Il trasporto marittimo dopo l'OSRA

Albert A. Pierce, direttore esecutivo dello TSA (Accordo di Stabilizzazione del Transpacifico) e del WTSA (Accordo di Stabilizzazione del Transpacifico in direzione Ovest), traccia un quadro del settore del trasporto marittimo di contenitori nell'era della deregolamentazione nonché del futuro ruolo degli accordi di stabilizzazione nell'ambiente creatosi dopo l'entrata in vigore dell'OSRA.

Il termine deregolamentazione è una definizione alquanto imprecisa di ciò che è avvenuto nell'ambito del mercato statunitense del trasporto marittimo di linea dopo l'entrata in vigore dell'OSRA (Legge di Riforma del Trasporto Marittimo). Si tratta, piuttosto, di un ulteriore ed accresciuto allentamento della normativa in materia, sulla scorta del processo iniziato con la legge sul trasporto marittimo del 1984.

L'OSRA, in effetti, smantella un sistema comune dei trasporti in cui il governo amministra una serie di controlli ed equilibri tra gli interessi dei vettori e dei caricatori al fine di assicurare un trattamento uguale per tutte le parti. Esso sostituisce quel sistema con un approccio maggiormente fondato sul mercato che consente ai vettori ed ai caricatori di tutte le dimensioni e merceologie di negoziare accordi di trasporto a seconda delle proprie esigenze individuali, seguendo modalità di natura più collaborativa e riservata.

L'OSRA rappresenta un passo in avanti inevitabile nell'evoluzione del trasporto marittimo ed intermodale. Di seguito se ne riportano le linee-guida.

  • Le conferenze tariffarie non possono più porre limiti alla capacità dei propri membri di sottoscrivere singoli contratti di servizio riservati. Uno o più caricatori e vettori possono partecipare a contratti di servizio individuali o congiunti; i caricatori possono non appartenere ad associazioni formali, sebbene i vettori che partecipano a contratti congiunti debbano aderire - a tale scopo - ad un accordo registrato ed in vigore;

  • le tariffe devono essere messe a disposizione del pubblico dai singoli vettori e non più a livello centrale dalla Commissione Marittima Federale;

  • i prezzi, l'origine/destinazione terrestre e le condizioni di servizio non vengono più resi pubblici nel contesto dei "termini essenziali" a disposizione del pubblico per i contratti di servizio. In tal modo, diviene impossibile per i caricatori in reciproca concorrenza richiedere termini equivalenti ai sensi dei cosiddetti "contratti anch'io";

  • i contratti di servizio multi-traffico e globali vengono riconosciuti dalla Commissione Marittima Federale; in tale contesto, solamente le parti rilevanti che disciplinano i traffici statunitensi sono soggetti alla registrazione per quanto attiene le specifiche, mentre la registrazione riguarda l'intero contratto in relazione agli scopi ed intenti riservati.

I caricatori - quali che siano le loro dimensioni - stanno diventando sempre più globali quanto al raggio delle operazioni, sia che si tratti di affidamento a terzi, produzione, distribuzione oppure vendite e marketing.

Essi considerano il trasporto in modo più completo: cioè, non tanto come una serie di movimentazioni "dal punto A al punto B", quanto come parte di una catena dell'offerta integrata estesa su tutti i mercati, tutte le linee produttive e le divisioni imprenditoriali.

I caricatori stanno cercando di razionalizzare i propri trasporti e logistica mediante l'impiego di un minor numero di vettori, la semplificazione delle tratte e dei trasferimenti, l'assortimento dei carichi al fine di riequilibrare gli equipaggiamenti ed, infine, la semplificazione della struttura tariffaria.

Infine, essi desiderano trarre un completo vantaggio dalle recenti innovazioni di servizio derivanti dal consolidamento del settore e dalla tecnologia informatica. Man mano che le fusioni e le alleanze ampliano il raggio d'azione del servizio dei vettori e che le linee di navigazione containerizzate vanno al di là del trasporto puro allo scopo di offrire una gestione delle scorte nonché servizi di espletamento delle ordinazioni, il contratto di servizio diviene un punto di riferimento che aggiunge concretamente valore alla catena dell'offerta.

