5. LEGISLAZIONE E SOSTEGNI AL SETTORE

Contributo Armatore ex art. 3 Legge 88/2001

Nell'aprile 2001 è stata pubblicata la legge 16/3/2001 N° 88 che, in alternativa al tradizionale contributo a favore del cantiere costruttore, fra le altre disposizioni, riconosce agli armatori un credito d'imposta (ex art. 2 della Legge) o un contributo in conto interessi (ex art. 3 della Legge) per i contratti relativi a nuove costruzione stipulati entro il 31 dicembre 2000.

Purtroppo la legge, per un inammissibile ritardo nella predisposizione del decreto attuativo, è diventata operativa solo un anno dopo, nel marzo 2002 con la pubblicazione del D.M. 27/12/2001 N. 487.

La Legge, quando ha cominciato a funzionare, si è subito bloccata per insufficienza di fondi.

Solo alcune delle iniziative già in corso hanno potuto ricevere i contributi spettanti.

Dobbiamo segnalare e stigmatizzare pesantemente l'insensibilità degli organi politici e governativi che non hanno provveduto a stanziare nella Finanziaria per l'esercizio 2003 i fondi, peraltro modesti, necessari per sostenere investimenti già avviati da tempo da parte di cantieri ed armatori, che hanno fatto affidamento sulla lealtà degli organi di governo nel mantenere impegni assunti con leggi vigenti dello Stato.

Auspichiamo che, con appropriati provvedimenti legislativi, già nel 2003 possano essere reperiti i fondi necessari, circa 24.000.000,00 di Euro, per garantire i sostegni per circa 20 iniziative, attualmente non assistite e già in avanzata costruzione.

Senza queste misure, che dipendono solo ed esclusivamente dagli organi nazionali, potrebbe esplodere in maniera incontrollabile la già grave situazione della cantieristica nazionale con pesanti ripercussioni anche sull'armamento.

La costruzione delle nuove navi è stata avviata da parte di cantieri e armatori nella certezza che lo Stato erogasse i contributi promessi e previsti dalle leggi vigenti, come sempre accaduto in passato, e come accade negli altri paesi europei, che dispongono tempestivamente di strumenti legislativi adeguatamente finanziati per la maggiore efficienza dell'apparato statale.

E' paradossale inoltre l'atteggiamento di insensibilità da parte del Governo, poiché tali navi sono indispensabili per l'economia e l'attività industriale del Paese, che dalla loro mancata consegna subirebbe un grave pregiudizio diretto e indiretto.


Normativa sulla demolizione del naviglio vetusto: legge 51 del 7 marzo 2001

Va segnalato che, grazie all'impegno dell'Amministrazione e delle Associazioni di categoria, è finalmente diventata operativa la legge 7 marzo 2001 N° 51, che prevede contributi per demolizione di naviglio cisterniero a singolo scafo di oltre 20 anni.

Questo provvedimento, ormai esaurito, è stato sicuramente importante ed apprezzabile da molti punti di vista. Tuttavia ha avuto una ricaduta pressoché nulla sull'acquisizione di nuovi ordini per i cantieri italiani ed europei.

Comunque, con logiche e necessarie revisioni, iniziative analoghe possono essere in futuro un sicuro punto di riferimento, abbinando un rispetto indispensabile per le decisive problematiche ecologiche e la necessità assoluta di un rilancio dell'attività produttiva dei cantieri.


Fondo centrale di garanzia

Dopo sei anni dalla sua emanazione come norma di legge (art. 5 della legge 31/7/1997 N° 261), è completamente inoperante il Fondo Centrale di Garanzia, che prevede la copertura dei rischi per le Banche che finanziano armatori per nuove costruzioni commissionate a cantieri nazionali.

Quello che poteva essere un importante strumento di sostegno, specie per gli armatori medi e piccoli, committenti storici dei cantieri ANCANAP, si è rivelato solo una vana ipotesi di lavoro, che ha impegnato inutilmente risorse finanziarie, intellettuali e di tempo, senza alcun risultato pratico.

Negli altri paesi europei provvedimenti analoghi sono applicati da tempo con risultati positivi, sia per la cantieristica che per l'armamento.


Regolamento CE "Meccanismo difensivo temporaneo per la costruzione navale"

Il 27 giugno 2002 è stato emanato il regolamento CE n. 1177/2002 del Consiglio relativo ad un meccanismo difensivo temporaneo per le costruzioni navali.

Il provvedimento prevede per i contratti stipulati entro il 31/3/2004 un sostegno fino al 6% del valore contrattuale prima dell'aiuto alle seguenti tipologie di navi:

  • Portacontainer

  • Chimichiere

  • Navi cisterna per prodotti petroliferi

  • Navi per trasporto di gas naturale liquefatto (LNG)

Per queste ultime, tuttavia, l'aiuto sarà autorizzato solo per i contratti definitivi firmati "previa comunicazione della Commissione nella Gazzetta ufficiale delle Comunità europee che confermi, sulla base delle indagini riguardanti il 2002, che l'industria comunitaria ha subito danni materiali ed un grave pregiudizio in questo di segmento di mercato a causa delle pratiche sleali coreane".

E comunque assurdo che il sostegno possa essere riconosciuto solo a condizione che venga dimostrato che un cantiere navale coreano è entrato in concorrenza per l'aggiudicazione del contratto offrendo un prezzo inferiore.

Si tratta evidentemente di una prova "diabolica" quasi impossibile da esibire.

Il Regolamento in Italia non è ancora operativo, in quanto la Legge Finanziaria per il 2003 non ha stanziato fondi per la copertura delle esigenze finanziarie e non è stato recepito, come necessario, dalla legislazione nazionale.

Il provvedimento, così come deliberato dal Consiglio dei Ministri europei (che ha completamente ignorato le indicazioni del Parlamento europeo che estendeva il provvedimento ad altre tipologie di nave e con aliquote superiori) è apprezzabile in linea di principio ma largamente insufficiente per contrastare i livelli di prezzo applicati dalla Corea ricorrendo a pesanti politiche di dumping.

E' essenziale comunque che tale provvedimento venga intanto adottato e finanziato dalla legislazione italiana e poi esteso, con un aumento dell'aliquota, anche alle gasiere, traghetti, fast ferry e supply vessel, che sono i segmenti di mercato, minacciati anch'essi dal dumping coreano, in cui i cantieri italiani operano maggiormente. E' proprio nel segmento di mercato ad alta tecnologia, infatti, che la Corea ha dichiarato di voler entrare in maniera prepotente per arrivare, entro i prossimi anni, almeno ad una quota del 35% di tale settore.
