LA POLITIQUE PORTUAIRE FRANCAISE

PREMIERE PARTIE

LES OBJECTIFS ET LES MOYENS DE L’ETAT
EN MATIERE PORTUAIRE

Selon les 'poques, les enjeux strat'giques et 'conomiques ont conduit l’Etat ' s’engager plus ou moins activement dans l’'quipement et la gestion des ports maritimes.

Le Havre est ainsi fond' par Fran'ois Ier en 1517 ' la fois comme base navale et comme port de commerce. Plus tard, Richelieu contribue ' cr'er une puissante flotte de guerre et de commerce. De nombreux ports sont fond's ou d'velopp's sous Colbert, secr'taire d’Etat ' la marine, en vue de d'fendre les c'tes : Bayonne, Bordeaux, Brest, Calais, Cherbourg, Le Havre, Nantes, Rochefort et surtout Dunkerque, qui fait l’objet des travaux les plus consid'rables. Les ports rel'vent alors des villes et des corporations, hormis la signalisation et l’entretien des profondeurs d’eau. C’est aussi sur la fonction militaire des ports que le premier Empire se concentre, en favorisant Boulogne, Brest, Dieppe, Dunkerque, Le Havre, et surtout Anvers, dont l’essor date de cette 'poque, ainsi que Cherbourg.

Le dix-neuvi'me si'cle repr'sente un tournant dans l’histoire portuaire, avec le d'veloppement propre des ports de commerce. La r'volution introduite par la navigation ' vapeur, le chemin de fer (ligne Paris-le Havre ouverte en 1847, Paris-Dunkerque en 1848) et l’ouverture du canal de Suez en 1869 puis celle du canal de Panama en 1914, permettent un d'veloppement consid'rable du trafic maritime. D’importants travaux sont entrepris : construction du bassin Napol'on ' Marseille, am'nagement des ports de Saint Nazaire et de Donges et endiguement de la Seine. Signe d’un int'r't certain pour les ports, la charge des travaux portuaires est attribu'e ' l’Etat par la Restauration. Pourtant, le programme de travaux publics du ministre des travaux publics, Charles de Freycinet, approuv' en 1878, ne comporte encore qu’un volet maritime restreint. De m'me, le programme Baudin, du nom du ministre des travaux publics, adopt' en 1903, est plut't ax' sur les voies navigables. De sorte qu’un important retard dans l’'quipement portuaire est accumul', qui conduit l’Etat, dans les ann'es 1900, ' autoriser les chambres de commerce ' intervenir sur le domaine public maritime pour y construire les 'quipements n'cessaires.

Au cours de la premi're moiti' du vingti'me si'cle, le trafic des ports progresse gr'ce aux 'changes avec les colonies, profitant principalement ' Marseille, Nantes et Bordeaux, d’une part, ainsi qu’' d’importantes dispositions protectionnistes, qui p'nalisent les marchandises d'barqu'es dans un port 'tranger, d’autre part. Deux ports, Bordeaux et Le Havre, se voient accorder un statut d’autonomie en 1924.

Apr's la seconde guerre mondiale, au fur et ' mesure de la d'colonisation et de la lib'ralisation du commerce international, de nouveaux courants d’'changes apparaissent, avec les Etats Unis puis avec le sud-est asiatique, facilit's par des navires sp'cialis's de tr's gros tonnage.

Pour faire face ' la n'cessit' - pr'vue par le V'me plan - d’'quiper les ports en cons'quence, six ports fran'ais de m'tropole se voient conf'rer un statut d’autonomie en 1965. Le l'gislateur de 1965 vise ' concentrer l’effort d’'quipement de l’Etat sur les principaux ports, ' constituer des unit's de gestion autonomes et ' coordonner et animer efficacement ces 'tablissements au niveau central. L’accroissement de l’intervention de l’Etat de 50 % jusqu’' 60 ou 80 % des principales d'penses d’investissement devait se traduire par une r'duction des droits de port ' la charge des usagers et donc par une am'lioration de la situation concurrentielle des ports.

Cette loi d’autonomie permit effectivement une forte croissance des investissements au cours de la p'riode 1965-1975 (cf. graphique en annexe n' 3). Les plus lourds de ces investissements ont 't' consacr's ' l’extension de leur capacit' et ' la cr'ation de p'les industriels situ's directement en bordure des quais, comme Fos ' Marseille, le port Ouest ' Dunkerque, ou encore Le Verdon ' Bordeaux, d'cid' en 1976. C’est aussi en 1972 que commencent les travaux du terminal p'trolier d’Antifer au Havre.