Tutto ciò si riferisce ad un nuovo genere di relazioni caricatore-vettore, di natura maggiormente collaborativa e contrassegnate da un più lungo periodo temporale, che comportano uno scambio dettagliato di informazioni ed integrazioni in ordine alle operazioni. Questo tipo di cambiamenti non possono aver luogo in una notte e - pertanto - sono ancora in divenire. Ci vorranno probabilmente altri uno-due anni affinché vengano portati a termine i cambiamenti in ambito contrattuale ed in quello delle relazioni tra caricatore e vettore, ma determinati aspetti della maniera in cui nel settore marittimo vengono condotti gli affari, in realtà, sono divenuti indifferenti a partire dal 1° maggio scorso.

Venendo a parlare dei traffici pacifici, il cambiamento più evidente è stata la sostituzione delle conferenze tariffarie con gli accordi di discussione/stabilizzazione, nonché il clamoroso incremento dei contratti di servizio.

Il 30 aprile scorso, due conferenze tariffarie - la TWRA e la ANERA - hanno cessato le operazioni, mentre la JUEFC (conferenza in direzione est per il Giappone) ha seguito la stessa strada poco tempo dopo. L'ANERA era stata costituita all'inizio del 1986 con 16 membri e quando si è disciolta ne aveva otto. Il TWRA ebbe inizio alla fine del 1985 con 19 membri ma al momento della chiusura ne aveva solo due.

A questo riguardo, l'OSRA ha rappresentato il colpo definitivo. I caricatori da qualche tempo chiedevano trattative faccia a faccia con singoli vettori di propria scelta. Essi desideravano trattative più rapide e semplici nonché riservatezza, in modo da non dover condividere le proprie strategie concorrenziali con altri vettori attorno al tavolo della conferenza ovvero con altri caricatori attraverso termini essenziali registrati pubblicamente e contratti multi-traffico o globali.

I vettori appartenenti a conferenze, nel contempo, avvertivano la pressione della concorrenza che li obbligava a rispondere più rapidamente alle proposte contrattuali. Allo scopo di offrire i più complessi servizi logistici a valore aggiunto richiesti dai caricatori, essi avevano bisogno di essere più vicini alla base clientelare per mezzo di trattative dirette in ordine ai contratti riservati. Da ultimo - ma non per questo meno importante - essi sono stati indotti a porre fine alle differenze di prezzo ed ai vantaggi di commercializzazione di cui usufruivano le principali linee di navigazione "indipendenti", le cui reti ed i cui servizi ed orari erano del tutto paragonabili a quelli degli altri ma che si collocavano quali alternative a basso costo alle conferenze.

Sparite le conferenze tariffarie, non era difficile prevedere che cosa sarebbe successo di lì a poco. Dal 1° maggio al 30 giugno, la Commissione Marittima Federale ha registrato la sottoscrizione di 15.000 contratti di servizio, rispetto ai circa 3.000 dello stesso periodo dell'anno precedente. Dal 1° maggio al 31 agosto, sono state registrate circa 34.000 modifiche contrattuali: una mole di attività enorme.

Pertanto, dove vanno a posizionarsi gli accordi di trattativa/stabilizzazione in questo nuovo e molto diverso panorama dei trasporti? Il TSA era stato costituito nel 1989, mentre il WTSA lo era stato nel 1991. Essi erano coincisi con l'emersione della nuova schiera di "indipendenti importanti". Si stava cominciando ad assistere nel Pacifico ad una crescente comunione di interessi tra vettori fondata sul calante divario di servizio.

Un vettore può usufruire di una struttura dei costi assai favorevole su base da porto a porto servendo in primo luogo il mercato del proprio paese (base clientelare interna, accordi preferenziali sugli ormeggi ed i terminals, bassi costi degli equipaggi e del personale di terra, finanziamenti per la costruzione delle navi, ecc.). Quando peraltro quel medesimo vettore fa un passo ulteriore verso i servizi intermodali, il livello degli investimenti in navi ed equipaggiamenti aumenta. La percentuale di costi operativi ed amministrativi fissi per partenza aumenta. L'urgente necessità di supporto marketing e vendite al fine di conseguire un livello maggiore di utilizzazione aumenta.

