Il lavoro portuale

Com'è noto, il fattore lavoro rappresenta uno degli elementi più rilevanti e delicati su cui si basano le prospettive commerciali di uno scalo marittimo e, nello stesso tempo, costituisce un fattore produttivo oggetto di molteplici pressioni dettate dall'evoluzione tecnologica e dagli assetti organizzativi delle imprese. La stabilità delle relazioni tra i lavoratori ed i datori di lavoro, la flessibilità nell'impiego di manodopera, il mantenimento di elevati standard di sicurezza e di produttività costituiscono un obiettivo comune ai maggiori scali europei, obiettivo che si intende perseguire attraverso una rinnovata organizzazione del lavoro orientata, in prospettiva, verso il parziale e progressivo superamento dei rigidi schemi di offerta e di impiego della manodopera portuale storicamente consolidatisi.

Considerata la tradizionale variabilità dei traffici con cui le imprese portuali si confrontano e la conseguente necessità di poter disporre, accanto alla manodopera stabilmente impiegata, di forza lavoro addizionale e temporanea, durante i picchi di attività, i principali porti europei hanno dato vita ad un sistema di organizzazione del lavoro che prevede, quale elemento centrale, la creazione di pool di manodopera in grado di rappresentare una sorta di “riserva” a cui fare riferimento per le esigenze di impiego di manodopera su base temporanea.

In un contesto così delineato, si stanno affermando alcune significative varianti al sistema fino ad oggi vigente e da tempo consolidatosi presso tutte le principali realtà portuali europee, varianti motivate dall'esigenza di ridurre quegli elementi di rigidità ed onerosità che vengono considerati inadeguati alle esigenze del mercato attuale. Anche l'organizzazione del lavoro portuale, infatti, allo stesso modo del modello di governo dei porti, tende a rinnovarsi e a trasformarsi, seppur molto lentamente, sulla spinta dei movimenti in atto nell'ambiente competitivo dei porti e della logistica.

Com'è noto, nel porto di Genova, ad oggi, due compagnie portuali, autorizzate all'esercizio dell'attività di impresa connessa allo svolgimento di operazioni e servizi portuali, ai sensi di quanto dispone l'art. 16, l. 84/94, forniscono la manodopera temporanea ed i servizi alle imprese operanti nelle operazioni di imbarco e sbarco delle merci, mentre non è stata autorizzata alcuna impresa la cui attività consista esclusivamente nella fornitura di lavoro temporaneo ai sensi dell'art. 17, comma 2, né si è proceduto ad istituire l'agenzia per la fornitura di lavoro temporaneo prevista dal comma 5 dello stesso articolo.

Allo scopo di corrispondere effettivamente alle nuove esigenze poste dall'economia portuale e dalla logistica, in relazione alle evoluzioni attese in termini di professionalità, specializzazione e flessibilità dell'organizzazione del lavoro portuale in linea con le intenzioni del legislatore, l'Autorità portuale si pone l'obiettivo di individuare delle ipotesi di possibile sviluppo dell'organizzazione del lavoro portuale nello scalo genovese, mettendo al primo posto le esigenze espresse dal mercato in relazione ai traffici previsti.

Con il fine di trarre alcuni elementi di valutazione, al momento puramente indicativi, utili a stimolare alcune prime riflessioni che coinvolgeranno tutte le parti sociali chiamate a dare attuazione alle disposizioni di legge, si presenta di seguito l'andamento occupazionale nel porto di Genova con riferimento al rapporto esistente tra il numero dei lavori diretti e le compagnie, posto a confronto con i dati di alcuni tra i principali porti europei:

Nota: (*) Ai fini di una più corretta valutazione dell'incidenza delle compagnie sul totale, è opportuno segnalare che il dato relativo agli occupati delle imprese portuali include gli addetti amministrativi (circa 40% del totale) e gli addetti operativi (circa 60% del totale). Le informazioni sopra presentate, per quanto debbano essere interpretate con la dovuta cautela, in ragione delle diversità esistenti tra le diverse realtà portuali considerate tanto con riguardo ai modelli di organizzazione del lavoro di banchina quanto al grado di automatizzazione del ciclo delle operazioni portuali, mettono in evidenza che, nel corso degli ultimi anni, anche se l'evoluzione del lavoro portuale ha continuato a seguire percorsi diversi, poiché, naturalmente, diversi erano la situazione esistente ed i meccanismi a disposizione delle parti sociali per discutere eventuali cambiamenti, nei porti nordeuropei l'incidenza del pool sul numero complessivo dei lavoratori portuali si è andato progressivamente riducendo o è rimasto sostanzialmente stabile, anche grazie al realizzarsi di politiche mirate.

In particolare a Rotterdam, la possibilità per le imprese di usufruire di manodopera temporanea esterna attraverso l'intermediazione di un'agenzia di lavoro temporaneo, anche se per il momento solo in via sussidiaria e comunque attraverso l'intermediazione del pool, risponde ad un'esigenza già da tempo manifestatasi, anche in altri settori dell'economia.

I porti di Brema ed Amburgo presentano un'incidenza percentuale dei lavoratori del pool più elevata, comunque inferiore al 30%, essendo detta percentuale calcolata considerando i soli addetti operativi ed escludendo invece gli impiegati in funzioni amministrative. Con specifico riguardo al porto di Brema, il più recente sviluppo dello scalo tedesco rispetto ai suoi competitori, Amburgo e Rotterdam, ha portato ad un più elevato utilizzo della manodopera del pool, in ragione della sua maggiore flessibilità di impiego.

Nel caso genovese, la forza lavoro facente capo alle compagnie continua a rappresentare una quota consistente dell'occupazione complessiva delle imprese portuali. Infatti, i lavoratori delle compagnie hanno rappresentato, a Genova, negli ultimi sette anni una percentuale che non è mai scesa al di sotto del 35% degli occupati complessivi. In particolare, quest'ultima percentuale corrisponde anche alla percentuale media di utilizzo della manodopera fornita dalle compagnie ai terminalisti genovesi operanti in prevalenza nel settore delle merci containerizzate, mentre una percentuale media più elevata e pari a circa il 40% si registra per i terminalisti del settore dei carichi convenzionali.

Ferma restando la necessità di adeguarsi alle disposizioni di legge, le prospettive di sviluppo e di consolidamento dei traffici debbono potersi tradurre in una più precisa rilevazione dei fabbisogni di forza lavoro e delle relative modalità organizzative, sui quali costruire il nuovo progetto di espansione e di qualificazione dell'occupazione e della base produttiva del porto di Genova.


La formazione

Per quanto concerne le attività di formazione che interessano i lavoratori nel porto di Genova, in base ad un accordo sindacale siglato nel 1999 tutti i nuovi assunti in ambito portuale devono seguire un corso di formazione di otto ore, organizzato dall'Autorità portuale e sviluppato con la partecipazione della ASL e dei sindacati. Il corso non sostituisce ma integra quello previsto dalla disciplina legislativa a carico del datore di lavoro ed obbligatorio, costituendo la frequenza al corso il requisito essenziale per ottenere il permesso di accesso al porto.

Sulla scorta dei risultati dello studio predisposto dalla Provincia di Genova relativo al progetto Genoa Port Training (Centre), l'Autorità Portuale di Genova intende inserire tra i propri programmi di breve periodo la creazione di una scuola di formazione portuale, sul modello di quelle già esistenti in altre realtà e il cui percorso di formazione recepisca gli standard già individuati proprio nelle esperienze portuali più evolute sotto questo profilo (Rotterdam, Amburgo, Marsiglia, Anversa, Barcellona, Gran Bretagna). Questo progetto verrà sviluppato d'intesa con la Provincia di Genova e in collaborazione con le associazioni sindacali e di rappresentanza dei lavoratori e dei datori di lavoro.

