I porti statunitensi: una forza con cui fare i conti

Dal momento che vi sono troppi porti importanti perché li si possa menzionare individualmente, le questioni attinenti il settore dei porti statunitensi possono essere affrontate attraverso l'analisi del funzionamento della AAPA (Associazione Americana delle Autorità Portuali), un organismo unico che rappresenta le autorità portuali pubbliche del paese e parla in loro nome. Essa non rappresenta invece il settore dei porti privati, sebbene naturalmente abbia stretti collegamenti anche con loro.

Negli Stati Uniti esistono 185 scali marittimi commerciali che includono 1.941 terminal marittimi pubblici e privati con 3.214 ormeggi per navi a pescaggio profondo. Essi sono situati in zone costiere ma anche sui Grandi Laghi oppure nell'ambito di sistemi fluviali interni.

I porti a pescaggio profondo accolgono le navi a lungo raggio che movimentano oltre il 95% dei traffici statunitensi d'oltremare in relazione al peso ed il 75% di loro in relazione al valore. I porti degli USA movimentano più di 2 miliardi all'anno di tonnellate di carichi interni ed in importazione/esportazione, mentre ci si aspetta che l'ammontare dei carichi trasportati via acqua venga triplicato entro il 2020.

Gran parte della produzione nazionale complessiva di derrate di base e di prodotti finiti viene trasportata dal settore marittimo. A titolo di indicazione, circa i due terzi di tutto il frumento e della farina di frumento degli Stati Uniti, un terzo della produzione di semi di soia e riso e quasi i due quinti della produzione statunitense di cotone vengono esportati attraverso i porti statunitensi.

E' interessante notare come i porti pubblici statunitensi comprendano un certo numero di svariate forme di proprietà, organizzazione ed amministrazione inerenti ad enti governativi non federali. Ad esempio, sono stati identificati 11 sistemi giurisdizionali portuali, tra cui porti che in realtà costituiscono dipartimenti municipali (Los Angeles e Long Beach), agenzie statali (Hawaii e Maine), distretti di navigazione per scopi speciali ed autorità bi-statali come New York/New Jersey.

Oggi, l'AAPA rappresenta 150 autorità portuali pubbliche e nell'emisfero occidentale i suoi 85 porti statunitensi sono situati lungo le coste dell'Atlantico, del Pacifico, del Golfo del Messico e dei Grandi Laghi, così come dell'Alaska, delle Hawaii, di Porto Rico, di Guam e delle Isole Vergini statunitensi.

Inoltre, vi sono 363 membri sostenitori ed associati, ditte e singoli individui che abbiano interessi negli scali marittimi dell'emisfero occidentale.

Ma perché dar vita ad un'Associazione delle Autorità Portuali Pubbliche?

Sul finire del secolo, era divenuto chiaro a molti che un raggruppamento così grosso di porti pubblici in concorrenza allora esistente, oltretutto separati geograficamente da grandi distanze e differenze regionali, avesse bisogno di un organismo potente e rappresentativo che perseguisse gli interessi ed il benessere del settore.

In effetti, gli albori dell'AAPA possono essere fatti risalire al 1912, allorquando venne esteso un invito ai responsabili dei porti pubblici di tutto il paese affinché partecipassero ad una conferenza delle autorità portuali statunitensi a New York, allo scopo di "scambiare idee in ordine all'organizzazione portuale, promuovere lo scambio di informazioni e lo sviluppo di metodi uniformi di amministrazione e possibilmente assicurare una qualche forma di organizzazione permanente tra le principali autorità portuali". L'ispirazione della riunione fu dovuta a Calvin Tompkins, Commissario dei Moli della Città di New York - il padre dell'AAPA - che era ben conscio della difficoltà di persuadere tali aspri rivali ad incontrarsi e a lavorare a titolo di collaborazione.

Tuttavia, i rappresentanti di Mobile, Los Angeles, San Francisco, Jacksonville, Baltimora, Cleveland, Filadelfia, Providence, Norfolk, New Jersey e - naturalmente - New York City presero poi parte alla riunione in occasione della quale venne abbozzato e ratificato l'atto costitutivo di quella che in seguito sarebbe stata conosciuta come l'Associazione Nazionale delle Autorità Portuali.

