Relazione del Presidente, Alfredo Tosato

Signore, Signori, Autorità, Cari colleghi, Cari amici, gentili ospiti

Vi porgo un cordiale saluto e un caloroso benvenuto a questa 41a assemblea nazionale che ci vede ritornare a Genova, nostra città natale, dopo le "convention" di Napoli nel 2010 e Venezia nel 2011.
Nell'assemblea dell'anno scorso avevamo già affrontato attentamente sia lo scenario generale sia gli episodi particolari in cui la nostra categoria ed alcuni nostri associati si trovavano coinvolti.
Oggi ad un anno di distanza non possiamo certo dire che il quadro sia migliorato, anzi per certi aspetti ci duole constatare come nessun progresso o soluzione sia emersa alle varie problematiche sottoposte alle autorità competenti, con l'aggravio di uno scenario globale ulteriormente peggiorato.
Come già indicato nella relazione scorsa, i rapporti con i vari Ministeri coinvolti sono eccellenti, tutte le amministrazioni interessate si sono dimostrate disponibili e pronte a esaminare le nostre istanze e le nostre difficoltà, ma purtroppo nel concreto non si è ottenuto altro che rinvii o esitazioni.
Siamo consapevoli del momento dove le priorità sono altre e dove prevale il rimodellamento delle strutture che il nuovo governo "tecnico" sta apportando alle organizzazioni ministeriali, ma sollecitiamo con forza che tutti gli argomenti attualmente in essere vengano prontamente affrontati e possibilmente risolti.

