La sicurezza nel trasporto di prodotti alimentari negli U.S.A.

Nel contesto del rafforzamento della sicurezza in seguito agli attacchi terroristici dell'11 settembre 2001, le agenzie governative statunitensi stanno lavorando febbrilmente al fine di realizzare una salvaguardia contro i futuri atti di terrorismo. Per coloro che sono coinvolti nella catena delle forniture, la "regola delle 24 ore" è forse la più conosciuta di tale iniziative. Ma tutto ciò, parrebbe, non era ancora nulla: milioni di spedizioni potrebbero essere interrotte se le ulteriori proposte inerenti al trasporto di alimentari dovessero essere approvate entro la fine del 2003.

Tali proposte derivano dalla legge sulla prevenzione e sulla risposta al bioterrorismo, approvata nel mese di giugno 2002. Questa norma è destinata a proteggere i consumatori statunitensi dalle interferenze terroristiche con le loro forniture di alimentari ed acqua e delega la U.S. FDA (Amministrazione Statunitense per gli Alimentari ed i Farmaci) a formulare la regolamentazione inerente alle comunicazioni preventive relative a tutte le spedizioni di alimentari importati negli Stati Uniti.

A questo riguardo, la FDA ha ricevuto circa 6 milioni di registrazioni in linea nel 2002, ciascuna relativa ad un diverso tipo di prodotto alimentare trasportato negli Stati Uniti, vale a dire il più significativo mercato di consumo del mondo. Dato che riguardano tutte le importazioni di alimentari e farmaci degli Stati Uniti, le proposte nella loro conformazione attuale si applicheranno altresì a carichi di trasbordo in transito nei porti statunitensi. In breve, i volumi coinvolti saranno enormi, il che impone ancora più imperativamente una soluzione percorribile.

L'impatto sulla catena delle forniture deriva dalle proposte contenute nel Titolo III (Protezione della sicurezza delle forniture di alimentari e farmaci). La norma che afferisce in modo maggiormente significativo la catena delle forniture è quella relativa alla necessità dell'avviso preventivo. La legge sul bioterrorismo sancisce che dal 12 dicembre 2003 occorra fornire un avviso preventivo in ordine a tutte le spedizioni di alimentari. In assenza di altre regole specifiche, il periodo di mancato avviso può andare da un minimo di otto ore ad un massimo di cinque giorni. Tuttavia, entrambe le norme in questione dovranno entrare in vigore dal 12 ottobre, dal momento che il Congresso statunitense richiede 60 giorni per rivederle. Lo stretto periodo previsto dalla legge non concede molto tempo alla FDA per prendere in completa considerazione le reazioni ricevute dal settore in questione e fornire una risposta soddisfacente.

Coloro che mettono a punto le politiche della FDA hanno cominciato a lavorare tenendo conto dei consigli di un piccolo gruppo di rappresentanti del settore nell'agosto 2002, chiedendo loro di formulare le proprie osservazioni, e domandando successivamente i commenti del settore una seconda volta. L'opportunità di presentare richieste è cessata nell'aprile 2003 e le reazioni sono state aspre.

I commenti un po' troppo critici sono insoliti per la FDA, che viene rappresentata come una "agenzia mamma-papà" e solitamente gode di un'immagine pubblica molto positiva. Un portavoce della FDA ha risposto che l'agenzia si aspetta un discreto numero di osservazioni rispetto alla legge sul bioterrorismo, dal momento che essa riguarda così tanti aspetti diversi dell'economia, sebbene egli non fosse in grado di fare commenti sul tono generale di quelli ricevuti.

Molti hanno fatto notare quanto queste proposte siano simili alla norma delle 24 ore e hanno effettuato pressioni sulla FDA affinché collabori più strettamente con il BCBP (Ufficio Dogane e Protezione Frontiere), le ex Dogane degli Stati Uniti. La NCBFAA (Associazione Nazionale dei Mediatori e degli Spedizionieri Doganali d'America) ha persino fatto pressioni per il ritiro delle attuali proposte a favore di una discussione più approfondita tra i due enti. La sua richiesta alla FDA affermava: " Questo non è certo il momento in cui le agenzie federali si possano mettere a combattere le loro guerre private a spese del pubblico". Un rappresentante del settore ha asserito che l'industria trasportistica ha già dovuto adattarsi in modo significativo: "E' come la goccia che ha fatto traboccare il vaso: non possono proprio continuare a caricare tutto su di lei".

