Art. 3.
(Servizi di cold ironing)

1. All'articolo 34-bis del decreto-legge 30 dicembre 2019, n. 162, convertito, con modificazioni, dalla legge 28 febbraio 2020, n. 8, sono apportate le seguenti modificazioni:

a) al comma 1 è premesso il seguente:

« 01. Per infrastruttura di cold ironing si intende l'insieme di strutture, opere e impianti realizzati sulla terraferma necessari all'erogazione di energia elettrica alle navi ormeggiate in porto. L'erogazione di energia elettrica da impianti di terra alle navi ormeggiate in porto costituisce un servizio di interesse economico generale fornito dal gestore dell'infrastruttura di cold ironing, individuato dall'autorità competente nelle forme e secondo le modalità previste dalla normativa vigente. Il gestore dell'infrastruttura di cui al primo periodo è:

a) un cliente finale ai sensi del decreto legislativo 16 marzo 1999, n. 79, ai fini della regolazione delle partite di energia elettrica prelevata dalla rete pubblica o dal sistema di distribuzione chiuso a cui tale infrastruttura è connessa;

b) un consumatore finale dell'energia elettrica, ai fini dell'applicazione del testo unico delle disposizioni legislative concernenti le imposte sulla produzione e sui consumi e relative sanzioni penali e amministrative, di cui al decreto legislativo 26 ottobre 1995, n. 504 »;

b) il comma 1 è sostituito dal seguente:

« 1. Al fine di favorire la riduzione dell'inquinamento ambientale nelle aree portuali mediante la diffusione delle tecnologie elettriche, entro centottanta giorni dalla data di entrata in vigore della presente disposizione, l'ARERA adotta uno o più provvedimenti volti a prevedere uno sconto, per un periodo di tempo proporzionato al predetto fine, sulle componenti tariffarie a copertura degli oneri generali di sistema di cui all'articolo 3, comma 11, del decreto legislativo 16 marzo 1999, n. 79, applicabile ai punti di prelievo dell'energia elettrica che alimentano le infrastrutture di cui al comma 01 del presente articolo »;

c) dopo il comma 1 è inserito il seguente:

« 1-bis. I soggetti gestori delle infrastrutture di cui al comma 01 trasferiscono i benefici derivanti dall'applicazione delle misure di cui ai commi 1 e 2 agli utilizzatori finali del servizio di cold ironing ai quali garantiscono condizioni di accesso e di fornitura eque e non discriminatorie. Nel caso in cui l'infrastruttura di cui al comma 01 insista su aree portuali già affidate in concessione ai sensi dell'articolo 18 della legge 28 gennaio 1994, n. 84, l'Autorità di sistema portuale adotta, anche mediante la previsione di apposite clausole negli atti di concessione, le misure necessarie a evitare che il concessionario possa beneficiare di vantaggi ingiustificati ovvero operare discriminazioni tra i diversi utilizzatori ».

“CERP - COMUNITÀ ENERGETICHE PORTUALI”