È quindi con grande piacere che salutiamo e ringraziamo per la loro presenza, il Dott Diego Rispoli Direttore del dipartimento accise del Ministero delle Finanze, il Rappresentante del compartimento Regionale dell'agenzia delle Dogane Dott Senigalli, il Dott Claudio Monteverdi Direttore dell' Agenzia delle Dogane della circoscrizione di Genova, e il Dott Luigi Merlo presidente dell'Autorità portuale di Genova notoriamente la più importante del sistema portuale Italiano, sia dal punto di vista doganale che dal punto di vista dei traffici marittimi.
L'essere qui con noi oggi testimonia ancora una volta l'attenzione, e l'interesse che le autorità centrali e periferiche hanno nei confronti della nostra categoria.
È quindi a loro che ci rivolgiamo oggi perché si possano affrontare e risolvere in concreto gli argomenti più urgenti ormai da troppo tempo giacenti sul tavolo delle discussioni.
Ci riferiamo in particolare alla questione della corretta interpretazione dell'art. 8bis e relativa emissione di bolletta doganale export, che ancora oggi appare non completamente definita nei suoi meccanismi e nella sua correttezza applicativa, lasciando in sospeso gravi contenziosi con alcuni nostri associati.
Ci riferiamo anche alla nuova normativa che limita il valore delle transazioni commerciali con pagamento in contanti, effettuate "sul territorio" nazionale.
La norma nasce con uno scopo ben preciso e condivisibile, ma se applicata anche alle operazioni di fornitura navale, mette a rischio la sopravvivenza di numerose aziende che durante la stagione estiva beneficiano dell'arrivo nei porti di numerose navi da crociera, che per l'occasionalità del rapporto regolano sempre in contanti i loro acquisti, con somme ben oltre i limiti ammessi dalla legge.
A tal proposito abbiamo inviato una nota ufficiale all' Agenzia delle Entrate, spiegando come tutte le nostre operazioni commerciali siano sempre accompagnate da documentazione doganale inequivocabile, con flussi assolutamente tracciabili e quindi non equiparabili ad acquisti effettuati presso esercizi commerciali al dettaglio, chiedendo quindi di essere esclusi dalla norma in essere , dopo tre mesi siamo ancora in attesa di un qualche commento al riguardo.
Nelle varie discussioni attorno all'articolo 8 e 8 bis, abbiamo più volte spiegato e chiarito quello che secondo noi è il corretto inquadramento giuridico del "fornitore navale" che svolge l'attività di appaltatore e che nella realtà delle cose si assume una parte degli obblighi contrattuali che l'armatore della nave ha nei confronti dell'equipaggio (al quale l'appaltatore fornisce i pasti), e quindi a buon diritto esercita, per quella parte, la funzione vera e propria del proprietario della nave.
Prova ne sia che a livello Internazionale, i crediti degli appaltatori nei confronti dell'armatore vengono considerati "privilegiati" così come i salari degli equipaggi.
Non può quindi l'amministrazione continuare a sostenere che non è ammessa l'applicazione dell'art. 8bis nei rapporti fra un fornitore navale che imbarca le provviste fatturandole non all'armatore ma ad un altro fornitore, che nel caso svolge la funzione di appaltatore, quando per di più, l'operazione avviene scortata da documenti doganali di esportazione.
Sono ormai due anni che ne discutiamo, e dopo ogni riunione presso l'agenzia delle entrate a Roma (l'ultima 2 settimane or sono ), si esce con un nulla di fatto, e con il proposito di avere chiarimenti e conferme fra le due amministrazioni coinvolte (Agenzia delle Dogane da una parte e Agenzia delle entrate dall'altra).
Auspichiamo quindi che, quanto prima i due argomenti di cui sopra, vengano affrontati e portati ad una qualche definizione, per garantire alle aziende di poter operare in tranquillità e chiarezza, seguendo procedure legittime nel rispetto di normative ben definite.
Abbiamo anche altri argomenti in sospeso con l'amministrazione, quali la compilazione della famosa "black list", che riteniamo richiesta assurda nei nostri confronti poiché una gran parte dei nostri clienti ha navi battenti bandiera di cosiddetti paradisi fiscali, ma è una prassi acquisita da decenni e non di certo, nasconde flussi di denaro poco chiari, quindi, la norma che sicuramente nasce per monitorare o scoraggiare comportamenti occulti o sospetti, non è riconducibile alla nostra attività dove da sempre le nostre aziende fatturano a clienti residenti in "paradisi fiscali", ma solo, per "convenienza" di bandiera e non certo per nascondere transazioni sospette.
Abbiamo anche richiesto l'innalzamento del valore del singolo articolo che può essere compreso nella voce doganale unica riservata alle forniture di bordo, per portarlo almeno ad Euro 9,000 (attualmente siamo fermi a euro 3,000 dal 1992), poiché gli attuali volumi di fornitura riferiti alle moderne navi da crociera, spesso contengono voci singole con valori ben superiori.
Tutto questo unitamente ad altri argomenti minori è il contenuto del nostro lavoro presso i Ministeri, e ancora una volta voglio ringraziare il nostro Vice Presidente Valentina Schiavi delegata ai rapporti con le istituzioni e gli uffici Governativi a Roma, per l'attento e costante lavoro svolto, che ci ha sempre consentito di presentare i nostri argomenti, nelle sedi opportune, con grande tempestività.

