La politica portuale europea

Quando la Commissione Europea fece circolare un libro verde sui porti europei nel 1997, l'iniziativa venne accolta assai favorevolmente come una opportunità di creare finalmente un campo di gioco livellato tra queste importanti porte d'accesso al continente.

Oggigiorno, tutti i porti si accusano reciprocamente di concorrenza sleale finalizzata a dirottare i carichi dal proprio corso naturale. Da allora, pochi disegni di legge hanno provocato un dibattito altrettanto acceso, ed il processo in questione è ben lungi dall'essersi concluso.

Per capire il conflitto in atto, può essere utile partire dal presupposto che non tutti i porti dell'Unione Europea sono gestiti allo stesso modo. Come dimostra la Tabella 1, alcuni appartengono ancora (e sono da loro gestiti) a monopoli di stato (Bremerhaven), mentre altri appartengono a (e sono gestiti da) monopoli privati (Felixtowe). Alcuni altri, come Rotterdam, appartengono a proprietari a controllo pubblico, ma sono stati concessi ad una varietà di operatori pubblici e privati, laddove le autorità portuali provvedono alle banchine ed al dragaggio, mentre gli affittuari pensano a tutto il resto. Tutti quanti, inevitabilmente, assumono posizioni diverse quanto alla concorrenza.

I cambiamenti fondamentali in seno alla Commissione Europea che hanno provocato contrarietà in molti consistono nel fatto che, invece di concentrarsi sulla concorrenza tra i porti, come si prefigurava in origine, l'unico disegno di legge contenuto nel pacchetto portuale concerne la concorrenza nell'ambito di ciascun porto. La decisione è stata infine annunciata nel "pacchetto portuale" proposto dalla Commissione Europea a febbraio del 2001, in seguito ad ampie consultazioni tra tutte le parti in gioco.

Wolfgang Elsner, dirigente dell'unità porti e cabotaggio marittimo della DG TREN (Direzione Generale Trasporti ed Energia) in seno alla Commissione Europea commenta: "Ciò che si deve ammettere è che quando si tratta di un libro verde, sono le sue caratteristiche a gettare sassi nello stagno, dopo di che non resta che vedere quello che succede. All'inizio, abbiamo tirato fuori un sacco di idee sulle quali tutti quanti sono stati chiamati a fare le proprie osservazioni. Date le questioni sul tappeto, era inevitabile che alla resa dei conti finissimo per scontentare qualcuno. Ma i cambiamenti sulle sostanza delle cose che proponiamo adesso non sono fondamentali se confrontati con le cose che abbiamo già discusso. Intendiamo ancora dialogare circa la questione dei finanziamenti statali tra i porti come è previsto nel dettaglio del pacchetto portuale, oltre alla trattativa in merito alla concorrenza interna".

La differenza fondamentale, tuttavia, è che il suo cosiddetto "pacchetto portuale" adesso cercherà solamente di affrontare la questione dei finanziamenti statali concessi agli operatori portuali. Esso, invece, non si occuperà della più controversa questione di come debbano essere finanziati gli investimenti in infrastrutture generali pubbliche. In termini di cassa, la prima rispetto alla seconda fa la figura delle noccioline.

Precisa Elsner: "Qui si fronteggiano due filosofie. Una è quella secondo cui gli investimenti in infrastrutture generalmente accessibili all'interno dei porti dovrebbero essere trattati come gli investimenti in strade, e pertanto finanziati dal portafoglio pubblico, facendo sì che possano essere utilizzate da tutti. Questo è, ad esempio, l'approccio seguito in Germania, Olanda, Francia, Italia e, fino ad un certo punto, Belgio".

Continua Elsner: "Poi esiste un'altra filosofia secondo la quale i porti dovrebbero essere gestiti come un'attività commerciale, compresa la necessità di reperire finanziamenti per gli sviluppi infrastrutturali nell'ambito di ciascun porto. Questa è la linea seguita da paesi come il Regno Unito, la Spagna, la Norvegia, la Svezia, l'Irlanda (in parte), il Portogallo (in parte) ed il Belgio (in parte). In questi casi, poi, esiste una differenza tra il Regno Unito, in cui molti grossi porti appartengono a privati, ed il continente, in cui invece appartengono ancora a proprietari pubblici".