E poi ci sono i fattori retrostanti: il rischio di esposizione diventa molto più grande. Il controllo dei costi, l'utilizzazione e la gestione dei beni ed i prezzi improvvisamente diventano attività molto serie. A quel punto, due applicazioni molto importanti dell'immunità anti-trust entrano in gioco: le alleanze e gli accordi di stabilizzazione. Insieme essi conseguono mete simili e costruttive in modo complementare.

E' ormai universalmente accettato che la razionalizzazione dei beni e dei servizi è vantaggiosa per la comunità marittima. Le alleanze, le fusioni ed i precedenti accordi di condivisione del naviglio hanno reso possibile la continua espansione del servizio ed una produttiva utilizzazione dei beni patrimoniali nel corso di periodi di eccesso di capacità e di tariffe in calo.

Inoltre, vi sono fattori di costo e di utilizzazione che i vettori non possono assolutamente affrontare a titolo individuale, mediante alleanze e persino attraverso le associazioni nazionali o locali degli armatori. I vettori, chiarendo che i tradizionali meccanismi di fissazione congiunta dei prezzi non sono più utilizzabili, sono stati più che espliciti circa la necessità di monitorare congiuntamente gli sviluppi di traffico e di raccomandare la fissazione individuale dei prezzi non vincolante ed altri accorgimenti operativi o di altra natura quali garanzie delle condizioni di mercato.

I vettori devono rispondere rapidamente alle fluttuazioni dei tassi di cambio, agli aumenti di prezzo del carburante, alle escursioni dei pedaggi terminalistici ed agli oneri di transito dei canali, ai problemi di intasamento dei porti, al magazzinaggio degli equipaggiamenti, alle difficoltà di detenzione e di posizionamento, all'aumento dei costi di raccordo alla luce dell'apertura di nuovi mercati, alla documentazione richiesta dalla pubblica amministrazione, alla certificazione ed ai ritardi dello sdoganamento, e così via.

Talvolta la risposta è correlata alle trattative con le agenzie governative, gli operatori terminalistici e le organizzazioni dei caricatori. Talvolta ciò significa dover richiedere congiuntamente delle modifiche alla normativa marittima di un particolare paese. Altre volte si tratta di una questione puramente tariffaria che riguarda gli aumenti o gli adattamenti degli oneri secondari.

Nell'attuale ambiente concorrenziale, un reale recupero dei costi attraverso semplici aggiustamenti della base tariffaria è assai improbabile. Ciò non attenua l'esigenza di tale recupero, tuttavia. Naturalmente, nessun caricatore è felice del verificarsi di un incremento delle tariffe tutto compreso. Peraltro, se si chiede ai caricatori se preferiscano pagare un sovrapprezzo relativo ai picchi di alta stagione oppure rischiare possibili penurie di equipaggiamento o interruzioni del servizio nel corso dei periodi di punta stagionali, lo scenario cambia.

Come si sa, i vettori transpacifici hanno valutato il mercato attuale e hanno portato a termine le proprie previsioni per il corrente anno 2000. Alla fine di tale processo di revisione è arrivato l'annuncio di un incremento tariffario complessivo di 400 dollari USA e del ripristino del sovrapprezzo di 300 dollari in relazione al periodo di punta stagionale, che ora è più compresso e va dal 1° luglio al 30 ottobre.

Due sono i punti critici in ordine agli incrementi tariffari di base dello scorso anno ed ai sovrapprezzi dei periodi di punta.

In primo luogo, non sarebbe stato assolutamente possibile ai vettori del TSA applicare una tariffa di base pari a 900-1.000 dollari (oltre ai 300 dollari dei periodi di punta stagionali) se il mercato non li avesse supportati. I caricatori ed i vettori si sarebbero scontrati sui conti, lo scorso anno.

Le tariffe relative al transpacifico dal 1995 erano già calate di più del 30%. Un improvviso, massiccio aumento dei traffici in direzione est nel 1998 in seguito alla crisi economica asiatica ha comportato una carenza di spazi ed equipaggiamenti. Il brusco calo dei volumi statunitensi in esportazione alla volta dell'Asia ha ingenerato una proporzione prossima al 3 : 1 negli equilibri inerenti agli equipaggiamenti nonché alti costi di riposizionamento, mentre i colli di bottiglia nella California meridionale e nel Texas hanno aggravato il problema; il tutto, mentre si avvicinavano i periodi di punta stagionali.

