L'indovinello dei consorzi marittimi

Chiunque avesse pensato che il conflitto normativo tra vettori marittimi e caricatori nell'ambito dell'Unione Europea sarebbe finito con l'abolizione delle conferenze di linea il 17 ottobre 2008, dovrebbe adesso ripensarci.

La revisione della Commissione Europa sul modo in cui i vettori marittimi concorrenti attualmente congiungono le forze nei consorzi presenta tutti i crismi di un altro prolungato dibattito, con pericolose conseguenze.

Sebbene la Direzione Generale per la Concorrenza della Commissione Europea abbia recentemente chiarito di ritenere ancora che i consorzi siano una buona cosa per i caricatori, sembra che questa volta stia per essere intrapresa una valutazione molto più rigorosa del regolamento 823/2000, rispetto all'ultima superficiale revisione del 2004.

Il regolamento dell'esenzione per categoria definisce come le linee di navigazione possano suddividere lo spazio reciprocamente sulle proprie navi nei consorzi, quali la Grand Alliance o la CKYH Alliance.

Esso dovrebbe essere rinnovato ad aprile del 2010 ed in seguito solo quelle procedure che si riterrà che corrispondano meglio agli interessi dei vettori marittimi e dei loro clienti resteranno esenti dalle normali normative anti-trust.

Fabrizia Benini, funzionaria dell'unità trasporti della Direzione per la Concorrenza della Commissione Europea, ha dichiarato: “Il regolamento ha comunque bisogno di essere modificato, al fine di tener conto della fine delle conferenze di linea nell'Unione Europea nel prossimo mese di ottobre, di modo che il momento è quello giusto per rivedere anche le altre cose”.

Per dare il via alla procedura, all'inizio dell'anno scorso è stato inviato un questionario a tutte le parti interessate e adesso i ministri degli stati membri devono essere consultati in ordine a ciò che dovrebbe accadere prossimamente.

Precisa la Benini: “Ci si aspetta che il processo di revisione richieda molto tempo, il che spiega perché si è cominciato così presto.

Noi speriamo di riuscire a pubblicare una bozza di proposta fra settembre ed ottobre, una volta sentiti gli stati membri; quindi, gli operatori del settore avranno da quattro a sei settimane per rilasciare commenti.

Dopo di che, dovremo tornare nuovamente dagli stati membri, prima di essere in grado di pubblicare la versione definitiva del documento”.

Occorre non confondere la pubblicazione di cui si parla qui con le linee-guida definitive della Commissione Europea su come la normativa sulla concorrenza dovrebbe essere interpretata dai vettori marittimi una volta che le conferenze di linea saranno divenute illegali nell'Unione Europea il prossimo 17 ottobre, quando verrà abrogato il regolamento sulle esenzioni per categoria 4056/86, evento ugualmente atteso prima della metà di ottobre.

Come al solito, la Commissione Europea non svela le proprie carte sul proprio pensiero in ordine a come dovrebbe essere modificato il regolamento 823, ma non può essere irrilevante il fatto che la Commissione Europea sia stata recentemente incaricata di indagare sul modo in cui le navi rinfusiere operano nei pool non di linea, che non è disciplinato dal regolamento 823, e, secondo varie fonti del settore, pare che non le sia piaciuto tutto ciò che ha scoperto.

Altra cosa di rilievo è forse il modo in cui la Commissione Europea ha recentemente lanciato una consultazione pubblica sul funzionamento di un regolamento sull'esenzione per categoria in relazione al settore delle assicurazioni, che consente certi accordi di collaborazione fra compagnie di assicurazione, fra cui l'istituzione di condizioni politiche standard non vincolanti, lo scambio di informazioni statistiche per il calcolo dei rischi e la realizzazione di pool assicurativi.

Ciò premesso, sembra che i regolamenti sulle esenzioni per categoria siano molto più sotto i riflettori di prima.

Neelie Kroes, Commissario per la Concorrenza, fa notare: “Abbiamo bisogno di verificare come ciascuna esenzione per categoria funzioni in pratica e se ci siano spazi sufficienti per rinnovarla.

Gli specifici regolamenti sulla concorrenza per settore sono strumenti giuridici eccezionali.

Se devono esserci regole specifiche per un settore particolare (che assicurino l'immunità anti-trust), ho bisogno di convincermi che esse siano giustificate nel senso che apportino reali vantaggi alla concorrenza ed ai consumatori”.