Vennero istituite due classi di partecipazione. La Classe Uno venne riservata agli amministratori dei porti pubblici, mentre gli altri con interessi correlati alla portualità furono classificati come "membri associati".

Venne eletto un certo numero di dirigenti e nel giro di un mese 11 porti avevano pagato la quota d'iscrizione e si erano registrati quali membri. Gli 11 erano: Baltimora, Filadelfia, Norfolk, Mobile, Rhode Island, Boston, Los Angeles, New Orleans, New York City, San Francisco ed il Consiglio del Commercio e della Navigazione dello Stato del New Jersey. E' interessante notare come tutti loro, o i loro successori amministrativi, siano ancora membri attivi dell'AAPA.

Quando l'associazione venne costituita, l'amministrazione portuale pubblica era ancora allo stadio infantile. Sebbene in un certo numero di stati e città portuali esistessero agenzie portuali pubbliche, poche - se non nessuna - realmente possedeva o gestiva terminali marittimi. I porti commerciali erano per la maggior parte dominati da potenti società ferroviarie, cui appartenevano i terminal e che controllavano l'accesso alle baie.

Nel corso del tempo, crebbe una vibrante protesta nei confronti del monopolio ferroviario che si concretizzò sotto forma di un movimento "per la libertà delle baie" in tutto il paese. Questi sentimenti erano alla base della decisione di convocare l'incontro a New York, dove essi vennero espressi in maniera particolarmente sostenuta da Calvin Tompkins, che dichiarò che i porti erano troppo importanti per essere lasciati ai capricci di potenti società di lucro. Invece, disse, i terminal degli scali marittimi dovrebbero essere realizzati con fondi pubblici e gestiti sotto controllo pubblico al fine di assicurare uguale accesso a tutti i vettori e caricatori. "Il settore pubblico, e non la sfrenata impresa privata, dovrebbero avere la meglio".

Si riconobbe che le agenzie portuali pubbliche sarebbero state amministrate in modo efficiente da professionisti competenti e ben addestrati "di levatura morale inattaccabile". Data questa esigenza, ne conseguì che era essenziale che le autorità portuali lavorassero insieme "al fine di promuovere la scienza dell'amministrazione di supporto, di sviluppare la professionalità tra i loro membri, e, in genere, di lavorare assieme per il bene comune". Così, il proposito di conseguire questi obiettivi portò alla costituzione dell'associazione e le diede un oggetto preciso.

Negli anni successivi, l'associazione raggiunse parecchie pietre miliari. Ad esempio, in seguito allo scoppio in Europa della Prima Guerra Mondiale, venne deciso di estendere la possibilità di partecipazione a porti situati in tutto l'emisfero occidentale e, di conseguenza, l'associazione venne ridenominata AAPA (Associazione Americana delle Autorità Portuali). I primi porti membri latino-americani dell'associazione furono Para, in Brasile, ed Arica, in Cile, mentre i suoi primi membri caraibici furono Ciudad Trujillo e la Repubblica Dominicana, che entrarono a farvi parte nel 1949.

Negli anni '20, venne pubblicato un bollettino mensile, World Ports, che si rivelò un successo immediato. In seguito a ciò, l'AAPA allora produsse un certo numero di importanti documenti nel corso degli anni. Nell'ambito del bollettino, vennero realizzati un repertorio annuale dei porti del Nord America così come un glossario di terminologia portuale, e furono anche pubblicate un'indagine sulle prassi finanziarie portuali ed una accurata bibliografia dei libri e degli articoli inerenti ai porti ed agli argomenti ad essi correlati.

Alla fine degli anni '70, l'AAPA aveva subito un enorme cambiamento. Vennero stabiliti un programma governativo di relazioni a tempo pieno, nonché frequenti udienze al Congresso e costanti contatti con agenzie federali-chiave e, in generale, una maggiore presenza a Washington caratterizzò quel periodo.

