Il cavallo di Troia dei contenitori

Gli Stati Uniti sono profondamente impegnati nello sviluppo di un sistema di sicurezza che possa salvaguardare la sua popolazione, le sue infrastrutture e la sopravvivenza della sua economia. Le branche legislativa ed esecutiva del governo stanno lavorando alla realizzazione di una struttura istituzionale finalizzata alla prevenzione degli attacchi terroristici all'interno degli Stati Uniti, riducendo la vulnerabilità degli U.S.A. nei confronti del terrorismo e minimizzando i danni derivanti dagli attacchi che dovessero comunque verificarsi. Non è chiaro se la struttura istituzionale già promulgata rifletta una conoscenza sufficientemente approfondita del problema tale da poter affrontare con efficacia queste nobili mete.

A luglio del 2002, l'Ufficio Statunitense della Sicurezza della Patria ha pubblicato la propria visione strategica al riguardo (la NSHLS 2002). Questo documento di 90 pagine costituisce le fondamenta concettuali, filosofiche e politiche per i futuri sforzi statunitensi in ordine alla sicurezza nazionale. Già in questo documento, è chiaramente visibile il profilo di un obiettivo troppo ristretto.

Dal punto di vista della sicurezza del trasporto marittimo, l'attenzione esplicitamente concentrata sul trasporto marittimo containerizzato è incomprensibile. Il trasporto marittimo containerizzato o di linea è di gran lunga il più accuratamente esaminato di tutti i tipi di carico di trasporto marittimo. Tale scrutinio si estende agli aspetti sia istituzionali che fisici dei carichi e delle navi, che rendono il container una piattaforma di consegna assai improbabile per un'arma di distruzione di massa.

Inoltre, al cuore del vero problema delle minacce terroristiche alla sicurezza nazionale degli Stati Uniti vi sono la cooperazione e le informazioni. Il documento, sebbene abbia una distinta sezione sulla "Cooperazione Internazionale", si concentra sulla cooperazione tra governi e sullo sviluppo della tecnologia finalizzata alla risoluzione dei problemi. Come la giornata dell'11 settembre 2001 ha chiaramente dimostrato, la tecnologia può essere compresa e gestita quasi da chiunque. Inoltre, la tecnologia, una volta compresa, può facilmente essere usata come un'arma.

La principale normativa che è derivata dalla NSHLS 2002 è rappresentata dalla legge del 2002 sulla Sicurezza della Patria (HLSA 2002), nonché dalla legge del 2002 sulla sicurezza del trasporto marittimo (MTSA 2002). La HLSA 2002 ha istituito il nuovo Dipartimento della Sicurezza della Patria. Tuttavia, fatta eccezione per il Titolo IV (Sicurezza dei Confini e dei Trasporti), che ha costituito un sottosegretariato per i confini ed i trasporti, vengono fornite ben poche direttive in ordine alle soluzioni inerenti alla sicurezza.

Il precipuo testo normativo destinato a regolamentare un approccio particolareggiato alle soluzioni inerenti la sicurezza in materia di trasporto marittimo è lo MTSA 2002. Questa legge tratteggia una struttura stratificata degli sforzi di pianificazione in ordine alle soluzioni relative alla sicurezza. Il processo di pianificazione, così come definito, consiste di tre livelli. In primo luogo, il Piano Nazionale per la Sicurezza dei Trasporti Marittimi; in secondo luogo, Il Piano di Zona per la Sicurezza dei Trasporti Marittimi; infine, in terzo luogo, il Piano per la Sicurezza delle Navi e delle Infrastrutture. I piani saranno coordinati lateralmente a livello di navi ed infrastrutture e successivamente tenuti sotto osservazione per confluire da ultimo in un Piano Nazionale per la Sicurezza dei Trasporti Marittimi onnicomprensivo.

Questi piani costituiranno le fondamenta dei nuovi provvedimenti da mettere in atto. Nel Piano per la Sicurezza delle Navi e delle Infrastrutture, il governo richiederà i dati a tutti gli operatori di navi ed infrastrutture negli Stati Uniti. Tuttavia, come si commentava in un articolo di Intercargo News del 15 novembre 2002, in ordine allo MTSA 2002, "questo provvedimento, una volta implementato, imporrà ampi requisiti di sicurezza al settore marittimo. Esso farà sì inoltre che gli Stati Uniti si ritrovino non più all'unisono con altri paesi in ordine a vari aspetti della sicurezza marittima". Così, inizialmente, la reazione da parte del settore marittimo non promette bene per la cooperazione futura.

