Annexe n' 1
LEXIQUE PORTUAIRE

Affr'tement (remise de navire) : distinguer du contrat de transport (remise de marchandises). L'affr'tement porte sur l'usage et la jouissance du navire par l’affr'teur (le "fr'teur" met le navire ' disposition de l’affr'teur) ; le contrat de transport porte sur la marchandise que le chargeur confie au transporteur contre paiement du fret.

Armateur : celui qui exploite le navire en son nom, qu'il soit ou non propri'taire.

BCMO : bureau central de main d'œuvre, organisme tripartite institu' dans chaque port par la loi de 1947.

Brouettage : transport par voie terrestre.

CAINAGOD : caisse nationale de garantie des ouvriers dockers, aliment'e par l'ensemble des entreprises de manutention (solidarit' institu'e en 1947) ; taux de cotisation fix' par arr't' pour chaque BCMO, d'pendant du taux d'emploi des intermittents.

Chargeur : exp'diteur de tout ou partie de la cargaison d'un navire.

Conf'rence maritime : association d'armateurs constitu'e pour fixer les conditions d’exploitation de lignes r'guli'res de navigation.

Consignataires de navires : repr'sentants du propri'taire ou de l'affr'teur du navire, ils organisent l'escale au port et, dans leurs fonctions d'agents maritimes, procurent le fret que le navire aura ' transporter. Ils peuvent donc 'tre en m'me temps entrepreneurs de manutention.

Courtiers maritimes : officiers minist'riels b'n'ficiant du privil'ge d'effectuer la mise en douane du navire, du paiement des droits de port pour le compte de l'armateur, de la traduction de tous les documents officiels ; 'galement privil'ge d'affr'ter un navire pour le compte d'un chargeur.

D'tournements de trafic : trafics exp'di's par des chargeurs fran'ais ou destin's ' ceux-ci et transitant par un port 'tranger.

EVP : (conteneur) 'quivalent vingt pieds ; en anglais TEU ou Twenty Equivalent Unit.

" Feeder " : navire d'apport.

Hub portuaire : plate-forme portuaire de groupage-d'groupage des marchandises, en g'n'ral conteneuris'es.

Lamanage (souvent assur' par une soci't' coop'rative) : amarrage, d'halage ou largage des amarres.

Ligne r'guli're (par opposition aux navires affr't's ou " tramping ") : service assur' par une compagnie maritime, ses navires naviguant ' intervalles r'guliers entre des ports d'termin's.

Marchandises diverses :
- trafic roulier : transports de poids lourds ou sur remorques sp'ciales ;
- trafic conteneuris' ;
- trafic conventionnel, march' ' forte valeur ajout'e, qui n'cessite du transport int'rieur.

Outillage : hangars, terre-pleins et engins de levage.

" Panamax " :

  • navire " post-panamax " : navire dont les dimensions, sup'rieures ' 32 m en largeur et de plus de 11 m de tirant d’eau, l’emp'chent de transiter par le canal de Panama.
  • portique " over-panamax " : portique aux dimensions adapt'es ' celles d’un navire post-panamax.

Pond'reux : combustibles min'raux solides et minerais (principaux consommateurs -4/5- : EDF et sid'rurgie).

Radoub (formes et engins de) : installations de r'paration navale.

Trafic "ro-ro" : roll on-roll off, trafic transport' par la technique du transroulage, qui concerne des navires dont la cargaison est manutentionn'e par roulage gr'ce ' une porte passerelle avant ou arri're.

Trafic au tramping (vagabond en anglais) ou ' la demande : trafic transport' par un navire lou' sous contrat, par opposition au navire de ligne r'guli're.

Trafic de transbordement : marchandises en provenance d’un pays 'tranger d'barqu'es dans un port fran'ais et rembarqu'es, apr's la r'exp'dition de la cargaison ' laquelle elles appartenaient, vers leur pays de destination.