Da questo punto di vista, viene auspicata anche una revisione delle disposizioni attualmente esistenti a livello nazionale in materia di sicurezza sul lavoro, in modo da individuare, in stretto raccordo con la ASL, le soluzioni formative che siano comuni a tutto il settore portuale nazionale.

Allo stato attuale, nel panorama italiano solo l'Autorità portuale di Venezia e quella di Livorno hanno creato delle strutture formative che offrono servizi volti a professionalizzare non solo le figure professionali più direttamente coinvolte nell'operativa portuale, ma anche, più in generale, quelle appartenenti alla comunità portuale (imprese, agenti, etc.).

Sulla base di questi orientamenti viene quindi sottolineato l'impegno da parte dell'Autorità Portuale a costituire il centro di formazione sulla portualità nell'ambito del porto di Genova.


La sicurezza del lavoro

Nel corso degli ultimi anni, anche a seguito di gravi episodi di infortuni ed incidenti mortali segnalati nell'ambito portuale, si è sentita l'esigenza di avviare una più incisiva pianificazione di misure concernenti la sicurezza in porto, nonché un monitoraggio continuo dell'applicazione delle stesse, attraverso un reale coordinamento tra parte pubblica, privata e componenti sindacali.

Gli incontri intercorsi tra i diversi soggetti coinvolti hanno portato alla redazione di un Protocollo di Intesa, da attuarsi in un triennio, con il quale sono stati definiti impegni ed iniziative volti a raggiungere l'obiettivo di un sostanziale miglioramento degli aspetti preventivi e di monitoraggio legati alla sicurezza.

Il Protocollo di Intesa, sottoscritto dalle parti in data 14/05/2007 e approvato dal Comitato Portuale nella seduta del 24 maggio 2007, prevede principalmente:

  • per le imprese portuali, ivi comprese le compagnie portuali, una serie di impegni ed iniziative volti a ridurre al minimo possibile gli eventi infortunistici;
  • per i soggetti di parte pubblica una serie di iniziative atte ad ottimizzare le azioni di prevenzione, controllo e formazione anche attraverso la costituzione di un Sistema Operativo Integrato (S.O.I.) che, coordinato operativamente dall'Azienda Sanitaria Locale, assicuri il monitoraggio ed il controllo delle attività e degli interventi posti in essere dalle parti.
In particolare le imprese portuali si sono impegnate a garantire un flusso informativo costantemente aggiornato relativo a tutte le risorse umane impegnate nelle operazioni, ad aggiornare il documento di sicurezza di cui all'art. 4 D.Lgs. 272/99, a rendere operativo il coordinamento di un nucleo di lavoratori (meglio individuati nel doc. integrativo cui si accenna in seguito), a promuovere l'incremento del Rappresentanti del Lavoratori per la Sicurezza (RLS) ed il loro coordinamento con i tecnici aziendali, a porre in essere una mirata attività di prevenzione tramite una chiara attribuzione di responsabilità, l'esercizio di un costante controllo dei fattori di rischio e del rispetto delle norme, la predisposizione di un'analisi dettagliata degli eventi infortunistici/incidenti e un concreto impegno in termini di formazione.

Le parti pubbliche, oltre ad orientare e a garantire il supporto per le azioni sopra descritte, si sono impegnate a potenziare il sistema di sorveglianza tramite l'utilizzo di nuovi sistemi e flussi informativi, a costituire un Sistema Operativo Integrato coordinato dall'ASL (del quale fanno parte Autorità Portuale, Capitaneria di Porto, DPL, INAIL, INPS e ISPESL) per il continuo monitoraggio e controllo delle azioni intraprese dalle imprese portuali, nonché a sviluppare un'azione di controllo del territorio portuale per risolvere le criticità emerse. L'Autorità Portuale doveva inoltre provvedere a mettere a disposizione una sede in territorio portuale per gli uffici della ASL 3, a ricercare modalità di funzionamento più efficaci del servizio di emergenza sanitaria e ad organizzare adeguati corsi di formazione per il personale ispettivo, in coerenza con le finalità del Protocollo.