Il settore marittimo è non solo desideroso ma addirittura impaziente di fornire le proprie conoscenze ed esperienze per far fronte alla guerra al terrorismo in materia marittima. E' chiaro, tuttavia, che gli Stati Uniti stanno lavorando a stretto contatto con la IMO (Organizzazione Internazionale Marittima), la quale sta parallelamente elaborando il Codice Internazionale sulla Sicurezza delle Navi e delle Infrastrutture Portuali. La questione ancora sul tappeto consiste nello stabilire se i necessari contatti di micro-livello ed i flussi di informazione in aumento siano sufficientemente dettagliati da essere sempre utilizzabili sul campo nelle attività di scoperta e deterrenza dl terrorismo.

La soluzione per la cooperazione estera sta nel coinvolgimento diretto degli Stati Uniti nel settore del trasporto marittimo privato internazionale. Nonostante la presenza dei governi, è con il settore del trasporto internazionale privato che devono dialogare gli Stati Uniti per ciò che attiene le attività e gli interessi, dato che sono essi a poter disporre del migliore accesso alle informazioni sul campo i tutti i porti del mondo. Allo scopo di far funzionare questi contatti di micro-livello, il governo statunitense deve coinvolgere tali organizzazioni ed i singoli nei propri sforzi anti-terrorismo.

Sebbene la sovrastruttura normativa ed amministrativa degli sforzi statunitensi in materia di sicurezza marittima sia impressionante, vi è un senso di incompiutezza. Nel mosaico ci sono tasselli mancanti. I pezzi mancanti devono essere trovati e messi al loro posto. Dalla sovrastruttura normativa, se ne potrebbe dedurre che i suoi architetti essenzialmente ritengono che gli Stati Uniti siano l'unico attore a controllare il campo marittimo. Tuttavia, delle prima 10 nazioni marittime, gli Stati Uniti vengono solo al quinto posto in classifica (dietro Cina, Norvegia, Giappone e Grecia).

La comunità internazionale dello shipping manifesta enorme interesse nella sicurezza marittima di tutti i tipi, spaziando dalla sicurezza della vita in mare all'ambiente marino. Il settore marittimo internazionale ritiene senza ombra di dubbio che sia proprio interesse quello di salvaguardarsi da tutti gli incidenti e le disavventure che possono verificarsi in mare e nei porti.

Nel corso degli anni, la comunità internazionale dello shipping e gli armatori hanno realizzato una estesa rete di agenti e contatti in tutti i porti ed i centri popolati del mondo. Le agenzie marittime nei porti di tutto il mondo sono organizzazioni diffuse a livello capillare, ben attente ai movimenti sociali, politici e religiosi delle proprie rispettive regioni. Di converso, il loro sostentamento dipende dal buon funzionamento e dalla sicurezza dei mercati internazionali dello shipping. Essi hanno contatti giornalieri con le navi, con gli equipaggi e con i manipolatori di carico basati a terra. Nel campo della sicurezza marittima, queste organizzazioni commerciali potrebbero costituire i primi fornitori di attendibili informazioni in ambito portuale.

La comunità internazionale dello shipping comprende in sé vari altri organismi che - ciascuno a proprio pieno diritto - potrebbe assicurare eccellenti intuizioni ed informazioni di cui potrebbe giovarsi la guerra contro il terrorismo. Tra loro vi sono varie associazioni internazionali inerenti ai traffici marittimi, quali la Intercargo (associazione internazionale degli armatori di navi per carichi secchi), la Intertanko (associazione internazionale degli armatori indipendenti di navi cisterna) e la Bimco (Consiglio Marittimo Baltico ed Internazionale).

