A. - La gestion des investissements et de l’'quipement

1' La d'finition des programmes d’investissement

Les programmes d’investissement des ports d'coulent des plans de d'veloppement pluriannuels dans lesquels ils inscrivent leur strat'gie. La plupart des ports ont aussi 'labor' des " plans d’entreprise ", contreparties pr'alables et n'cessaires au versement de la dotation en capital attribu'e en 1988. En outre, pour la pr'paration des r'unions bisannuelles du C.I.E.S., une programmation ' trois ans des investissements portuaires est g'n'ralement demand'e. S’ils ont le m'rite d’exister, ces travaux de programmation sont n'anmoins caract'ris's par des ambitions irr'alistes et des 'tudes pr'alables insuffisantes.

a) L’irr'alisme des ambitions

La Cour avait d'j' relev' dans son rapport public de 1990 que " les pr'visions ' moyen terme des ports demeurent caract'ris'es par l’optimisme des estimations de trafic et la fragilit' financi're des hypoth'ses retenues ". Ce ph'nom'ne persiste, comme cela a 't' relev' pr'c'demment au sujet de l’'laboration des contrats de plan Etat-r'gion et ' propos des proc'dures budg'taires, ' partir de l’exemple du port autonome de Dunkerque, qui n’est pas le seul en la mati're.

Syst'matiquement, les pr'visions affichent une enveloppe d’investissements maximale. Cette politique budg'taire pr'sente l’inconv'nient majeur d’'viter d’afficher les choix ' faire en mati're d’investissements, malgr' les recommandations fr'quentes et conjointes des repr'sentants de la tutelle au conseil d’administration. Dans une r'ponse 'crite ' la Cour, le directeur du port autonome de Dunkerque explique et justifie cette situation de plusieurs fa'ons :

- la volont' de disposer d’une marge de manœuvre suffisante : figurent au titre des pr'visions des projets qui d'pendent de la concr'tisation d’un contrat commercial ou d’une analyse plus fine de la justification effective de l’op'ration ;

- la n'cessit' d’afficher vis-'-vis des clients ou partenaires une politique ambitieuse de d'veloppement, largement comment'e dans la presse, " qui s’int'resse davantage aux perspectives de d'veloppement qu’au rythme effectif de r'alisation des investissements qui est ajust' en tenant compte des priorit's 'conomiques ou techniques et des capacit's de financement de l’'tablissement ";

- la notification tardive par l’Etat du programme d’investissement d’infrastructures effectivement retenu au titre de l’exercice concern' ;

- une sous-estimation des d'lais inh'rents ' la r'alisation des investissements.

b) L’insuffisance des 'tudes pr'alables

La Cour a constat' ' maintes reprises et au cours de plusieurs contr'les successifs sur les m'mes ports que des investissements ont 't' engag's sur le fondement d’'tudes pr'visionnelles de rentabilit' insuffisantes.

Le rapport Boiteux (34) constatait d'j' que peu de projets d’investissement faisaient l’objet d’une 'tude 'conomique d'taill'e. Il soulignait les probl'mes d’analyse 'conomique sp'cifiquement rencontr's par les ports :

- l’incertitude sur les trafics au-del' de cinq ans est tr's grande, alors que la dur'e de vie d’investissements lourds est de l’ordre de cinquante ans ;

- la strat'gie des ports, conscients de la non comp'titivit' de la manutention vis-'-vis des ports des pays voisins, a 't' de conserver leurs parts de march' plut't que de rechercher la rentabilit' de leurs investissements, avec l’espoir qu’une r'forme de la manutention viendrait un jour la leur apporter ; ils ont donc pratiqu' une forte p'r'quation entre les trafics, ce qui fausse l’analyse de la rentabilit' financi're.

Des d'fauts d’analyse pr'alable se retrouvent, par exemple, dans le cas de l’acquisition par le port autonome du Havre pour 37,9 MF d’une grue automotrice sur pneus, qui n’a fonctionn' que 58 heures en 1992 parce que le quai - entre autres raisons - ne pouvait pas supporter le poids de la grue lorsqu’elle 'tait charg'e.

