Il sistema della portualità ha bisogno di una governance semplificata e centrale.

1) LAVORO

Rinnovato il CCNL dei lavoratori dei porti: 12 mesi di trattative, di non facili mediazioni tra tutte le componenti delle delegazioni trattanti. Momenti in cui è mancata la condivisione con i lavoratori sull'andamento delle trattative e sul merito delle questioni e delle problematiche che si stavano affrontando, da una parte, dall'altra momenti in cui gli equilibri tra associazioni datoriali sono stati messi in discussione rischiando di perdere il focus sulla portata e sugli effetti di un contratto “collettivo”.

Ora abbiamo un “prodotto” che porterà il livello di inquadramento di riferimento a una retribuzione mensile lorda di circa duemila euro, che ha inserito strumenti di welfare, che aumenterà le prestazioni a copertura della polizza sanitaria, che apre a tutte le tipizzazioni del contratto di apprendistato. Abbiamo due anni davanti per lavorare su una piattaforma di prossimo rinnovo che renda il nostro contratto ancora più un modello per le aziende e i lavoratori.

Il valore del nostro CCNL va confermato per la sua capacità di regolare l'attività imprenditoriale nei porti e i rapporti di lavoro, ricordandoci che il nostro comparto esiste in quanto “autorizzato” dallo Stato, attraverso un processo pubblicistico di concessioni e autorizzazioni che hanno alla base la capacità di fare impresa e di sviluppare traffici funzionali a potenziare e garantire import, export e turismo: tutte attività utili al sistema produttivo del Paese.

Assiterminal crede fortemente nel CCNL dei porti, così come nella regolazione del lavoro nei porti che resta e deve restare elemento distintivo nel nostro mercato del lavoro per garantire adeguate condizioni economiche, certezza nell'organizzazione del lavoro, assenza di lavoro irregolare e di conseguenza rafforzare i presupposti per un lavoro sicuro. I porti e lo shipping sono gli unici due settori in cui lo Stato (attraverso le Autorità di sistema e le Capitanerie, ciascuno per il proprio ambito) assicura insieme alle imprese la regolarità dei rapporti di lavoro: di questo dobbiamo essere orgogliosi e valorizzare la nostra specificità.

L'efficienza delle imprese si fonda sulla loro capacità di investire sulle donne e sugli uomini che ne fanno parte: formazione, equità, valorizzazione delle diversità, welfare, corrette relazioni sindacali, engagement sul territorio, ma anche misure idonee per accompagnare il ricambio generazionale e accogliere i giovani: tutti valori e presupposti che condividiamo e promuoviamo quotidianamente.

1.1) PROPOSTE
  • La regolazione e la regolamentazione del lavoro nei porti dovrebbero essere garantite e disciplinate da un unico impianto normativo nazionale che superi la distinzione tra operazioni e servizi portuali (dm 585/95 - dm 132/2001) comprendendo quindi il ciclo delle operazioni portuali in un'unica disciplina, segmentabile (appaltabile quindi secondo le norme di carattere generale, sempre ovviamente in un alveo autorizzativo)
  • La somministrazione di lavoro temporaneo portuale, in un'ottica di servizio di interesse generale e laddove si ravveda la necessità di una sua istituzione nelle forme previste dall'art.17, legge 84/94, potrebbe prevedere, in coerenza con quanto sopraesposto, l'estensione ad attività oggi cd “accessorie” a condizioni di mercato. Valutare inoltre quali eventuali soluzioni - diverse dalle attuali - adottare per assicurare adeguate forme di tutela per i lavoratori somministrati
  • Confidiamo che in legge di bilancio possa passare l'emendamento per l'esigibilità del cd “fondo prepensionamento lavoratori portuali” funzionale ad avviare con adeguate misure di sostegno un graduale e necessario ricambio generazionale in un settore in cui la media anagrafica dei lavoratori “operativi” tende a superare i 50 anni: i processi di automazione vanno accompagnati !
  • Procedere all'individuazione, anche graduale, dell'inserimento di alcune mansioni di lavoro portuale tra le categorie usuranti

2) GOVERNANCE

Premettiamo un principio a noi molto caro: l'efficienza dei porti è data dalla capacità di produrre valore da parte delle aziende. Il nostro sistema portuale è fondato su un modello in linea di principio ideale, di partnership pubblico privato, Stato/impresa, concedente/concessionario che deve svilupparsi attraverso meccanismi che semplifichino anche per le Autorità di Sistema l'esercizio delle loro funzioni dando certezza a chi investe o voglia investire.

Non è in discussione la natura giuridica delle ADSP: il demanio è un bene pubblico strategico per il sistema Paese: dobbiamo superare una visione immobiliaristica del demanio portuale, l'equazione canone per metro quadro non può più essere centrale, così come i criteri di rivalutazione dei canoni (abbiamo visto cosa hanno generato lo scorso anno).