Alla fine degli anni '80, si erano verificati una notevole espansione del ruolo di appoggio dell'associazione a livello nazionale ed internazionale (con speciale accento sulle materie del dragaggio e dell'ambiente), il lancio di un programma di consapevolezza nazionale pubblica ed un vigoroso risveglio della sua politica dei "puertos amigos" che venne estesa ai porti latino-americani e caraibici.

Ma che cosa fa l'associazione, e come lavora?

Attualmente, l'AAPA - che ha sede ad Alexandria, in Virginia, appena fuori Washington - fornisce una varietà di servizi al fine di far fronte alle esigenze dei dirigenti portuali professionisti a tempo pieno.

Essa fornisce programmi di formazione ed addestramento ai dirigenti portuali; lavora al fine di espandere la consapevolezza pubblica dei porti ed offre servizi di ricerca ed informazione sul settore portuale. Fornisce altresì servizi di appoggio sulle materia normativa e regolamentare statunitense, sebbene attualmente questi ultimi vengano espletati solamente per conto dei membri statunitensi dell'AAPA.

Come spiega Rexford Sherman, direttore servizi ricerche ed informazioni dell'AAPA, "i nostri membri possono beneficiare di un'ampia gamma di seminari, conferenze e programmi, che vengono strutturati al fine di migliorare la professionalità portuale, accertare l'eccellenza dei programmi e dei singoli e dare un contributo alla realizzazione delle politiche del settore.

"A questo fine, l'AAPA offre un'ampia gamma di programmi formativi e di addestramento che riguardano quasi tutte le aree di interesse del settore portuale. Questi programmi forniscono informazioni di valore incalcolabile sulle ultime linee di tendenza e sugli sviluppi afferenti gli scali dell'emisfero occidentale.

Molti dei programmi di formazione ed addestramento fanno altresì obbligatoriamente parte del programma di certificazione PPM® (Dirigente Portuale Professionale) dell'AAPA, istituito nel 1995. Le finalità del PPM® mirano ad incoraggiare e promuovere gli standard professionali della dirigenza portuale pubblica nonché ad assistere le autorità e le agenzie portuali pubbliche nell'assunzione e promozione di personale qualificato di livello superiore per gli scali marittimi".

L'AAPA è strutturata su 13 commissioni permanenti tecniche e 3 politiche. Le commissioni tecniche possono comprendere singoli individui provenienti da tutte le categorie di partecipanti; i membri delle commissioni politiche comprendono solo membri associati ed in genere affrontano questioni di politica legislativa e di gestione dell'associazione. Queste commissioni svolgono un ruolo decisivo nelle attività dell'AAPA e l'aiutano a definire le politiche, a sviluppare nuovi programmi e fungono altresì da valida risorsa per i membri dell'AAPA.

In seguito agli eventi dell'11 settembre 2001, l'AAPA venne improvvisamente spinta a capofitto sulla ribalta in ordine alla questione della sicurezza nei porti degli Stati Uniti, soggetto in relazione al quale pochi porti, poche autorità e persino poche agenzie governative avevano in precedenza qualsiasi esperienza significativa, e sicuramente laddove venivano coinvolte le questioni della sicurezza in patria e della lotta al terrorismo internazionale.

Le autorità portuali avevano urgentemente bisogno di consulenza ed assistenza da parte di un organismo centrale, coordinato ed esperto e, quasi immediatamente, l'AAPA si è assunto quella veste. In breve, essa divenne la voce autorevole del settore quasi nel giro di una notte, ed i principi che essa ha formulato, molti dei quali di conseguenza sono stati adottati, hanno costituito il fondamento delle future azioni e della formazione politica per l'intero settore portuale statunitense.

Kurt Nagle, presidente dell'AAPA dal 1995, chiarisce che "l'AAPA supporta energicamente l'emanazione della normativa federale e l'adozione delle regole finalizzate a migliorare la sicurezza marittima ed a proteggere gli scali marittimi americani da atti di terrorismo e da altri delitti di competenza federale. La sicurezza della patria è una priorità nazionale e la protezione dei porti americani è un fattore cruciale per la crescita e la vitalità economica della nostra nazione".