Transitaire maritime : repr'sentant portuaire du propri'taire de la marchandise et responsable des op'rations li'es au transit.

Vracs :
- liquides : surtout produits p'troliers;
- solides : sid'rurgie et combustibles min'raux solides, engrais et nourriture pour le b'tail (entr'e), c'r'ales (sortie).

Annexe n'2
RAPPEL DES PRECEDENTES INSERTIONS AU RAPPORT PUBLIC
DE LA COUR RELATIVES AUX PORTS MARITIMES (1983-1996)

1. Rapport public 1983 : les investissements des ports de commerce non autonomes

La Cour a constat' que 47 % des d'penses portuaires d’investissement (contre 22 % cinq ans auparavant) 'taient consacr'es ' l’'quipement des ports de commerce non autonomes, alors que le trafic de ces derniers ne repr'sentait que 12 % du trafic portuaire total. Les n'cessit's de l’am'nagement du territoire et le souci de r'pondre ' des besoins de d'veloppement fortement ressentis au plan local pouvaient expliquer ce ph'nom'ne. La Cour a n'anmoins relev' que cette 'volution n’'tait pas coh'rente avec la volont' affich'e de concentrer les efforts sur les grandes implantations portuaires, seules capables de lutter efficacement contre les d'tournements de trafic par la concurrence 'trang're.

En outre, la Cour a relev' que nombre d’investissements r'alis's avaient 't' lanc's sur la base d’estimations exag'r'ment optimistes du trafic probable, parfois sans v'ritables 'tudes et sans une coordination suffisante ' l’'chelon national entre tous les projets pr'sent's par les diff'rents ports. Ils n’ont pu atteindre un seuil minimum de rentabilit' et ont entra'n' des charges financi'res difficilement supportables.

Les exemples d'velopp's par la Cour concernaient : en Bretagne, la multiplication d’'quipements largement dimensionn's, plus concurrents que compl'mentaires, en mati're de trafics li's ' l’activit' agricole ; le trafic trans-Manche ; l’am'nagement des fa'ades atlantiques et m'diterran'ennes ; la r'paration navale.

La Cour recommandait en conclusion :
- que la programmation des investissements, rendue d’autant plus n'cessaire mais aussi plus d'licate par la d'centralisation des projets, 'vite les doubles emplois ;
- que des 'tudes 'conomiques et financi'res pr'alables ' chaque investissement soient effectu'es en temps utile ;
- qu’au-del' du d'veloppement des infrastructures, l’accent soit mis sur la qualit' des services rendus par le port dans son ensemble.

2. Rapport public 1984 : les investissements du port autonome de Dunkerque pour la r'ception des produits pond'reux

La Cour a relev' que la programmation g'n'rale de ces investissements avait 't' imparfaitement ma'tris'e, et qu’au cas particulier du quai ' pond'reux Ouest, le choix du site avait 't' insuffisamment pr'par'. Les r'alisations qui ont engag' l’avenir industriel et commercial du site ne paraissaient pas avoir 't' toujours pr'c'd'es d’une 'tude prenant en compte l’ensemble des co'ts et avantages pour la collectivit' publique, pour le port lui-m'me et pour ses usagers (risque d’un sous-emploi global, avec concurrence entre quais publics et quais priv's d’Usinor). Les ambitions du port ont manifest' un optimisme excessif dans le maintien prolong' d’une conjoncture favorable.

3. Rapport public 1985 : l’avenir des installations du port autonome de Bordeaux

La Cour constatait que des baisses de trafic avaient occasionn' des pertes importantes et un endettement croissant. Les autorit's portuaires avaient pris diverses mesures de rigueur, accompagn'es par l’octroi de concours publics. Mais il paraissait douteux que le dispositif retenu permette de faire face aux difficult's structurelles et financi'res auxquelles 'tait d'sormais confront' le port.