Il Ministero delle Infrastrutture e dei Trasporti deve confermare la sua centralità e con essa l'esercizio delle funzioni di pianificazione, regolamentazione, vigilanza e controllo: se per fare questo è necessaria o utile creare o rafforzare un Ente - Agenzia centrale, che si proceda velocemente in tal senso.

In quest'ottica, la Conferenza nazionale dei presidenti, allargata alle associazioni nazionali maggiormente rappresentative (sul modello della rappresentanza del CCNL) potrebbe finalmente assurgere a soggetto di coordinamento formalizzato di una governance di sistema centralizzata.
Abbiamo bisogno che sia confermata una disciplina specialistica per il nostro settore che valorizzi gli investimenti e la produzione del valore delle aziende e anche degli investimenti pubblici.

La modernizzazione del Sistema necessita di un'assegnazione di compiti e funzioni chiare, di una ripartizione di competenze tra Ministero, ART, ADSP che oggi è squilibrato, così come di una razionalizzazione dei compiti e delle funzioni degli enti preposti ai controlli sulle merci e sui passeggeri.

Qualunque riforma - in ottica di regia centrale - non può certo stravolgere l'assetto delle concessioni (dal punto di vista delle attuali assegnazioni) ma potrebbe guardare anche oltre, come ad esempio ai temi dell'underwater, dell'offshore e dello sviluppo di depositi costieri ovvero il mondo variegato che si svilupperà intorno alla transizione energetica.

2.1) PROPOSTE
  • La portualità è un tema strategico per il sistema produttivo nazionale e come tale deve essere gestito con una visione e processi di derivazione governativa e non locale.
  • Il Comitato di Gestione delle ADSP dovrebbe essere assimilato a una conferenza di servizi in cui ogni Ente si pronuncia una sola volta.
  • I Presidenti dovrebbero durare in carica per un periodo superiore ai 4 anni, avere tutele legali rafforzate, scegliere il proprio Segretario generale e poter gestire una struttura con strumenti (come il CCNL) di diritto del lavoro privatistico, con conseguenti maggiori possibilità di affidare in outsourcing attività consulenziali e di progetto.
  • Il Piano nazionale della logistica e della portualità dovrebbe essere aggiornato ogni 3 anni e essere lo strumento utile alla pianificazione degli interventi e dell'utilizzo delle risorse a livello nazionale
  • Deve essere chiara e rafforzata la funzione dei PRP: evidente che detti strumenti devono essere aggiornati periodicamente e valutati dal centro per renderli uniformi a una programmazione nazionale, non locale (vedi punto precedente)
  • Deve essere chiara la funzione di regolazione delle ADSP, distinta da quella di impresa, attraverso strumenti che lo consentano (peraltro già esistenti e adottabili) senza stravolgerne la natura giuridica.
  • Lo shift modale verso il trasporto ferroviario o verso altre forme di trasporto sostenibili dovrebbe essere incentivato attraverso incentivi parametrati all'adozione di metriche misurabili (le norme ad oggi vigenti sono inattuate anche in quanto prive di criteri misurabili)
  • Il regolamento sulle concessioni e le linee guida applicative vanno ripresi. Il regolamento deve essere uno e uguale per tutte le portualità; le linee guida devono essere riformulate utilizzando criteri (ad esempio quello per il calcolo del WACC) adeguati al nostro sistema produttivo (non, ad esempio, ai meccanismi delle concessioni autostradali in cui la tariffa è regolata e remunera gli investimenti). La portualità vive di dinamiche di mercato in un contesto di traffici internazionali in cui le politiche tariffarie hanno dinamiche negoziali. Contemporaneamente vanno aboliti i regolamenti concessioni locali delle ADSP.
  • Stesso discorso vale per la redazione del bilancio (o dei bilanci): opportuno procedere a un'unica linea guida che standardizzi sia la parte “amministrativa” che quella “commerciale”
  • A mero titolo di esempio i criteri cd “premianti” che concorrono alla determinazione dell'assegnazione di una concessione dovrebbero essere misurabili:
    a) l'adozione di sistemi di gestione sulla sicurezza,
    b) la riduzione delle emissioni attraverso meccanismi di misurazione del carbon foot print (tassonomia) per i terminal merci. Criteri trasparenti e misurabili (l'indicatore della CO2 complessiva evitata)
  • Valutare un diverso modello di “governance” per i servizi tecnico nautici in quanto funzionali all'efficienza dei porti: i sistemi tariffari e i processi di affidamento potrebbero essere maggiormente oggetto di una centralizzazione dei criteri e dei relativi processi ovvero diversamente regolati e regolamentati da parte delle ADSP in coordinamento con il centro.
  • Affermare il principio in base al quale le ADSP possono concorrere (direttamente o meno) all'acquisizione, anche in forme di compartecipazione, di asset e servizi logistici diversi dal porto
Governance vuol dire avere una visione chiara nell'assegnazione e nell'utilizzo di un asse strategico come quello portuale, guardando oltre in tema di investimenti infrastrutturali, guardando alle dinamiche dei mercati dei traffici, alla concorrenzialità dei vettori e quindi degli asset logistici che da e per i porti si muovono. In sintesi, concorrenzialità si verso le portualità di altri paesi, non interna e con regole di ingaggio e regolazione della concorrenza (anche tra operatori) che preservi l'equilibrio nella gestione/concessione degli asset.

