L'era della liberalizzazione

Nicolette van der Jagt, consigliere europeo dell'ESC (European Shippers' Council), spiega perché gli spedizionieri appoggiano le proposte dell'Unione Europea di aprire i porti dell'Europa a una maggiore competizione.

La Commissione Europea ha pubblicato la sua bozza di proposta per aprire il mercato dei servizi connessi ai porti, compresa la movimentazione dei cargos, per raggiungere l'obiettivo di una maggiore competitività. La proposte sono mirate a rendere il settore dei porti sempre più efficiente e trasparente, e hanno provocato l'ostilità di alcuni attori dell'industria portuale, specialmente di quelli che vogliono proteggere con più tenacia i loro monopoli e altre pratiche commerciali restrittive.

In una sua recente dichiarazione introduttiva delle intenzioni della Commissione, Loyola de Palacio ha enfatizzato che una delle intenzioni principali della Commissione era, fra le altre cose, quella di introdurre delle procedure di selezione aperte e giuste sotto forma di offerte pubbliche in tema di garanzie, in particolare, ai fornitori di servizi di movimentazione dei cargos e di servizi di tipo nautico nei porti dell'Unione Europea.

Gli spedizionieri europei che si affidano a servizi portuali efficienti e competitivi per migliorare le performances delle loro catene di offerta hanno lavorato con i proprietari di nave europei per incoraggiare la Commissione ad agire in quest'area. Gli spedizionieri sostengono gli obiettivi esplicitati nelle proposte della Commissione e che consistono nell'aprire i porti dell'Europa a maggiori livelli di competitività e concorrenza. Il Consiglio Europeo degli Spedizionieri (ESC) accoglie di buon grado la forza dirompente delle proposte il cui intento è l'armonizzazione delle procedure riguardanti l'assegnazione delle concessioni per i servizi portuali, quali movimentazione di carichi, rimorchio, pilotaggio, ormeggio, stoccaggio delle merci, attività di magazzinaggio e consolidamento dei containers.

I porti giocano un ruolo chiave nelle operazioni delle catene di trasporto intermodali di tipo door-to-door ed il loro funzionamento efficiente è di vitale importanza per gli spedizionieri. Complementariamente alle proposte necessarie stilate dalla Commissione, gli spedizionieri ritengono anche che le misure legislative avanzate dalla Commissione agiranno da grande stimolo per il settore portuale per migliorarne le performances generali, l'affidabilità e gli standards di stazzatura.

La richiesta della Commissione di servizi di alta qualità nei porti rispecchia appieno lo scopo dell'ESC di rimuovere le inefficienze dalla catena dell'offerta per rendere capaci l'industria ed il mondo degli affari portuali dell'Europa di restare competitivi nei difficili mercati domestici e di oltremare. Servizi portuali inefficienti sono visti come un ostacolo nelle performances delle catene dell'offerta dei trasporti.

Nell'elaborare una risposta valida alla Comunicazione della Commissione l'ESC guarderà a come i principi sottomessi dall'ESC nel 1998, e diretta conseguenza del Libro Verde sui Porti allora prodotto dall'istituzione dell'Unione Europea, saranno riflessi nella proposta della Commissione. Questi principi, che dovrebbero contribuire a rendere i porti ed i servizi portuali un elemento di maggiore attrattiva nella catena dell'offerta, includono:

          mercati aperti e concorrenza leale e libera tra porti e all'interno dei porti stessi;

divieto di abuso di posizione dominante;

abolizione dei monopoli - sia nei porti che tra i porti e, dove questi monopoli non possono essere evitati, consultazioni frequenti con gli utenti più diretti;

divieto di imposizione di servizi;

procedure di prezzo corrette ed evidenti;

divieto di discriminazione di alcun tipo;

abolizione di pratiche lavorative obsolete e restrittive.

Lo scopo generale riguardante i servizi portuali deve essere quello di assicurare che i mercati di tutti i servizi siano aperti alla concorrenza e che offrano i miglior livello possibile di servizi ai clienti. La chiave sta nell'assicurare alle nuove compagnie di entrare nei porti in modo tale da renderle in grado di competere con gli operatori portuali già esistenti e da tempo operanti sul mercato, assicurando così indirettamente livelli di servizio più elevati, così come richiesto dall'industria, indipendentemente dalla grandezza del porto.