La Commissione Europea ha infine deciso di sottrarsi alla scelta ritenendo che ciò avrebbe equivalso più o meno a scegliere una religione tra due fazioni in guerra. Lamenta infatti Elsner: "Avevamo dei dubbi che ciò fosse possibile. Ma ci sono altri modi di affrontare il problema. In primo luogo potremmo finire per lasciar perdere ed accettare il fatto che il mondo non è perfetto, ammettendo che la tendenza degli ultimi anni, in ogni caso, è nel senso che un numero sempre maggiore di porti si sta trasformando in strutture commerciali".

Continua Elsner: "La seconda via è quella di affrontare di petto la situazione mediante l'introduzione di un appropriato sistema di tariffazione completa. Se ci fosse un sistema simile per tutte le modalità di trasporto in seno all'Unione Europea, strada e ferrovie comprese, non ci sarebbe motivo di preoccuparsi circa il reperimento di fondi. La Commissione Europea è intenzionata a fare una proposta al riguardo il prossimo anno, ma non possiamo cominciare proprio dai porti perché per noi sarebbe come spararci sui piedi. La piena tariffazione probabilmente renderà più costosi i trasporti. In un momento in cui stiamo cercando di dirottare una quota maggiore di traffico dalla strada all'acqua, non sarebbe saggio cominciare proprio dai porti".

Ma, nel passaggio da questo campo di battaglia a quello della concorrenza all'interno nei porti, la Commissione Europea sembra essere caduta dalla padella nella brace. Sin dall'annuncio della decisione a febbraio dello scorso anno, essa ha dovuto reggere l'urto delle ondate di lamentela da parte di quei porti che più probabilmente ne subiranno le conseguenze, per quanto talvolta celate in parte dalle graziosità del linguaggio diplomatico.

La parte del "pacchetto portuale" che in particolare ha infiammato molti operatori portuali del Regno Unito e dell'Europa settentrionale consiste nella necessità di avere almeno due operatori terminalistici per ciascun porto primario, a meno che non siano da prendersi in considerazione circostanze speciali. Il che non equivarrebbe a dire che devono per forza essercene due, ma solamente che agli altri operatori terminalistici dovrebbe essere concessa una opportunità concreta di competere in quei porti in cui la concorrenza al momento è impedita, nel caso dovessero richiederlo. E' questa la situazione di Amburgo, Lubecca, Kiel, Bremerhaven, Rotterdam, Felixtowe, Southampton e Thamesport.

I favorevoli a questa iniziativa comprendono la ECSA (Associazione Europea delle Comunità degli Armatori) e lo ESC (Consiglio dei Caricatori Europei), oltre a quei porti che già sono allineati a questa linea di pensiero. I contrari comprendono invece i porti e gli operatori terminalistici che con tutta probabilità dovranno subirne le conseguenze, rappresentati in parte da organizzazioni-ombrello come la Feport (Federazione degli Operatori Portuali Privati Europei), la ESPO (Organizzazione Europea Porti Marittimi), ed il Raggruppamento Porti Primari del Regno Unito. Anche la ITF (Federazione Internazionale Lavoratori Trasportistici) si è espressa con forza contro il provvedimento per quanto attiene alla sicurezza.

Così come stanno le cose adesso, le proposte della Commissione Europea, unitamente a diversi emendamenti, tra cui l'omissione dei servizi di pilotaggio, sono state appena approvate dal Parlamento Europeo. Le sue conclusioni, più le osservazioni della Commissione Europea su tali emendamenti, ora devono essere discussi dal Consiglio dei Ministri dei Trasporti dell'Unione Europea.

Ed è quella la sede in cui la questione diventerà davvero politica, poiché il settore dei trasporti potrà anche non essere di alto profilo, ma dispone di un sacco di voti elettorali nei paesi membri: il cibo e le bevande dei ministri. Mentre l'attuale presidente del Consiglio, che è belga, sembra avere poco interesse a definire la questione, il prossimo presidente (spagnolo) in carica da gennaio 2002 sembrerebbe invece intenzionato a portarla a conclusione.

