Gli assicuratori collaborano con gli operatori ed i fornitori di equipaggiamenti per eliminare alla radice i motivi delle richieste di risarcimento

Gli assicuratori stanno lavorando assieme agli operatori ed ai fornitori di equipaggiamenti allo scopo di migliorare la sicurezza del personale a terra, di far sì che le gru restino sui binari e di ridurre le domande di risarcimento.

Pur vantandosi di possedere la maggior parte dei caratteri di un'industria allo stato maturo, la containerizzazione su scala industriale conta in realtà su di un'anzianità di un solo mezzo secolo.

Peraltro, questo tempo avrebbe dovuto essere abbastanza per affinare a meraviglia le procedure operative.

La verità è che il risultato appare inadeguato, tanto che molti esperti affermano che - in termini di statistiche di sicurezza personale - essa si trova di un decennio o più arretrata rispetto a gran parte dell'industria pesante.

Questo obbliga il settore delle assicurazioni ad occuparsi a fondo dell'ipertrofia delle richieste di risarcimento, specialmente in un momento in cui i premi sono sotto pressione a causa della concorrenza, mentre i riassicuratori a loro volta domandano una disciplina più rigorosa della sottoscrizione.

Se ciò dovesse apparire difficile da accettare, si dovrebbe rammentare che nella maggior parte degli incidenti vi sono costi nascosti che le assicurazioni non risarciscono.

Dato il numero sempre maggiore di grossi assicuratori a caccia di lavoro, fra cui l'imponente Lloyd's ed altri operatori del mercato, un enorme bagaglio di competenze viene dedicato alla copertura portuale.

Sarebbe sorprendente, tuttavia, se tutti fossero diligenti come Laurence Jones quando si trovano alle prese con le domande di risarcimento.

Jones, direttore del dipartimento valutazione rischio globale del TT Club, ha analizzato oltre 1.800 richieste di risarcimento per danni a beni presentate nel corso degli ultimi due anni e mezzo.

Jones ha estratto ad una ad una le relazioni sulle richieste dai file elettronici reciproci e le ha messe da parte.

In quella che probabilmente costituisce la più rigorosa analisi di questo genere sino ad oggi, egli si è gettato a capofitto sui guai ed i problemi dei 400 porti e terminal presenti nel portafoglio-aziende del club.

Questa approfondita ricerca è servita ad identificare i fattori che hanno indotto gli errori da parte di uomini e macchinari sulle banchine, nonché a contribuire all'eliminazione delle cause.

"Ciò che non si può misurare, non si può gestire" afferma Jones.

Jones trascorre un bel po' di tempo a parlare con organismi quali l'Associazione Produttori Equipaggiamenti Portuali, che dalla sua costituzione nel 2004 ha accolto nel proprio seno molti importanti produttori.

La maggior parte delle problematiche, afferma Jones, è comune a tutte le operazioni terminalistiche; "la mia attenzione è rivolta a ciò che possa aiutare il settore".

Finora, Jones si era concentrato sull'esame dei danni fisici, piuttosto che sulle richieste di risarcimento per responsabilità.

I dati si basano su tutte le richieste relative a beni e si riferiscono a danni agli equipaggiamenti, alle infrastrutture ed alle navi.

Prima cosa da tener presente: il danno fisico spesso comporta una responsabilità.
Questo approccio è insolito nei circoli assicurativi, dove l'attenzione si concentra su chi possa essere indicato quale responsabile di un incidente.

Jones fa un passo indietro al fine di estrarre le radici delle cause di danno.

Poiché i sistemi computerizzati sono progettati per entrare nei particolari della responsabilità, Jones ha dovuto sezionare "manualmente" ciascuna richiesta di danno a beni in una corsa contro il tempo (da 5 a 10 minuti per documento).

Assieme ai suoi colleghi, Jones ha in programma lo sviluppo di un sistema finalizzato all'espletamento automatico di questa analisi, ma nel frattempo il catalogo dei guai di ordinaria amministrazione - veicoli e gru che ammaccano i box, navi che picchiano nelle banchine - viene riletto a più non posso.

"L'analisi dei danni ai beni consente di rendersi conto in modo realmente approfondito delle cause degli incidenti e degli episodi che avvengono e ci aiuta ad effettuare ulteriori ricerche sulle questioni operative" afferma Jones.

Talvolta, accade che una nave scardini una gru dal molo, una roba che si paga a caro prezzo visto che le unità nuove presentano un valore fra i 6 ed i 9 milioni di dollari USA; e le gru a terra possono perdere il controllo quando meno ce lo si aspetta.

Jones cita un incidente in cui il braccio di una gru da banchina aveva colpito una gru di una nave, con un danno di valore pari a 2 milioni di dollari.

La gru da banchina è rimasta fuori servizio sei mesi, accumulando notevoli costi correlati all'interruzione dell'attività.

Queste seccature sono quasi del tutto prevenibili mediante l'installazione di sensori anticollisione.