De m'me, la construction du terminal fruitier du port autonome de Nantes-Saint-Nazaire a 't' d'cid'e en septembre 1992 sur le fondement d’'tudes pr'alables de rentabilit' 'conomique gravement insuffisantes, r'alis'es entre 1989 et 1991, et malgr' les r'serves exprim'es par le tr'sorier payeur g'n'ral et le contr'leur d’Etat. L’objectif affich' d’un trafic annuel de 250 000 ' 300 000 tonnes pour cet investissement de 45 MF pr'visionnels, et de 61 MF in fine, n’a pas 't' atteint. Le trafic n’'tait que de 30 000 tonnes en 1995 et 7 500 tonnes en 1994 alors qu’il 'tait pr'vu qu’il atteindrait 200 000 tonnes pour cette premi're ann'e d’exploitation. Une 'tude ult'rieure, men'e en 1995, soit apr's la r'alisation de l’investissement, avait limit' l’objectif de moyen terme, estim' entre 90 000 et 100 000 tonnes.

Afin de cr'er un troisi'me terminal ' conteneurs et de faire de Pointe-'-Pitre-Jarry un port de redistribution de la zone Cara'be, le port autonome de Guadeloupe avait r'alis' un investissement de 140 MF cofinanc', aux termes d’une convention d’octobre 1993, par le fonds europ'en de d'veloppement r'gional (programme d’initiative communautaire REGIS) ' hauteur de 40 %, le port (38 %), l’Etat (14 %) et la r'gion (8 %). Il s’'tait appuy' sur une 'tude r'alis'e en ao't 1990 par un ing'nieur du port autonome de Marseille qui pr'voyait une forte croissance du trafic domestique et le d'veloppement du trafic de transbordement de conteneurs, hypoth'se d'nu'e de fondement 'conomique cr'dible. En effet, le port autonome, seul port d’approvisionnement de la Guadeloupe, traite essentiellement un trafic franco-fran'ais, r'pondant aux besoins d’importation de la Guadeloupe et d’exportation vers la m'tropole. Il ne pouvait raisonnablement 'tre consid'r' comme un centre commercial ' rayonnement international, fut-ce ' moyen terme.

Les imperfections de ces analyses ont un impact direct sur le taux d’utilisation des outillages publics.

A titre d’exemple, au port autonome de Dunkerque, ce taux, mesur' par le rapport entre les heures r'elles de fonctionnement et la capacit' maximale th'orique, est, selon les sites, faible ou moyen, et ne justifiait pas d’investissements nouveaux en outillages. Il s’'levait en 1995 ' : 24 % de la capacit' maximale th'orique des grues du port Est, au rendement d'croissant ; 71 % pour celles du quai de grande Synthe, mais 38 % en moyenne sur la p'riode 1991-1995 ; 48 % au quai aux aciers ; 21 % au terminal ' conteneurs, mais 16 % en moyenne sur la m'me p'riode ; et 59 % au quai ' pond'reux ouest.

2' Le suivi des investissements ' l’int'rieur des 'tablissements

Comme la Cour l’a constat', les co'ts de certains investissements sont tr's mal ma'tris's et l’ex'cution des op'rations elles-m'mes n’est pas suivie sur le plan financier. Ces d'fauts sont accentu's lorsque l’ampleur de l’assiette ' prendre en compte, la valeur des estimations et la pertinence des proc'dures internes posent probl'me.

Deux op'rations examin'es au port autonome de Marseille illustrent cet 'tat de fait. Ainsi, dans le cas de la remise en 'tat du pont basculant de Martigues, le conseil d’administration et le ministre d'l'gu' ' la mer avaient autoris' l’op'ration ' hauteur de 5,86 MF, hors frais d’'tudes et de surveillance des investissements. Cette estimation ainsi que le contenu des travaux 'taient en r'alit' peu pr'cis, de sorte que certaines d'penses du service " automatismes et communications " sans rapport direct avec la r'novation du pont basculant, mais qui pouvaient " rentrer dans l’enveloppe ", ont 't' imput'es ' l’op'ration, tandis que des d'penses semblant en relever, telles que la remise en 'tat du mouvement de basculement du pont, n’y ont pas 't' rattach'es.

De surcro't, ' aucun moment, l’'tat d’avancement de l’op'ration, qui n’'tait pas termin'e en 1997 alors que les derni'res d'penses imput'es dataient de novembre 1993, n’a fait l’objet de compte rendu. Il n’est donc pas possible de savoir in fine si les 5,86 MF effectivement consomm's correspondent au co't v'ritable de l’op'ration, vraisemblablement situ' entre 4,3 et 8,12 MF selon la conception plus ou moins extensive que l’on peut en avoir, soit une amplitude du simple au double. Cette incertitude manifeste le manque d’information du conseil d’administration, qui n’a connu que les dossiers constitu's pour l’examen des projets et les documents diffus's ' l’appui des budgets, mais qui n’a pas suivi les r'alisations.

