I PUM e la Pianificazione urbanistica

8.1 Il trasporto pubblico locale (TPL) e la mobilità urbana

L'offerta di trasporto pubblico locale su gomma (urbano ed extraurbano) è aumentata dell'84% tra il 1970 e il 1996 con il massimo raggiunto nel 1990 ed un successivo decremento del 2%; opposto è invece l'andamento dell'offerta dei servizi tramviari, in diminuzione fino al 1994, anno in cui è cominciata la ripresa (6% dal 1994 al 1996). E' cresciuta di 4,5 volte l'offerta di servizi di metropolitane dal 1970 al 1996, ma va rilevato che in 25 anni sono stati costruiti appena 74 km di linee.

Con l'emanazione decreto legislativo 400 del 20.09.99, modificativo del decreto legislativo 422/97 lo Stato ha completato la riforma del trasporto pubblico locale, decentrando tutte le competenze in materia, puntando alla creazione di soggetti pubblici locali forti nell'esercizio delle funzioni di programmazione, amministrazione e controllo ed alla riorganizzazione della gestione dei servizi sulla base di aziende efficienti in regime di concorrenza.

Rimane ancora necessario l'impegno dello Stato sul tema del coordinamento e del monitoraggio del processo di attuazione della riforma e del sostegno pubblico nell'affrontare il problema della mobilità urbana e metropolitana, vera e propria emergenza nel nostro sistema di trasporti.

L'elemento innovativo di maggior rilievo è l'introduzione di un sistema di concorrenza per il mercato. La liberalizzazione regolata e la concorrenza nell'affidamento della gestione dei servizi - con l'obbligo di coprire con i ricavi almeno il 35% del costo complessivo - sono gli strumenti per permettere che il trasporto locale corrisponda meglio alle esigenze dei cittadini e recuperi competitività.

Si consentirà così la distinzione chiara tra i ruoli di programmazione e controllo - di competenza dell'Ente pubblico - e di gestione del servizio, di competenza della società di trasporto. L'introduzione di elementi di concorrenza stimolerà la modernizzazione, e la presenza sul mercato di più operatori garantirà maggior efficienza e un miglior rapporto costo/prestazioni.

Le relazioni tra i diversi soggetti saranno regolate da contratti di servizio, per definire le singole competenze e lo standard per la qualità dei servizi. L'interesse per il cittadino-utente converge con l'obiettivo di realizzare un sistema di mobilità sostenibile per le aree urbane e metropolitane, per le quali si richiede l'attivazione di una serie di misure infrastrutturali, di ammodernamento dei mezzi del trasporto pubblico, di maggior efficienza gestionale, di integrazione tariffaria, di governo del traffico con tecnologie informatiche e telematiche.

L'intera rete ferroviaria di interesse regionale e locale passa alla competenza delle Regioni. Lo Stato continuerà a garantire i finanziamenti per il risanamento tecnico e per lo sviluppo, alimentando gli interventi per la straordinaria manutenzione e per l'ammodernamento.

Grande attenzione è riservata alla qualità dei servizi, individuando livelli minimi di qualità, raccogliendo le valutazioni degli utenti e prevedendo meccanismi sanzionatori.

Il DPR 277 del 27.7.98 recepisce le direttive europee, per la costruzione di un mercato aperto dei servizi ferroviari. In definitiva l'intera normativa costruisce un apprezzabile strumento di apertura del mercato del trasporto ferroviario regionale. Le trasformazioni societarie da sole ben poco produrrebbero, senza una riorganizzazione produttiva ed economico-finanziaria e il processo chiama in causa le Regioni, le aziende e le forze sociali.

Il previsto ricorso al contratto di servizio deve garantire la corrispondenza tra gli oneri per i servizi e le risorse disponibili; contenere gli impegni del gestore per i piani di sviluppo e potenziamento delle reti e degli impianti e fissare il coefficiente minimo di utilizzazione sia per la istituzione che per il mantenimento di ciascuna linea. Tutti gli elementi del contratto costituiscono i componenti del capitolato di appalto della gara per l'affidamento del servizio, e ciò rappresenta una garanzia di trasparenza. L'obiettivo è quello di generare un circolo virtuoso: migliorare la qualità del servizio, attrarre più utenza, migliorare il rapporto ricavi-costi, generando così più risorse per investimenti ed ulteriori miglioramenti dell'offerta.