"Queste cose accadono in pressoché tutti i terminal del mondo con le gru per contenitori e per carichi generali" sospira Jones.

"Con una spesa di circa 10.000 dollari per i sensori, tali incidenti possono essere sicuramente evitati.

Molte grosse imprese indicano con precisione i sensori quando ordinano nuove gru, ma i produttori che quotano il prezzo migliore non sempre vi comprendono questa caratteristica di sicurezza.

Questa è una delle ragioni per cui lavoriamo a stretto contatto con l'associazione dei produttori al fine di condividere le informazioni e di incoraggiare l'adozione di tali supporti nello standard delle progettazioni".

Le principali cause degli incidenti di danno ai beni sono rimaste ostinatamente immutate nel corso degli anni.

A detta del TT Club, in cima alla lista ci sono i fattori operativo ed umano, che rappresentano il 79% di questo tipo di richiesta di risarcimento, malgrado l'esperienza, la tecnologia e la formazione disponibili.

In assoluto, le questioni operative od umane contribuiscono all'80-90% delle richieste di risarcimento.

Gli incidenti relativi alle straddle carrier hanno costituito solamente il 12% del numero delle richieste di risarcimento, ma hanno rappresentato il 29% dei costi.

Quando questi veicoli si ribaltano, spesso ne deriva una perdita totale per un costo di circa un milione di dollari USA.

Le guide delle cellule sono spesso un argomento del contendere, quando gli operatori della nave - come accade spesso - affermano che il terminal ha danneggiato le guide, mentre il terminal dichiara che le guide erano già danneggiate o inadeguatamente sottoposte a manutenzione.

In ogni caso, sussiste la necessità di una migliore formazione dei gruisti e ciò ha ancora più senso adesso che i simulatori sono meno costosi, dice Jones.

Gli spreader e le funi sono l'articolo più usato ed abusato dell'equipaggiamento di un terminal contenitori e devono subire la maggior parte delle richieste di risarcimento relative alla manutenzione (il 23% secondo il club).

Gli incendi causati dal carburante o dalle infiltrazioni idrauliche nelle straddle carrier e negli elevatori pesanti rappresentano la seconda voce quanto a numero di richieste di risarcimento per guasti e quella dai costi più elevati.

Il conto pressoché totale è il risultato delle infiltrazioni idrauliche nel motore.

L'installazione di sistema di spegnimento del fuoco in un camion fino a poco tempo fa costava circa 8.000 dollari, ma il club ha consigliato i propri membri di prendere in considerazione un nuovo sistema denominato Fire Foe (www.quick-fire.com) che provvede allo spegnimento degli incendi per una cifra prossima ai 500 dollari; la cosa può risultare persino più conveniente, dato che il club ha negoziato con il produttore uno sconto del 10% per i propri membri.

E che dire delle condizioni meteorologiche, che sono la rovina degli assicuratori ovunque?

Per tutti i porti, una tempesta rappresenta un problema, dato l'enorme numero di gru che volano via dai binari.

Talvolta sono gli operatori e le autorità portuali che non rinforzano gli ormeggi delle gru malgrado le previsioni meteorologiche, ma oggigiorno le tempeste e le raffiche di vento improvvise si verificano ovunque.

Mentre in passato i danni derivavano per lo più dagli uragani dell'Atlantico e dai tifoni e cicloni del Pacifico occidentale, adesso l'incidenza è divenuta casuale.

I costi delle richieste di risarcimento sono aumentati, in particolare in Europa.

Sebbene il numero delle richieste di risarcimento correlate alle condizioni meteorologiche sia aumentato leggermente nel corso degli ultimi tre anni, il loro costo si è più che triplicato.

Si richiedono migliori procedure di fissaggio e migliori sistemi di frenatura sulle gru.

Il TT Club sta attualmente rivedendo l'opuscolo sulle tempeste che aveva prodotto nel 2006, in collaborazione con l'ICHCA (International Cargo Handling and Coordination Association).

Jones afferma che ai dirigenti spetta il ruolo principale da svolgere per quanto attiene il miglioramento della sicurezza: "Tutti commettiamo errori e nessuna formazione, per quanto approfondita, potrà eliminare tutti gli errori.

Perciò, noi dobbiamo anche valutare quali procedure o modifiche tecniche possano essere messe in atto al fine di mitigare i rischi o fornire un supporto agli operatori ed ai gruisti".
Semplici provvedimenti possono produrre meraviglie: ad esempio, il cambiamento del flusso di traffico da due sensi a senso unico può far diminuire in modo clamoroso il rischio di incidenti per veicoli e pedoni.

Conclude Jones: "Tutti i terminal pensano di essere del tutto diversi dagli altri, ma tutti quanti hanno gli stessi problemi e spendono denaro per risolverli.
Se si riesce a continuare ad incoraggiarli a condividere tecnologie, idee e procedure, tutti tutti possiamo trarne vantaggi".