L'argomento sta diventando particolarmente interessante nel settore di linea dato che, nelle loro risposte al questionario della Commissione Europea, i vettori marittimi membri della ELAA (Associazione Europea per gli Affari di Linea) hanno richiesto alcuni cambiamenti di ampia portata.

Quello di maggiore importanza si riferisce all'abolizione del tetto del 35% delle quote di mercato imposto a ciascun consorzio in ogni direttrice di traffico.

Il tetto era stato imposto dalla Commissione Europea al fine di evitare che i consorzi stabilissero una posizione dominante di cui si potesse abusare, di modo che la sua abolizione rappresenta una proposta intrigante.

Chris Bourne, c.e.o. della ELAA, commenta: “Ovviamente, maggiore sarà la quota di mercato che ai consorzi sarà consentito possedere, meglio sarà per tutti, dal momento che navi più grandi significano maggiori economie di scala ed un ambiente molto più salutare”.

Le navi certamente stanno diventando più grandi e le navi più grandi sono “più verdi”, di modo che Bourne non ha tutti i torti, ma i caricatori potrebbero senza dubbio interpretare la proposta come una minaccia alla gestione di una concorrenza libera e leale.

Se la cosa venisse accettata, portata alle sue estreme conseguenze, un consorzio potrebbe controllare tutte le navi presenti in una direttrice di traffico, creando così l'ambiente giusto per aumentare le tariffe di nolo mediante la fornitura della sola capacità appena sufficiente a far fronte alla domanda.

Tale prassi, alla fine, dovrebbe incoraggiare nuovi concorrenti ad intervenire, ma è dubbio che essi possano disporre di economie di scala bastevoli a porre una seria minaccia.

Al fine di agevolare l'analisi di come le attuali regole funzionino in pratica, la tabella in basso mostra il confronto fra i principali consorzi ed alcuni dei loro concorrenti che effettuano operazioni nella direttrice di traffico dall'Estremo Oriente all'Europa del Nord al 1° gennaio 2008, così come calcolato da Containerisation International nella sua indagine “Offerta e domanda future per i servizi di linea 2007-2009”.

Le quote di mercato per ciascun consorzio o ciascuna linea mostrano la percentuale della loro capacità navale rispetto al totale fornito da tutti i vettori marittimi e non la percentuale dei carichi trasportati, di modo che occorre trattare questi dati con molta cautela.

Il tetto alla quota di traffico imposto sulla percentuale di carico trasportato è parecchio più difficile da calcolare, dal momento che la definizione del mercato containerizzato complessivo in ciascun direttrice di traffico su cui si basa è aperta ad un'interpretazione assai lata.

Alcuni traffici possono essere containerizzati dal punto di vista commerciale solo quando le tariffe delle rinfuse diventano troppo elevate.

Si può sostenere che altri traffici, come lo sono alcuni carichi refrigerati, possano essere containerizzati solo in certi periodi della stagione.

Nel periodo di punta, normalmente decollano le navi refrigerate specializzate.

Si potrebbe anche sostenere che i veicoli assemblati potrebbero essere gettati nel calderone, essendo containerizzabili, anche se solo una frazione del totale viene movimentata in tal modo.

Un ulteriore problema sorge quando i carichi possono essere spediti da due regioni diverse, come dall'Europa centrale all'Europa settentrionale ed al Mediterraneo.

Ovviamente, maggiori sono le dimensioni che caratterizzano il calderone complessivo, maggiori saranno le dimensioni del tetto al 35% in termini reali.

Se tutti i carichi containerizzabili dovessero esservi gettati dentro, il 35% potrebbe crescere sino a ben oltre il 50% in termini reali in alcuni dei traffici più esili.

La ELAA ha altresì proposto che ai consorzi fosse più chiaramente consentito di condividere lo spazio con altri consorzi nelle medesime direttrici di traffico e che ai consorzi membri venisse permesso di scambiare slot con altre linee di navigazione in un'ampia varietà di altri modi.

Essa ha ottime ragioni per fare così, compreso il risultato consistente nel fatto che i caricatori conseguirebbero una copertura portuale di gran lunga migliore.

Essa sostiene che le navi stanno diventando più grandi, di modo che non tutti i porti possono essere serviti a causa dei limiti di pescaggio.

Anche la velocità delle navi oggi è in corso di riduzione a causa della necessità di risparmiare carburante, il che rende i tempi di viaggio fra alcune coppie di porti inaccettabilmente lunghi per tutta una serie di caricatori.

