazione. L'ARC spera di ottenere il tutto in 5 anni, dopodiché si scioglierà.

  2. Perché, secondo l'ARC, c'è bisogno di più concorrenza? Per svariate ragioni:
    a) La concentrazione delle industrie nel settore ferroviario in USA ha implicato un decremento nel numero degli operatori Class One da 42 nel 1980 a solo 4 nel 1999. Queste 4 stanno attualmente esercitando un oligopolio, chiudendo alcune linee e stazioni secondo il loro proprio tornaconto.
    b) Le 4 majors generano oltre il 94% delle entrate dell'intero settore.
    c) Se si continuasse con tutte queste fusioni, si produrrebbe un sistema di quasi monopolio e la concorrenza verrebbe virtualmente eliminata.
    d) Molti utenti delle ferrovie sono costretti ad usare una sola linea e sono imprigionati in prezzi e tariffe ingiustamente più alte del 30% almeno.
    e) L'industria ferroviaria sarebbe più forte finanziariamente ed i suoi clienti più felici se si introducesse la concorrenza. I profitti netti del comparto da soli infatti crescerebbero dei almeno 500 milioni di dollari a partire dal 2005.
    f) L'aumento di concorrenza porrebbe meglio l'attenzione sulle esigenze dei clienti delle ferrovie e ne stimolerebbe crescita ed efficienza dei servizi.
    g) La situazione attuale del mercato ferroviario non permette libertà di scelta ai clienti, né fa i loro interessi.
    h) La legislazione odierna non è preparata all'evoluzione del mercato ferroviario così come si sta prospettando oggi a causa delle continue fusioni, e non è nemmeno preparata per un ingresso della concorrenza nel mercato delle ferrovie.