Nel complesso meccanismo che comprende e regola il trasporto marittimo di merci e passeggeri le nostre aziende svolgono un ruolo "terzo" ma di assoluto valore operativo ed economico, ed è quindi fondamentale poter lavorare in trasparenza e sicurezza ma soprattutto con normative "certe", "chiare" e applicate uniformemente su tutto il territorio nazionale.
È quindi essenziale per noi il supporto delle amministrazioni e delle autorità preposte per consentire lo svolgimento del lavoro quotidiano, nel rispetto delle regole ed al servizio di navi che sostano nei porti per poche ore e senza intervalli fra giorno e notte, festività comprese.
Mi rivolgo in particolare a Genova e alle sue strutture organizzative Portuali, Doganali e Veterinarie, in quanto è universalmente riconosciuto come Genova venga considerata banco di prova per ogni nuova normativa o procedura operativa si voglia metter in atto a livello nazionale, sia per adeguamenti legislativi o per nuovi flussi di traffico marittimo.
Nel Nord Europa, i nostri colleghi possono operare 7 su 7 e h24 attraverso sportelli telematici sempre operativi, oppure gestendo la documentazione in proprio ed inserendola nel sistema quando lo sportello doganale è nuovamente disponibile.
Questo è uno dei nostri obiettivi più ambiziosi, e facciamo affidamento alla sensibilità dell'autorità doganale al fine di poterlo raggiungere al più presto.
Ci auguriamo sentitamente che tutte le procedure presenti o future applicate a Genova per la gestione delle merci destinate alle provviste delle navi, vengano poi estese e uniformemente adottate anche in tutti gli altri scali nazionali, cosa che purtroppo oggi non accade (da sempre sappiamo che ogni dogana italiana è una repubblica a sé).
Già lo scorso anno lamentavamo come la moderna organizzazione e ripartizione del lavoro all'interno dei porti mercantili ha visto l'affermarsi dei cosiddetti "terminalisti", che gestiscono le aree in concessione in assoluta indipendenza a autonomia, con regole di accesso, sì dettate dalle loro esigenze operative e/o di sicurezza ma senza tenere in considerazione che le navi in banchina, possono e devono avere esigenze di assistenza da soggetti estranei alla pura attività del terminal.
Non è accettabile che un terminal non "preveda" l'accesso di camion sottobordo per consegnare provviste o pezzi di ricambio e limiti tali operazioni a pochi minuti al termine delle attività commerciali della nave, costringendo mezzi ed autisti a soste di ore ed ore in attesa che il "piazzale" dia l'OK per effettuare la consegna, spesso in piena notte dopo essere giunti al varco nel primo pomeriggio.
Abbiamo già discusso con una delle associazioni di terminalisti, ma al momento non abbiamo progressi e con rammarico dobbiamo constatare che la nostra attività e la nostra funzione di supporto alla nave non è attualmente né prevista né regolamentata in alcun modo nelle aree portuali italiane gestite privatamente.
Riferendoci al mercato marittimo constatiamo che Il livello dei traffici non sia cresciuto come nelle aspettative e la sola area dove si registra un modesto incremento è ancora l'estremo oriente che fa riferimento alla Cina, mentre Russia e India su cui si faceva affidamento appaiono ancora incerte, mentre forti segnali positivi vengono intravisti per l'area Sud America dove il Brasile può costituire un fronte di concreto sviluppo.

Gli Stati Uniti e l'Europa sono fermi, e quindi non si intravvedono indici economici positivi che possano in qualche modo influire sulla ripresa dei traffici marittimi, mentre si confida molto nella rinascita dell'economia Nord Africana che dopo la "primavera araba", potrebbe presentare di nuovo i vari paesi che si affacciano sul mediterraneo come mercati in ripresa ed in grado di crescere.
A questa considerazione possiamo aggiungere la positiva fase economica e sociale che proviene dal Sud Africa, prossimo mercato suscettibile di crescita interessante, per cui nel prossimo futuro il continente Africano potrà generare nuovi e maggiori flussi di traffico marittimo, che ci auguriamo vedano coinvolti anche gli operatori ed il sistema portuale Italiano.
Il quadro generale comunque rimane incerto, contrastato e senza prospettive concrete di crescita, con il risultato di continue oscillazioni dei noli, sempre più al ribasso, non consentendo agli Armatori di stabilire scelte di lungo periodo ed investimenti futuri.
Gli armatori Italiani, nostro abituale punto di riferimento, già da tempo avevano scelto un programma di nuove costruzioni che consentisse un profondo ringiovanimento e ammodernamento della flotta nazionale, e pur nella dolorosa scelta di tagliare e/o posticipare alcuni ordini già piazzati con i cantieri costruttori, sono comunque oggi largamente presenti sul mercato internazionale con la speranza che una ripresa dei traffici e conseguentemente l'innalzamento dei noli dia sollievo alla gestione delle loro navi e premi le loro scelte di efficienza e rinnovamento.

