II. LES RESULTATS DE LA GESTION

Trois critiques principales peuvent 'tre faites ' la gestion du domaine portuaire par les 'tablissements portuaires :

- les services responsables connaissent tr's mal l’'tendue, la consistance et la valeur du domaine ;

- ils ne l’entretiennent ni ne l’exploitent pour en tirer un gain 'conomique ;

- ils n’adaptent pas ce domaine g'r' aux besoins proprement portuaires.

A. - La connaissance du domaine

Malgr' les impr'cisions et r'serves ' faire sur la notion de domaine portuaire (cf. encadr' ci-dessous), il est possible de consid'rer qu'en 1995, le domaine des ports maritimes relevant de la comp'tence de l'Etat s''tend sur environ 35 000 hectares de surfaces terrestres et sur 258 000 hectares de plans d'eau ; la partie terrestre des emprises rel've majoritairement du domaine public.

La mesure du domaine portuaire

La notion de circonscription est le crit're de r'f'rence pour l'appr'ciation de la superficie du domaine des ports autonomes. Cette circonscription est d'termin'e par d'cret en Conseil d’Etat (article L. 111-3 du code des ports maritimes). Elle peut 'voluer dans le temps en fonction des besoins et comprend notamment les acc's nautiques.

La notion de d'limitation sert de crit're de r'f'rence pour l'appr'ciation de la superficie du domaine des ports d'int'r't national. La d'limitation des ports maritimes relevant de la comp'tence de l’Etat, du c't' de la mer, ou du c't' des terres, est r'alis'e par le pr'fet (article R.151-1 du code des ports maritimes). L' encore, cette limite est 'volutive. La superficie du domaine portuaire qui d'coule de cette notion est baptis'e limite administrative et toutes les acquisitions, r'alis'es par l'Etat ou son concessionnaire dans le cadre de la concession, sont incorpor'es au domaine public.

Ces p'rim'tres ne donnent cependant pas l''tendue effective du domaine portuaire relevant de la comp'tence de l'Etat. En effet, ils ont - notamment la limite administrative - une signification plus juridique qu''conomique. Il s'agit de l'espace dans lequel s'exerce les comp'tences de police portuaire d'finies par le code des ports maritimes.

Or, certaines parcelles de terrains incluses dans ces limites sont des terrains ' caract're priv' (terrains compris dans le p'rim'tre de cessibilit' des ports autonomes, incorporations pr'vues apr's acquisitions mais non effectivement r'alis'es, terrains d'class's ...), tandis que d'autres parcelles, bien qu''tant la propri't' des collectivit's publiques (terrains ayant ou non une vocation portuaire) sont hors des p'rim'tres pour diverses raisons. Au titre des terrains ' vocation portuaire hors p'rim'tres, on peut notamment mentionner ceux qui r'sultent d'erreurs dans la fixation des limites (Nantes-Saint-Nazaire) ou d'acquisitions post'rieures ' celle-ci (Marseille, Rouen).

En l'absence de cadastrage exhaustif du domaine des ports (par exemple ' Rouen o' plus d'un sixi'me des superficies ne sont pas cadastr'es), l''tendue du domaine portuaire, qui peut 'tre maritime et fluvial pour les ports d'estuaires, r'sulte pour partie d''valuations r'alis'es par les services portuaires ' la demande de la Cour, dont l'examen montre les d'faillances.

es ports autonomes

a) L’'tendue du domaine des ports autonomes

Sans m'sestimer les difficult's de suivre et de g'rer un domaine partiellement cadastr' et en constante 'volution, la Cour constate que les ports autonomes ne connaissent que tr's imparfaitement la consistance de leur domaine malgr' la pr'sence en leur sein de services sp'cialis's g'n'ralement bien dot's en personnel. L'enqu'te, fond'e sur l'estimation exhaustive de la situation territoriale des ports en 1985, 1990 et 1995, a mis en lumi're l'absence d'historiques fiables retra'ant la totalit' du domaine g'r' par les ports. Elle a ainsi permis de d'tecter d’importants dysfonctionnements internes au sein des ports autonomes.

