3' L’impact sur les ports fran'ais

Ce nouveau contexte de l’activit' portuaire a conduit ' des changements structurels dans le classement des ports fran'ais et dans l’exercice de leurs missions.

L’organisation statutaire actuelle des ports ne correspond plus aux r'alit's 'conomiques : la hi'rarchie des ports, telle qu’elle r'sulte de leur activit', n’a plus vraiment de rapport avec le classement r'sultant de leurs diff'rents statuts de ports autonome ou d’int'r't national. La dispersion des moyens de l’Etat, qui d'coule de cette hi'rarchisation inadapt'e entre les ports fran'ais, est d’autant plus pr'occupante que les grands ports fran'ais ont perdu des parts de march' au regard de leurs concurrents 'trangers au cours des ann'es quatre-vingt dix.

a) Le d'calage s’est accru entre les ports fran'ais et europ'ens

Analyse compar'e du trafic total

Le trafic total des ports fran'ais est compos' de 50 % de vracs liquides (dont 94 % sont des produits p'troliers), de 23 % de vracs solides et de 27 % de marchandises diverses, dont 7 % de conteneurs. Le trafic passagers en 1997 s’'l've pour sa part ' 32,3 millions de passagers.

L’analyse du trafic total des ports fran'ais et europ'ens (graphique n' 1), montre que le retard de croissance des ports fran'ais s’est accru au cours de la p'riode 1990-1994, marqu'e par la lenteur et les difficult's de la r'forme de la manutention portuaire. Alors que, sur la p'riode 1991-1997, le trafic total a augment' de 5,3 % ' G'nes, de 6,3 % ' Rotterdam, de 10,4 % ' Anvers, de 17 % ' Hambourg ou de 28 % ' Tarragone, la croissance du trafic global des ports autonomes m'tropolitains n’a 't' que de 0,24 %.

Cette moyenne recouvre en fait des 'volutions diff'rentes, soit une baisse de trafic de - 3,5 % de 1991 ' 1994 et une hausse de 3,9 % de 1994 ' 1997. Certes, ce dernier chiffre, d' ' une conjoncture favorable en 1996 et 1997, est sup'rieur ' celui enregistr' ' Anvers (2,2 %), G'nes (0,05 %) ou Zeebrugge (-1,4 %). Mais il est inf'rieur ' celui observ' dans d’autres ports europ'ens sur la m'me p'riode : 5,5 % ' Rotterdam, 12,2 % ' Hambourg ou 31 % ' Tarragone.

Le regain d’activit' enregistr' dans plusieurs ports depuis 1997 n’est pas encore de nature ' rattraper ce retard de croissance cumul'e.

Analyse compar'e du trafic de marchandises diverses et du trafic conteneuris'

Les graphiques n' 2 et 3 permettent de comparer ces types de trafic des ports autonomes m'tropolitains, en valeur absolue et en croissance, au trafic trait' par d’autres ports europ'ens.

Le trafic de marchandises diverses de l’ensemble des ports autonomes m'tropolitains a augment' de 3,7 % en moyenne de 1991 ' 1997, tandis qu’il a cr' de 31 % ' Rotterdam, 24 % ' Anvers, 33 % ' Hambourg, 42 % ' Zeebrugge et 141 % ' G'nes. La croissance est particuli'rement faible (0,3 %) sur la p'riode 1994-1997. Mais ce taux est principalement d' ' l’effondrement du trafic transmanche de Dunkerque qui explique une chute de 60 % du trafic de marchandises diverses (de 4,8 Mt). En revanche, les taux de croissance observ's ' Marseille (19,5 %), au Havre ( 20 %) et ' Nantes-Saint-Nazaire (24 %) sont l'g'rement sup'rieurs ' ceux de Rotterdam (13 %), Anvers (13,5 %) ou Hambourg (14 %).

Le trafic de marchandises diverses conteneuris'es suit les m'mes 'volutions : pour les ports autonomes m'tropolitains, il a cr' de 32,7 % sur 1994-1997 apr's avoir diminu' de 3,6 % sur 1991-1994. La croissance des principaux ports europ'ens au cours de la p'riode 1994-1997 s’est 'lev'e ' 16,4 % ' Rotterdam, 37,4 % ' Anvers et 22,5 % ' Hambourg.

Le retard de croissance du trafic conteneuris' des ports autonomes m'tropolitains sur 1991-1997 est toutefois net : de 1991 ' 1997, il n’a cr' que de 28 % (+ 4,5 Mt), contre 45 % ' Rotterdam (+ 18 Mt), 79 % ' Anvers (+ 15 Mt), 60 % ' Hambourg (+ 13 Mt), 101 % ' Zeebrugge (+ 4 Mt) et 227 % ' G'nes (+ 7,5 Mt). Les graphiques n' 4 et n' 5 permettent aussi de comparer la part du trafic mondial de conteneurs trait'e par les ports fran'ais ' celle des premiers ports mondiaux et europ'ens de conteneurs, o' seul Le Havre 'merge.

