Relazione del presidente di Assoporti, Daniele Rossi, all'assemblea annuale dell'associazione

Autorità, Signore, Signori, Gentili ospiti,

anche a nome dei colleghi Presidenti vi porto il saluto ed il ringraziamento della Associazione dei Porti Italiani per la vostra partecipazione alla nostra Assemblea Annuale.

Introducendo la relazione annuale desidero rivolgere un ringraziamento al nostro Ministero di riferimento, ed in particolare al Sottosegretario Onorevole Traversi che ha recentemente ricevuto la delega alle attività di indirizzo e vigilanza sulle Autorità Portuali, all'Ufficio di Gabinetto ed alla Direzione Generale, che sotto la guida autorevole della Ministra DeMicheli, ci hanno garantito vicinanza ed il costante supporto per affrontare, in un clima di ritrovata serenità e franchezza, la quotidiana complessità della nostra attività.

Uno speciale benvenuto alla Vice Capo Gabinetto dottoressa Maria Teresa DiMatteo per la recente nomina alla Direzione Generale per la Vigilanza sulle Autorità Portuali.

Un sentito sincero ringraziamento al Comandante Generale delle Capitanerie di Porto Ammiraglio Giovanni Pettorino per essere qui con noi oggi. La tua presenza, Giovanni, è per noi testimonianza indelebile di amicizia e fraterna solidarietà fra uomini e donne che vivono i porti, amano il mare e lavorano con l'unico scopo di servire il bene pubblico.

Mancherei però ad un mio desiderio e dovere se aprendo i lavori non facessi un riferimento alla città che ci ospita . Al grande patrimonio storico e cultura le di Napoli, ai suoi personaggi, dai Borbone agli Angioini, agli Aragonesi. Agli uomini e alle donne che hanno portato la cultura di Napoli nella storia, nelle arti, nel cinema, che hanno reso Partenopee conosciuta in tutto il mondo.

Lo sentiremo più volte anche oggi, quello in corso è l'annus horribilis dell'economia mondiale. La mancata produzione, i mancati consumi, hanno determinato inevitabilmente minori traffici. Nel primo semestre nei porti italiani abbiamo avuto una contrazione generale in tutte le tipologie di merci, come mai si era vista dal dopoguerra. Nei primi sei mesi di quest'anno sono state movimentate 200 milioni di tonnellate di merci, con una perdita di quasi il 12 percento rispetto allo stesso periodo dell'anno precedente. Passeggeri quasi azzerati, crocieristica ferma. Hanno retto i rotabili ed container con un calo solo del tre percento.

I traffici perduti non si possono recuperare, dobbiamo mitigarne gli impatti negativi, soprattutto sui lavoratori. Non dovremo dimenticare mai quegli uomini e quelle donne che hanno consentito alla logistica italiana di superare con successo una prova drammatica. Non dovremo dimenticare mai il grande risultato che abbiamo ottenuto: tutti i nostri porti sono stati operativi sempre, garantendo la sicurezza dei lavoratori,dei marittimi e delle merci.

Anche in questo periodo Assoporti ha garantito il coordinamento delle Autorità associate nel costante dialogo con il Ministero, con le Organizzazioni Sindacali dei lavoratori e delle imprese, con la Agenzia delle Dogane, con gli Enti di promozione commerciale e turistica. Lo ha fatto al meglio delle proprie possibilità, ma sempre con dedizione ed impegno, con onestà e trasparenza.

La stessa onestà e trasparenza, passione ed impegno, che hanno caratterizzato l'operato di tutti i presidenti dei porti italiani. Non posso evitare di menzionare lo sgomento e l'amarezza che hanno generato nella comunità portuale, anche internazionale, le vicende di alcuni presidenti esposti troppo in fretta e con troppa foga al pubblico ludibrio.

Funzionari dello Stato colpiti nella loro capacità e nel loro dovere di servire l'Istituzione da giudizi che si dimostreranno, tutti indistintamente, superficiali ed inconsistenti.