I membri di queste organizzazioni possiedono e gestiscono oltre il 90% delle navi e del tonnellaggio mondiale. L'industria della navigazione marittima di linea (nell'ambito della quale, molti sono associati alla Bimco) dispone altresì di altre organizzazioni, quali il Consiglio Mondiale dello Shipping e l'Associazione Europea degli Affari di Linea, che potrebbero essere chiamate ad assisterla in caso di lotta al terrorismo. Inoltre, i proprietari dei carichi e gli armatori dispongono di una grande rete di supporto costituita da società assicurative, associazioni forensi per la difesa in giudizio, associazioni per la protezione e le indennità, che hanno un interesse personale nella riduzione dei rischi degli incidenti e delle perdite commerciali per i propri associati.

Nella politica della sicurezza marittima statunitense, si parte da un presupposto erroneo, e cioè che i carichi di linea - per lo più carichi containerizzati - siano il più grande generatore di scali navali annui negli Stati Uniti. Le navi che trasportano contenitori rappresentano solamente il 29% degli scali complessivi annui. I vettori di rinfuse secche e liquide costituiscono il 53% di tutti gli scali negli Stati Uniti. Gli sforzi legislativi e strategici sono, per molti versi, concentrati sui containers. Un gruppo di Washington, cioè il Consiglio delle Conferenze, nonché la Booz Allen Hamilton, hanno intrapreso una "simulazione di guerra" nel contesto della quale sono stati simulati gli effetti di "bombe sporche in contenitori" per una serie di città degli Stati Uniti. I risultati di tali simulazioni sono stati sottoposti al Dipartimento della Sicurezza della Patria.

Tale concentrazione al riguardo è alquanto malriposta, sebbene a prima vista potrebbe sembrare logico per i terroristi l'uso dei containers marittimi quali cavalli di Troia per i propri congegni nucleari o le proprie bombe sporche. Tuttavia, come correttamente sottolinea la NSHLS 2002, i terroristi preferiscono colpire bersagli ed utilizzare veicoli di consegna che presentino le minori difficoltà possibili. Per tradizione, i containers marittimi costituiscono la modalità di trasporto marittimo maggiormente ispezionata. Per convenzione, si presuppone che le Dogane degli Stati Uniti esaminino solo il 2% dei contenitori che entrano negli Stati Uniti.

Tuttavia, il commissario Robert C. Bonner, del Servizio Doganale statunitense, dichiara: "Il CBP (Ufficio statunitense delle Dogane e della Protezione delle Frontiere) ispeziona più del 2% dei contenitori. Il fatto più importante è che noi ispezioniamo il 100% dei containers che presentano il rischio potenziale di celare un'arma terroristica. Una delle nostre maggiori priorità al CBP è quella di far sì che i nostri scali marittimi siano chiusi ai terroristi, ma aperti ai legittimi traffici commerciali. Lo strumento che potrà farci raggiungere queste due mete non consiste nel numero dei containers ispezionati, bensì nel fatto che ispezioniamo le spedizioni giuste, cioè quelle che presentano una potenziale minaccia terroristica. Noi sappiamo per lunga esperienza che la maggior parte dei contenitori marittimi non presentano rischi.

Il CBP adesso riceve dettagliate informazioni elettroniche su tutti i containers diretti negli U.S.A. prima che vangano caricati sulle navi alla volta di uno scalo estero. Utilizzando questa ed altre informazioni, così come per mezzo di software sofisticati, il CBP procede alla attenta valutazione del 100% di tutti i contenitori marittimi a rischio prima che essi giungano negli Stati Uniti. E, cosa ugualmente importante, ogni contenitore identificato come potenzialmente ad alto rischio viene ispezionato sia all'estero ai sensi della CSI (Iniziativa per la Sicurezza dei Contenitori) del CBP sia all'arrivo, per mezzo di attrezzature del tipo a raggi X su larga scala nonché di congegni per la scoperta di radiazioni".

A causa del fatto che quasi tutte le merci ad alto valore vengono spedite in contenitori, i paesi esportatori, per lo più per ragioni fiscali, desiderano accertare il contenuto di ogni container che parte dal paese. La nazione ricevente vorrà, per la stessa ragione, sapere esattamente che cosa sta arrivando nel proprio paese. Perciò, per quanto riguarda i contenitori, esiste una procedura di controllo sia nei paesi di esportazione che in quelli di importazione.

