Sentimenti contrastanti sul regime dell'immunità anti-trust per la navigazione di linea

Com'era stato ampiamente annunciato nel corso degli ultimi mesi, con la pubblicazione del regolamento del consiglio della Commissione Europea n. 1419/2006 che sostituisce la 4056/86, l'immunità anti-trust nei traffici di linea da e per l'Europa sarà abolita a partire dal prossimo mese di ottobre.

L'economista ed accademico esperto in materia di navigazione marittima dr. Rawindaran Nair ha sottolineato, nel contesto di un'analisi di questo sviluppo: "Con l'abrogazione dell'esenzione dalla normativa dell'Unione Europea sulla concorrenza, il futuro appare difficile per i vettori globali, i caricatori e la logistica".

Una delle ragioni che il dr. Nair ha addotto a sostegno di questa affermazione consiste nel mantenimento dell'immunità anti-trust in altre parti del mondo.

Ha infatti dichiarato: "Gli Stati Uniti manterranno in vigore il proprio attuale regime ai sensi della legge sullo shipping del 1984, dal momento che esso solo recentemente, in seguito alla promulgazione dell'OSRA (legge di riforma della navigazione marittima) del 1998, è stata modificata con l'aggiunta di un certo numero di elementi relativi alla concorrenza.

Anche il Canada di recente ha rinnovato la propria normativa al riguardo e continua con un modello simile a quello statunitense.

In Australia, tuttavia, è in corso un processo di revisione che probabilmente sarà più prossimo all'approccio dell'Unione Europea e che sembrerebbe favorire l'annullamento dell'esenzione attualmente garantita ai sensi del regime sulla concorrenza in vigore".

Peter J. Gatti, vice presidente esecutivo della NITL (Lega Nazionale Trasporto Industriale), che rappresenta i caricatori con sede negli Stati Uniti, è entusiasta: "Anche la Commissione sulla Concorrenza in India ha chiesto al ministero della marina mercantile di abolire le conferenze marittime di linea.

Ciò comporterebbe conseguenze sulla più vecchia conferenza dl mondo, la IPBCC (India Pakistan Bangladesh Ceylon Conference).

La normativa sulla concorrenza è in fase di revisione anche in Cina".

La situazione negli Stati Uniti è leggermente diversa perché l'OSRA ha mantenuto l'immunità, anche se nello stesso tempo consente per la prima volta la negoziazione di contratti riservati tra vettori marittimi e caricatori.

Sembra che non ci sia alcuna intenzione da parte sia della FMC (Commissione Federale Marittima), sia del Congresso, di iniziare ad apportare modifiche alla legge sulla navigazione marittima del 1984.

Infatti, la OSRA è stata il risultato di anni di dibattiti e compromessi tra molte parti.

Non sorprende, perciò, che alcuni dirigenti di primo piano di vettori marittimi con sede negli Stati Uniti supportino la continuazione dello status quo.

Nel contempo, i caricatori e le loro organizzazioni si oppongono strenuamente alla continuazione dell'immunità anti-trust, che essi vedono come un anacronismo, in particolar modo in seguito agli sviluppi al riguardo in Europa.

Rivela Gatti: "In una dichiarazione rilasciata alla Commissione Europea lo scorso mese di novembre, la NITL, unitamente ad altre organizzazioni di caricatori, sotto gli auspici del Forum dei Caricatori Globali, ha chiesto che venissero introdotte delle modifiche alla normativa, al fine di allineare la navigazione marittima di linea agli altri settori industriali (che non dispongono di immunità anti-trust).

La domanda, adesso, è; quale impatto avranno i cambiamenti (implementati dalla Commissione Europea) sulla navigazione marittima tra gli Stati Uniti e l'Europa? La risposta è: non lo sappiamo".

Come si spiega in seguito, i caricatori hanno indicato una serie di ragioni a sostegno della loro presa di posizione.