4. Rapport public 1987 : les investissements r'alis's par les ports autonomes pour la r'ception des pond'reux

La Cour a constat' que des capacit's d’accueil ont 't' d'velopp'es, faute d’orientation au plan national, sur le fondement d’une sur'valuation g'n'rale des pr'visions et donc des moyens mis en œuvre. De m'me, les modernisations des installations ont 't' trop nombreuses et r'alis'es sans planification d’ensemble, conduisant ' une sous-utilisation des installations qui ne permet plus de couvrir leur co't.

Ce double 'chec 'tait imput' par la Cour ' une absence de choix entre deux objectifs : celui de la recherche d’'conomies d’'chelle, qui exige une certaine concentration des trafics, et celui de la multiplicit' des p'les de d'veloppement portuaires, qui exclut une telle concentration. Dans l’avenir, un arbitrage des projets 'tait souhaitable au plan national, afin que les investissements r'alis's dans chacun des ports autonomes contribuent de fa'on compl'mentaire, plut't que concurrentielle, ' la satisfaction globale des besoins du pays.

5. Rapport public 1987 : la r'paration navale

La Cour a effectu' un bilan des interventions publiques en faveur de la r'paration navale. Ce bilan a r'v'l' l’inefficacit' des aides, l’ampleur du soutien apport' en pure perte ' la principale entreprise de r'paration navale (Ateliers fran'ais de l’Ouest, repris par les Ateliers r'unis du Nord et de l’Ouest), et l’importance des charges incombant aux 'tablissements portuaires au titre des 'quipements.

6. Rapport public 1990 : application de la loi du 29 juin 1965 sur les ports maritimes autonomes

La Cour constatait que le cadre administratif et financier d'fini en 1965 n’avait pas permis de faire face efficacement ' l’'volution du commerce maritime et de l’industrie portuaire. Il s’en est suivi une r'duction sensible des parts de march' des ports m'tropolitains et une d'gradation de leurs r'sultats.

La Cour relevait notamment deux causes de dispersion des efforts : une insuffisante concentration sur les ports autonomes, et notamment sur les deux sites majeurs de Marseille et du Havre, des cr'dits allou's par l’Etat ; une coordination insuffisante des projets d’'quipements, en particulier dans le domaine des terminaux ' marchandises diverses et ' conteneurs.

Elle d'non'ait en outre la confusion des responsabilit's. L’Etat a vid' de sens le principe d’autonomie des ports, marqu's par une gestion inadapt'e ' leur r'le industriel et commercial. En outre, la d'limitation des responsabilit's des ports face aux professions portuaires et aux collectivit's locales est apparue impr'cise ' la Cour. Cette observation 'tait illustr'e par l’importance de la participation des ports autonomes dans la restructuration de la main-d’œuvre docker.

7. Rapport public 1992 : la soci't' fran'aise d’'tudes et de r'alisations maritimes, portuaires et navales (Sofremer)

La Cour a constat' une d'gradation de la situation financi're, faute d’une activit' suffisante, de cette soci't' d’'conomie mixte cr''e pour promouvoir ' l’'tranger, notamment dans les pays en voie de d'veloppement, les techniques fran'aises dans les domaines maritimes et portuaires. Elle a relev' que le d'sint'r't d’un actionnariat (Etat, CGM et ports autonomes) insuffisamment concentr', illustr' par la concurrence des prestations d’ing'nierie des ports autonomes, compromettait l’utilit' 'conomique de la soci't'.

8. Rapport public 1996 : am'nagement de la zone portuaire de S'te-Frontignan

Les juridictions financi'res ont relev' les graves erreurs 'conomiques et techniques affectant la conception des ouvrages r'alis's, peu utilis's ou peu utilisables, et dont le montant global d'passait 400 millions de francs. Les critiques portaient notamment sur le processus de d'cision des collectivit's publiques, qui avait n'glig' les r'serves 'mises par les principaux utilisateurs potentiels et avait 't' acc'l'r' par la disponibilit' de cr'dits europ'ens.