Per quanto riguarda in particolare la mobilità urbana viene proposto di lasciare ai Comuni o aggregati di Comuni totale libertà nella scelta degli interventi infrastrutturali, tecnologici, gestionali ed organizzativi volti al miglioramento dei livelli di servizio del sistema di trasporti nelle singole realtà locali e di riservare allo Stato il ruolo di cofinanziatore degli interventi qualora essi vengano ritenuti capaci di raggiungere precisi e quantificabili obiettivi prefissati. I Piani Urbani della Mobilità (PUM) sono lo strumento attraverso il quale le realtà locali definiscono l'insieme di interventi più appropriati per il raggiungimento di detti obiettivi.

Con i PUM si potranno richiedere finanziamenti allo Stato per interventi atti a conseguire gli obiettivi di mobilità generale previsti dal Governo, ai quali possono aggiungersene altri delle Amministrazioni locali. I finanziamenti quindi non saranno più per opere, ma per obiettivi.

Il PUM si differenzia anche dai Piani Regionali dei Trasporti (PRT) per le dimensioni dell'area sulla quale esso agisce.

I soggetti beneficiari potranno essere gli agglomerati urbani con popolazione superiore a 100.000 abitanti, singoli Comuni, aggregazioni di Comuni limitrofi e Province aggreganti Comuni limitrofi. Per accedere ai finanziamenti - ottenuto il parere favorevole dalla Regione - le richieste potranno essere attivate in modo standardizzato a cadenza annuale (sulla base della legge Finanziaria).

I principali obiettivi che devono essere perseguiti con le opere previste dai PUM sono:

· il soddisfacimento dei bisogni di mobilità;

· il rispetto degli obiettivi fissati con il protocollo di Kyoto;

· la sicurezza del trasporto;

· la qualità del servizio;

· l'efficienza economica del trasporto.

A questi obiettivi se ne possono aggiungere altri d'interesse locale.

Fermi restando tali obiettivi, il PUM deve rispettare alcuni vincoli tra i quali il rispetto degli strumenti programmatori esistenti, la possibilità di effettuare interventi per fasi funzionali e la disponibilità delle risorse finanziarie. A tale proposito è necessario che lo Stato preveda un piano poliennale di investimenti stanziando una cifra annuale non inferiore a 1000 miliardi di lire in aggiunta alla media delle risorse stanziate negli ultimi 5 anni dalle singole leggi di settore. Tali investimenti sono aggiuntivi rispetto ai trasferimenti di fondi dallo Stato alle Regioni e avranno termine nell'arco temporale massimo di 10 anni prefissato per il raggiungimento degli obiettivi dei PUM.

Le principali fonti di copertura del piano possono essere così sintetizzate:

· per il finanziamento degli investimenti: il finanziamento statale, il cofinanziamento UE o da bilancio degli Enti Locali, capacità interna del sistema di autofinanziamento;

· per il finanziamento della gestione: le risorse esterne, ovvero forme di incentivazione;

· i rientri tariffari da trasporto pubblico, dal pricing delle strade (road e park-pricing);

· i risparmi da recupero di produttività aziendale;

· i tributi locali.

Infine, per l'aspetto urbanistico, è indispensabile che il PUM intervenga come variante dei Piani urbanistici esistenti e, con le politiche e le previsioni della mobilità, costituisca uno degli elementi rilevanti per la predisposizione degli strumenti urbanistici generali ed attuatitivi: il tema della mobilità, anche in base ai suoi aspetti ambientali, rivisto alla luce delle tematiche della pianificazione territoriale, può assumere il valore di "standard" qualitativo. Tale concetto va esteso alla pianificazione di area vasta, anche in base alla definizione dei soggetti beneficiari dei finanziamenti per obiettivi di mobilità. Occorre considerare che le forme di pendolarismo giornaliero e settimanale su distanze medio-lunghe sono un fenomeno particolarmente evidente nelle macro aree urbane e sono, in gran parte, effetto delle scelte di localizzazione delle espansioni residenziali di "corona", prive di una correlata politica di miglioramento della mobilità e dell'adeguamento delle infrastrutture esistenti. Nel caso della pianificazione di area vasta, occorre approfondire il tema relativo alla diversità dei soggetti competenti in tema di mobilità, non necessariamente solo pubblici, che appaiono doversi formare per "aggregazione" intorno al problema della mobilità stessa.

Dovrà essere monitorato il raggiungimento degli obiettivi gestionali e predisposto successivamente un regolamento nel quale siano indicate le modalità e le procedure di accesso, valutazione, concessione ed erogazione di finanziamenti, i parametri e le valutazioni di merito. A tal fine l'Amministrazione centrale dovrà dotarsi di un ufficio per la valutazione e il successivo monitoraggio dei PUM.