l'attuale Governo sta valorizzando la blue economy e con essa la portualità come asset strategici per la crescita economica del Paese anche dal punto di vista degli assetti geopolitici che si stanno delineando.
Lo sviluppo degli asset infrastrutturali del nostro Paese (di cui i porti sono un elemento centrale) è essenziale per la competitività anche all'interno del bacino del Mediterraneo così come lo è un'adeguata transizione energetica attraverso una pluralità di soluzioni e strumenti che possano velocizzare l'efficacia di processi adeguati.
La transizione energetica per il nostro Paese, soprattutto per l'ambito portuale non è solo un tema di sostenibilità ambientale ma anche un tema di tenuta del sistema portuale italiano verso le portualità NON UE del Mediterraneo alla luce della Direttiva comunitaria 2003/87/CE “European Emission Trading Scheme (EU - ETS) estesa anche al trasporto marittimo
L'inclusione del trasporto marittimo è avvenuta per effetto della Direttiva del Parlamento Europeo e del Consiglio (UE) 2023/959 del 10 maggio 2023 che gli Stati membri UE sono tenuti a recepire entro fine anno. In base al sistema ETS, dal 2024 le compagnie di navigazione dovranno, progressivamente, acquistare e trasferire permessi (“EUAs”) per ogni tonnellata di emissioni CO2eq rilasciata nell'atmosfera durante un anno solare. A partire dal 2027, le compagnie dovranno, in pratica, pagare, indipendentemente dalla nazionalità o bandiera della nave, per il 100% delle emissioni GHG generate nelle tratte intra-EU e il 50% delle emissioni GHG nelle tratte internazionali da o verso uno scalo europeo.
Ciò comporta ovviamente - per ammortizzare l'aumento dei costi di trasporto marittimo - l'esigenza di adottare tutte le iniziative utili a favorire la maggior capacità possibile dei porti di essere hub energetici: il Cold Ironing certamente è uno degli strumenti più utili - e non derogabili - ma non solo: questo, evidentemente può provocare un forte pregiudizio per la competitività del nostro settore verso l'industria portuale dei Paesi NON UE (dai porti del nord africa a quelli inglesi …) che non è soggetta a analoghe normative ambientali e quindi che si troverà ad essere economicamente ancor più competitiva rispetto a noi.
Alla luce quindi della evidente e ineludibile necessità di accelerare la transizione energetica nei porti (da considerarsi non solo come hub di movimentazione di merci e persone ma anche come potenziali hub energetici) e di poter fruire di norme uniformi sul territorio nazionale, nonché di strumenti adeguati, Vi sottoponiamo la seguente proposta che andrebbe collocata all'art.3 del DDL n. 795 in esame.
Obiettivo della nostra proposta, condivisa con il cluster dello shipping, della logistica energetica, della cantieristica navale e delle marine da diporto, è disciplinare compiutamente gli aspetti afferenti il “cold ironing” insieme a quelli delle “comunità energetiche portuali” funzionali alla promozione di un unico, potenziale, sistema e processo, utile alla transizione energetica, efficientamento energetico, nonché abbattimento delle emissioni in atmosfera derivanti dalle attività portuali e marittime nei porti italiani.
Una impostazione normativa uniforme su tutto il territorio nazionale eviterebbe differenziazione tra modelli potenzialmente distorsivi della concorrenza interna (tra porto e porto, ovvero sistemi di Autorità di Sistema Portuale) e favorirebbe maggiormente il dialogo pubblico - privato (concedente - concessionario) per la realizzazione di progetti efficaci, così come avviene in altri analoghi contesti europei.
Siamo fermamente convinti che anche attraverso lo sviluppo di strumenti che agevolino i privati (che operano su demanio pubblico) a investire per favorire una propria autonomia energetica in collaborazione con il Pubblico (che gestisce il demanio) possa favorire la messa a sistema della maggiore produzione possibile di fonti energetiche da utilizzare sia per le diverse modalità di trasporto che per i benefici conseguenti sul territorio.
Tutto ciò premesso la proposta di prevedere che la CERP possa essere costituita/partecipata da un ampio alveo di soggetti esercenti concessioni demaniali, nonché da soggetti produttori, amplia potenzialmente l'efficacia della stessa sia dal punto di vista di produzione che dal punto di vista dei beneficiari

Art. 3 Servizi di cold ironing e comunità energetiche portuali

Al comma 1 sono apportate le seguenti modifiche: dopo la lettera “b)” è inserito il seguente periodo: “c) le comunità energetiche portuali eventualmente costituite ai sensi del comma 2 del presenta articolo
al comma 1-bis, sono apportate le seguenti modifiche: dopo le parole “… che il concessionario” sono inserite le seguenti parole: “che ai presenti fini può essere gestore dell'infrastruttura di cold ironing

Il comma 2 dell'articolo 9, del Decreto-legge 17 maggio 2022, n. 50 convertito con modificazioni dalla Legge 15 luglio 2022, n. 91, è modificato come segue.