Venendo all'attività associativa ricordo che l'Associazione ha sottoscritto alcuni importanti accordi di collaborazione a beneficio della economia portuale e del “sistema Paese”. Fra quelli di maggiore rilevanza:
  • il Protocollo quadro con l'Agenzia delle Dogane

    per favorire la digitalizzazione delle procedure doganali nelle aree portuali, nonché la standardizzazione delle modalità operative. Una sinergia tra l'Agenzia ed Assoporti che consentirà di realizzare progetti concreti ed in tempi definiti.
  • Il Protocollo d'intesa con Cassa Depositi e Prestiti

    finalizzato a disciplinare la collaborazione tecnico-finanziaria della Cassa con le singole Adsp per la definizione degli aspetti progettuali, economici e contrattuali nella realizzazione di nuove opere infrastrutturali.
  • Il Protocollo d'intesa con MEDCRUISE

    Che identifica forme di collaborazione nelle iniziative di comune interesse per lo sviluppo del traffico crocieristico.
  • Il Protocollo d'intesa con SVIMEZ

    Con il quale è stato costituito un “Osservatorio economico sulle ZES e sulle iniziative di sviluppo delle aree portuali”.
  • Il Protocollo d'intesa conICE e UIR

    Per collaborare nella partecipazione alle maggiori fiere internazionali di settore. Attendiamo con ansia di poter riprendere l'attività di promozione commerciale del sistema portuale e turistico italiano.
Altro impegno significativo dell'Associazione è stato (ed è tutt'ora) la partecipazione ai tavoli negoziali per il rinnovo dei contratti dei lavoratori portuali. Trattativa non facile, in un contesto reso più complesso ed incerto dalla emergenza sanitaria. Imprese e lavoratori sono chiamati oggi più che mai ad esercitare il loro senso di responsabilità e trovare quanto prima una equa soluzione contrattuale. Siamo certi che lo faranno presto, perché non è tempo per il Paese e per le banchine di nuova conflittualità.

Questo contratto, comunque vada, ha forse inconsapevolmente posto al centro del dibattito un tema di valore culturale e sociale non ancora risolto. Il tema è il giusto prezzo dei beni, dei servizi, del lavoro. Glorifichiamo gli eroi di questi tempi, i lavoratori che hanno consentito al mondo di sopravvivere, ma abbiamo creato un sistema economico mondiale che ancora non sostiene il costo della dignità del lavoro. Una maglietta non può e non deve costare due euro. Il problema ovviamente trascende le nostre banchine e dovrebbe essere affrontato in chiave politica dall'Unione Europea nelle relazioni con quegli stati che sopravvivono o prosperano fornendo opportunità di dumping sociale.

Sempre nell'ambito delle relazioni industriali, registriamo la modifica alla legge 84 introdotta con la conversione in legge del Decreto “Rilancio” che dovrebbe risolvere la vexata questio dell'autoproduzione. L'autoproduzione resta, ma sarà consentita solo dove non ci siano soggetti autorizzati in grado di garantire il servizio. Comunque la si pensi, e noi pensiamo sia stata trovata una soluzione di equilibrio, è ora il tempo di prendere atto della nuova situazione di certezza normativa, girare pagina e contribuire a regolare in maniera più razionale, programmata e trasparente il mercato del lavoro portuale, coinvolgendo sindacati, armatori e terminalisti, sotto la regia delle AdSP, alla elaborazione del Piano dell'organico dei lavoratori portuali di cui agli artt. 16, 17 e 18.

Ugualmente è il tempo per i fornitori di servizi portuali e per le organizzazioni sindacali di mostrare consapevolezza e responsabilità per fare di una buona legge una occasione di collaborazione, sostegno e rilancio dei nostri porti.

Molti sono i temi che hanno caratterizzato il dibattito politico, amministrativo ed operativo nei porti in questi ultimi tempi. Alcuni arrivano da lontano, come lo Sportello Unico Doganale e lo Sportello Unico Amministrativo che faticano a vedere compiuta la loro attuazione. Al nostro Ministero chiediamo uno sforzo eccezionale, al quale dobbiamo e vogliamo contribuire, per attivare quanto prima i tavoli di coordinamento con tutti gli enti e ministeri coinvolti. Grande è l'aspettativa di semplificazione che ha il Paese, queste procedure devono oggi essere attuate sotto la regia del MIT.

Ugualmente non è più procrastinabile la garanzia di poter dragare i porti italiani, ne va della sopravvivenza delle nostre comunità portuali. Un primo significativo passo potrebbe essere rappresentato dalla rimozione dei limiti allo spostamento dei sedimenti all'interno dello stesso bacino portuale e dalla sburocratizzazione del deposito temporaneo dei sedimenti, il cui termine andrebbe opportunamente prorogato. Noi crediamo sia possibile una tutela rigorosa dell'ambiente operando scelte normative equilibrate, in un quadro regolamentare chiaro, portando certezze e semplificazione nelle procedure.