La consistance effective du domaine g'r' par l'ensemble des ports autonomes n’a pu 'tre mesur'e. En effet, si les superficies g'r'es par les ports de Bordeaux, Marseille, Nantes-Saint-Nazaire, Rouen et de Guadeloupe ont pu 'tre d'termin'es avec une faible marge d'incertitude pour 1995, il n'en va pas de m'me pour celles des ports de Dunkerque et du Havre. En outre, la moiti' des ports autonomes n’ont pas su produire les donn'es demand'es pour 1985 et 1990. Pourtant, en application des prescriptions du d'cret du 29 d'cembre 1962 portant r'glement g'n'ral sur la comptabilit' publique, les 'tablissements publics ont l'obligation de tenir des inventaires de leur patrimoine selon des modalit's fix'es par le conseil d'administration dans le cadre de leur plan comptable particulier. La connaissance de leur patrimoine devrait passer par un meilleur r'colement entre l'inventaire physique et l''tat de l'actif comptable de l'ensemble des terrains.

Face ' ces difficult's d''valuation, les autorit's de tutelle n’ont produit qu’un 'tat des superficies fonci'res des ports autonomes dat' de f'vrier 1994 qui ne concorde pas avec les donn'es fournies ' la Cour par les ports autonomes. Elles m'connaissent donc la consistance du domaine portuaire, alors qu’il leur revient d’en fixer ou d’en modifier la d'limitation.

Le domaine g'r' par les ports autonomes en 1995

La superficie totale du domaine g'r' par les ports autonomes serait de l'ordre de 288 000 ha. La partie terrestre repr'sente approximativement 32 200 ha en 1995, soit pr's de 93 % de l''tendue du domaine des ports relevant de la comp'tence de l'Etat. Les terrains hors circonscription, qui s''tendent sur plus de 4 000 ha, soit 12% de la superficie terrestre, ont majoritairement vocation ' 'tre int'gr's dans les circonscriptions portuaires.

Les principales 'volutions depuis 1985

L''volution de la consistance du domaine des ports autonomes r'sulte principalement d'acquisitions et cessions, et plus marginalement de transferts de gestion, d''changes d'emprises et de terrains gagn's sur la mer (exondements). Aucune op'ration importante n'a 't' engag'e au cours de la p'riode 1985-1995, qui se caract'rise par une relative stabilit' globale du domaine g'r'. Les op'rations futures auront en revanche pour cons'quence de r'duire celui-ci.

Les modifications de la p'riode se sont faites principalement par des transferts de gestion peu nombreux, qui ont concern' des superficies relativement modestes, soit moins de 100 ha pour l'ensemble des ports autonomes. Ces transferts concernent des immeubles d'pendant du domaine public dont la destination est modifi'e. Les biens en cause, qui ne pr'sentent plus d'utilit' pour les ports, doivent conserver le caract're de domanialit' publique pour le nouveau gestionnaire. Les transferts concernant des emprises incluses dans les circonscriptions des ports qui leur ont 't' remises gratuitement par l'Etat lors de l'autonomie, sont majoritairement r'alis's au profit de collectivit's territoriales et ont, pour une part minoritaire, donn' lieu ' indemnisation.

Au titre des projets en cours on peut notamment mentionner deux transferts pr'visibles ' Marseille, l'un au profit de la commune de Martigues (20 ha), l'autre ' celui de l’'tablissement public Eurom'diterran'e (10 ha). A Nantes, un transfert de gestion en plusieurs 'tapes est pr'vu au profit du Conservatoire de l'espace et du littoral et des rivages lacustres dans le cadre de l'op'ration "plan Loire" d'cid'e en 1994. Il concernerait 1 512 ha de domaine public fluvial et devrait 'tre ult'rieurement compl't' par des remises de terrains priv's du port (375 ha). A Rouen, il est envisag' de transf'rer ' titre on'reux au domaine public routier la gestion de terrains situ's rive droite, concern's par le sixi'me franchissement de la Seine.

b) La r'partition juridique du domaine des ports autonomes

Si les plans d'eau, ou plus exactement leurs fonds terrestres, sont du domaine public, il n'en va pas de m'me pour les emprises terrestres qui peuvent relever soit du domaine public soit du domaine priv', pour les terrains appartenant ' l'Etat ou aux ports autonomes.