I vettori marittimi, così come la FMC, peraltro, hanno una lista di ragioni a supporto della persistenza dell'immunità anti-trust, custodita nella OSRA.

Rivolgendosi alla Commissione statunitense per l'Ammodernamento dell'Anti-Trust, l'ex presidente della FMC, Steven R. Blust, ha dichiarato: "Ritengo che la legge sulla navigazione marittima e le sue recenti modifiche stiano funzionando nel modo inteso dal Congresso.

La OSRA ha rappresentato l'ammodernamento delle problematiche anti-trust da parte del Congresso in relazione alla navigazione marittima di linea ed agli operatori terminalistici marittimi degli Stati Uniti, nonché il più recente passo verso la deregolamentazione nel contesto di due decenni di ricerche, dibattiti e revisioni sui limiti dell'immunità anti-trust ai sensi della legge sulla navigazione marittima.

Le modifiche normative introdotte dalla OSRA hanno rimosso molte delle principali preoccupazioni che le parti coinvolte (caricatori, intermediari di trasporto marittimo, porti statunitensi, organizzazioni sindacali marittime statunitensi e vettori marittimi) avevano in merito alla originaria struttura normativa della legge del 1984".

Bob Sappio, vice presidente anziano della divisione traffici transpacifici della APL, dichiara: "Parlando a nome della comunità dei vettori, dico: se una cosa non è rotta, non ripararla.

La OSRA funziona; l'Europa è l'eccezione quanto all'abrogazione dell'immunità anti-trust, non la regola.

Solo perché in Europa hanno cominciato a fare così, non significa che sia la cosa giusta.

Prima, i caricatori non hanno mai avuto l'opportunità di scegliere servizi variabili secondo prezzi variabili presso i loro vettori marittimi.

La contrattazione riservata tra vettori e caricatori è estremamente produttiva.

Ho assistito ad un'evoluzione nelle relazioni vettore/caricatore.

Le trattative adesso vertono più sul servizio che su quale prezzo sarà applicato da Hong Kong a Long Beach.

Possiamo scrivere nei contratti quasi tutto ciò che ci piace, se ci sono spazi, le garanzie di viaggio o sull'equipaggiamento, ovvero le penalità per la mancata prestazione".

Continua Sappio: "Il TSA (Accordo Stabilizzazione Transpacifico), del quale fanno parte 14 vettori tra cui la APL, è un accordo inerente alle trattative, di modo che esso non dispone di alcune autorità sulla determinazione delle tariffe.

Tutto ciò che viene discusso tra i suoi membri, lo è su base volontaria e non vincolante".

Anche il WTSA (Accordo Stabilizzazione Transpacifico Direzione Ovest) è un accordo relativo alle trattative.

Esiste una sola conferenza al servizio dei principali traffici di linea est-ovest da e per gli Stati Uniti: il TACA (Accordo Conferenza Transatlantico).

Le tariffe istituite ai sensi di questa conferenza sono state utilizzate da una percentuale decrescente di caricatori che movimentano i carichi nel transatlantico dall'implementazione dell'OSRA e la conferenza sarà abolita in ogni caso con l'abrogazione del Regolamento 4056/86.

Blust apporta diverse altre ragioni a favore della continuazione dello status quo: "La limitata immunità anti-trust contenuta nella legge sul trasporto marittimo si estende agli accordi operativi dei vettori che migliorano l'efficienza e mantengono la concorrenza, fungendo da limitazione alle fusioni ed alle acquisizioni nel settore, nonché agli accordi inerenti ai terminal marittimi che promuovano l'efficienza del trasporto terrestre.

Questi ultimi accordi riducono i costi, agevolano i progetti finalizzati alla riduzione della congestione nelle città portuali ed attorno a loro, promuovono i provvedimenti per la pulizia dell'ambiente ed aiutano a reperire i finanziamenti per le infrastrutture vitali per il trasporto merci.