Governance vuol dire gestire fenomeni di un marcato che sta assumendo dimensioni sempre più grandi sia per le aggregazioni e integrazioni dei player che per le dinamiche geopolitiche

Nel 2025 si riaprirà il tema dei regimi fiscali del registro internazionale e della tonnage tax: per quanto trattasi di aspetti che andrebbero regolati a livello dello spazio economico europeo, ribadiamo la strategicità e l'importanza dei suddetti regimi fiscali, alternativi tra loro, laddove questi restino però perimetrati all'ambito del trasporto marittimo, fatte salve ovviamente le attività “ancillari” del settore crocieristico.


3) TRANSIONE ENERGETICA

Qualunque processo di transizione va accompagnato e guidato: quindi anche questi processi hanno bisogno di essere guidati dal centro.

La transizione energetica o ecologica per le imprese e i terminal deve avvenire attraverso meccanismi e strumenti incentivanti/premianti (anche all'interno dei meccanismi concessori/autorizzativi) sia per l'acquisto di nuovi equipments che per l'adozione di processi di autoproduzione di energia da fonti rinnovabili – alternative

Cold ironing - Shore Power: al netto della fase di infrastrutturazione dei POD, della loro “capacità” di collegamento alla rete elettrica nazionale, dell'abbattimento degli oneri si sistema sulla tariffa, è indispensabile procedere individuando soluzioni concrete

3.1) PROPOSTE
  • Individuare i modelli operativi: concessione ai sensi dell'art 24 reg. nav. mar. (in parallelo a subconcessioni ai sensi dell'art 45 bis cod. nav.) ovvero affidamenti disciplinati dal codice appalti
  • Agevolare e promuovere forme di cooperazione tra operatori portuali e produttori di energia elettrica (premiando forniture prodotte da fonti rinnovabili) per ovviare alla non avvenuta regolamentazione delle comunità energetiche portuali
  • prevedere all'interno di un processo di concessione/sub concessione un periodo di ammortamento degli investimenti in impianti di produzione da fonti rinnovabili e assimilato, adeguato al periodo utile di produzione.
  • Adottare meccanismi (modello transizione 5.0) anche all'interno dei regimi concessori e autorizzativi per promuovere il refitting degli equipments operativi
L'elettrificazione delle banchine e/o dei processi operativi non è l'unica soluzione verso l'imposizione di una transizione energetica; la pianificazione verso investimenti in infrastrutture di stoccaggio e processi di fornitura di “carburanti” alternativi deve essere gestita dal “centro” con una flessibilità tale da consentire adeguamenti tecnico funzionali rapidi e procedure operative analoghe per tutti i porti. Le navi non sono gli unici utenti dei porti, l'autotrasporto, il trasporto ferroviario, l'utenza di crociere e traghetti devono poter trovare anche nei porti punti di approvigionamento - rifornimento di combustibili alternativi.

Risorse utili a agevolare tali percorsi devono essere trovate, ad esempio, attraverso i meccanismi legati alla tassazione ETS


4) TRANSIZIONE DIGITALE

Il Ministero delle Infrastrutture e dei trasporti, anche tramite RAM stanno accelerando misure e processi utili alla transizione digitale della filiera logistica che vede nei porti e negli operatori portuali il fulcro nevralgico per una corretta e fluida gestione dei dati e conseguentemente dei flussi. L'omogenizzazione della raccolta dei dati, nel rispetto della loro matrice e funzione, favorirebbe anche il “decisore” in analisi e azioni conseguenti anche dal punto di vista della pianificazione degli interventi e degli investimenti (es. analisi dei flussi)

4.1) PROPOSTE

La digitalizzazione dei processi dovrebbe riguardare anche gli adempimenti e la relazione tra terminal/imprese e Enti
  • Procedere attraverso il SIN (o altri strumenti) alla mappatura dei sedimi portuali, delle concessioni e autorizzazioni, dei regolamenti e degli atti delle ADSP per favorire un monitoraggio e una maggiore fruibilità (trasparenza) della gestione degli asset demaniali
  • Procedere alla digitalizzazione dei processi autorizzativi/concessori
  • Favorire una razionalizzazione delle procedure di controllo di merci e passeggeri (anche ai fini di security)
  • Implementare la connettività nei porti