En r'alit', la situation juridique du domaine des ports autonomes est aussi mal connue par les 'tablissements que sa consistance et ses limites physiques.

Selon les donn'es produites par la DTMPL, qui diff'rent de celles fournies par les ports, le domaine public portuaire serait minoritaire : il ne repr'senterait que 15 545 ha sur les 33 995 ha d’emprises terrestres recens's. Cependant les incertitudes sont telles qu'il s'av're tr's difficile d'appr'cier la consistance du domaine selon son r'gime juridique. Le cas de Dunkerque est exemplaire de ces d'faillances : sur une superficie totale probable de 6 100 ha, la r'partition juridique des emprises entre le domaine public et le domaine priv' serait, selon le port, de 50/50. En revanche, selon la DTMPL, la r'partition est fort divergente : 20 % pour le domaine public et 80 % pour le domaine priv'.

Les situations juridiques du domaine sont tr's contrast'es d'un port ' l'autre. On observe ainsi que le domaine public est minoritaire ' Bordeaux (37 %) et ' Marseille (26 %), tandis qu'il est tr's sensiblement majoritaire ' Nantes-Saint-Nazaire (82 %) et ' Rouen (67 %), de m'me qu'au Havre, et en Guadeloupe.

c) La r'partition fonctionnelle du domaine g'r' par les ports autonomes

La r'partition fonctionnelle de l'ensemble du domaine terrestre g'r' par les ports autonomes en 1995 figure dans le tableau ci-apr's. Elle pr'sente un caract're tr's indicatif dans la mesure o' l''tendue m'me de leur domaine est incertaine et o' les crit'res fonctionnels des diff'rents ports peuvent sensiblement diverger et se modifier dans le temps. Quatre grandes cat'gories sont distingu'es : deux zones sont li'es ' l'activit', l'une regroupant les zones portuaires et les occupations spatiales li'es aux servitudes diverses telles que les voiries et les espaces verts, l'autre concernant les zones industrielles ; une troisi'me zone pourrait ' l'avenir changer de destination et regroupe les zones urbaines ; une quatri'me zone est constitu'e des r'serves fonci'res et naturelles.

En 1995, la part des r'serves est globalement majoritaire, celle des zones industrielles repr'sente moins de 30% du domaine, tandis que les zones urbaines sont relativement marginales.

Ce constat montre l’impact financier r'duit des mesures incitatives mises en place pour une meilleure int'gration ville-port, telles que la restitution de 90 % du produit des cessions fonci'res sous forme d’apports en fonds propres. Cette mesure d’ordre g'n'ral a 't' prise pour r'gler des probl'mes particuliers, comme l’op'ration Dunkerque-Neptune de r'habilitation urbaine du site portuaire des anciens chantiers de r'paration navale. Dans ce dernier cas d’ailleurs, elle n’a pas eu d’effet.

d) La valeur du domaine g'r' par les ports autonomes

Cette valeur peut 'tre estim'e gr'ce aux bilans des ports autonomes. En effet, si les terrains ont 't' remis aux ports gratuitement par l'Etat lors de l’octroi de l'autonomie, ils ont n'anmoins fait l'objet d'une estimation par le service du domaine de fa'on ' ce que celle-ci figure dans le patrimoine des ports. La valeur estim'e de ces emprises figure dans les bilans des ports autonomes en contrepartie du compte d'apports. Les actifs ont fait l'objet de r''valuations ' la fin des ann'es 1970 et les acquisitions r'alis'es par les 'tablissements sont enregistr'es ' leur co't historique d'entr'e.

Un tableau joint en annexe n' 6 consolide les valeurs bilantielles des ports autonomes m'tropolitains. La valeur historique du domaine a 't' appr'hend'e ' partir de la nomenclature comptable par le cumul des valeurs brutes en francs courants figurant aux comptes concern's.