"Di conseguenza, l'AAPA ed i suoi membri porti pubblici stanno lavorando a stretto contatto con la Guardia Costiera degli Stati Uniti, le Dogane statunitensi ed altre agenzie federali allo scopo di migliorare la sicurezza marittima ed essere sempre più un valido partner nell'azione di protezione della nostra patria".

Scendendo nei dettagli, Nagle ha esposto le questioni-chiave che a giudizio dell'AAPA dovrebbero essere incluse in qualsiasi nuovo programma federale che prenda in considerazione la sicurezza degli scali marittimi.

Ad esempio, per quanto attiene ciò che egli definisce "l'approccio associativo", Nagle argomenta che "la protezione dei confini dei nostri scali marittimi internazionali dovrebbe rappresentare una responsabilità condivisa tra i governi federale, statali e locali, i porti e l'industria privata".

Tuttavia, dal momento che è essenziale continuare a proteggere i porti americani e non rallentare la movimentazione dei carichi, le agenzie federali come la Guardia Costiera ed i servizi doganali incaricati della protezione degli scali marittimi americani devono ricevere maggiori fondi affinché possano disporre delle risorse necessarie a fare tale lavoro in modo appropriato.

Inoltre, sostiene Nagle: "Dall'11 settembre, dato che i porti hanno preso provvedimenti più rigorosi per quanto concerne la sicurezza - ed a questo riguardo occorrono altri miglioramenti - le autorità portuali pubbliche statunitensi hanno bisogno di un aiuto finanziario federale. I 93,3 milioni di dollari (95 milioni di euro) concessi dal Congresso ai porti rappresentano un buon primo passo, ma vi è l'esigenza di molti altri finanziamenti".

Inoltre, l'AAPA ritiene che la sicurezza dei singoli porti debba essere coordinata a livello locale ed il porto attualmente lavora a stretto contatto con la Guardia Costiera statunitense allo scopo di costituire commissioni locali per la sicurezza negli scali marittimi che svilupperanno un programma sulla sicurezza finalizzato a far fronte alle singole necessità di ciascun porto.

Queste commissioni dovranno espletare gli accertamenti in ordine alla vulnerabilità portuale, collaborare riguardo agli argomenti dei reati terroristici commessi in ambito portuale e sviluppare suggerimenti che dovranno essere accolti dagli operatori terminalistici in occasione dello sviluppo di programmi di sicurezza per le loro infrastrutture. Questi ultimi dovranno successivamente essere rivisti a livello locale allo scopo di occuparsi di specifici argomenti relativi alla sicurezza in concreto.

Come tale, "l'AAPA supporta lo sviluppo degli standard delle prestazioni che riflettono la natura mutevole dei rischi di un'infrastruttura portuale e che fungono da eccellenti strumenti per determinare se i metodi usati per mettere in sicurezza un porto o un'infrastruttura sono stati conseguiti".

Esiste, tuttavia, un certo numero di altre importanti questioni che devono essere affrontate in ordine ai programmi sulla sicurezza sia esistenti che nuovi. Come ha spiegato Nagle, "in relazione al terrorismo, il governo federale ha in atto programmi finalizzati ad adeguare la vulnerabilità di ciascun porto a tali azioni".

"Anche se i porti vogliono lavorare a stretto contatto con il governo federale su questo serio argomento, è importante che le agenzie federali se ne assumano la responsabilità, se non altro a causa della loro esperienza in questo settore. Inoltre, la situazione dovrebbe essere rigorosamente monitorata. I porti e le agenzie con giurisdizione sulla sicurezza portuale hanno bisogno di condividere le informazioni affinché le commissioni locali sulla sicurezza portuale possano sia concentrare i propri sforzi sia rafforzare la sicurezza nell'ambito dell'area portuale".

Un altro vantaggio derivante dalla condivisione delle informazioni, a giudizio dell'AAPA, sta nel fatto che il miglioramento dello scambio internazionale di informazioni sui reati e sulla sicurezza fornirà un'opportunità per ridurre il flusso degli stupefacenti e degli altri trasporti illegali negli Stati Uniti.

