Vi sono particolarmente grato per l'invito rivoltomi a partecipare a questa tavola rotonda che affronta un tema così interessante.

La liberalizzazione e la privatizzazione del trasporto marittimo sono argomenti molto attuali per l'intera industria armatoriale e rientrano nel più ampio scenario della globalizzazione ed internazionalizzazione dei mercati.

Questa evoluzione del mondo economico ha costretto gli operatori ad affrontare e risolvere problemi di particolare delicatezza, la recente esperienza della liberalizzazione del traffico marittimo di cabotaggio, tra i paesi dell'Unione Europea, ha ampiamente dimostrato come tali processi producano problemi economici e sociali estremamente complessi.

La liberalizzazione del mercato del trasporto marittimo crea però anche un'occasione irripetibile per spingere l'intero sistema marittimo-portuale nazionale a raggiungere più elevati livelli di efficienza ed economicità, unica condizione per poter essere competitivi a livello internazionale e consentire l'acquisizione di nuove quote di mercato nonché rilanciare la modalità marittima come valida alternativa al trasporto terrestre di merci e passeggeri nell'ambito della più ampia politica di riequilibrio modale perseguita dal Piano Generale Trasporti.

Ma tornando al tema della riunione mi sembra di capire che si vogliano analizzare i processi di liberalizzazione e privatizzazione del traffico marittimo sotto il particolare profilo degli effetti negativi che gli stessi potrebbero determinare sulla sicurezza della navigazione.

In primo luogo ritengo di poter affermare che il processo di privatizzazione del traffico marittimo, cioè il graduale trasferimento dallo Stato ai privati della proprietà di società di navigazione, non comporti alcun pericolo per la sicurezza in quanto non è certo la natura pubblica o privata dell'armatore che può determinare maggiori o minori rischi, quanto piuttosto la serietà professionale con la quale viene gestita l'attività armatoriale ed i controlli ai quali viene sottoposta.

Mi limiterei pertanto ad esaminare solo le problematiche connesse alla liberalizzazione del mercato dei traffici marittimi e gli effetti dannosi che potrebbero scaturirne per la sicurezza della navigazione.

Non c'è dubbio che i processi di liberalizzazione dei mercati se non adeguatamente regolamentati possano costituire un rischio per la sicurezza.

In particolare nel settore dei trasporti marittimi questo rischio è stato fortemente avvertito in occasione dell'apertura del mercato del traffico di cabotaggio europeo quando si è temuto che potesse essere consentita una facile concorrenza non solo sotto il profilo economico, per i più bassi costi gestionali di alcune bandiere, ma anche sotto l'aspetto della sicurezza in quanto molte navi potevano diventare competitive proprio in quanto sotto standard.

Fortunatamente esistono normative internazionali molto severe per la verifica degli standard operativi delle navi ed anche un insieme di strumenti di controllo che svolgono un'azione deterrente nei confronti di coloro che mirano ad entrare nei mercati ad ogni costo con poco riguardo alla sicurezza.

Tali strumenti sono a tutti noti, ma mi sembra opportuno evidenziare quello che è risultato finora il più incisivo e che peraltro vede coinvolta direttamente anche la categoria dei piloti.

Mi riferisco alla Direttiva Europea del 19/6/1995 n. 21 sul controllo dello Stato di approdo, comunemente chiamata "Port State Control".

Tale direttiva ha finora dato ottimi risultati consentendo agli Stati membri della Comunità di controllare nei proprio porti le navi di qualunque bandiera al fine di individuare quelle substandard, riducendo così drasticamente, nelle acque comunitarie, la presenza di navi pericolose sia per la sicurezza della navigazione e della vita umana che per l'ambiente.

In questo contesto acquistano particolare rilievo le funzioni tipiche svolte dai piloti dei porti sia per quanto riguarda l'organizzazione ed il coordinamento dei movimenti delle navi che il vero e proprio pilotaggio delle stesse.

E' indubbio che tali funzioni sono importanti per il mantenimento degli alti livelli di sicurezza operativi come è altrettanto vero che i progressi tecnologici relativi alla manovra della nave possono costituire un valido ausilio per ulteriormente migliorare l'efficienza e la produttività del servizio di pilotaggio.

Ciò premesso ritengo comunque doveroso affrontare alcune delicate questioni.