Ad integrazione del Protocollo è stato inoltre definito un documento integrativo tra Prefettura, Autorità Portuale, Asl 3, Imprese Portuali e Organizzazioni Sindacali, in forza del quale è stata, come accennato, convenuta la costituzione di un nucleo di 8 lavoratori al fine di potenziare il sistema dedicato alla sicurezza in ambito portuale.

A seguito ditali intese, nella seduta di Comitato del 23 luglio 2007 è stato individuato il dettaglio degli interventi da promuovere, così sintetizzabili:

  • rendere operativo il coordinamento di un nucleo di lavoratori appartenenti alle imprese portuali per l'espletamento delle funzioni previste dal Protocollo di intesa;
  • fornire a tali lavoratori e all'insieme degli Organismi previsti nelle intese i necessari supporti logistici e strumentali;
  • garantire una migliore organizzazione del servizio chimico in porto.
Per le esigenze connesse agli interventi previsti si è provveduto ad istituire un'apposita addizionale sulla merce sbarcata/imbarcata nel porto di Genova.

In merito al Sistema Operativo Integrato, sono stati ad oggi perseguiti i seguenti obiettivi:

  • individuazione delle 28 imprese sottoposte al Protocollo (comprese le due Compagnie Portuali);
  • istituzione del registro dei Rappresentanti dei Lavoratori della Sicurezza (R.L.S.) con informazioni dettagliate in merito alle nomine degli stessi e alla formazione prevista dalla legge;
  • elezione a cura delle Organizzazioni Sindacali di otto lavoratori rappresentanti di sito;
  • completamento del percorso di formazione rivolto al personale ispettivo dell'Autorità Portuale e corso di formazione base per Rls a cura delle Organizzazioni Sindacali rivolto al personale distaccato;
  • individuazione delle sedi dedicate alla U.O. Psal Ambito Porto presso la Stazione Marittima di Ponte Andrea Doria e alla Struttura di coordinamento sindacale presso Ponte Andrea Doria Testata;
  • relazione dell'Autorità Marittima a seguito dei sopralluoghi effettuati presso le aree comuni del porto in merito a illuminazione, segnaletica, manto stradale ingombri etc.;
  • convocazione Comitato Igiene e Sicurezza del Lavoro (5 ottobre e 14 dicembre) e convocazione SOI (18/12/07);
Inoltre, sono in fase di predisposizione le seguenti azioni:
  • l'implementazione di un sistema informativo per via telematica a cura dell'Autorità portuale ed in stretta collaborazione con ASL e DPL per la rilevazione giornaliera dell'impiego di personale operativo presso le imprese finalizzato ad un riscontro circa l'osservanza delle disposizioni in materia di lavoro;
  • l'elaborazione dei dati infortunistici aziendali richiesti alle imprese con nota congiunta AP-ASL del 21 settembre 2007;
  • il monitoraggio sul campo delle attività operative con riferimento a modalità di lavoro, uso e manutenzione dei mezzi ed idoneità di aree;
  • una campagna organica organizzata da Autorità portuale e da Autorità marittima per il controllo del territorio portuale e alfine di effettuare gli opportuni interventi di adeguamento e ripristino della conformità alle disposizioni in materia di sicurezza nelle aree comuni;
  • il coinvolgimento del Servizio 118 e dei VV.FF. per analizzare eventuali criticità riscontrate per l'accesso del servizio di emergenza in porto.
Le attività del Protocollo sono coordinata dalla ASL in stretta collaborazione con l'Autorità Portuale di Genova e le altre pubbliche amministrazioni.