Il punto cruciale della discussione verte sull'interruzione del flusso dei traffici. Nel settore trasportistico vi è la sensazione che la FDA non capisca l'impatto che tali norme potrebbero comportare. Le osservazioni presentate dalla NCCFAA alla FDA hanno criticato le proposte come "irreali ed indebitamente onerose". Tom Mathers, direttore delle comunicazioni della NCBFAA, ha asserito che, dal momento che la principale funzione dei suoi membri è quella di contribuire ad agevolare i traffici, interruzioni come queste "riducono la nostra efficienza". Chris Koch, presidente del WSC (Consiglio Mondiale dello Shipping), che rappresenta l'industria del trasporto marittimo di linea negli Stati Uniti, è un esempio tipico di ciò che il settore pensa al riguardo: "La norma, così com'è stata proposta, potrebbe comportare enormi problemi".

I tempi di esecuzione proposti dalla FDA costituiscono una questione particolare, data la natura deperibile di molte derrate alimentari. Gran parte del trasporto merci marittimo è già prevista nella regola delle 24 ore, che richiede che la nave rilasci informazioni 24 ore prima del carico (sebbene vi siano questioni pratiche in ordine alle imprese di importazione che devono riferire informazioni sul trasporto che potrebbero non avere, in particolar modo perché le rotte delle navi possono cambiare con breve preavviso). Tuttavia, il traffico frontaliero dai paesi del NAFTA non è compreso nella regola delle 24 ore.

Molte richieste inerenti alla nuova normativa sperano che vengano adottati periodi di tempo simili in relazione alla nuova proposta del BCBP sulla registrazione preventiva del manifesto inerente a strada e ferrovia. Il Consiglio Pesca del Canada è un organismo di caricatori che ha attirato l'attenzione sul problema dei prodotti freschi lasciati fermi per un giorno.

La FDA sostiene che il periodo di tempo proposto è necessario per reindirizzare gli ispettori della FDA verso i porti statunitensi che non sono dotati di una agenzia presente in modo permanente. Ancora, la AAEI (Associazione Americana degli Esportatori ed Importatori) nella propria richiesta suggerisce un preavviso preventivo di due ore, sulla base del fatto che il BCBP detiene il container fino all'arrivo degli ispettori della FDA. Senza dubbio perché frustrata dalla mancanza di coordinamento tra le due agenzie, la AAEI sottolinea: "La FDA ed il BCBP fanno parte della stessa pubblica amministrazione".

Le proposte della FDA si propongono qualche flessibilità nel consentire una modifica due ore prima, il che permette la precisazione di una stima, sebbene la natura del prodotto alimentare non possa essere cambiata radicalmente. Ad esempio, "pesce" potrebbe diventare "tonno", ma "pesce" non potrebbe diventare "mele". Tuttavia, gli importatori devono registrarsi alla FDA due volte, una con l'avviso preliminare e dopo con la modifica, il che aumenta il loro carico di lavoro. Inoltre, ciò non tiene conto delle spedizioni di prodotti freschi in consegna dove non vi sono acquirenti statunitensi. Per i vettori, la NCBFAA sottolinea che essi potrebbero non essere in grado di sostituire i carichi registrati che non sono pronti, il che avrebbe conseguenze sui costi dei vettori. Dal momento che gli spazi dei carichi subiscono delle maggiorazioni, tali costi passerebbero ai caricatori per mezzo delle tariffe applicate.

Le proposte della FDA rendono gli importatori responsabili circa le informazioni di registrazione negli avvisi preventivi, ed insistono sul fatto che ciò che viene richiesto è necessario per aiutare la FDA a rintracciare il prodotto alimentare indietro sino al coltivatore. Anche se ciò nella maggior parte dei casi è facilmente rintracciabile nelle registrazioni presso il BCBP , i critici della norma sottolineano che alcune informazioni non sembrano avere pertinenza con la sicurezza. Le osservazioni della AAEI si domandano quale sia la necessità della quantità: "200 kg di pesce fresco o di cipolle gialle sono più pericolosi di 160 kg?". Invece, l'Associazione Produttori Cioccolato indirizza l'attenzione sul problema di identificare i singoli piantatori di grani di cacao in una spedizione, dopo diversi trattamenti di miscela prima della partenza. Vi è la sensazione che si tratti di burocrazia governativa alla difesa di se stessa contro le accuse che potrebbero seguire ad un futuro attacco terroristico. Un rappresentante del settore ha dichiarato a Containerisation International: "Vi è la diffusa percezione che un sacco di questa roba non sia altro che una sorta di tenda da finestra".

La mancanza di chiarezza nelle regole proposte rafforza l'idea del settore trasportistico che la FDA non capisce come funzioni la catena delle forniture. Ad esempio, la concezione della FDA di "paese d'origine" è diversa da quella del BCBP e da quella dell'Organizzazione Mondiale del Commercio, il che potrebbe comportare la conseguenza che gli importatori debbano conservare due serie di documentazione: ciò non solo è poco pratico, ma rappresenta altresì un costo aggiuntivo.