Durant la d'cennie suivante, sous l’effet de la crise p'troli're, qui arr'te la course au gigantisme des navires p'troliers, le rythme des grands am'nagements portuaires a diminu', ' l’exception de la cr'ation du site de Montoir ' Nantes-Saint-Nazaire en 1980.

Au cours des ann'es quatre-vingt-dix, hormis les apports partiels des lois de 1992 et 1994 sur la manutention et le domaine portuaires, l’Etat et les responsables politiques fran'ais ne se sont gu're int'ress's aux adaptations n'cessaires ' une meilleure comp'titivit' des ports.

Le volet maritime de la politique des transports a, de fait, rarement 't' une priorit' 'conomique en France, malgr' un littoral m'tropolitain de 4 500 kilom'tres qui lui conf're une vocation maritime naturelle, mais explique aussi la multiplicit' des ports qui rend n'cessaire mais d'licat tout arbitrage national.

I. - LES EVOLUTIONS RECENTES DE L’ACTIVITE PORTUAIRE ET LES OBJECTIFS DE LA POLITIQUE DE L’ETAT

Dans le nouveau contexte de l’activit' portuaire, l'Etat n’a pas su d'finir les objectifs de sa politique. Cette situation s’est traduite, au cours des ann'es quatre-vingt dix, par des r'formes juridiques parcellaires et des choix financiers peu efficaces.

A. - LA nouvelle donne de l’activit' portuaire

1' Les 'volutions 'conomiques et technologiques

Depuis la loi de 1965 sur l’autonomie portuaire, les conditions de l’'conomie maritime ont chang', dans un contexte g'n'ral d’accroissement des 'changes et, ' la suite des chocs p'troliers, de r'duction des ambitions industrielles inscrites dans les V'me et VI'mes plans et envisag'es notamment ' Fos et Dunkerque.

Le trafic trait' par les entreprises fran'aises de transport maritime s’est fortement r'duit, du fait de l’effacement des grandes compagnies (Compagnie G'n'rale Maritime, Delmas-Vieljeux). Il s’est restreint aux trafics ' r'serv's ' : DOM-TOM, Corse et, dans une certaine mesure, transmanche. Entre 1980 et 1996, le tonnage transport' par la flotte fran'aise est pass' du neuvi'me au vingt-quatri'me rang mondial. Dans ces conditions, les ports fran'ais d'pendent largement des choix effectu's par les armements 'trangers.

La concentration des compagnies maritimes en m'ga-alliances est la principale caract'ristique du transport maritime depuis les ann'es 1980. Il s’agit en fait du deuxi'me temps de la ' r'volution du conteneur ', qui remonte quant ' elle aux ann'es 1970. L’'mergence de nouveaux armateurs asiatiques a cr'' un march', en forte croissance certes, mais o' la surcapacit' permanente a incit' au regroupement des op'rateurs.

Aujourd’hui, sur les vingt premiers armements mondiaux, dix sont asiatiques, huit europ'ens, dont un seul fran'ais, et deux sont am'ricains. Ils assurent ' eux seuls 45 % de la capacit' mondiale de transport. Dans un contexte de forte concurrence, les grands armements se sont lanc's dans une politique de rationalisation, de recherche d’'conomies d’'chelle sur les navires, et de pression sur les autorit's portuaires. Les cons'quences sont de plusieurs ordres.

w La taille des navires s’est accrue. Alors qu’en 1985, les grands armements poss'daient des bateaux de 3 000 conteneurs ' 'quivalent vingt pieds ' (EVP) environ, les b'timents actuels dits ' post-panamax ' (cf. lexique) ont plus de 4 000 EVP. La cinqui'me g'n'ration de porte-conteneurs correspond ' des navires de 6 000 EVP.

w Des lignes ' tour du monde ' ont 't' cr''es pour rationaliser les d'placements des navires, dont le co't d’immobilisation ou de transit devient de plus en plus 'lev'. Elles supposent de tr's fortes contraintes de qualit' du service portuaire (temps, fiabilit', s'curit') pour 'viter que les temps morts se r'percutent sur l’ensemble des escales.

w Le niveau des co'ts d’investissement dans les navires contraint les compagnies ' s’allier pour partager les risques commerciaux et maritimes, ainsi que pour rechercher des positions dominantes sur les principaux march's, face ' des chargeurs qui eux aussi se concentrent. L’objectif est double : il s’agit de peser tant sur les co'ts portuaires que sur le taux des frets maritimes, en garantissant l’apport d’un niveau significatif de trafic.