Questo scenario incerto ma comunque caratterizzato da un forte segnale negativo ha penalizzato e sta ancora fortemente penalizzando tutte le rate di nolo siano esse riferite a navi General cargo, Bulk Carriers, Petroliere ed ha raggiunto anche le Portacontainer che hanno vissuto una breve stagione di gloria a cavallo fra il 2010 e il 2011, ma che oggi, come prevedevamo nella nostra relazione dell'anno scorso vedono i noli a picco a causa dell'eccesso di stiva provocato dell'arrivo sul mercato dei giganti da 14,000 teu.
Al riguardo è iniziata una massiccia corsa alle demolizioni per eliminare le navi obsolete ma anche per riequilibrare l'offerta, operazione comunque non sufficiente al punto che alcuni armatori hanno rinegoziato con i cantieri lo spostamento delle consegne per le nuove navi previste già uscita nel 2011 addirittura al 2014 e 2015.
Gli unici segmenti ancora con segnale positivo sono le navi Gasiere e le "Heavy Lift" per le quali il mercato è ancora in crescita lieve ma stabile e offre noli remunerativi.
Il solo comparto marittimo che appare in salute ed in costante crescita è il mercato della navi da crociera, dove sono ripresi i contratti per le nuove costruzioni, con in prima fila la nostra Fincantieri, e dove, nonostante il grave episodio dell'Isola del Giglio, le navi riescono a viaggiare con altissima percentuale di passeggeri.
La stagione per i nostri scali nazionali, abituale meta delle ‘'grandi navi bianche ‘', si prospetta quindi positiva, ed il nostro paese, grazie alle sue incredibili risorse storiche e culturali, si conferma ancora una volta meta preferita, per centinaia di migliaia di crocieristi con una ottima ricaduta per l'intera filiera marittima.

C'è quindi il consolidamento di questo ramo del trasporto marittimo dove numerosi nostri associati sono operativi da anni con buoni risultati, soddisfazione dei clienti e altrettanto buone prospettive di sviluppo.
Come già accennato nella relazione dello scorso anno, lo sviluppo e la crescita delle nostre aziende è direttamente legato ai traffici e alla capacità del nostro sistema portuale di attrarli sul mercato e gestirli con profitto.
È inspiegabile come non si comprenda che nell'attuale sistema di economia globale, le strutture portuali di un paese, e soprattutto di un paese come l'Italia equivalgono ad insediamenti industriali che producono risorse, posti di lavoro e quindi crescita.
Un porto moderno ed efficiente inquadrato in una situazione geografica favorevole,come quella Italiana, è in grado di garantire la ricettività delle merci non solo destinate alle industrie ed ai consumatori nazionali, ma può costituire un importante varco di ingresso per tutti i paesi confinanti con noi e addirittura per tutto il nord Europa.
È però importante che i porti nazionali si presentino sul mercato con le opportune risorse tecniche ed infrastrutturali, in quanto oggi la concorrenza nel Mediterraneo è spietata e la nostra eccezionale posizione geografica non è più essenziale e determinante come in passato.
A questo scopo ancora una volta chiediamo alle istituzioni preposte di trovare le opportune risorse e di rimuovere tutti gli ostacoli burocratici, in modo da consentire alle Autorità Portuali Italiane di avviare sollecitamente o completare tutte le opere infrastrutturali così come già programmate ed in parte finanziate già da alcuni anni.