Les m'mes impr'cisions de d'finition de l’assiette d’une op'ration d’investissement se retrouvent dans la r'novation du terminal ' passagers des bassins est de Marseille. Apr's une premi're estimation de 244 MF effectu'e en 1991, le montant des travaux a 't' 'valu' ' 312,5 MF en mars 1993, ' 317 MF en novembre 1993, 301 MF en 1995, 225 MF en 1996 et ' 239 MF en 1997. Toutefois, le port n’a pas retenu dans le p'rim'tre du projet des 'tudes pr'alables, des op'rations qui 'taient li'es au projet lui-m'me telles que le transfert du terminal fruits et l'gumes ainsi que les cons'quences de la suppression du pont d’Arenc. N’y ont pas 't' non plus compris des 'quipements d’accompagnement destin's ' am'liorer les conditions de transit et d’accueil des passagers. Le co't global de la r'novation du terminal est de l’ordre de 360 MF si l’on tient compte de ces diff'rents 'l'ments.

3' La coh'rence des investissements

a) Les grands 'quipements structurants des fa'ades maritimes

La Cour a examin' la situation des 'quipements de l’ensemble des terminaux portuaires de la fa'ade Atlantique, distingu's par grands types de trafic : vracs liquides, vracs solides, conteneurs et marchandises diverses. Elle a constat' que les 'quipements portuaires, infra- et superstructures, sont suffisants et plut't sous-employ's. Il convient donc principalement de les entretenir et de les rentabiliser davantage.

Les terminaux de vracs liquides

Au Havre, le trafic de vracs liquides qui repr'sente 60 % du trafic du port est r'parti ' 'galit' entre deux terminaux conc'd's ' la Compagnie industrielle maritime (CIM) : deux postes ' Antifer, con'us en 1971 pour accueillir 100 Mt par an, mais n’en traitant que 16 ' 17 Mt ; et dix postes au terminal du Havre. En 1995, les droits de ports des navires p'troliers constituaient 60 % des recettes totales de droits de port per'us par le port autonome. A Nantes-Saint-Nazaire, les vracs liquides, soit les deux tiers de l’activit' portuaire, sont trait's dans les terminaux p'trolier de Donges et m'thanier de Montoir. A Dunkerque, deux raffineries ont chacune leur terminal. A Rouen, se juxtaposent six terminaux p'troliers, deux terminaux de vracs liquides et un terminal de gaz liqu'fi'. Enfin, ' Bordeaux, les vracs liquides repr'sentent 45 % du trafic du port et sont trait's sur les sites d’Amb's et de Pauillac.

L’analyse des comptabilit's analytiques par site et/ou par trafic - lorsqu’elles existent, et qui doivent 'tre appr'ci'es avec toutes les r'serves faites pr'c'demment - montre que les r'sultats de ces terminaux sont tr's b'n'ficiaires pour les ports qui, pourtant, sont loin d’'tre comp'titifs, avec un surco't en moyenne de 3 ' 4 francs par tonne par rapport aux ports europ'ens. Cette situation pr'sente donc des risques de perte d’activit' et de ressources importantes dans un contexte de fermeture de raffineries p'troli'res en Europe, ou de transfert de trafic, comme ' Bordeaux. L’observatoire des co'ts de passage portuaire devrait permettre d’affiner cette analyse, les seuls 'l'ments de co't disponibles jusqu’ici 'tant ceux recens's par l’Union fran'aise des industries p'troli'res, mais dont les r'sultats sont contest's par les ports.

Les terminaux ' conteneurs et marchandises diverses

Au Havre, le principal investissement r'cent a 't' la construction d’un port rapide ' l’aval de l’'cluse Fran'ois Ier, o' se situent trois des cinq terminaux de marchandises diverses, 'quip's de 22 portiques ' conteneurs, dont huit sont d'tenus par les entreprises de manutention. A Dunkerque, le terminal ' conteneurs est d'sormais 'quip' de deux portiques " over-panamax " (cf. lexique). A Rouen, un ambitieux programme de d'veloppement du terminal ' conteneurs et marchandises diverses de Grand Couronne / Moulineaux est pr'vu mais sa compatibilit' avec le projet " port 2000 " du port autonome du Havre n’est pas assur'e. A Bordeaux, le terminal ' conteneurs du Verdon est nettement surcapacitaire, alors que le trafic a diminu' de moiti' en dix ans, passant de 27 727 ' 12 751 conteneurs. En outre, le port autonome a r'alis' en 1995 un terminal ' Bassens-aval.

En raison notamment du manque de marchandises et de l’insuffisance de la tarification des prestations d’outillage, les sites ' conteneurs ne sont pas rentables et sont sources de d'ficits : -60 MF au Havre, -32 MF ' Dunkerque, -17 MF ' Nantes-Saint-Nazaire en 1995, sans oublier le Verdon.