L'impatto di questa immunità è mitigato da diverse realtà: 1) la maggior parte dei questi carichi sono movimentati ai sensi di singoli contratti di servizio riservati, piuttosto che secondo tariffe individuali o stabilite dalle conferenze; 2) c'è una notevole concorrenza nel settore del trasporto marittimo; 3) gli accordi registrati presso la FMC sono a disposizione del pubblico; 4) questa collaborazione è assoggettata ad un consolidato sistema di normative, applicate da un'agenzia federale indipendente di comprovata esperienza (la FMC)".

Rispetto al punto 4), a seguito dell'inizio dell'indagine n. 25 da parte della FMC, nel 2003 è stata ulteriormente assoggettata a limitazioni la capacità dei vettori di discutere ed istituire tariffe.

La suddetta indagine è stata messa in moto da due organizzazioni di spedizionieri non operanti con navi che avevano chiesto alla FMC di prendere provvedimenti contro il TSA in relazione alle trattative sulle tariffe e sulle condizioni contrattuali di servizio che riguardano gli NVO; l'indagine si è poi allargata ai vettori marittimi.

Attenendosi alla decisione, i membri del TSA hanno concordato di astenersi da trattative o concertazioni sulla razionalizzazione della capacità di servizio, è stato proibito lo scambio di informazioni sulle specifiche dei caricatori inerenti ai contratti di servizio individuali e le trattative sulle tariffe o sulla capacità sono state limitate agli incontri registrati presso la FMC.

Un altro positivo sviluppo per gli operatori senza navi è avvenuto nel 2005, allorquando è stato loro consentito di stipulare contratti riservati con i caricatori loro clienti, ai sensi dei cosiddetti NSA (Accordi di Servizio NVOCC).

Sappio sottolinea i più recenti sviluppi nell'ambito del TSA da cui hanno tratto vantaggio sia i vettori che i caricatori: "Il TSA ha preso una strada diversa a partire più o meno dall'anno scorso.

Nel 2006 Al Pierce si è dimesso e l'organizzazione non ha più avuto un direttore esecutivo autonomo.

La direzione è tornata nelle mani dei vettori, con una comitato esecutivo che gestisce il TSA.

Noi cerchiamo di condividere le informazioni sulle complesse questioni che adesso si agitano nel nostro settore, come la sicurezza e l'ambiente, così come i costi in aumento, tra cui quello del carburante diesel marittimo, che è quasi raddoppiato lo scorso anno sino a quasi 500 dollari USA alla tonnellata.

Il TSA ha anche coinvolto i caricatori; nel 2007, per la prima volta, abbiamo avuto forum con la partecipazione di membri del TSA e caricatori, al fine di discutere, fra l'altro, che cosa il TSA dovrebbe fare di diverso.

Dieci anni fa, questo sarebbe stato inimmaginabile, mentre adesso questo percorso è consentito alla luce del nuovo regime.

L'evoluzione prosegue in modo positivo ed io ritengo che chi volesse cambiare il regime dovrebbe assumersi l'onere di dire che cosa c'è di sbagliato in esso e quanto sarebbe migliore il cambiamento".

Tra i fautori dell'abrogazione dell'immunità anti-trust negli Stati Uniti c'è il gruppo lobbistico AgTC (Agricultural Transportation Coalition), che ha sede a Washington.

Il suo direttore esecutivo, Peter Friedmann, riconosce come la capacità dei caricatori e dei vettori di stipulare contratti riservati, a partire dall'entrata in vigore dell'OSRA, sia stato un fattore positivo per il settore.

Afferma peraltro Friedmann: "La fissazione congiunta di prezzi non è mai una cosa buona per l'economia.

La posizione della AgTC è che i vettori marittimi dovrebbero sottostare alle stesse regole sulla concorrenza di qualsiasi altro settore industriale negli Stati Uniti fatta eccezione per la lega principale di baseball, così come di tutta l'industria ai sensi della normativa europea a partire da ottobre 2008.