Quale direttore dei trasporti del caricatore statunitense Herbalife, che spedisce circa 5.000 TEU all'anno complessivamente, Hudson Warren è particolarmente preoccupato circa le proposte della FDA. La Herbalife ha avuto alcuni problemi ad osservare la regola delle 24 ore, dal momento che l'agente si registra tramite il vettore (con qualche eccezione per spedizionieri e nvoccs). Tuttavia, non vi è chiarezza su quale parte abbia la responsabilità delle registrazione ai sensi delle regole proposte dalla FDA. Data la combinazione tra informazioni del caricatore e modalità di trasporto, né l'agente né il vettore potrebbero fornire una descrizione completa.

Molti nel settore risentono del lavoro aggiuntivo richiesto dal fatto di doversi registrare presso due diverse agenzie, in particolare poiché sia la FDA che il BCBP non hanno in programma - a quanto si può capire - l'integrazione delle due interfaccia elettroniche fino al 2005, malgrado le assicurazioni fatte di voler lavorare assieme. Dato il lento sviluppo dell'Ambiente Commerciale Automatizzato del BCBP, il finanziamento rappresenta un problema. Nel contempo, i racconti relativi a molteplici ispezioni da parte di agenzie diverse in posti in cui non è stato trovato nulla sono troppo comuni e vanno ad aggiungersi al generale sentimento negativo. Tuttavia, nel corso di aprile, la FDA si è incontrata con il BCBP ed i rappresentanti del settore sperano che ne derivi qualcosa di buono.

E c'è poi un altro anello della catena delle forniture che potrebbe essere spezzato dalle proposte nella loro conformazione attuale. Queste norme, infatti, potrebbero diventare un problema pressante per i vettori marittimi. Quando si ha a che fare con i carichi di trasbordo - ovvero con i carichi movimentati in attesa di sdoganamento attraverso gli Stati Uniti - non vi è nessun importatore o agente statunitense che si prenda la responsabilità di riferire alla FDA circa le merci. In questo caso, la FDA propone di imputare al vettore la responsabilità della relazione, rendendolo quindi assoggettabile a sanzioni.

Commenta Koch: "Il problema della regola della FDA consiste nel fatto che l'informazione che essa richiede non è per nulla quella presente sulla polizza di carico. Ciò che essi vogliono è un'informazione che il vettore non conoscerà mai: chi ha coltivato il prodotto, chi lo ha confezionato, non quale è stata l'origine della spedizione, ma l'origine delle merci stesse, vale a dire il relativo codice alimentare della FDA: un'informazione che noi non saremo mai in grado di avere".

Dal momento che lo scopo dichiarato della norma è quello di proteggere i consumatori statunitensi, il Consiglio Mondiale dello shipping ritiene che questa informazione non sia necessaria, dal momento che i carichi di trasbordo non sono destinati gli Stati Uniti. Il BCBP già provvede al monitoraggio delle spedizioni in attesa di sdoganamento che entrano ed escono dal paese.

Tuttavia, se le proposte dovessero andare avanti così come sono, le conseguenze per i traffici potrebbero essere serie. Koch si domanda se i vettori possano evitare tale peso: "Si dovrebbero semplicemente respingere i prodotti alimentari che ricadono in questa categoria e poi riuscire a capire come movimentarli".

Ciò comporterebbe non solo notevoli costi per i caricatori, ma altresì serie conseguenze per le attività di trasbordo dei porti statunitensi. L'intenzione della FDA di trattenere nel porto d'ingresso i carichi in arrivo senza avviso preventivo potrebbe già comportare un ulteriore intasamento presso i porti statunitensi la cui capacità è già al limite (a differenza della regola delle 24 ore, ai sensi della quale i carichi rifiutati non arrivano neanche negli Stati Uniti). Riguardo poi al trasbordo, si potrebbero perdere notevoli attività, dal momento che i vettori non farebbero altro che modificare le loro rotte evitando i porti degli Stati Uniti.

E' ovvio che la FDA dovrà tener conto di un bel po' di commenti critici nel formulare le regole definitive. Koch del Consiglio Mondiale dello Shipping conclude: "Chiaramente, la FDA non ne capisce granché di traffici marittimi internazionali e di come essi funzionino, ma, dopo che avranno letto i commenti e li avranno presi in considerazione, sono ottimista circa la possibilità che li si possa convincere che tali regole non sono qualcosa che sia possibile portare avanti".

Nessuno discute la necessità di sicurezza, in particolar modo negli Stati Uniti. Ma, dato il periodo di tempo per lavorare concesso dalla legge, la FDA sarà in grado di imporre i propri vincoli ai consumatori statunitensi, consentendo nel contempo alla catena delle forniture di funzionare?