Pour les trafics de la fili're bois/papier se pose le probl'me de la concurrence des installations de La Rochelle dont l’extension est pr'vue pour un montant de 125 MF, du terminal sp'cialis' de Chevir' avec des investissements de modernisation pr'vus pour 16 MF, et du projet de " p'le ' bois " de Bassens ' Bordeaux dont le co't sera de 36 MF.

En mati're de trafic sucrier, les installations de Dunkerque et de Calais (o' le terminal a 't' construit et mis en service en octobre 1995 sans concertation aucune avec Dunkerque) paraissent jusqu’ici compl'mentaires, mais elles sont tr's proches d’Anvers qui est dot' de trois terminaux sucriers. Elles suscitent cependant une concurrence tarifaire exacerb'e, pour des services comparables : ' titre d’exemple, selon une 'tude du port de Dunkerque, les droits de port pour un navire de 14 000 T 'taient en d'cembre 1995 de 7 000 F ' Calais, 25 000 F ' Dunkerque, 38 000 F ' Anvers et 44 000 F au Havre. De m'me, la construction d's 1995 d’un terminal sucrier ' Rouen pour un montant de 140 MF, essentiellement financ's par la soci't' int'ress'e et ' hauteur de 32 MF sur fonds publics, comportait le risque de concurrencer le terminal sucrier du Havre sans qu’il en r'sulte un trafic suppl'mentaire.

Les terminaux de vracs solides

En sens inverse, les terminaux de vracs solides conservent une certaine coh'rence entre eux. A Dunkerque, le trafic de minerais et charbon est effectu' sur les quais priv's de Sollac et sur le quai public ' pond'reux ouest (QPO), dont l’exploitation s’est sold'e par une perte de 58 MF en 1995 alors que des investissements de 244 MF ont 't' effectu's de 1991 ' 1995.

A Rouen, les vracs solides sont principalement des c'r'ales, trait'es par des terminaux priv's ou publics. Les 'quipements du port du Havre ne peuvent rivaliser avec ceux du port de Rouen et le co't des acheminements de ce dernier demeure le plus int'ressant : sur ce trafic, il y a moins de risque de concurrence st'rile entre ports.

L’examen des diff'rents types de terminaux fait donc ressortir des probl'mes de coh'rence et de rentabilit' des 'quipements qui, ind'pendamment du r'le d’arbitrage de l’Etat examin' en premi're partie, rel'vent au premier chef de la responsabilit' des ports autonomes. En effet, il leur revient, compte tenu de leurs capacit's d’expertise, de mieux prendre en compte les 'quipements existants ou les projets qui peuvent, sans susciter de nouveaux trafics, concurrencer leurs propres investissements, puis de rentabiliser davantage ces derniers.

b) La politique informatique

Les ports autonomes ont une responsabilit' encore plus directe pour les investissements li's ' leur fonctionnement interne tels que l’informatique.

Un bon outil informatique est un des facteurs cl's de la comp'titivit' d’un port ' vocation internationale. Les syst'mes informatiques performants mais on'reux des deux premiers ports fran'ais qui auraient eu vocation, en cons'quence, pour des questions de co't et de facilit' d’interconnexion, ' 'tre d'velopp's en commun, l’ont n'anmoins 't' s'par'ment par Marseille (PROTIS) et Le Havre (ADEMAR+).

A l’instar des grands ports de l’Europe du Nord (SEAGHA ' Anvers, INTIS ' Rotterdam, COMPASS ' Br'me, DAKOSY ' Hambourg), le port autonome du Havre s’est dot' d’une informatique portuaire adapt'e aux besoins des usagers : le Havre a 't' raccord' au syst'me douanier SOFI (Syst'me d’Ordinateurs pour le Fr't International) et a d'velopp' un syst'me compl'mentaire baptis' " ADEMAR " (Acc'l'ration du D'douanement des MARchandises), puis " ADEMAR+ " mis au point de 1985 ' 1991.