Ce d'calage de croissance des trafics conteneuris's est d’autant plus pr'occupant que ce segment d’activit' est appel' ' conna'tre une progression continue au cours des prochaines ann'es. Des pr'visions ont 't' r'alis'es par les bureaux d’'tudes sp'cialistes des transports maritimes de conteneurs, Ocean Shipping Consultants et Drewry Shipping Consultants entre 1993 et 1996. Elles retenaient ainsi des taux moyens annuels d’augmentation de 5 ' 6,6 % dans les ports d’Europe de l’Ouest.

En outre, les marchandises diverses, qui sont des marchandises conditionn'es de valeur plus 'lev'e que les vracs liquides et solides, peuvent cr'er davantage de valeur ajout'e locale lorsque certaines op'rations de distribution sont faites sur place. L’enjeu 'conomique de leur captation est donc plus important.

Les parts de march' des ports fran'ais et 'trangers pour le commerce ext'rieur de la France

Une analyse des statistiques douani'res de 1991, dont les ordres de grandeur seraient aujourd’hui les m'mes, permet d’'valuer les parts de march' des ports fran'ais et 'trangers pour le commerce ext'rieur de la France. Il en ressort qu’environ 16 % du trafic maritime des r'gions fran'aises - hors p'trole brut, dont l’importation se fait presque exclusivement par les ports fran'ais - sont trait's par les ports belges (11 %), n'erlandais (4 %) et allemands (1 %). Ce pourcentage atteint 16 % du trafic maritime de la r'gion Midi-Pyr'n'es, 18 % en r'gion Nord, 19 % en Ile de France, 19 % en Rh'ne-Alpes, en Limousin et en Auvergne, 38 % en r'gion Centre, 42 % en Bourgogne, 44 % en Franche-Comt', 54 % en Picardie, 68 % en Lorraine et 71 % en Alsace et en Champagne-Ardenne. En revanche, il atteint 4 % en Basse Normandie, 3 % en Aquitaine, 2 % en Haute Normandie, en Bretagne et en Languedoc, et 1 % en Pays de la Loire et Poitou Charente. Ces chiffres sont n'anmoins anciens, et il est regrettable que, depuis la suppression des fronti'res int'rieures du march' unique en 1993, l’Etat ne dispose plus de ce type de donn'es statistiques.

b) Le d'calage s’accro't entre les ports fran'ais

Les cat'gories des ports autonomes, dont la liste a 't' fix'e en 1965, et des ports d’int'r't national, d'termin's en 1983, ne correspondent plus aujourd’hui ' la situation de l’'conomie portuaire. Il n’y a pas d’ad'quation entre l’importance des ports, mesur'e en termes d’activit' ou de fili're, et le classement d'coulant de leur statut.

Les ports d’int'r't national repr'sentent environ 20 % du trafic national, mais plus du tiers du trafic non p'trolier et plus de 50 % du trafic de marchandises diverses (58 % en 1997 contre 46 % en 1990). Leur disparit' interne est importante : il y a peu de points communs entre le port de Concarneau (50 506 tonnes en 1997), de Toulon (447 161 tonnes) ou de Dieppe (1,7 Mt) et celui de Calais. Le port de Calais traite en effet un trafic de 35,6 Mt, constitu' ' 96 % d’un trafic roulier transmanche de marchandises diverses, et se situe au quatri'me rang des ports fran'ais derri're Marseille (94,3 Mt), Le Havre (56,7 Mt) et Dunkerque (36,5 Mt), mais devant Nantes - Saint Nazaire (26,1 Mt) et Rouen (20 Mt).

Inversement, le trafic des ports autonomes de Bordeaux (8,4 Mt en 1997) et de la Guadeloupe (2,8 Mt) ne para't pas justifier leur statut de port autonome. Il se rapproche plus des trafics des ports d’int'r't national, tels que La Rochelle (6,5 Mt) et Bayonne (4,5 Mt).

Certains ports dits d’int'r't national n’ont en r'alit' qu’un int'r't r'gional, dans la mesure o' ils traitent exclusivement des trafics r'gionaux, ' l’exclusion de tout trafic li' au commerce international.

Aujourd’hui bien plus encore qu’en 1965, peu de ports sont en mesure de r'pondre aux exigences des op'rateurs du commerce mondial. Une hi'rarchisation nette s’op're donc entre les ports en mesure de traiter une part de ce commerce mondial - en France, Le Havre et Marseille - et les ports ne pouvant justifier le d'barquement des plus gros porte-conteneurs.