Di conseguenza, l'associazione ritiene che il Dipartimento di Stato statunitense dovrebbe svolgere un ruolo maggiore ed assumersi la responsabilità nella condivisione a livello internazionale delle informazioni, mentre l'Amministrazione Marittima statunitense ed altre agenzie competenti dovrebbero coordinare un programma internazionale di scambio sui reati e sulla sicurezza.

Non sorprende, quindi, il fatto che l'AAPA incoraggi lo sviluppo di programmi appropriati finalizzati all'addestramento del personale della sicurezza portuale in ordine alle materie inerenti la sicurezza nello scalo secondo standard riconosciuti e certificati in cui i propri attuali programmi di addestramento possano servire da modelli.

Nel contesto di ciò che essa considera quale un proprio dovere nei confronti dei propri membri e del settore portuale, l'AAPA tiene un dossier e fornisce consigli su diverse questioni quali il dragaggio, l'ambiente ed altri argomenti trasportistici, che sono tutti quanti essenziali perché il settore possa continuare ad operare e crescere, adesso ed in futuro.

A titolo indicativo dell'importanza di queste materie, Sherman sottolinea alcuni fatti che sono istruttivi ed illuminanti.

"Oltre il 90% dei principali 50 porti del paese movimentano circa il 93% di tutto il commercio statunitense annuo di origine marittima, e tutti quanti hanno bisogno di regolare dragaggio di manutenzione, che è stato espletato in collaborazione con l'USCE (Corpo degli Ingegneri degli Stati Uniti) sin da quando la legge del 1824 aveva istituito l'USCE quale "agenzia responsabile del sistema di navigazione per il mantenimento dell'accesso dal lato marittimo alle infrastrutture portuali".

Al fine di migliorare la comprensione del fenomeno del dragaggio, Sherman precisa: "Ciò che la maggior parte della gente non capisce è che oltre 300 milioni di yarde cubiche di materiale dragato vengono rimossi dai canali navigabili ogni anno, mentre altri 100 milioni di yarde cubiche vengono dragati dagli ormeggi e dai terminal privati. E questi 400 milioni di yarde cubiche di materiali dragati equivalgono ad una autostrada a quattro corsie, profonda 20 piedi e 6 pollici, da New York City a Los Angeles".

La maggior parte dei porti non sono profonde baie naturali e molti di loro sono situati alla foce dei fiumi dove la corrente contraria raccoglie il suolo del territorio, che poi viene trasportato dalla corrente a favore e depositato là dove le baie terminano. Molti porti sono stati realizzati dall'uomo attraverso un processo di dragaggio e riempimenti del terreno.

Di pari passo con l'incremento delle dimensioni delle portacontainers e delle altre navi, deve aumentare anche il pescaggio dei canali navigabili. Alla fine del '700, la goletta media a tre alberi aveva bisogno di una profondità di 8 piedi (2,4 metri). All'inizio degli anni '30, il vapore medio aveva bisogno di 26 piedi (7,9 metri) di pescaggio. Oggi, le moderne portacontainers, ad esempio, è probabile che presto avranno bisogno di profondità sino a 50 piedi (15,2 metri) ed i porti devono essere dragati se gli Stati Uniti vorranno continuare ad essere competitivi nei traffici internazionali.

Oltre al dragaggio, come continua Sherman, "un trasporto efficiente dipende dai collegamenti tra la strada, la rotaia e l'acqua. Allo scopo di movimentare rapidamente i carichi di origine marittima da e per l'hinterland, l'autotrasporto e le ferrovie debbono avere libero accesso ai porti. Per alcuni porti, l'anello debole nelle proprie catene logistiche è situato alle loro porte sul retro, dove le autostrade intasate o le inadeguate connessioni ferroviarie ai terminal marittimi causano ritardi e fanno aumentare i costi di trasporto".