Entrambi i problemi possono essere risolti in modo conveniente mediante scambi di slot con altri vettori ed in effetti vengono regolarmente risolti in questo modo al di fuori dell'Unione Europea, dove le regole sulla concorrenza sono meno rigorose.

I vettori marittimi ribattono che il regolamento 823 è assai più rigoroso della normativa sulla concorrenza applicata nella maggior parte degli altri paesi, di modo che il rilassamento delle sue restrizioni potrebbe contribuire ad allineare maggiormente la normativa con le prassi globali.

Le cose potrebbero benissimo stare così, ma questa argomentazione non ha impedito alla Commissione Europea di vietare le conferenze di linea nell'Unione Europea stessa.

Vale la pena sottolineare che le conferenze di linea saranno ancora consentite in tutti gli altri paesi dopo il 17 ottobre 2008, il che permette l'istituzione di tariffe di nolo, in aggiunta alle quali gli accordi negoziati negli Stati Uniti possono esprimere raccomandazioni sugli incrementi dei prezzi e sui sovrapprezzi; tutto questo, va ben al di là di ciò che sarà consentito nei traffici da e per l'Unione Europea dal prossimo 17 ottobre.

I membri della ELAA altresì vorrebbero che la Commissione Europea prendesse in considerazione l'ipotesi di abolire il periodo massimo di 36 mesi rispetto al quale i membri possono essere vincolati ai consorzi, lasciandoli liberi di trattare l'un l'altro con minori impedimenti.

Quando questa regola venne introdotta, si era sostenuto che i membri avrebbero dovuto essere liberi di andare e venire dopo non meno di 36 mesi sulla base del fatto che la scelta dei clienti avrebbe allora avuto un'influenza pratica.

I vettori marittimi sostengono che, dal momento che molte delle loro navi vengono ora prese in leasing o noleggiate per periodi di tempo compresi fra gli 8 ed i 10 anni, i membri dei consorzi di conseguenza dovrebbero poter essere in grado condurre trattative fra loro.

Mettendo assieme tutte queste raccomandazioni, la ELAA ha dato ai caricatori molto da pensare al riguardo, di modo che sarà intrigante assistere a come la Commissione Europea reagirà alle sue proposte di normativa nei prossimi due mesi.

L'ESC (Consiglio dei Caricatori Europei), che rappresenta gli importatori ed esportatori europei, e la CLECAT, l'associazione europea dei servizi di spedizione, trasporto, logistica e dogane, supportano ancora il diritto dei vettori marittimi di continuare a lavorare assieme nei consorzi.

Tuttavia, nella loro richiesta alla Commissione Europea, essi hanno espresso un certo numero di preoccupazioni commerciali circa il futuro.

Ci sono state anche molte risposte presentate dai caricatori direttamente alla Commissione Europea.

Alla richiesta di commentare le controverse proposte della ELAA, Nicolette van der Jagt, segretario generale dell'ESC, ha risposto: “Ovviamente, siamo preoccupati, ma il prossimo passo in questo procedimento di revisione per la Commissione Europea sarà quello di valutare le risposte di tutti quanti e quindi di assumere iniziative di conseguenza.

Se ce lo verrà chiesto, faremo i nostri commenti in anticipo, ma altrimenti attenderemo le sue proposte prima di dire ancora qualcosa”.

Un importante caricatore ben conosciuto in Europa fa notare: “Detto tra noi, posso affermare di non essere d'accordo sulla revoca e persino sulla mera modifica delle soglie della quota di mercato quali sono oggi.

Sto ancora cercando di capire la logica secondo la quale la ELAA chiede che gli scambi di slot, le sostituzioni ed i noleggi di slot vengano inseriti nel contesto del regolamento sull'esenzione per categoria, ma ancora non mi sono fatto un'opinione in merito.

Lo stesso dicasi per il limite dei 36 mesi per gli accordi fra consorzi”.

Steven Cox, dirigente del trasporto merci marittimo globale della Heinz, importante produttore di generi alimentari, osserva: “Anche noi, allo stesso modo, non abbiamo obiezioni da sollevare nei confronti dei consorzi, ma dobbiamo far sì che qualsiasi revisione del regolamento 823 non si limiti ad assicurare ai vettori marittimi vantaggi simili a quelli delle conferenze.

La nostra reazione inziale a quello che è stato proposto dalla ELAA è il convincimento che vi sia più di una piccola allusione a ciò, sfortunatamente; perciò, stiamo aspettando con vivo interesse il prossimo passo della Commissione Europea.

Lo spazio è di sicuro degno di attenzione”.