Ci si deve, perciò, aspettare nei prossimi mesi un gran pigia pigia che vada dritto al cuore ed alla mente degli elettori. Commenta Elsner: "Non ci si rende conto che ci sta volendo così tanto tempo per arrivare ad una conclusione sul pacchetto portuale perché si devono tenere in considerazione approfondite discussioni prima che tutti lo comprendano - sempre che lo vogliano, naturalmente".

"Se si guarda allo scenario mondiale, si troverà uno sviluppo che comporta l'abbandono del vecchio sistema in cui lo stato è l'unico responsabile delle strutture portuali e dei suoi servizi, sia direttamente che indirettamente. Sta succedendo persino in Cina ed in Russia. Ma vi sono alcuni porti in Europa che ancora pensano che la vecchia via sia la migliore. Io non sono d'accordo. Perché ci dovrebbe essere la concorrenza tra venditori di giornali e non tra i fornitori di servizi portuali?".

Elsner scende quindi nei dettagli: "Guardate i porti italiani. Fino a non molto tempo fa, non avevano speranze, e Rotterdam era il principale porto containers per l'Italia. Ma poi hanno cominciato a darsi da fare e adesso non sono più gli ultimi d'Europa. Come hanno fatto? Rinunciando al controllo statale su tutto quanto e accettando ciò in cui gli italiani sono bravissimi, cioè la concorrenza. La stessa situazione ora più o meno esiste in Spagna. In breve, devo ancora riuscire a trovare una buona ragione perché la concorrenza illimitata tra i porti non debba esistere, mentre c'è in tutti gli altri settori".

Gli altri porti in cui vige la limitazione alla concorrenza interna chiedono rinvii in base alle più varie argomentazioni, tra le quali non ultima è quella consistente nella domanda: se l'attuale sistema non è guasto, perché ripararlo? I porti europei generalmente vengono considerati più efficienti e competitivi di quelli situati altrove. Patrick Verhoeven, segretario della ESPO, riassume questa posizione: "Non abbiamo alcuna obiezione rispetto al cambiamento, ma solamente laddove sia stata identificata una impellente necessità a farlo. Di conseguenza, bisogna ancora riuscire a persuadere molti dei nostri membri circa il fatto che tale necessità sia stata riscontrata".

A conferma di questa opinione, la Feport ha commissionato l'analisi sulle tariffe portuali mostrata nella Tabella 2.

Secondo John Dempster, direttore esecutivo del Raggruppamento Porti Primari del Regno Unito, i suoi membri non hanno ancora ricevuto un solo reclamo diretto dai propri clienti riguardo allo scarso livello dei servizi.

Elsner, tuttavia, dispone di argomentazioni per contrastare tutti questi punti di vista, affermando che c'è molta "disinformazione" diffusa in giro. Afferma infatti: "Tutto ciò che bisogna fare è studiare il recente studio sui colli di bottiglia nel cabotaggio marittimo, laddove risulta che un sacco di caricatori e di vettori marittimi si sono lamentati degli alti costi dei porti europei e della loro inefficienza. I clienti vogliono avere la possibilità di scelta in ordine a coloro di cui intendono servirsi e sanno che la scelta deve avvenire tra soggetti che sono stati selezionati in modo trasparente".

Le risultanze del suddetto studio sullo short-sea contengono un'accusa nei confronti di molti porti, colpevoli di avere imposto servizi non necessari, oneri per servizi non resi, tariffe eccessive e non trasparenti basate su posizioni monopolistiche nonché condizioni di lavoro rigide e pericolose.

Lo ESC e la ECSA sono, con pochissime eccezioni, assai favorevoli al pacchetto portuale. Commenta Alfons Guinier: "Tempo fa, e precisamente nel 1998, in risposta al libro verde della Commissione Europea, sia lo ESC che noi avevamo dichiarato che occorreva incoraggiare i seguenti principi:

  • libero accesso al mercato
  • libera e leale concorrenza nell'ambito dei e tra i porti
  • posizioni monopolistiche non abusate ed eliminabili laddove possibile
  • servizi non imposti da comprovare
  • tariffazione leale e trasparente
  • adattamento delle prassi lavorative.