La comparaison du nombre de conteneurs trait's par les ports europ'ens et mondiaux entre 1991 et 1997 (cf. graphiques n' 3, n' 4 et n' 5) montre que seuls Le Havre et Marseille peuvent pr'tendre conserver une part significative du march' des conteneurs. Ils repr'sentent, de mani're constante au cours des ann'es quatre-vingt dix, les trois quarts du trafic conteneuris' trait' par les ports fran'ais.

Alors que la direction du transport maritime, des ports et du littoral entend s’appuyer, pour mieux s'lectionner ses investissements et appr'cier la vocation des diff'rentes places portuaires, sur l’analyse de l’'volution des fili'res de produits, la diff'renciation entre ports autonomes et d’int'r't national ne refl'te pas une hi'rarchie des ports qui r'sulterait de cette notion de fili're. Dans ses travaux de 1996 en vue de l’'laboration d’un sch'ma d’am'nagement des ports maritimes, deux vocations portuaires 'taient d’ailleurs ainsi distingu'es : celle des ports ' g'n'ralistes ', ' dont rel'vent les ports autonomes maritimes mais aussi des ports d’int'r't national ', et celle des ports ' sp'cialistes '.

c) Les missions portuaires sont de plus en plus contradictoires

Dans un contexte de forte concurrence et de croissance du r'le des collectivit's territoriales, les ports sont conduits ' exercer des missions qui ne leur 'taient pas confi'es initialement.

Missions de service public et activit's ' caract're priv'

Les ports autonomes ' assurent, concurremment, une mission de service public ' caract're administratif, en ce qui concerne notamment l’am'nagement, l’entretien et la police des am'nagements et acc's du port, et une activit' de nature industrielle et commerciale, en ce qui concerne en particulier l’exploitation des outillages du port '.

Parmi ses missions de service public administratif, l’'tablissement g're la police portuaire, la s'curit', le balisage, l’organisation du service de la manutention, et ex'cute, pour le compte de l’Etat, des travaux g'n'raux sur les infrastructures maritimes, tels que l’entretien des acc's maritimes et dragages, des op'rations de modernisation des bassins et acc's ainsi que des travaux d’infrastructure et de radoub ne relevant pas des cat'gories pr'c'dentes.

Parmi ses missions de service public ' caract're industriel et commercial, l’'tablissement met ' disposition l’outillage, construit et entretient des b'timents, fournit des services aux utilisateurs du port (gardiennage, approvisionnements) et encadre les fonctions portuaires d’int'r't g'n'ral telles que le pilotage, le remorquage et le lamanage, assur'es par des tiers. Il est d's lors en relation constante avec les diff'rents usagers : pilotes et lamaneurs, manutentionnaires, transitaires, armateurs.

A ce titre, les ports ne peuvent plus se contenter de mettre ' disposition leurs installations et se consid'rent davantage responsables de la rentabilisation de celles-ci. Cette 'volution pose deux probl'mes : d’une part, un probl'me de principe, car les ports s’orientent vers la recherche de trafics, sans 'tre suffisamment outill's pour cela et au risque de supporter les responsabilit's qui incombent aux op'rateurs priv's ; d’autre part, un probl'me de financement, les ports op'rant, par le biais des droits de port, de larges compensations tarifaires entre secteurs d’activit'. Or cette compensation n’est pas justifi'e d's lors que la mission de prise en charge des investissements et de l’activit' d’exploitation des outillages est ou pourrait 'tre remplie par des op'rateurs priv's.

Tel est le cas, pour le port autonome de Marseille du secteur sinistr' de la r'paration navale dont l’activit' n’est pas indispensable ' celle du port. Les difficult's structurelles de ce secteur en rendent la viabilit' douteuse : faible volume des affaires, comp'titivit' insuffisante, situation financi're pr'caire. Or le port autonome enregistre depuis de nombreuses ann'es pour cette branche un d'ficit direct - hors frais g'n'raux - r'current, de 40 MF en 1997, d' non seulement ' une restructuration insuffisante des effectifs et de l’organisation du travail du service de la r'paration navale mais aussi au surco't li' au type de service propos' par le port autonome. En effet, outre la r'paration ' flot, ce dernier a souhait' assurer un service totalement ind'pendant des entreprises de r'paration navale pour la gestion des cales s'ches et la mise ' sec des navires. Mais ce service est particuli'rement d'ficitaire car son taux d’utilisation des formes de radoub n’est que de 20 %. Aujourd’hui, le plan d’entreprise du port autonome pr'voit de red'finir ces missions et obligations ' l’'gard des entreprises de r'paration. Il importe, en effet, que l’activit' de r'paration navale soit 'quilibr'e ' l’avenir, ce qui suppose que l’exploitation et les investissements relatifs aux formes de radoub, qui appartiennent au port autonome, soit plus largement support's par les entreprises.