Ripetiamo, è assoluta miopia non comprendere come un moderno sistema portuale sia sul piano degli approdi, dei pescaggi, della logistica e delle reti autostradali e ferroviarie, possa costituire un assoluto sistema industriale in grado di produrre posti di lavoro, ricchezza e gettito fiscale per lo Stato.
Non è tollerabile che veti incrociati o interventi pretestuosi dei vari Ministeri fra di loro, blocchino per anni i piani di dragaggio di quasi tutti i porti, impedendone l'accesso alle moderne navi da carico.
Siamo letteralmente circondati da porti, che si offrono sul mercato a condizioni vantaggiose e non dobbiamo sottovalutare i porti Spagnoli, Sloveni e Croati che si stanno proponendo quali nuovi varchi di ingresso per le merci in Europa, cercando di sottrarci traffici in nome di pescaggi, rese orarie,collegamenti ferroviari e autostradali che noi non siamo in grado di contrastare.
È essenziale il buon funzionamento del sistema “porto” in tutte le sue componenti poiché il mercato è sempre più competitivo e i flussi di merci e navi si spostano con irrisoria facilità sempre alla ricerca di efficienza, tempi operativi il più ottimizzati possibile, tariffe competitive.
Concretizzandosi una crescita dei traffici per il Sud Africa, come già accennato, uno dei possibili scenari è il collegamento diretto delle grandi portacontainer che dall'India e dall'estremo oriente, evitino Suez e passando da Cape Town, raggiungano il Nord Europa attraverso l'Atlantico escludendo il Mediterraneo dalle loro rotte.
La sofferenza per il nostro sistema sarebbe gravissima, e con una situazione già precaria vedrebbe svanire almeno il 30% del flusso merceologico attualmente in transito e che abitualmente sbarca in Mediterraneo con destinazione Nord Europa.
È quindi fondamentale offrire agli armatori un sistema completo, portuale, doganale, logistico, ferroviario e autostradale , efficiente ed in grado soprattutto di offrire servizi rapidi ed economici.
Sentiamo notizie di contrasti e fratture in seno alle autorita portuali Italiane e li esortiamo a rimuovere concordemente le situazioni di conflitto, che non portano mai beneficio, ma li esortiamo al confronto che intenda trovare soluzioni unitarie ed in grado di sollecitare i Ministeri preposti per ottenere le risorse necessarie e gli appositi dispositivi di legge che mettano la portualità Italiana al primo posto fra le infrastrutture del nostro paese, in grado di produrre crescita economica.
Sul piano Europeo il nostro rapporto con OCEAN, che ci rappresenta a Bruxelles, è diventato primario e indissolubile, e durante la riunione del Board del 4 Novembre 2011 sono stato eletto Presidente a testimonianza della grande considerazione che i fornitori navali Italiani e ANPAN godono in Europa e come tangibile riconoscimento e apprezzamento per il lavoro svolto in questi anni.
Particolarmente significativo l'essere stato eletto come primo Presidente proveniente dal Sud Europa, quando fino ad oggi la carica era sempre stata appannaggio di candidati nord europei, ed in alternativa ad un agguerritissimo candidato Olandese che rappresenta una delle maggiori organizzazioni mondiali della nostra categoria.
Come ben sapete il lavoro svolto da Ocean Bruxelles è di vitale importanza per la nostra industria, in quanto tutte le normative e le nuove disposizioni legislative vengono pensate e decise in quella sede.

I tre gruppi di lavoro in cui abbiamo diviso la struttura si occupano di problemi doganali, veterinari e fiscali, e la segreteria con la nuova incaricata Sandra Splouchal, che assiste il segretario generale Mr Meriaux, è costantemente impegnata nel seguire settimanalmente il lavoro delle Commissioni Europee coinvolte negli argomenti di nostro interesse, fra cui al momento la preparazione del Nuovo Codice Doganale Comunitario, sempre più improntato alla gestione elettronica del sistema Dogane Europeo.
Posso assicurare che per la prima volta il lavoro dei fornitori navali sare esattamente identificato e determinato con normative precise e riferite esattamente alla nostra attività, e non più assimilato ad altre categorie di esportatori con normative in cui non ci siamo mai riconosciuti.
Al momento uno degli obiettivi immediati è l'approvazione ed il riconoscimento di un documento che possa costituire "prova alternativa" all'avvenuto imbarco ed esportazione della merce quando il sistema elettronico doganale per qualche motivo non registri automaticamente lo scarico del documento per errore nel sistema alla dogana di uscita.
OCEAN è quindi impegnata costantemente e con grande attenzione nel seguire tutte le normative e disposizioni che la Comunità Europea prevede di emanare nel prossimo futuro ed in considerazione dell'importante e vitale lavoro svolto, è stato deciso durante l'ultima riunione del Board in Spagna di ridisegnare le risorse a disposizione con l'intento di suddividerle più equamente fra gli stati membri per mettere in condizione Bruxelles di non ridurre le ore di lavoro dedicate.