w La cons'quence de ces 'volutions sur les ports est directe. Chaque alliance tend ' regrouper les flux d’une zone, europ'enne par exemple, dans un nombre limit' de ports, en r'duisant les escales et en concentrant leur logistique terrestre, de fa'on ' accro'tre la comp'titivit' de la cha'ne de transport. Ces ports principaux sont baptis's ' hubs ' par r'f'rence ' une pratique d'j' ancienne du trafic a'rien. Les alliances y concentrent leur activit', avant que le trafic soit ensuite 'clat' par syst'me de cabotage (feedering) dans les ports secondaires. Chaque alliance cherche ' disposer de son ou de ses hubs propres, de fa'on ' 'tablir une position dominante vis-'-vis des acteurs portuaires. Cette 'volution explique l’apparition de ports de transbordement tels qu’Algesiras et Gioia Tauro en M'diterran'e.

w De nouveaux acteurs portuaires sont d's lors apparus : les acteurs priv's - plac's traditionnellement dans les ports autonomes dans une relation de forte d'pendance de l’'tablissement public portuaire - interviennent davantage par des prises de participation dans l’investissement, par une gestion effective de la manutention ou dans la gestion des zones industrielles. Les logisticiens ont un r'le nouveau, et qui n’est pas exclusivement portuaire, comme celui des manutentionnaires ' ancien style '. Les grands ports europ'ens ont connu une expansion tr's rapide de l’implantation des activit's de distribution : Rotterdam propose un ensemble de plates-formes de distribution, ' Distripark ', de plus de 270 hectares ; ' Anvers sont implant's les groupes Katoen Natie (plus de 100 hectares d’entrep'ts couverts), Hessenatie et Noord Natie. Or, par leurs d'cisions ou leur refus d’implantation, ces groupes peuvent avoir un effet important sur l’activit' d’un port ou sur son d'clin.

w La standardisation des produits transport's accro't et facilite la tendance ' la concentration des armateurs : les marchandises diverses sont de plus en plus conteneuris'es, comme le montrent la progression des cinq grands ports du nord-ouest europ'en et celle du nombre de conteneurs trait's dans les ports.

En outre, les flux maritimes ont 'volu'. Longtemps domin's par les 'changes entre les 'conomies europ'ennes et nord-am'ricaines, les flux - notamment conteneuris's - se dirigent surtout vers la zone Asie-Pacifique ou en proviennent.

Le trafic des ports fran'ais doit 'tre replac' dans ce contexte mondial. Si Hong-Kong, Singapour et Kaohsiung (Ta'wan) sont les trois premiers ports ' conteneurs au monde, le premier port europ'en est Rotterdam, en quatri'me position, tandis que Le Havre se situe ' la trente-quatri'me place mondiale et Marseille ' la soixante-cinqui'me.

w Il d'coule aussi de ces 'volutions que, m'me lorsque les frais d’escale (droits de port + pilotage + remorquage + lamanage) d’un port sont moins 'lev's, comme c’est le cas du Havre vis-'-vis de Rotterdam, les d'penses rapport'es aux conteneurs charg's et/ou d'charg's sont en revanche deux fois sup'rieures au Havre, compte tenu de la faiblesse du trafic. La fr'quence des escales et l’importance des chargements sont devenues un facteur majeur de comp'titivit'.

2' L’ouverture europ'enne

La politique portuaire est directement concern'e par la politique de la concurrence et la politique des transports d'finies au niveau de l’Union europ'enne. Ces deux politiques ont d’ailleurs fait l’objet du ' livre vert relatif aux ports et aux infrastructures maritimes ' pr'sent' par la commission europ'enne en d'cembre 1997. La commission y ' juge important de promouvoir le secteur portuaire par un certain nombre de mesures visant ' am'liorer ses performances globales. Ces actions ont notamment pour but d’am'liorer l’efficacit' des ports, de lever les obstacles qui entravent les 'changes et d’encourager l’am'lioration des ports et des infrastructures portuaires '.

a) La politique communautaire de concurrence

Selon la Commission europ'enne : ' la disparition progressive des hinterlands nationaux captifs signifie que les d'cisions concernant la tarification, l’am'nagement et le financement d’un port particulier peuvent avoir des cons'quences d'terminantes sur les ports voisins ' l’'chelle nationale et internationale. D’o' l’int'r't et l’opportunit' d’une approche mieux coordonn'e de l’am'nagement portuaire au niveau paneurop'en qui permettrait, entre autres, de s’assurer que les ports rivalisent sur des bases commerciales saines '. Les ports fran'ais peuvent 'tre confront's ' deux types d’interventions de la commission. Une premi're intervention porte sur le r'le des professions r'glement'es et des professions ' privil'ges, en particulier la manutention portuaire. Une seconde concerne l’encadrement des ' aides d’Etat ' qui, dans le domaine portuaire, proviennent aussi bien de l’Etat central que des 'tablissements publics portuaires (ports autonomes et chambres de commerce et d’industrie concessionnaires de ports d’int'r't national) ou des collectivit's territoriales.