L'abilità dei porti Europei di attrarre una vasta gamma di servizi è di importanza critica per gli esportatori Europei. Gli spedizionieri sono preoccupati del fatto che alcuni fornitori di servizi portuali stiano oggi sfruttando esageratamente la loro posizione di monopolio, nonostante il trend di questo periodo sia la concorrenza e la liberalizzazione. La fornitura di servizi spesso rappresenta costi sproporzionatamente alti agli utilizzatori dei servizi portuali.

Sono però state mosse delle critiche all'iniziativa della Commissione. È stato detto, in proposito, che la Commissione non riuscirà mai a riformare il settore portuale, uno degli ultimi baluardi del protezionismo nei trasporti, e la Commissione è consapevole di tutto questo. La Commissione è stata accusata di perseguire una strada filosofica poco realistica. L'International Transport Federation si sente oltraggiata e teme molto la prospettiva dell'introduzione di maggiore competizione nei servizi portuali. La Commissione è stata anche criticata di elaborare delle proposte troppo dogmatiche e anti-commerciali, e di imporre la concorrenza troppo dall'alto in modo estremamente artificioso.

In effetti, un porto che ha solamente un terminal specializzato nella gestione delle rinfuse avrebbe l'obbligo, con le nuove leggi, di aprirsi a un nuovo attore per prestare servizi di movimentazione delle merci, ovvero dovrebbe permette il self-handling. La Commissione, infatti, richiede che almeno due fornitori di carichi siano presenti ed operino in ciascun porto investito dalla competenza della direttiva, "a meno che non prevalgano delle circostanze eccezionali". Nei casi in cui l'accesso ai servizi è ristretto ad un numero limitato di prestatori di servizi, la Commissione è preoccupata che l'assegnazione delle licenze sia soggetta ad una procedura di selezione obiettiva e trasparente, organizzata sulla base di gare per gli appalti che siano coerenti con le condizioni della proposta.

Queste autorizzazioni dovrebbero essere garantite solo per un periodo limitato di tempo, che dovrebbe riflettere i costi di investimento incombenti sull'operatore. Questo periodo non dovrebbe superare i cinque anni nei casi di coinvolgimento di investimenti piccoli o addirittura nulli. Per converso, le licenze possono essere estese a dieci o vent'anni qualora sia coinvolto un consistente investimento, a seconda però della sua natura.

In Gran Bretagna, alcuni soggetti operanti nell'industria portuale hanno espresso la loro opposizione alle proposte della Commissione. La Gran Bretagna però possiede un settore portuale molto più movimentato rispetto alle altre Nazioni Europee. L'industria portuale locale, dalle Autorità Portuali fino alle imprese di minori dimensioni, è quasi interamente nelle mani dei privati. Come risultato, i porti inglesi sono ritenuti molto più efficienti ed attenti alle esigenze dei loro clienti, ma gli spedizionieri della Gran Bretagna sostengono che non ci sia spazio per le lamentele e pensano che ci sia sempre posto per un miglioramento delle performances - soprattutto se i porti inglesi intendono mantenere la loro leadership.

Mentre le forze di mercato stanno già manifestando il loro effetto, se non altro per il forte potere contrattuale delle alleanze di spedizionieri e di vettori, molti dei quali posseggono o partecipano alle operazioni portuali, hanno contribuito a accrescimenti nell'efficienza e nella produttività, c'è ancora necessità di miglioramento.

Gli spedizionieri accolgono con favore le pressioni concorrenziali, ma riconoscono anche che questo processo non è uniforme, come non è armonizzata la legge in tutta l'Europa. Ci sono forti rigidità nel sistema portuale e mancanze di flessibilità nel rispondere alle esigenze dei consumatori. L'importanza crescente nell'affidabilità e nelle performances delle catene di fornitura dei manufattori, così come il bisogno di aumentare l'efficienza nella catena dell'offerta, hanno creato forti domande nell'industria.

Per questa ragione, gli spedizionieri gli spedizionieri sostengono un set di regole e linee guida della Commissione. Questo spingerà in avanti il processo di liberalizzazione del settore portuale, che è tanto importante quanto la liberalizzazione del settore dell'energia e delle telecomunicazioni, per l'obiettivo finale di un mercato Europeo integrato, completo e armonizzato.