Ce syst'me est exploit' par une soci't' cr''e par les professionnels portuaires, qui 'tait initialement financi'rement pr'caire et sous-capitalis'e (0,3 MF r'partis entre neuf actionnaires), la SOGET (Soci't' de Gestion de Terminaux informatiques), et dans laquelle le port n’'tait pas actionnaire. Au 31.12.1998, ses fonds propres s’'levaient ' 7 MF dont 3,1 MF de capital social et le port autonome du Havre y 'tait d'sormais actionnaire. La redevance pay'e au port par la SOGET pour l’utilisation du mat'riel et la mise ' disposition de personnel peut 'tre qualifi'e de " symbolique ". Elle a 't', en effet, calcul'e pour ne couvrir que 10 % des investissements r'alis's par le port, soit 3,3 MF sur cinq ans en ce qui concerne ADEMAR+. De surcro't, elle n’est vers'e - avec des d'lais de paiement accord's pour cause de fragilit' financi're de la SOGET - que depuis la mise en exploitation effective, donc sans tenir compte du co't du portage financier par le port.

Quelle que soit la qualit' technique de l’informatique portuaire d'velopp'e au Havre depuis 1980, la Cour a constat' que l’'tablissement public a support' avant 1992 l’essentiel du co't direct (r'seau et applicatifs : 37 MF pour une op'ration initialement 'valu'e ' 23 MF, plate-forme de communication et d’'changes EDI : 9,3 MF) et l’essentiel des risques d’un syst'me qui profite ' l’ensemble de la communaut' portuaire sans que les responsabilit's aient 't' d'finies avec assez de pr'cision. La forte repr'sentation des professionnels au conseil d’administration du port n’est sans doute pas 'trang're ' cette r'partition d's'quilibr'e des r'les : les premiers utilisent et exploitent le syst'me, m'me s’ils le financent indirectement par les droits de port, le second en supporte les risques techniques et le financement direct.

De m'me, ' Marseille, le syst'me PROTIS est g'r' par la soci't' Gyptis dans laquelle le port n’'tait pas non plus actionnaire, alors qu’il a pris en charge des investissements qui s’'levaient ' 49 MF fin 1995 sur un budget de 56 MF. Comme le soulignait d'j' le rapport public 1990 de la Cour, ce mode de financement est propre aux ports fran'ais. En effet, l’informatisation des grands ports internationaux a tr's 'troitement associ' les acteurs portuaires priv's.

Compte tenu de son montant 'lev' et de son int'r't, le d'veloppement du projet informatique aurait d' faire l’objet d’une coordination entre places portuaires, ce qui n’a pas 't' le cas. La direction charg'e des ports n’a pas jou' de r'le actif ' cet 'gard. Outre le fait qu’elle aurait permis de r'aliser des 'conomies d’'chelle substantielles obtenues, notamment sur les phases d’'tude, une collaboration entre les principaux ports fran'ais aurait r'pondu au vœu des armateurs de disposer d’un acc's standardis' de leurs propres informatiques aux syst'mes portuaires. Tel n’est pas le cas, m'me si les ports de Marseille et du Havre ont particip' ' un groupe de travail sur la d'finition des standards de communication et se retrouvent dans le cadre de l’association EDITRANSPORTS (Afnor). Toutefois, la Cour constate que le port autonome du Havre est r'cemment devenu actionnaire de la SOGET et que le port autonome de Marseille a 't' autoris' par arr't' du 4 f'vrier 1999 ' prendre une participation ' hauteur de 3 MF, soit 35,8 %, dans le capital de la soci't' Gyptis : cela devrait leur permettre d’exercer un meilleur contr'le sur les conditions d’exploitation des syst'mes pour lesquels ils ont support' la majeure partie des risques financiers et techniques.

La coordination des politiques informatiques des ports ne fait pas l’objet d’une attention suffisante de la part des tutelles. Aujourd’hui, alors que les deux syst'mes acceptent de dialoguer et d’investir ensemble pour l’'tape de d'veloppement ult'rieure, il serait utile, comme le recommande le contr'le d’Etat, de valider, gr'ce ' une expertise externe, leurs hypoth'ses de d'veloppement.

Recommandations

- fonder les pr'visions d’investissement ' moyen terme des ports sur des estimations de trafic r'alistes et sur des hypoth'ses et analyses 'conomiques financi'res solides ; 'tablir diff'rents sc'narios en fonction des hypoth'ses retenues ; entretenir et rentabiliser davantage les 'quipements portuaires en infra- et superstructures, avant de lancer d’'ventuelles op'rations nouvelles ; en cas d’op'rations nouvelles, mieux prendre en compte les 'quipements existants ou les projets risquant de concurrencer les investissements sans susciter de nouveaux trafics ;


- am'liorer le suivi des op'rations d’investissement et en rendre compte de fa'on d'taill'e et r'guli're au conseil d’administration ;
- acc'l'rer le rapprochement des syst'mes informatiques portuaires des ports du Havre et de Marseille ; engager une expertise externe sur les hypoth'ses de d'veloppement du projet.