A cet 'gard, le syst'me portuaire fran'ais est marqu' par une certaine volont' d’organisation rationnelle et de transparence ainsi que par des pratiques administratives de bonne gestion et de contr'le, qui imposent notamment aux gestionnaires portuaires dot's de la personnalit' morale (ports autonomes, concessionnaires de ports d’int'r't national) de produire des comptes et de les publier, tout en accueillant en leur sein des administrateurs qui sont des usagers portuaires.

A l’inverse, l’organisation des ports nord-europ'ens confie traditionnellement la gestion des activit's portuaires ' une r'gie municipale (cf. encadr' ci-dessous sur les r'gimes d’administration des ports en Europe). Sans comptes annuels publi's ind'pendamment de ceux de la commune, g'r'e uniquement par les 'lus locaux, la r'gie constitue une forme de gestion particuli'rement opaque, qui ne permet que difficilement d’identifier les aides publiques en mati're portuaire. Cette situation place donc les ports fran'ais dans une position plus expos'e puisque plus transparente.

S’agissant des ports fran'ais, les principaux risques de concurrence d'loyale sont doubles.

Ils affectent, d’une part, les relations commerciales avec les op'rateurs portuaires, par le biais des d'cisions tarifaires. Les distorsions peuvent concerner les droits de port, lorsque des ristournes b'n'ficient ' certains op'rateurs plus qu’' d’autres, les tarifs d’outillage lorsqu’ils privil'gient certains manutentionnaires, ainsi que les conditions d’utilisation des installations portuaires, voire l’acc's ' celles-ci. Ainsi, Irish Ferries, qui souhaitait implanter ' Roscoff une desserte transmanche, n’avait pu trouver un accord avec la chambre de commerce et d’industrie de Morlaix, concessionnaire du port de Roscoff et actionnaire minoritaire (' hauteur de 5,74 %) de la soci't' Bretagne-Angleterre-Irlande (d'nomm'e ' BAI ' ou ' Britanny Ferries '), repr'sentant 70 % du trafic et 80 % des recettes du port en 1996. Devant cette situation, Irish Ferries d'cida de porter le contentieux devant la Commission europ'enne. Celle-ci a estim' que la chambre de commerce avait abus' de sa position dominante d’op'rateur du port de Roscoff puisqu’elle avait refus' d’autoriser l’acc's aux installations de ce port. N'anmoins, par la suite, un accord a 't' trouv' en mai 1995 entre la chambre de commerce et la compagnie, cette derni're ayant accept' de signer un contrat d’engagement sur cinq ans, d’apporter une garantie de recettes, de lever les poursuites et de prendre en charge certains travaux.

Les risques existent, d’autre part, lorsque des acteurs publics prennent en charge des investissements destin's ' des op'rateurs priv's. Cette pratique peut 'tre consid'r'e comme une distorsion de concurrence avec des op'rateurs portuaires d’autres zones europ'ennes.

En fait, comme l’expose le livre vert de la Commission europ'enne, ' par le pass', les ports 'taient plut't consid'r's comme des lieux privil'gi's d’'changes et des p'les de croissance pour le d'veloppement r'gional et national, et donc comme des prestataires de services d’int'r't 'conomique r'gional qui devaient 'tre fournis par le secteur public et essentiellement financ's par les contribuables. Aujourd’hui la tendance est, de plus en plus, de consid'rer les ports comme des entit's commerciales qui doivent r'cup'rer leurs co'ts aupr's des usagers b'n'ficiant directement de leurs infrastructures. '

L’impact des diff'rences de statuts juridiques entre ports europ'ens devrait faire l’objet d’un examen approfondi de la part des institutions de l’Union europ'enne, au moins autant que d’autres types de distorsion plus directement 'conomiques.

Comparaison des r'gimes d’administration des ports maritimes en Europe

Allemagne

La plupart des ports sont g'r's par les L'nder (Hambourg et Br'me) et/ou par les communes (L'beck, Kiel).