Inoltre, sebbene il contenitore marittimo standard sia fatto di acciaio sottile, una bomba sporca od un congegno nucleare sarebbero probabilmente schermati, di modo che non potrebbe fuoriuscirne alcuna radiazione avvertibile. Il container potrebbe, tuttavia, costituire una piattaforma di consegna migliore per armi chimiche e biologiche.

La situazione nei traffici delle rinfuse è molto diversa. Un carico di minerale grezzo di ferro, ad esempio, caricato in Brasile su una nave appositamente attrezzata e diretta ad un porto statunitense, potrebbe facilmente nascondere un congegno nucleare od una bomba sporca che sarebbe quasi impossibile scoprire. Le radiazioni emesse dal congegno potrebbero probabilmente essere celate da quelle proprie del minerale grezzo di ferro. Anche altri tipi di naviglio potrebbero presentare questo tipo di minaccia. Congegni nucleari o di altro tipo terroristico potrebbero facilmente essere nascosti ed entrare negli Stati Uniti senza essere scoperti in quasi tutti i tipi di navi rinfusiere.

Di conseguenza, la probabilità che i terroristi portino un'arma di distruzione di massa negli Stati Uniti tramite il settore del trasporto marittimo alla rinfusa è maggiore di quella relativa al settore del trasporto marittimo internazionale di linea. Gli effetti di tale combinazione sono potenzialmente molto più devastanti dell'opzione relativa alla bomba sporca od al congegno nucleare nel contenitore. Se si accetta il comune convincimento che solamente il 2% dei containers in entrata siano controllati a fondo, si dovrebbe osservare, tuttavia, come lo 0% dei carichi alla rinfusa in entrata sia soggetto a verifica.

La difesa del settore marittimo statunitense è compito della Guardia Costiera degli Stati Uniti. Il Dipartimento della Difesa degli Stati Uniti funge nella sostanza da agenzia di supporto alla Guardia Costiera. Entrambi gli enti, unitamente alla Agenzia per la Sicurezza dei Trasporti, compongono la prima linea di difesa del settore marittimo degli Stati Uniti. Pertanto, è cruciale che i primi due organismi citati concentrino la propria attenzione sull'intero spettro delle operazioni marittime internazionali e non si concentrino in maniera miope sul settore della navigazione di linea.

La comunità dei servizi informativi dovrebbe stabilire contatti al più presto possibile con le comunità internazionali dello shipping. In questo caso, non basta stabilire solamente canali di comunicazione ad alto livello. Più importante ed efficace è il collegamento con i singoli soggetti del trasporto marittimo. Tali contatti potrebbero essere meglio istituiti tramite le società armatrici ed operative.

Come l'analisi indica, molti degli elementi essenziali del mosaico che andrà a costituire la risposta degli Stati Uniti al terrorismo sembrano essere leggermente poco centrati. Questa breve valutazione della reazione ufficiale alle minacce terroristiche nel campo del trasporto marittimo inevitabilmente conduce alla conclusione che esistono serie crepe nelle fondamenta filosofiche delle valutazioni del governo degli Stati Uniti e nella sua risposta.

E' importante che il governo statunitense, attraverso la Guardia Costiera, il Dipartimento della Difesa e l'Agenzia per la Sicurezza dei Trasporti, vada alla ricerca di collaborazione, e non solo nell'area da governo a governo, ma anche direttamente nei confronti del settore marittimo. Qualsiasi modifica nei parametri economico-istituzionali inerenti a questi mercati potrebbe rivelarsi devastante per il singolo operatore marittimo e per l'intero settore dell'industria marittima internazionale. Gli Stati Uniti possono senza dubbio contare sulla cooperazione, ma non imponendola, in particolar modo se tali imposizioni si basano su fondamenta incomplete od erronee.

E' di massima importanza che questi sforzi non diventino miopi. La maggior parte delle navi che fanno la spola sulle acque internazionali sono rinfusiere. Tali navi operano in mercati che sono molto più difficili da capire rispetto ai ben regolamentati servizi containerizzati da punto a punto assicurati dalle compagnie di navigazione di linea. Ciononostante, esse portano con sé una potenziale minaccia che è molto più difficile da scoprire e molto più devastante nelle sue conseguenze di qualsiasi altra che possa essere nascosta in un container da 20 piedi.