Riferendoci ai rapporti internazionali, i nostri contatti e la nostra presenza in ISSA, che, da Londra, rappresenta i Fornitori Navali di tutto il mondo, sono sempre molto solidi e di grande partecipazione.
Provengo come alcuni di Voi dall'assemblea di Cadice, dove erano presenti 41 paesi, e dove si è svolta la prima riunione di consiglio secondo la nuova struttura organizzativa votata a Dubai, secondo il nuovo statuto, con da una parte il Consiglio esecutivo formato dal Presidente, dal Tesoriere e dai Vice-Presidenti, e dall'altra il Consiglio generale formato dai rappresentanti dei vari stati membri.
È stata confermata la decisione di tenere a Londra le prossime tre assemblee annuali ISSA, quindi fino al 2015 compreso, cancellando la storica struttura delle assemblee in giro per il mondo, al fine di ottenere una probabile maggiore presenza di associati, in un contesto più vicino al mondo marittimo internazionale di cui facciamo parte.
Per argomenti più strettamente legati al nostro lavoro, vi comunico che il nuovo catalogo verrà pubblicato a fine 2012 o inizio 2013 e che ho cercato, purtroppo da solo nell'assemblea, di far ritornare la stampa ad un volume unico eliminando la divisione dei due libri, con maggiore attenzione a pagine ripetitive e piene con doppioni degli stessi articoli, ma credo rimarremo inascoltati.
È stato presentato un piano per "formare" via "web" il personale che lavora o che è interessato ad operare nel nostro settore, ma poiché l'addestramento proposto è limitato a nozioni organizzative e commerciali, abbiamo suggerito di includere anche un programma di lavoro indirizzato a formare "tecnicamente" i candidati, ma abbiamo dubbi che il suggerimento venga recepito.

Commentando l'anno trascorso, che potremo definire tranquillamente ‘'annus horribilis ‘', fra l'incidente nell' arcipelago Toscano, il sequestro ad opera dei pirati di numerose navi fra cui alcune di bandiera italiana, e la recente detenzione dei nostri soldati imbarcati su nostre navi mercantili, dobbiamo ammettere che ancora una volta siamo chiamati a grandi sacrifici per mantenere le nostre aziende vive e disponibili sul mercato a disposizione dei nostri clienti.
Da quasi due anni ANPAN ha trasferito gli uffici della segreteria nella nuova sede di Piazzetta S. Matteo, dove ci siamo riuniti alla nostra associazione madre ALCE, e dove oltre alla prestigiosità dell'edificio, abbiamo migliorato la funzionalità, con l'emissione di una più ampia e dettagliata gamma di circolari e comunicati, e con un servizio sempre più sollecito alle problematiche segnalate dai vari associati.
Ancora una volta vogliamo confermare l'assoluta convinzione che la fiducia nel nostro lavoro e la nostra determinazione avranno ragione delle difficoltà e delle incertezze che incombono sul mercato , esortiamo quindi tutti ad un rinnovato e continuo impegno nella convinzione che le nostre aziende supereranno anche questo difficile periodo.
Questo è la mia ultima relazione, il mio lavoro termina oggi dopo questo ultimo mandato, ringrazio tutti i componenti del consiglio direttivo e la segreteria per il grande lavoro svolto e la grande unità di intenti che ci ha legato e sostenuto in questi ultimi 4 anni, ringrazio infine il nostro presidente onorario Raimondo Bonini per i suoi illuminati consigli.