«2. Allo scopo di contribuire alla crescita sostenibile del Paese, alla decarbonizzazione del sistema energetico e per il perseguimento della resilienza energetica nazionale, le Autorità di sistema portuale, anche in deroga alle previsioni di cui all'articolo 6, comma 11, della medesima legge 28 gennaio 1994, n. 84, nonché i soggetti concessionari di aree e banchine in ambito portuale ai sensi della legge 28 gennaio 1994, n. 84, anche diverse dalle PMI, nonché le imprese in grado di produrre, stoccare e/o distribuire energia rinnovabile possono promuovere, la costituzione, in ambito portuale, di una o più comunità energetiche rinnovabili (CERP) ai sensi dell'articolo 31 del decreto legislativo 8 novembre 2021, n. 199, anche in deroga ai requisiti di cui al comma 1 lettere b) e d) e di cui al comma 2, lettere b), c) e d), dell'articolo 31 del medesimo decreto legislativo, in coerenza con il documento di pianificazione energetica e ambientale di cui all'articolo 4-bis della medesima legge n. 84 del 1994. Gli incentivi previsti dal decreto legislativo n. 199 del 2021 si applicano agli impianti da fonti rinnovabili inseriti in comunità energetiche rinnovabili costituite ai sensi del presente comma, anche se di potenza superiore a 1 MW. Resta comunque esclusa la possibilità di realizzare gli impianti nelle aree naturali protette di cui alla legge 6 dicembre 1991, n. 394.
3. L'impresa che promuove o aderisce ad una CERP può proporre all'Autorità di sistema portuale, anche congiuntamente ad altre imprese concessionarie, uno o più progetti di investimento finalizzati alla realizzazione di impianti di produzione di energie rinnovabili o di impianti di stoccaggio di energia rinnovabile, in ambito portuale o in aree esterne a tale ambito da connettere alla rete elettrica portuale. La realizzazione di impianti di produzione di energie rinnovabili o di impianti di stoccaggio di energia rinnovabile, in ambito portuale o in aree esterne a tale ambito da connettere alla rete elettrica portuale, può avvenire su iniziativa pubblica o privata.
5. Gli investimenti effettivamente sostenuti dai singoli soggetti aderenti alla CERP, debitamente comprovati e rendicontati, sono considerati lavori di straordinaria manutenzione soggetti alla disciplina di cui all'art. 3 comma 1 lett. g) del Decreto-Legge 5 Ottobre 1993, N. 400, convertito dalla Legge 4 dicembre 1993, n. 494.
6. Per gli impianti di produzione e di stoccaggio di energie rinnovabili realizzati con risorse del bilancio dell'Autorità di sistema portuale, i relativi proventi dell'energia che non sia direttamente auto-consumata dall'Autorità di sistema portuale, sia attraverso il ritiro dedicato, sia attraverso il meccanismo incentivante propria della CERP, verranno accreditati alla medesima Autorità di sistema portuale al netto dell'incentivo acquisito in ragione dei consumi associati agli impianti di cold ironing presenti in porto e quest'ultimo verrà utilizzato per ridurre la tariffa di tale servizio.
7. Per la celere definizione dei procedimenti amministrativi volti alla realizzazione degli impianti di cui al comma 4, sono ridotti della metà i termini di cui: agli articoli 2 e 19 della legge 7 agosto 1990, n. 241; al decreto legislativo 3 aprile 2006, n. 152, in materia di valutazione d'impatto ambientale (VIA), valutazione ambientale strategica (VAS) e autorizzazione integrata ambientale (AIA); al regolamento di cui al decreto del Presidente della Repubblica 13 marzo 2013, n. 59, in materia di autorizzazione unica ambientale (AUA); al codice di cui al decreto legislativo 22 gennaio 2004, n. 42, e al regolamento di cui al decreto del Presidente della Repubblica 13 febbraio 2017, n. 31, in materia di autorizzazione paesaggistica; al testo unico di cui al decreto del Presidente della Repubblica 6 giugno 2001, n. 380, in materia edilizia.
7bis. Al fine di consentire di ricomprendere l'intero ambito territoriale di un porto all'interno di una unica CERP è concessa facoltà di accedere ai regimi di sostegno del decreto legislativo 8 novembre 2021, n. 199 anche per la quota di energia condivisa da impianti e utenze di consumo non connesse sotto la stessa cabina primaria, previo pagamento degli oneri di rete riconosciuti per l'illuminazione pubblica, anche in deroga ai requisiti di cui al comma 2, lettera c) dell'articolo 31 del medesimo decreto legislativo 8 novembre 2021, n. 199.
8. Fatto salvo quanto previsto dagli articoli 22-bis e 23 del decreto legislativo 8 novembre 2021, n. 199, eventuali autorizzazioni, licenze, permessi, concessioni o nulla osta comunque denominati la cui adozione richiede l'acquisizione di pareri, intese, concerti o altri atti di assenso comunque denominati di competenza di più amministrazioni sono adottati ai sensi dell'articolo 14-bis della legge n. 241 del 1990; i termini ivi previsti sono ridotti della metà e sono altresì ridotti alla metà i termini di cui all'articolo 17-bis, comma 1, della legge 7 agosto 1990 n. 241.
9. Il Ministero delle infrastrutture e dei trasporti, il Ministero dell'ambiente e della sicurezza energetica e le regioni ed i comuni possono stabilire incentivi, sovvenzioni e finanziamenti da destinare alla promozione delle CERP.
10. Al fine di promuovere effettivamente la costituzione CERP, ciascuna Autorità di sistema portuale adotta i necessari provvedimenti, sentito l'Organismo di partenariato della risorsa mare di cui all'art. 11-bis della legge 28 gennaio 1994, n. 84, entro novanta giorni dall'entrata in vigore della presente legge.»