Missions d’infrastructure pour le transport maritime et autres missions d’int'r't public en mati're d’am'nagement du territoire et de d'veloppement urbain

Outre la mise ' disposition d’infrastructures pour le trafic maritime, les ports autonomes ont pour mission, en application de la loi de 1965, d’am'nager et de promouvoir les espaces industriels et portuaires. L’objectif initial 'tait de permettre aux ports de b'n'ficier des recettes n'cessaires ' l’'quilibre de leur budget. Or cette activit' de promotion industrielle mobilise de plus en plus les ports, au point qu’il est l'gitime de s’interroger sur la part qu’il convient de r'server ' cette vocation d’am'nageur foncier, qui ne doit pas 'tre mise en oeuvre au d'triment de l’activit' portuaire. Le risque est en effet que, comme ' Dunkerque, le port attire des entreprises dont le trafic portuaire est quasi nul, alors qu’au contraire l’enjeu est de parvenir ' recentrer le d'veloppement des zones industrielles portuaires sur les activit's de commerce maritime.

Il est normal que les ports constituent des 'l'ments d’une politique de valorisation 'conomique des r'gions. Ces apports 'conomiques des zones portuaires sont d’ailleurs estim's, par quelques rares 'tudes r'alis'es pour les ports. Ils sont g'n'ralement mesur's par la valeur ajout'e et les emplois directement ou indirectement cr''s par l’activit' portuaire : 15 milliards de francs et 20 800 emplois ' Dunkerque en 1990, 6,8 milliards de francs et 23 300 emplois ' Rouen en 1988, 8,1 milliards de francs et 15 000 emplois ' Nantes-Saint-Nazaire en 1988, 14 milliards de francs (en 1988) et 35 500 emplois (en 1995) au Havre. Mais le risque existe que les collectivit's territoriales consid'rent exclusivement les ports comme un outil d’am'nagement du territoire, ce qui n’est pas leur but premier. Ainsi, des ports assurent parfois la ma'trise d’ouvrage d’am'nagements urbains qui ne sont pas de leur comp'tence, au motif que leur domaine se trouve pour partie en zone urbaine. Au Havre, l’am'nagement du site Manche-citadelle a conduit ' engager un programme quinquennal d’am'nagement de 235 MF, qui comportait notamment un volet d’am'nagements urbains et paysagers, cofinanc' par les collectivit's locales et le FEDER. Les limites de la collaboration, n'cessaire, des ports avec les am'nageurs urbains devraient 'tre mieux d'finies par les ports et leurs tutelles.

Enfin, en l’absence d’autres acteurs portuaires suffisamment forts, le port autonome se retrouve de facto dans un r'le d’unique animateur ou presque de sa place portuaire, exer'ant des missions qui 'chappent ' sa sp'cialit' d’'tablissement public, notamment par le biais de sa politique commerciale ou de communication. Ainsi, la politique commerciale des ports autonomes manque parfois de fondement r'glementaire solide : le code des ports maritimes (11) peut 'tre interpr't' au sens strict comme donnant au port la seule mission de fournir une infrastructure d’outillage, sans se pr'occuper du trafic trait'.

Le Conseil d’Etat a, certes, fix' des limites souples au principe de sp'cialit' des 'tablissements publics : un EPIC peut se livrer ' d’autres activit's 'conomiques que celles d'finies dans sa mission ' la double condition que ces activit's soient le compl'ment normal de la mission statutaire principale et qu’elles soient ' la fois d’int'r't g'n'ral et directement utiles ' l’'tablissement.(12) Dans ce cadre, il appartient toutefois ' la tutelle de suivre et contr'ler davantage les initiatives des 'tablissements, par le moyen des plans de d'veloppement pluriannuels, et surtout par celui d’une participation efficace au conseil d’administration.

Recommandations

- susciter, dans le cadre de l’Union europ'enne, un examen approfondi de l’impact des diff'rences de statuts juridiques entre ports europ'ens en mati're de concurrence ;
- actualiser le code des ports maritimes de fa'on ' 'tablir une distinction claire entre les missions administratives et les missions commerciales revenant aux ports, ainsi qu’entre les missions relevant des ports et celles relevant du secteur priv' ; red'finir des r'gles tarifaires en cons'quence ;
- exercer une tutelle plus vigilante sur les missions 'chappant ' la sp'cialit' de l’'tablissement public ; mieux d'finir les limites des interventions des ports en mati're d’am'nagement et pr'ciser notamment les modalit's de la collaboration, n'cessaire, des ports avec les am'nageurs urbains.