I vettori non avevano scelta ed i caricatori sapevano che, anche dopo aver pagato la tariffa di base ed il sovrapprezzo, le loro tariffe sarebbero solamente tornate - nella migliore delle ipotesi - ai livelli del 1994.

Il secondo punto è persino più critico per i caricatori. Molto è stato fatto in ordine al previsto incremento del 26% della capacità - tra cui sei nuovi servizi - che avrebbe dovuto essere immessa nel Pacifico nel biennio 1999-2000. Quanti si sarebbero fatti avanti ed avrebbero impiegato navi ed equipaggiamenti propri, ovvero avrebbero stipulato accordi di noleggio o di leasing, ovvero si sarebbero impegnati in accordi terminalistici, oppure avrebbero aperto uffici e preso del personale, se le tariffe prevalenti sul mercato nel Pacifico si fossero attestate sui livelli precedenti? Oppure se le tariffe di base ed i sovrapprezzi dei periodi di punta non si fossero assestati?

Certamente, la domanda che invocava altre navi ed altri servizi era chiara prima del 1° maggio. Non lo era più, però, alla fine dello stesso mese di maggio, quando la parola d'ordine nel mercato era la stabilizzazione degli incrementi tariffari e dei sovrapprezzi relativi ai periodi di punta e che i vettori si sentivano al sicuro. Ciò cui abbiamo assistito lo scorso anno equivaleva ai "lavori in corso" del mercato.

I vettori nel complesso si aspettano una crescita dei carichi del 1999 dall'Asia agli Stati Uniti nella misura del 10%, con una ulteriore crescita dell'8% nel 2000. Tutti gli indicatori mostrano che l'economia statunitense continuerà ad essere forte e che vi sarà una sostenuta domanda di consumo e di attività per i prodotti asiatici. Partendo dal presupposto di questi livelli di crescita, ci si può aspettare che l'offerta e la domanda per gli spazi sulle navi - data la nuova capacità - resti grosso modo in equilibrio.

Dal lato dei costi, i vettori mirano ad una serie di nuovi accordi sul lavoro marittimo e sull'autotrasporto che andranno ad aggiungersi in modo significativo ai costi relativi alla movimentazione dei carichi all'inizio del 2000. Ci si aspetta che aumentino i costi dei noleggi delle navi e dei contratti con i servizi di raccordo asiatici. I prezzi del carburante per le navi hanno fatto registrare impressionanti aumenti negli ultimi mesi ed i vettori non hanno potuto recuperare tali costi extra a causa del fatto che le tariffe "tutto compreso" della maggior parte dei contratti di servizio non hanno consentito l'applicazione di sovrapprezzi dovuti alle spese per carburante che potessero pareggiare la fluttuazione dei relativi costi.

E, malgrado i piccoli incrementi delle esportazioni statunitensi in Asia, non ci si aspetta che il servizio in direzione ovest possa assicurare i volumi di carico o gli introiti per ovviare all'attuale squilibrio degli equipaggiamenti, che al momento presenta una proporzione prossima a 2 : 1. Se si aggiungono le incognite, quali la proposta dell'istituzione di tasse per la conservazione delle baie ora all'esame del Congresso ed i costi definitivi inerenti alla prevenzione dello Y2K, le pressioni esercitate dai costi per un adeguamento di 400 dollari diventano giustificate.

E' significativo come il transpacifico sia stato un mercato del caricatore nell'ultimo decennio. Il livello dei servizi ha fatto registrare un notevole balzo in avanti, a cui non hanno corrisposto (se non in minima parte) aumenti tariffari in termini reali. Abbiamo assistito sia ad un consolidamento che all'ingresso di nuovi soggetti nei traffici, mentre i prezzi sono stati guidati principalmente dall'offerta e dalla domanda. La struttura legale, normativa e politica che governa il settore marittimo di linea si è mossa stabilmente in direzione della deregolamentazione.

La comunità dello shipping ha chiaramente tratto benefici sia dal sistema che è stato costituito sia dal processo di cambiamento evolutivo che il sistema sta ora attraversando. Si può ritenere che l'OSRA contenga in se stessa ottime promesse per i vettori come per i caricatori, alle soglie del nuovo secolo e di una nuova era.