È indispensabile un confronto su questo tema con il Ministero dell'Ambiente ed ISPRA. Noi ci siamo, con i tecnici delle nostre Autorità e l'esperienza maturata sul campo.

Altresì è necessario un impegno governativo forte per completare la semplificazione delle norme che presidiano la realizzazione delle opere portuali avviata con il DL semplificazioni. Bisogna infine mettere mano alla pianificazione portuale, se ci vogliono tre anni per l'adozione del DPSS (esperienza di La Spezia e Bari) e poi 3/4 anni per il PRP vuol dire che qualcosa non funziona, bisogna arrivare ad una gestione delle procedure amministrative in tempi rapidi per evitare che la pianificazione diventi obsoleta. Si potrebbe iniziare conferendo valenza urbanistica - nel solco del
Decreto rilancio - al DPSS almeno per quanto riguarda le destinazioni funzionali delle banchine. Per questo sembra bastare una disposizione ministeriale interpretativa, il che permetterebbe di conferire certezza e coerenza alla numerose opere pubbliche che potranno auspicabilmente essere
realizzate nei prossimi anni.

A proposito di opere pubbliche, per sostenere la ripresa economica è necessaria una nuova stagione di pianificazione strategica di medio periodo che, fra l'altro, contribuisca a ridurre il divario fra il Centro-Nord ed il Mezzogiorno.

La recente assegnazione delle risorse del Fondo Infrastrutture disposta dalla Ministra De Micheli ha risolto in modo soddisfacente le attuali necessità di investimento in opere portuali. La portualità italiana non ha bisogno di campioni infrastrutturali nazionali, la concentrazione logistica è innaturale e si scontra con la morfologia del nostro Paese. Io credo gli amici di Confetra abbiano colto nel segno, ciò di cui abbiamo veramente bisogno è restare connessi, unire materialmente ed immaterialmente gli hub logistici e portuali da nord a sud del Paese.

In particolare, i porti del sud del Paese non potranno esprimere la loro potenzialità e contribuire alla costruzione di una rete logistica nazionale diffusa se non potranno fare affidamento su una rete ferroviaria moderna ed efficiente. Interventi mirati su ferrovie, strade, digitalizzazione: qui devono essere concentrati gli sforzi e le risorse del Recovery Fund, con particolare attenzione alla integrazione logistica del sud del Paese.

La spinta alla digitalizzazione non coglierà impreparati i porti italiani. L'accordo con le Dogane, per il quale ancora ringraziamo il Direttore Minenna, ne è un esempio importante. Altrettanta aspettativa abbiamo nel nuovo management di Uirnet per la fiducia che ancora gli è stata concessa
e che auspichiamo possa imprimere in tempi brevi una svolta significativa alla implementazione del Port Community System nazionale.

Gli investimenti saranno fondamentali, ma non ci sarà ripresa senza una vera semplificazione normativa. Importanti passi sono stati fatti anche recentemente in questa direzione, ma ora è necessario porre con forza una questione culturale. Le mele marce devono essere estirpate, ma la pubblica amministrazione merita fiducia e rispetto e deve essere messa in condizione di lavorare con efficienza e serenità. Questo significa semplificare davvero il codice appalti ed il codice ambiente. Limitando le sanzioni penali, inasprendole, ai soli casi di comprovata patologica infedeltà.

Per quanto ci riguarda più da vicino, crediamo si debba arrivare quanto prima ad una compiuta attuazione della riforma della legge 84. In particolare la Conferenza dei presidenti deve funzionare con regolarità per garantire l'effettivo coordinamento centrale della portualità nazionale. Solo quando l'impianto normativo della riforma sarà a regime potremo valutarne l'efficacia e la necessità di modifiche. Discuterne oggi sarebbe solo una simpatica nostalgia.

Da ultimo, non voglio sottrarmi ad una riflessione sulle misure contenute nel Decreto Rilancio a favore del cluster marittimo portuale. Abbiamo apprezzato la sensibilità mostrata dal Governo verso lavoratori e compagnie portuali, così come per gli ormeggiatori, e ci siamo attivati per riconoscere prontamente i benefici concessi.

Per quanto riguarda canoni confidiamo si possa trovare una interpretazione della norma coerente con le aspettative dei terminalisti e dei piccoli concessionari. Non appare un esercizio facile, ma in ogni caso è opportuno preliminarmente completare l'analisi in corso delle effettive esigenze.