Mi riferisco in primo luogo alla struttura monopolistica del mercato di pilotaggio e alle problematiche ad esse connesse.

Per quanto concerne la struttura monopolistica questa rappresenta una costante in tutti i porti europei ed appare pertanto poco ragionevole ipotizzare l'introduzione nei singoli porti di più organizzazioni di pilotaggio in concorrenza tra loro. Ciò viene peraltro confermato anche dalla necessità di affidare 24 ore al giorno e 365 giorni l'anno ad un'unica organizzazione la responsabilità del coordinamento degli accessi delle navi al porto, il controllo delle precedenze e l'assunzione di obblighi di servizio pubblico, specie in casi di emergenza.

La struttura monopolistica si lega pertanto al carattere di universalità del servizio di pilotaggio e come tale si può condividere in quanto ritenuta la più rispondente alle esigenze operative dei porti, ma crea comunque una posizione dominante da parte dell'erogatore del servizio con il rischio che possa facilmente degenerare in abuso.

Diventa quindi necessario esaminare attentamente quali possono essere i casi in cui l'esclusiva si trasforma in abuso di posizione dominante allo scopo di individuare quali correttivi possono essere adottati per evitarlo.

In primo luogo è indispensabile garantire che le tariffe di pilotaggio siano fissate attraverso un procedimento trasparente che consenta di rapportare al costo effettivo del servizio universale, intendendo per tale il costo complessivo di una efficiente organizzazione di pilotaggio tenendo conto delle caratteristiche operative di ciascun porto.

Mi sembra di poter affermare che tale esigenza sia già oggi sufficientemente soddisfatta dall'attuale sistema di adeguamento tariffario basato sulla famosa "formula matematica", in vigore dalla fine degli anni '70. Peraltro questo sistema ha ottenuto anche una autorevole approvazione dalla Corte di Giustizia europea nella sua nota sentenza del 18 giugno 1998 che, sebbene si riferisca alle tariffe del servizio di ormeggio, può essere facilmente estesa anche al servizio di pilotaggio per la stretta analogia esistente tra i due sistemi di tariffazione.

Certamente il metodo è perfettibile e l'occasione che ci viene offerta dall'istruttoria nazionale sui criteri ed i meccanismi di formazione delle tariffe, prevista dall'art. 14, comma 1 bis della legge n. 84/94, può essere proficuamente sfruttata, nella consapevolezza, però, che il vigente sistema non può certo essere stravolto essendo lo stesso una base di riferimento pienamente condivisa da tutte le Associazioni rappresentative degli utenti del servizio.

E' inoltre necessario che il pilotaggio venga prestato agli utenti secondo le effettive esigenze della nave, la presenza del pilota a bordo può, infatti, essere in alcuni casi non necessaria ed imporla ingiustificatamente potrebbe costituire un abuso di posizione dominante.

Nell'affermare ciò sono pienamente consapevole che questo rappresenta uno dei problemi più delicati in quanto coinvolge sia l'estensione del sistema di pilotaggio in VHF che l'applicabilità, anche nei porti italiani, del certificato di esenzione dal pilotaggio (PEC).
E' indiscutibile che i progressi tecnologici relativi alla conduzione della nave (bow thrusters e propulsori azimutali) consentono oggi alla stessa una più sicura manovrabilità anche in specchi acquei ristretti e che la disponibilità di sistemi di navigazione come il GPS e di controllo del traffico come il VTS rendono possibile un più facile coordinamento e controllo della nave senza la necessità obiettiva della presenza a bordo del pilota.

Per quanto riguarda il certificato di esenzione dal pilotaggio (PEC) lo studio svolto nel 1995 dalla società di consulenza danese RH & H, per conto della Commissione europea, ha mostrato che in gran parte dei porti del Nord Europa tale certificazione è da tempo in vigore, specialmente nei confronti delle navi traghetto con elevata frequenza di scali, mentre nei porti del Mediterraneo non risulta essere applicata.