En 1995, pour les ports autonomes m'tropolitains, la valeur historique moyenne brute comptable des terrains s''tablit ' 0,10 MF par hectare. En tenant compte des ouvrages d'infrastructure, elle ressort ' 0,19 MF par hectare. Ces valeurs patrimoniales sont purement indicatives. Elles reposent sur des superficies al'atoires, des montants non actualis's, et font abstraction de l'obsolescence des infrastructures r'alis'es qui repr'sentent 43 % de la valeur brute totale.

Les diff'rences de ces valeurs moyennes comptables sont relativement importantes d'un port ' l'autre. Ind'pendamment du fait que les superficies du Havre et de Dunkerque sont tr's incertaines, on constate que le domaine des ports normands est nettement plus co'teux que celui des autres ports, tant au niveau des valeurs initiales que des co'ts d'infrastructure. Il convient malgr' tout de pr'ciser que, selon les ports, les grosses r'parations sont ou ne sont pas immobilis'es.

Ces valeurs historiques comptables ne repr'sentent pas la valeur effective actuelle du patrimoine. Seule une estimation des emprises par les services des domaines permettrait de l'approcher.

2' Les ports d’int'r't national

a) Le domaine g'r' par les ports d’int'r't national

La consistance du domaine des ports d’int'r't national (PIN) est fond'e sur leurs limites administratives. La connaissance de la superficie totale du domaine qu’ils g'rent demeure tr's imparfaite. Toute 'valuation globale, incluant superficie terrestre et plans d'eau, s'est r'v'l'e impossible. Les renseignements produits ' la Cour (cf. tableau ci-apr's) sont incomplets, notamment ' Saint-Malo, Bayonne et Nice, voire inexistants en ce qui concerne les surfaces de plans d'eau.

En 1995, la partie terrestre du domaine des PIN repr'sente environ 2 500 ha, soit 7% de l'ensemble du domaine g'r' par les ports relevant de la comp'tence de l'Etat.

Depuis 1985, on rel've globalement une l'g're tendance ' l'accroissement (moins de 10 %) du domaine des ports d'int'r't national.

Le cas de Nice illustre les difficult's de recensement : la DDE mentionne une superficie totale de 9,83 ha jusqu'en 1990 puis de 8,41 ha, du fait d'un transfert de voiries urbaines pour 1,42 ha. Or ce chiffre diverge fortement de celui qui est inscrit dans la concession de 1978, soit 16,5 ha pour le port de Nice-C'te d'Azur.

b) La r'partition fonctionnelle et la valeur du domaine g'r' par les ports d’int'r't national

Le domaine des ports d’int'r't national, peu 'tendu comparativement ' celui des ports autonomes, est essentiellement d'di' ' l'exploitation portuaire. Ces ports qui n'ont quasiment pas de zones industrielles disposent de quelques r'serves fonci'res et naturelles qui sont de l'ordre de 100 ha pour l'ensemble d’entre eux. Cependant on remarque qu'elles sont relativement importantes dans deux cas. En effet, elles repr'sentent plus du quart du domaine des ports de Lorient (40 ha) et de Bayonne (28 ha).

Contrairement aux ports autonomes, aucun 'l'ment comptable ne permet de valoriser le domaine des ports d'int'r't national. D'une part, les emprises conc'd'es n'ont pas fait l'objet d'une estimation lors de la passation des actes de concession, qui peuvent au demeurant 'tre tr's anciens, et ne sont donc pas comptabilis'es. D'autre part, pour les parcelles non conc'd'es, l'absence de comptabilit' patrimoniale de l'Etat emp'che toute estimation. En outre, les informations recueillies sur les mouvements sont trop partiels pour 'tre pris en compte.

Recommandations

- 'tablir l’inventaire du patrimoine des ports (limites physiques, situation juridique, r'partition fonctionnelle, valeur effective) ; engager un r'colement syst'matique entre l'inventaire physique et l''tat de l'actif comptable de l'ensemble des terrains ; faire co'ncider les donn'es des ports et celles de la tutelle.