Pensiamo che tali principi siano ancora attuali e ci piacerebbe vederli applicati appena possibile".

In relazione al confronto tra le tariffe portuali, Elsner ribatte: "E' sempre pericoloso confrontare i porti poiché essi hanno strutture tariffarie differenti. Se si vogliono confrontare i porti, bisognerebbe esaminare tutte le tariffe, comprese le tasse portuali sulle navi (che riguardano l'uso delle banchine e dei canali), sul pilotaggio, sul rimorchio e sull'ormeggio, perché talvolta le cose non sono sempre come sembrano. Quando si parla dei costi portuali, di solito si attira l'attenzione sui soli elementi che convengono".

Egli afferma, altresì, che Hong Kong e Singapore sono cattivi esempi di porti d'oltremare, essendo entrambi dei quasi-monopoli che attualmente perdono quote di mercato a favore di altri (v. Tabella 2). Le loro tariffe di movimentazione ai terminali possono anche essere più alte rispetto a quelle degli altri, ma i loro oneri su tutto il resto sono inferiori.

In relazione al fatto che nessuno si è ancora direttamente lamentato di specifici porti od operatori terminalistici in Europa, Elsner commenta: "Potrà anche essere così, ma si dovrebbe riconoscere che se qualcuno dovesse mai davvero lamentarsi formalmente, ci potrebbero volere da tre a quattro anni per risolvere i conseguenti problemi legali. La gente non dispone proprio di tutto questo tempo da perdere. Hanno bisogno di risposte in tre/quattro settimane o mesi, non anni, perché alla fine di quel periodo il mondo potrebbe essere un posto molto diverso".

Come già detto, la ITF è un altro organismo che ha sollevato parecchie obiezioni nei confronti del pacchetto sui porti della Commissione Europea. Al fine di fornirne una dimostrazione, dal momento della sua pubblicazione sono state organizzate dai portuali di diversi porti un paio di giornate di protesta. Ci si preoccupa del fatto che i parametri di sicurezza potrebbero essere sacrificati se la concorrenza portuale sia interna che esterna dovesse divenire troppo intensa, più o meno allo stesso modo in cui adesso alle navi sub-standard viene permesso di entrare in ed uscire da certi porti, a dispetto dei controlli che teoricamente esistono al fine di evitarlo. L'organismo suddetto afferma altresì di non essere stato consultato nelle forme dovute.

Commenta Elsner: "E' cosa del tutto falsa dire che noi non abbiamo consultato i sindacati in relazione al pacchetto portuale. Li abbiamo invece consultati in parecchie occasioni. Solo perché le nostre proposte non sono al 100% in linea con le loro richieste, ciò non costituisce una mancanza di consultazione, a meno che questa non sia la loro definizione di consultazione".

Continua Elsner: "Rispetto ai futuri standard di sicurezza, la direttiva afferma esplicitamente che le regole inerenti alle attuali strutture di sicurezza dovrebbero restare in vigore. Tuttavia, questo non ha impedito ai sindacati di lamentarsi del fatto che i datori di lavoro saranno liberi di scegliere i loro dipendenti. Tale situazione già esiste oggi. Essa non dice che i primi possono far entrare chiunque nei porti. L'autorità portuale avrà ancora la facoltà di stabilire i criteri ai sensi dei quali la gente potrà essere assunta nei porti. Di modo che, se l'autorità portuale oggi è contenta di impiegare dei vaccari, potrà farlo anche domani".

A partire dal voto del Parlamento europeo del 14 novembre, un certo numero di operatori terminalistici privati, tra cui la Hutchison Ports, ha nuovamente chiarito che a meno che - e finché - il pacchetto portuale non venga modificato dal Consiglio dei Ministri dei Trasporti, i futuri investimenti in infrastrutture esistenti saranno a rischio, mettendo di conseguenza a rischio posti di lavoro. La ITF, dal canto suo, ha chiarito che ci si dovrà aspettare un numero maggiore di scioperi.

Se mai esistono questioni destinate a rivelare di che pasta sono fatti i ministri dei trasporti, questa promette di esserne una.