Nel suo enunciato in vigore, la legge sul trasporto marittimo sancisce che i vettori marittimi possono accordarsi per trattare le offerte contrattuali o regolamentare le tariffe di trasporto e le altre condizioni di servizio.

I vettori possono mettere assieme o attribuire le entrate, i guadagni o le perdite dei traffici tra loro.

Essi possono impegnarsi reciprocamente in relazioni esclusive o di collaborazione nelle proprie attività, nonché controllare, regolamentare o prevenire la concorrenza nel trasporto internazionale.

Ovvero, essi possono trattare e concordare qualsiasi questione correlata ai contratti di servizio.

Questo è quanto la legge dice e noi stiamo discutendo le modifiche di tali provvedimenti.

Alcuni dicono di non fare queste cose; ma, dal punto di vista dell'applicazione dell'anti-trust, se non si fanno queste cose, allora perché lottare per conservare quei privilegi?".

Friedmann prosegue nel discorso chiedendosi la validità o la pertinenza, nell'attuale mercato della navigazione di linea negli Stati Uniti, di alcuni obiettivi della politica economica marittima del paese istituita dal Congresso mediante la legge sul trasporto marittimo a supporto dell'immunità anti-trust.

Dichiara infatti: "Secondo la norma in questione, la politica consiste nell'assicurare un sistema di trasporto che sia in armonia con e che dia risposte alle prassi trasportistiche internazionali.

La Commissione Europea, peraltro, ha modificato le proprie prassi in ordine alla capacità dei vettori di istituire congiuntamente le tariffe.

Anche la nostra politica ha quale obiettivo l'incoraggiamento dello sviluppo di una flotta di linea battente bandiera statunitense solida dal punto di vista economico.

Queste argomentazioni erano state espresse da vettori in precedenza appartenenti ad armatori statunitensi: la originaria US Lines, la Sea-Land, la Lykes Line e la APL quando aveva sede ad Oakland.

In terzo luogo, la politica è finalizzata a promuovere la crescita e lo sviluppo delle esportazioni statunitensi mediante un trasporto marittimo competitivo ed efficiente.

Le esportazioni statunitensi sarebbero cresciute più di quanto non abbiano fatto, se non avessero avuto a che fare con l'istituzione collettiva di prezzi, eccetera?

Probabilmente sì, dato che una maggiore concorrenza comporta sempre un servizio superiore".

Friedmann sottolinea altresì la slealtà dell'immunità dei vettori nel contesto di altri segmenti del mercato statunitense del trasporto marittimo: "La UPS, la FedEx, la DHL e la Kuehne+Nagel non hanno alcuna immunità anti-trust.

Né loro od altri operatori senza navi o fornitori di logistica per conto terzi possono mettersi assieme e parlare dei clienti, dei porti serviti o degli aerei o delle navi con cui effettuano operazioni.

I vettori marittimi hanno dichiarato che gli enormi investimenti hanno necessità di essere protetti e che la capacità deve essere indirizzata dov'è necessario.

Allora, la FedEx e la UPS hanno chiesto: "Che dire della nostra flotta di aerei?".

Andrew Gillespie, direttore dei trasporti presso la Ansell Healthcare, con sede a Red Bank, nel New Jersey, che spedisce oltre 10.000 TEU all'anno, commenta: "Il settore dei vettori marittimi è assai maturo, contenendo in sé società con grandi risorse che sanno come competere.

Esse non hanno più bisogno che il TSA od il TACA le aiutino a decidere i punti di riferimento inerenti a quali aggiustamenti sui prezzi e sui sovrapprezzi effettuare sei mesi prima.

Io sono il cliente e socio del vettore: possiamo vedercela fra noi, nella nostra qualità di soci nell'attività, ed effettuare gli aggiustamenti quando si dimostra necessario".

Pertanto, come avviene in Europa, continuano ad essere sostenute opinioni contrastanti sia a favore sia contro la persistenza dell'immunità anti-trust negli Stati Uniti; al momento attuale, peraltro, nessun cambiamento allo status quo sembra probabile.