8.2 Linee guida per la redazione dei Piani Regionali dei Trasporti

Al fine di promuovere un effettivo rinnovamento nelle modalità di predisposizione dei Piani Regionali dei Trasporti (PRT), di assicurare il massimo di coordinamento con le scelte del PGT, di consentire una chiara confrontabilità tra le proposte dei vari PRT, sono state indicate le linee guida per la redazione e la gestione dei PRT stessi. Ciò in quanto l'unitarietà fisica e funzionale del sistema dei trasporti consiglia, in sede di programmazione, coerenza di obiettivi, di vincoli e di strategie su tutto il territorio nazionale. La mobilità locale, infatti, si svolge in parte su infrastrutture, quelle di interesse nazionale, per le quali le scelte di intervento rimangono in carico allo Stato e in parte su infrastrutture, di preminente interesse regionale, per le quali le scelte vengono demandate alle Regioni. Diventa quindi essenziale che i PRT vengano predisposti in stretto coordinamento con il PGT, nella sua dimensione dinamica di piano-processo.

E' fondamentale che i Piani Regionali non vengano più intesi come mera sommatoria di interventi infrastrutturali, ma si configurino come "progetti di sistema" con il fine di assicurare una rete di trasporto che privilegi le integrazioni tra le varie modalità favorendo quelle a minore impatto sotto il profilo ambientale.

Gli obiettivi diretti sono:

· garantire accessibilità per le persone e le merci all'intero territorio di riferimento, anche se con livelli di servizio differenziati in relazione alla rilevanza sociale delle diverse zone;

· rendere minimo il costo generalizzato della mobilità individuale e collettiva;

· assicurare elevata affidabilità e bassa vulnerabilità al sistema, in particolare nelle aree a rischio;

· contribuire al raggiungimento degli obiettivi di Kyoto;

· garantire mobilità alle persone con ridotte capacità motorie e con handicap fisici.

Obiettivi indiretti sono:

· ridurre gli attuali livelli di inquinamento;

· proteggere il paesaggio e il patrimonio archeologico, storico e architettonico;

· contribuire a raggiungere gli obiettivi dei piani di riassetto urbanistico e territoriale e dei piani di sviluppo economico e sociale.

Nel perseguire questo sistema di obiettivi, i piani locali di trasporto debbono rispettare i vincoli derivanti da direttive europee e da leggi nazionali, in particolare i vincoli di budget imposti da scelte del governo centrale o dei governi regionali. Particolare attenzione va dedicata anche ai vincoli relativi all'inquinamento atmosferico.

Le principali strategie da adottare sono:

· strategie istituzionali che consistono nella promozione del coordinamento e dell'integrazione di competenze, nell'introduzione di procedure moderne di pianificazione ed istituzione di Enti e uffici specifici (uffici di Piano, osservatori sulla mobilità) e nell'attivazione di procedure di controllo sull'attuazione del piano;

· strategie gestionali che vanno adottate ai sensi del Decreto legislativo 400/99;

· strategie infrastrutturali che consistono nel riequilibrio della ripartizione della domanda tra le diverse modalità, sia per i passeggeri sia per le merci, nell'integrazione fra le diverse componenti del sistema (intermodalità), nella utilizzazione massima delle infrastrutture esistenti con il recupero di quelle divenute obsolete o sottoutilizzate.

Le Regioni devono innanzitutto produrre congiuntamente, attraverso la Conferenza Stato - Regioni, la costruzione di un quadro complessivo delle attese, cioè la chiara e concordata elencazione dei principi chiave dell'assetto trasportistico desiderato in termini di soglie di costo delle modalità di trasporto, di soglie tariffarie, di ubicazione strategica delle infrastrutture nodali, di realizzazione e mantenimento delle reti portanti, nonché di indicatori di sicurezza e ambientali.

La procedura per i finanziamenti da parte dello Stato dovrebbe quindi prevedere:

· la costituzione di un Fondo Unico per gli investimenti sulle infrastrutture di interesse regionale, dimensionato in un primo tempo sulla spesa storica;

· la ripartizione del fondo tra le Regioni, secondo i parametri da stabilire in sede di Conferenza Stato-Regioni, in base a metodologie che tengano conto delle strategie di riallineamento della qualità dei trasporti a livello nazionale;

· la predisposizione da parte delle Regioni degli studi di fattibilità relativi a singoli investimenti, nei quali è definito il piano finanziario e quindi la copertura dei costi.