"Date le previsioni secondo cui i traffici dovrebbero triplicarsi in meno di tre decenni, le infrastrutture della nostra nazione dovranno affrontare la sfida dell'adeguamento a tale incremento delle movimentazioni di merci, specialmente in conseguenza dei crescenti intasamenti cagionati da altro traffico commerciale e passeggeri. Problemi quali la semplice mancanza dei segnali di traffico sulla mano sinistra per i camion che partono dai terminal marittimi, ovvero i passaggi a livello ferroviari sulle strade locali, possono strozzare il traffico e creare colli di bottiglia per il trasporto di merci".

In termini di investimento, i porti prevedono che allo scopo di aggiornare ed ammodernare le proprie infrastrutture, essi spenderanno poco più di 8,3 miliardi di dollari nel periodo dal 2000 al 2004.

Al fine di far sì che i porti siano in grado di finanziare questi investimenti, molti di loro sono entrati in società con l'industria privata, il che è qualcosa che l'AAPA non solo approva, ma cerca anche di favorire.

Molti organismi portuali di tutti gli Stati Uniti per lungo tempo hanno tenuto fermo il convincimento che le operazioni portuali avrebbero dovuto essere lasciate al settore privato, ma, secondo l'AAPA, il dibattito ora volge nel senso che la privatizzazione costituisce una delle principali soluzioni ai problemi che si ritiene debbano essere affrontati dai porti pubblici statunitensi, quali la mancanza di esposizione alle pressioni verso operazioni commerciali del tutto competitive, l'operatività a livelli meno che efficaci, nonché l'essere soggetti a pressioni politiche indebite.

A fronte di queste argomentazioni, vi è il convincimento secondo il quale il sistema portuale degli U.S.A. è già assai decentrato, altamente competitivo, estremamente efficiente e già privatizzato mediante varie forme giurisdizionali. Inoltre, i discorsi sulla privatizzazione dovrebbero sempre essere temperati dalla comprensione che le autorità portuali erano state in origine costituite negli Stati Uniti al fine di porre fine al monopolio ed agli abusi del settore privato e di fornire le infrastrutture ed i servizi essenziali che il settore privato non era in grado (o non voleva) assicurare.

Quali che siano i pro ed i contro delle suddette argomentazioni, la questione è troppo complessa ed esiste tanta confusione in molte teste quando si cerca di comprendere lo scenario portuale statunitense.

Ad esempio, in diversi casi, il desiderio di commercializzare le operazioni portuali pubbliche ha indotto alcune autorità portuali a costituire consociate operative quasi private, com'è accaduto per la Autorità Portuale della Virginia (Virginia International Terminals), l'Amministrazione Portuale del Maryland (Maryland International Terminals) e l'Autorità Portuale di Tampa Bay (Tampa Bay International Terminals).

In effetti, una recente indagine dell'AAPA sui suoi porti associati ha identificato 31 porti in cui la movimentazione dei carichi viene espletata da personale dell'autorità portuale, 34 porti in cui tali funzioni vengono svolte da operatori terminalistici affittuari e 7 agenzie operative portuali che noleggiano alcune infrastrutture e ne gestiscono in proprio altre.

Così, come si può vedere, il settore privato è ben radicato negli USA; molti porti noleggiano i singoli terminal direttamente agli stivatori ed agli armatori. La P&O Ports, la SSA, la Hanjin Shipping, la Maersk SeaLand, la Evergreen e la OOCL sono solo alcuni degli affittuari che occupano i terminal in porti pubblici quali Los Angeles, Long Beach, Seattle, New York/New Jersey, Baltimora e Huston, per nominarne solo qualcuno.

Tuttavia, dato che gli Stati Uniti non hanno al riguardo alcun organismo normativo nazionale ed i suoi porti costituiscono una materia affidata ai singoli stati con relative varianti sia per quanto attiene la politica sia per ciò che riguarda le procedure, "la AAPA può essere d'aiuto ad unificare i porti e contribuire alla professionalità dell'amministrazione portuale, e noi speriamo di servire al settore portuale per molti, molti decenni ancora in futuro" ha concluso Nagle.