Belgique

Jusqu’ici, les ports d’Anvers, Gand et Ostende faisaient partie du patrimoine municipal et 'taient g'r's par les communes. Le port d’Anvers 'tait g'r' par une r'gie portuaire, dot'e de la personnalit' juridique. La r'gie communale g'rant le port de Gand 'tait en revanche d'pourvue de la personnalit' morale, mais autonome sur le plan comptable. Le port de Zeebrugge appartient ' l’Etat, mais son exploitation est conc'd'e ' une soci't' de droit priv'e contr'l'e par les pouvoirs publics, la MBZ. Elle 'tait d'tenue ' hauteur de 65 % par la r'gion flamande (qui a remplac' l’Etat ' la suite du processus de r'gionalisation) et ' hauteur de 31 % par la commune de Bruges. Une r'forme de f'vrier 1999 confie d'sormais la gestion de ces quatre ports ' une entreprise portuaire communale autonome dot'e de la personnalit' juridique.

Espagne

L’Etat a une comp'tence exclusive sur les ports d’int'r't g'n'ral. Ces ' ports de l’Etat ' sont g'r's par des 'tablissements publics dot's de la personnalit' morale et de ressources propres, eux-m'mes plac's sous le contr'le d’un 'tablissement public national, ' Puertos del Estado '.

Italie

Les ports de l’Etat sont 'galement g'r's par des 'tablissements publics dot's de la personnalit' morale et de l’autonomie financi're. Les op'rations portuaires sont en revanche transf'r'es ' des entreprises priv'es concessionnaires.

Pays-Bas

Les ports sont g'r's par les communes, soit directement, soit par un organisme municipal d'pourvu de la personnalit' juridique (cas de Rotterdam et d’Amsterdam). Les comptes de ce dernier sont cependant s'par's de ceux de la commune. L’'tablissement municipal loue les infrastructures ' des compagnies priv'es par des contrats de longue dur'e.

Royaume Uni

Certains ports, g'n'ralement petits (' l’exception de Portsmouth), sont d'tenus par les autorit's locales. Une centaine de ports sont g'r's, pour le compte de la collectivit' locale propri'taire, par des conseils autonomes. Enfin, d’autres ports sont des ports priv's, principalement d'tenus par Associated british Ports (ABP). Six d’entre eux 'taient g'r's par des conseils autonomes, avant d’'tre privatis's par le Ports Act de 1991.

b) La politique europ'enne des transports

La politique europ'enne des transports privil'gie la d'finition de grands corridors de fret, utilisant en particulier le fer et la voie d’eau, et desservant des ports consid'r's comme strat'giques ' l’'chelle de l’Union. Cette politique est notamment encourag'e par des Etats comme la Belgique, les Pays-Bas et l’Allemagne, qui y sont directement int'ress's.

Deux projets particuliers sont en cours. Il s’agit de la ligne ferroviaire sp'cialis'e dans le fret, la ' Betuwe ', entre Rotterdam et la Ruhr, et de la ligne ferroviaire ' Rhin d’acier ', entre la Ruhr et Anvers/Zeebrugge. Ces projets, consid'r's comme d’envergure europ'enne et financ's ' ce titre, prolongent les politiques de desserte mises en œuvre par les principaux ports de l’Europe du Nord-Ouest. Ces derni'res consistent ' organiser des trains-blocs de conteneurs, g'r's par des soci't's priv'es subventionn'es par les pouvoirs publics, qui desservent notamment Rotterdam ' partir des principales villes europ'ennes, y compris celles qui appartiennent traditionnellement ' l’hinterland d’un autre port : c’est le cas de Prague pour Hambourg, de Turin pour G'nes, ou de Lyon pour Marseille.

Les projets europ'ens de corridors de fret ne font qu’amplifier un mouvement d'j' en cours : la massification des transports, notamment ferroviaires, oriente les trafics vers les ports qui disposent d'j' d’une bonne infrastructure d’acc's. A l’inverse, les ports fran'ais, qui ne sont pas pris en compte dans les projets de corridors europ'ens, sont g'n's par les difficult's de contournement de la r'gion parisienne, ainsi que par l’absence de cha'nes logistiques efficaces et peu co'teuses.

De ce point de vue, la politique des transports, en France, a suivi le mouvement du trafic vers le nord : l’autoroute du nord, qui dessert Anvers et Rotterdam, a ainsi 't' achev'e bien avant celle qui dessert Le Havre ; la SNCF a mis en place des trains-blocs en direction de la Belgique, r'pondant en cela ' la demande des transporteurs fran'ais, alors que le trafic ne suffisait pas ' justifier un m'me service vers Le Havre et Marseille. Dans ces deux ports, seule l’initiative des 'tablissements portuaires a pu compenser l’absence des autres op'rateurs publics ou des logisticiens priv's.