Relazione Illustrativa

La proposta emendativa mira a favorire, nonché propone una disciplina organica, effettiva e semplificata, alle Comunità energetiche in ambito portuale, timidamente ipotizzata dall'art. 9 del decreto-legge 17 maggio 2022, n. 50.
Per disciplinare lo snellimento dei procedimenti amministrativi aventi ad oggetto le autorizzazioni necessarie alla realizzazione di impianti di produzione di energia rinnovabile da parte delle imprese concessionarie portuali (in larga parte si ipotizzano impianti fotovoltaici), vengono richiamate testualmente le convincenti disposizioni semplificatorie introdotte in occasione dell'istituzione delle ZES (vedasi al riguardo l'art. 5 del decreto-legge 20 giugno 2017, n. 91).
Inoltre, pare opportuno derogare al limite posto dall'art all'articolo 42-bis, comma 3, lettera b) del decreto-legge 30 dicembre 2019, n. 162 - recante Autoconsumo da fonti rinnovabili - laddove prevede che, nel caso di comunità energetiche, i relativi azionisti o membri sono [..], piccole e medie imprese. Infatti, come noto, diverse imprese concessionarie non rientrano nella definizione di PMI e da una tale limitazione normativa si giungerebbe al tanto indesiderato, quanto irrazionale, effetto di impedire (o per lo meno svilire) la costituzione di Comunità energetiche portuali.
Sulla costituzione e gestione della CERP, si prevedono le seguenti possibilità.
In primo luogo, la formulazione lascia aperte due ipotesi: che la CERP sia costituita su iniziativa “pubblica”, ossia dell'AdSP, oppure, nell'eventuale inerzia delle Ente pubblico, su iniziativa “privata” delle imprese concessionarie di aree portuali interessate in tal senso.
Nel primo caso, viene richiamato il decreto legislativo 19 agosto 2016, n. 175, T.U. in materia di società a partecipazione pubblica. Al riguardo, deve osservarsi che la previsione si colloca in sintonia con l'art. 4 comma 2 lettera a) del predetto T.U., posto che la CERP rientra pacificamente nell'ambito della “produzione di un servizio di interesse generale, ivi inclusa la realizzazione e la gestione delle reti e degli impianti funzionali ai servizi medesimi”; e, in quanto tale, è un'attività esercitabile direttamente o indirettamente dalla P.A. / AdSP ai sensi del predetto articolo 4.
Inoltre, pare opportuno qui richiamare, per completezza, la circolare del Ministero delle Infrastrutture e dei Trasporti del 17/04/2018 che, nel ribadire l'abrogazione del D.M. 14/11/1996 - regolamento che un tempo individuava i servizi di interesse generale in ambito portuale - specifica: ..potrebbero rimanere nelle competenze di codeste Autorità (di sistema Portuale, n.d.r.) i servizi da rendere alle generalità degli utenti portuali quali, ad esempio, quelli di illuminazione delle parti comuni [..].