Tale distinzione tra porti nord europei e porti mediterranei viene di solito giustificata in base alle caratteristiche operative di questi ultimi che essendo quasi tutti affacciati sul mare (porti breakwater) ed in quanto dotati di specchi acquei operativi molto più ristretti non possono essere equiparati a quelli nord europei ove la nave con elevata frequenza di scali può invece operare in sicurezza anche senza l'ausilio del pilota in quanto la navigazione per l'ingresso e l'uscita da porto avviene lungo corsie di marcia predeterminate e di solito alle foci di fiumi cioè in condizioni meteo marine meno avverse.
Pur apparendo convincenti tali considerazioni non escludono il dato di fatto che quando una nave ed il suo comandante sono frequentatori abituali di un porto la funzione del pilota a bordo risulta notevolmente ridimensionata prevalendo invece quella del pilota inteso come regolatore e coordinatore del traffico portuale. Per questa ragione a tali navi in futuro dovrebbe essere allargata il più possibile alla facoltà di ricorrere alla prestazione di pilotaggio via radio (shore based pilotage).

Affermo questo senza toni polemici in quanto sono convinto che, sia pure con una certa difficoltà, nella categoria dei piloti italiani stia già maturando la consapevolezza di dover pervenire a tale soluzione la quale, a mio avviso, consentirebbe di stemperare notevolmente la crescente richiesta, da parte degli operatori, di ottenere, alla stregua degli altri porti europei, forme di esenzione totale di pilotaggio.

Lo shore based pilotage consentirebbe, infatti, di salvaguardare le esigenze della sicurezza della navigazione mantenendo un costante contatto tra nave e torre di pilotaggio e garantendo altresì un pronto intervento del pilota in caso di emergenza. Il tutto senza gravare eccessivamente sui costi della nave e senza far subire alla stessa alcun ritardo operativo.

Una analoga considerazione ritengo doveroso fare anche in ordine all'attuale sistema di pilotaggio obbligatorio con pilota a bordo per le navi mercantili in transito nello stretto di Messina superiori a 15.000 GT, anche qui la prossima installazione del sistema VTS dovrà comportare una verifica puntuale della necessità di mantenere il pilotaggio obbligatorio a bordo della nave valutando la possibilità di sostituirlo con un servizio di pilotaggio in VHF.

La Commissione europea, in coerenza con quanto indicato nel famoso libro verde sui porti, ha recentemente affidato ad una società di consulenza olandese, la "Dynamar", uno studio sui servizi tecnico nautici portuali in vista dell'emanazione di una direttiva comunitaria.

Questa potrebbe essere l'occasione per individuare criteri comuni per evitare la concorrenza sleale tra i vari porti nel campo dei servizi tecnico nautici.

Mi riferisco in primo luogo alla necessità di vietare qualunque disposizione statale che preveda condizioni di favore per le navi battenti bandiera dello Stato al quale appartiene il porto. L'Italia da tempo ha eliminato queste distorsioni ed oggi si può affermare che non sussiste nei porti nazionali alcuna discriminazione tariffaria basata sulla bandiera della nave. Situazioni del genere sembrano invece esistenti ancora in altri Stati membri come ad esempio in Grecia dove le navi passeggeri di bandiera greca e cipriota sono completamente esentate dal servizio di pilotaggio, ma anche in altri Stati comunitari esistono sconti tariffari a navi di bandiera nazionale che appaiono palesemente in contrasto con le regole della concorrenza e con il principio della libera circolazione dei servizi.

In secondo luogo un'altra possibile distorsione della concorrenza, che la direttiva comunitaria dovrebbe affrontare e risolvere, è costituita dal fatto che in alcuni Stati il costo del servizio di pilotaggio è posto totalmente a carico dell'utente, come avviene in Italia, mentre in altri viene in parte sostenuto dallo Stato attraverso varie soluzioni quali ad esempio attribuendo ai piloti lo status giuridico di funzionari pubblici (Belgio, Grecia, Portogallo e Danimarca) ovvero finanziando in tutto o in parte i mezzi e le strutture del servizio di pilotaggio.

Inoltre sarebbe opportuno definire a livello europeo gli standard minimi professionali dei piloti con obbligo di aggiornamento e perfezionamento come garanzia per una uniforme prestazione qualitativa del servizio di pilotaggio a livello comunitario.

In conclusione nel prossimo futuro ci attendono impegni molto delicati che dovremo saper affrontare e risolvere. Come già in passato sarà a tal fine determinante lo spirito collaborativo che tradizionalmente lega i piloti all'armamento e non credo quindi di esagerare se affermo che è proprio questa fattiva collaborazione a farmi credere che i nostri rapporti in futuro non potranno che migliorare.
